IS IT TRUE? November 4, 2011

IS IT TRUE that a few relatively nasty and borderline threatening messages were sent to the City County Observer today?…that they were borderline so we did check the IP address from which the messages came?…that the IP leads directly to the Civic Center?…that when we investigated further with respect to general postings that have been placed on the CCO from that same IP address that low and behold there are 540 posts from a total of 36 different posting aliases coming from the Civic Center?…that much of these posts are very recent?…that we do appreciate the traffic but are curious just how much public money is being spent right now to pay people who are posting from the Civic Center?…that we expect that the same cast of characters are spending at least an equal amount of time posting comments on the Courier and Press My Turn section?…that we encourage our posters to confine their posting to breaks and lunch time as taxpayer dollars should be spent on work?…that whomever sent the threat will get one pass but if that shows up again we will turn the IP chain over to the sheriff to deal with it?…that we have had to do this before?

IS IT TRUE that we would like to thank and congratulate the Evansville-Vanderburgh Drug Task force and the DEA for the silent work that lead to the destruction of a major crack cocaine operation?…that law enforcement does not always get the recognition that they deserve and that we wish to commend all who participated in this operation and the families back home who support their efforts?

IS IT TRUE that in our effort to become more and more efficient and increasingly predictable and reproducible in our day to day living that we often discard thoughts and actions that are outside of the bounds of mainstream norms?…that if we pass the same pile of garbage or rubble everyday that our minds actually paint the garbage into our expectations of acceptable reality?…that after a while we do not even recognize the things in our lives that are profoundly ugly or beautiful?…that goes for most of the people but not for everyone?…that there are people who see through the clutter and succeed in living outside the box?…that people tend to love their boxes so much that they treasure life inside the box?…that some people never accept a boxed in way of living and even in death cheat the box (casket) by choosing an alternative way of disposing of a now useless body?…that Albert Einstein summed it up very eloquently when he said the following?

IS IT TRUE that the places in this world that recognize what Dr. Einstein calls “the gift” of an intuitive mind and reward such gifts always seem to do much better than those that seek the path of the drone?…that we encourage our readers to drone when you must but be as intuitive as your mind will let you?

IS IT TRUE for those who are questioning the use of pictures that the City County Observer fairly uses for the purpose of reporting the news so as to justify using an un-owned image themselves for a purpose that that picture was never intended for, in a distorted format that diminishes the value of that picture, should familiarize themselves with the “FAIR USE” laws as they apply to news outlets?…that the CCO shall “continue to report news under protection of the fair use act – and will willfully remove any images if a request is made by the owner through a cease & desist order”, as we have on one previous occasion?

IS IT TRUE that under Article 50 of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPs) requires that signatory countries enable courts to remedy copyright infringement with injunctions and the destruction of infringing products, and award damages.”?…that one way to remedy the unauthorized use of a piece of intellectual property is to demand for the destruction of all of the unauthorized copies of the material?

Mole Nation and Mole #3 Predictions to be Released Sunday

Nine of the City County Observer Moles that make up a number of tips that we use to expose local government malfeasance along with our undefeated champion Mole #3 will be releasing their predictions for the upcoming City of Evansville elections sometime this Sunday.

Mole #3 stated this morning that it is predicting a margin of victory in the race for Mayor of Evansville of less than 500 votes. When bribed with Mole Chow and Beer Mole #3 still did not succumb and disclose which candidate it was predicting to win by this small margin.

Mole #3 also was insistent that on Tuesday night that it’s identity will be revealed and that it’s retirement to Florida will be announced. She (oh did I say she), I meant it is looking forward to being out of the turmoil of Evansville politics and the day to day pressure to expose more dirty little secrets.

It was twenty years ago today Jake Burton, snowboard pioneer produced a video with the “Red Army” theme to underscore the newfound freedom of the Soviet People. The Berlin Wall had fallen. It was time to play!

This same video was shown in 1992 by the Paoli Pro Shop to promote their pre-season demo ski and snowboard sale. We feel this video is a valid today as it was 20 years ago. Enjoy!

Democrats Amend Campaign Finance Report to Include $11,474.64 of Debt

The much maligned Vanderburgh County Democrat Party amended the false campaign finance report filed on October 21, 2011 to reflect a debt of $11,474.64. All of the debt was incurred well prior to October 21, 2011 report deadline and payments were being made so there is no possibility that the earlier false report was not known about by Democrat officials.

Itemization of Debt:

Burkert Walton Inc. $777.40

SMG for October 2010 Jefferson Jackson Dinner: $7,614.86

The Bauerhaus for Awards Dinner: $3,082.38

Total Debt Reported: $11,474.64

In another peculiar circumstance when compared to other campaign finance reports, a number of checks made out to Justin A. Jarvis, the Political Director and classified as salary were not accompanied by any payments for payroll taxes or FICA contributions.

