A successful 2014 legislative session

6

The 2014 legislative session has come to a successful close with many notable accomplishments to mention.  When Speaker Brian Bosma and the rest of our caucus announced our 2014 legislative agenda, Working on Progress, we set our sights on five priorities: preparing kids for their careers, equipping our workforce, connecting crossroads to communities, stopping burdensome regulations, and cutting taxes. I am proud that within ten weeks we were able to achieve our goals.

My focus continues to be on jobs, education and addressing the skills gap facing Hoosiers. It is no secret that students in Indiana are expecting to enter the workforce after graduation. However, students will have trouble finding rewarding careers if they do not have the necessary skills to enter competitive job markets.

Through House Enrolled Act (HEA) 1003 , we further incentivized schools and businesses to collaborate through select educational partnerships, which in turn, will increase potential earnings of Hoosier workers. Additionally, tax credits will be offered to businesses that hire students who have successfully completed cooperative programs. This will help Hoosier students gain real-world experiences while also helping Indiana businesses that need specific skill sets to fill open positions.

Another agenda bill that spurs commerce, economic development and employs thousands of Hoosiers is HEA 1002 . This legislation frees up more funding, upwards of $400M from the state, to build and maintain the state’s highway system by transferring a portion of the funds allocated in the 2013 budget to be used now. By investing this money now, the federal government will chip in close to $1.6B throughout the life of the projects. Indiana’s fiscal integrity over the past few years has positioned us to be able to make these prudent investments, which will greatly benefit our state.

During session fellow legislators and I were able to address many different types of legislation. However, we were able to do this while looking to trim the size of government and address outdated and unnecessary laws and regulations that make government inefficient. HEA 1005 was a direct effort to bring a more efficient government to Indiana, and we were able to cut red tape that ties the hands of businesses that are looking to expand in Indiana. The private sector is always striving to be more efficient, and the public sector can certainly follow that lead – not to mention Washington D.C. Moving forward, we must continue to allow the free market to function, and look for ways to trim the government.

The measures took in the 2014 agenda will bring economic growth and push our state forward. We were able to accomplish so much while still concentrating on other issues and keeping in mind the overall goal, to make Indiana the best state to live, work and raise a family.

IS IT TRUE March 24, 2014

Mole #??
Mole #??

IS IT TRUE there has been a pretty big dust up over emails sent by Vanderburgh County Republican Party Chairman Wayne Parke to a certain Precinct Committee person who is openly supportive of Bruce Ungenthiem’s campaign to become the Republican candidate for Vanderburgh County Commissioner in the fall general election? …Mr. Parke has openly supported incumbent Marsha Abell and has refused to provide any information concerning the Vanderburgh County mailing list for the Republican party to Mr. Ungenthiem? … a search of the rules of the Indiana Republican Party clearly states when a Precinct Committee Person can be removed for supporting an opposing candidate and it is not something that is even possible before the primary? …the actual words in Rule 1-6 that clearly put Mr. Parke’s oppressive actions against Mr. Ungenthiem’s candidacy totally out of line?

“Rule 1-6. Each and every member and officer of any Party Committee or Subcommittee shall be a true representative Republican, in good standing in the Party. If an individual openly supports a candidate after the Primary Election, who is opposing a Republican Candidate, they are not in good standing in the Party and may be removed for cause under Rules 3-22 and 3-23. (See Rule 1-8)”

IS IT TRUE that Mr. Parke’s assertions that his personal support of Commissioner Abell constitutes an official State Party endorsement is unraveling as completely untrue? …his further assertions that Abell and her husband’s contributions to the party are deterministic in which primary candidate is the best candidate is also a crock of bull? …while Mr. Parke seems to be exercise some imaginary authority with the audacity of a southern sheriff who says “I am the law around here”, the reality of the situation is that the Republican primary for the candidacy has turned from a routine campaign to a bully fest to rival anything the Vanderburgh County Democrats did in the 2011 Mayoral election in their PINKY SHAKE meeting that gave the election to current Mayor Lloyd Winnecke?

IS IT TRUE that The Vanderburgh County Republican Party Chairman Wayne Parke has also endorsed County Council member Pete Swaim over his GOP challenger John Montrastelle in the upcoming GOP primary?                … don’t be surprised after the primary that supporters of  both Bruce Ungethiem and John Montrastelle make a public call for Wayne Parke to resign as party Chairman?

IS IT TRUE it is now the two week anniversary of the night that the Evansville City Council failed to start the process to rescind the $4.8 Million loan to Earthcare Energy LLC that they were tricked and intimidated into passing two years ago?…it was a mistake and a monument to complacency that the City Council was silent on this subject just days after the Loan Administration Board extended the $200,000 loan to Earthcare on no basis at all except that Earthcare has no money?…every day that this loan approval is not rescinded is a day that the Winnecke Administration has the full authority to write a check to these guys?…we encourage the City Council to wear their big boy pants to next Monday night’s meeting (March 31) so as to avoid being fools for the 3rd Fool’s Day in a row?

IS IT TRUE that the round of 64 in the NCAA basketball tournament has come to an end with ZERO of the 10 division 1 teams in Indiana getting into the tourney and certainly none joining the sweet 16?…the announcers for the game between Kentucky and Kansas State rubbed salt in that wound by reminding us that Kansas only has 3 D-1 teams and all three are in the tournament and that 3 of Kentucky’s six D-1 teams made the tournament?…we hope that the state of basketball affairs in Indiana is not an indicator of things like the economy and the education system?…all three of these could use some serious improvement?

IS IT TRUE there are a couple of Indiana artifacts in the NCAA tournament with IU star Steve Alford coaching the resurgent UCLA Bruins and former University of Evansville coach Jim Crews who led the St. Louis Billikens into the round of 32 before falling to the Louisville Cardinals?…that some say that both Crews and Alford were shunned by Evansville and IU?…these are just two more local people who for some reason could not crack the old boys networks and have taken their brilliance elsewhere?…the last NCAA appearance by the Purple Aces was during the end of Jim Crews tenure as coach?

Vaughn named editor of The Shield

0

james-vaughn-2-_NewsVertical

James Vaughn, a junior journalism major hailing from Indianapolis, will soon be topping the masthead as the new editor in chief of the University of Southern Indiana student newspaper, The Shield during the 2014-15 academic year. Vaughn has served as news editor, reporter, and staff writer for the paper since January 2012, and looks forward to the responsibilities the new position holds. He takes the reigns from current editor in chief, Shannon Hall in fall 2014.

During his time working for The Shield, Vaughn has taken the time to analyze what does and doesn’t work. “I share one goal with all former editors of The Shield –retain readership,” he said. “But a secondary goal – my goal – is transparency. In other words, make what we are distributing to our readers understandable for our readers.” He plans to do this by building upon his predecessor, Hall’s ideas, and expanding into a more interactive avenue with the use of social media, photography, video, and blogs.

Erin Gibson, faculty adviser to The Shield, and instructor in journalism, understands that news must be distributed across an array of formats. In an on demand society, news must be timely, incorporating social media and visual elements. “James understands this and he recognizes that this understanding is what can set him apart in building his portfolio. He has this skill set,” said Gibson.

In addition to his experience with The Shield, he brings