IS IT TRUE that neither rain can nor elections slow down the size and content of the daily Evansville Police Department activity reports that the City County Observer posts each day?…that even on a day like yesterday when mother nature sent us all a clear message to stay inside our fair city racked up 13 pages of crimes?…that it was for the most part the usual crimes of theft and drugs in the all too familiar locations in the 3rd and 4th Wards in which the bulk of our police efforts are being spent?…that we are beginning to wonder if there is something in the water that makes so many people in Evansville think it is just fine to steal?

IS IT TRUE that speaking of stealing that the picture of Brent Grafton that was mailed out to people in the 5th Ward yesterday under the authority and paid for by the Vanderburgh County Democrat Party is not the property of the Vanderburgh County Democratic Party and that the Party did not receive permission to use the picture in the mailer from the person who took the picture? ?…that this picture was taken by none other than Mr. Joe Wallace in the Civic Center at the press conference called by Mr. Grafton to announce his candidacy for Evansville City Council?…that Mr. Grafton paid the City County Observer for the right to use the picture and that Mr. Joe Wallace was paid a fair sum of money for the use of that image?…that the unauthorized use of intellectual property is indeed considered to be theft?…that maybe our police are so busy with stealing because in some circles living outside the bounds of law is a way of life?…that people learn from their leaders?

IS IT TRUE that many of you will be puzzled to see an ad in the CCO for Vectren’s rebate program to promote energy efficiency?…that we have been pretty rough on Vectren for having the highest electricity rates in Indiana and triple what the rates are across the money saving bridge?…that this program is one that anyone who wishes can get a rebate for doing something that will save them money?…that before someone screams an obscenity we would like to advise you that we do have some ads available for public service announcements at no charge and that THE CCO PROVIDED THIS SPACE TO VECTREN FOR FREE?

IS IT TRUE that the other part of the Campaign Finance Report filed by the Vanderburgh County Democrat Party on 10/21 and AMENDED yesterday to reflect the debts that they knew they had that sticks out like a sore thumb has to do with a number of recurring checks classified as “Salary” that were written to Justin A. Jarvis?…that unlike the report filed by the Winnecke campaign which has multiple entries for expenses classified as “payroll taxes” with checks made out on a regular basis to the Indiana Department of Revenue and the IRS, the Vanderburgh County Democrat Party had no such expenses in their report?…that having some experience with such things and knowing what legally constitutes an “employee” vs. a “contractor” that the “employee” classification for the staff of Winnecke for Mayor campaign seems to be correct and the campaign has clearly reported the expenses of “payroll taxes” in the appropriate manner?…that while it is possible that Mr. Jarvis truly fits the IRS description of “contractor” that we find it strange that the checks would be classified as “Salary”.

IS IT TRUE that this writer is clearly a consultant in that I am not expected to keep any hours at any location period?…that my fees are determined by an open negotiation with each and every job and that sitting on my rear for 8 hours in any designated location will result in exactly no earnings?…that I have on my left a check that was handed to me yesterday that is based on a performance contract that states on the memo line “Fall 2011 Consulting”?…that I have never ever had a situation as a consultant where any check came with the word “Salary” on it?…that it may be worth reviewing if the Vanderburgh County Democrat Party has the correct classification for Mr. Jarvis with respect to his employment status?…that as a consultant that there are reporting and filing requirements that are very different than what is applied when an employer-employee relationship is the proper IRS determination of status?

IS IT TRUE that there has been plenty of scurrying around and finger pointing coming from the ranks of the Vanderburgh County Democrat Party people about who is to blame for the filing of the false campaign finance report and the accumulation of debt?…that the accumulation of debt is not really an issue outside of those who are due to be paid and the Party?…that the person responsible for the accuracy of the Campaign Finance Report is the Party Treasurer whose signature is on both the false and the amended returns?…that this signature is at-large candidate for Evansville City Council, Mr. Conor O’Daniel?…that we will grant the possibility that Mr. O’Daniel like many others this election cycle got “snookered” or “bamboozled” by some other insider and was just handed the forms to sign?…that we would welcome a statement by Mr. O’Daniel regarding the whole set of conditions that led to his signature being affixed to a false official document?

AG Zoeller says Mobile Informational Call Act would strike down Indiana’s Do Not Call law

EVANSVILLE, Ind. – Hoosiers’ long-standing telephone privacy rights are under attack by proposed federal legislation aiming to strike down Indiana’s Do Not Call and Do Not Fax laws, according to Indiana Attorney General Greg Zoeller.
Zoeller called on Hoosiers today to share their opinions with their congressional representatives about House Resolution 3035 known as the “Mobile Informational Call Act of 2011.” Zoeller has been invited to testify in opposition of the proposal on Friday before the U.S. House Subcommittee on Communications and Technology hearing in Washington, D.C..
“This measure proposed by Congress constitutes a federal assault on Americans’ privacy that would allow robo-call messages to be sent en masse to people who do not want and have to pay for these calls,” Zoeller said. “There is a clear and present danger that Hoosiers’ privacy will be disrupted in the sanctity of their homes. This is not the help constituents need from Washington, D.C.”

House Resolution 3035 would amend the Communications Act of 1934 and allow for robo-calling to all cell phones, leaving consumers to foot the bill, Zoeller said. State attorneys general would not be able to enforce state laws against junk faxes, prerecorded calls or text messages.

More than 2 million phone numbers are currently on Indiana’s Do Not Call list. Since the Do Not Call law went into effect Jan. 1, 2002, the Attorney General’s Office has obtained 273 settlements with or judgments against telemarketers, resulting in awards of penalties and costs totaling more than $14.5 million.

At the request of Zoeller, the Attorney General’s Office launched a free email and text message update service, called “Privacy Alerts,” that Hoosiers can sign up for to receive updates on the bill’s progress. To sign up consumers can visit www.indianaconsumer.com.
Hoosiers can also voice their opinion on the proposal by contacting their representative or by visiting Popvox’s nonpartisan website at https://www.popvox.com/bills/us/112/hr3035. Popvox will forward your comments to your members of Congress.
Zoeller said two separate ongoing court cases are also challenging Hoosiers’ right to telephone privacy. The Attorney General’s Office has appealed to the Indiana Supreme Court to hear a recent lower court ruling that would allow automated calls from political candidates. FreeEats.com challenged whether the state should be constitutionally allowed to restrict robo-calls to residents.
“People’s rights of privacy include the right to be free from the ringing of their phones from those they have not specifically asked to hear from,” Zoeller said.
Patriotic Veterans Inc. also challenged Indiana’s Automatic Dialing Machine Statute. The U.S. District Court for the Southern District of Indiana ruled the state’s ban on robo-calls playing political messages cannot be enforced if the calls originate outside Indiana, but the Attorney General’s Office is appealing the decision.

As the only woman ever to head a county highway department in Indiana and a life long Republican, I found out the dirty side of politics first hand. I was appointed by Republican Party Chairwoman Suzanne Crouch and County Commissioner Carol McClintock. I was still naive I guess, into thinking I was supposed to see things ran openly. Instead, I was made the scapegoat for getting rid of Cletus Muensterman, the former Democrat head of the county highway. It was made apparent that I wasn’t supposed to do anything significant in my position as highway superintendent but ride around in my new State Police car and keep my mouth shut.

Furthermore, Democrat Pat Tuley commented to the paper that I was so stupid I didn’t even know where the county highway was until I was given the job. The newspaper didn’t even bother calling me to verify his comments, because if they would have, they would have found out I had previously worked just a few doors down the road. I might add Mr. Tuley and his wife have been supported very well by taxpayers their whole careers, and part of the “Machine”!

Like Rick Davis, I didn’t hide behind the workings of the political machine. I was witness to despicable self-interested decision-making. Collectively, both parties are guilty in this town of wielding heavy handed control when in power and their self-interested tactics undoubtedly contributed to the stadium and baseball field fiascoes, as well as countless other decisions that have served the few and not the many in our community.

As an advocate for the well-being of children my whole life, I have a hard time understanding the endorsement of The Right to Life of Lloyd Winnecke. I don’t believe in aborting the well being of children after they are born especially considering Indiana has unfortunately been number one in child abuse deaths. This clearly is not how their Mayoral candidate feels knowing that as a County Councilman, Winnecke voted to de-fund the “Welfare-to-Work” program that provided child care to underprivileged children while their parents worked to bring themselves out of unfortunate circumstances. As I have done for several years I stand out front when they are going into the show, and try to get them to care about children after they are born. They don’t read my signs. Not one sign says I am for or against abortion. Instead, they yell at me things like “you wouldn’t be here if your parents had aborted you.” These people in Right to Life have thrown the baby out with the bath water after their born, but will back a politician solely if he attends their indoctrination rally!

Troy Tornatta and Mayor Weinzapfel got into an altercation during the primary race becauseTroy didn’t think the Mayor properly backed him during the race. That’s why he lost? No. Rick won because he didn’t wait for the machine to put their agenda in place and he was the superior candidate. This is the mentality of heavy-handed power wielding and it will happen in the Republican Party, too. I can attest to that.

Rick Davis is an open caring person who will not compromise his integrity for a vote or popularity in the party machine. I’ve been in the trenches like Rick and had dirt kicked in my face. I spit it out and kept fighting for children to have a better life than follow narcissistic adults who’s agenda is against what feels right personally. Rick Davis is the person with the right amount of education, experience, grit, and determination needed in order to take our city in a new direction. Rick is a leader and was the first candidate to speak out about our Meth epidemic and the only candidate to offer a transparency plan for city government that will restore trust in our community in how the city does business.

Also I am no relation to Rick, but would be proud if I were.
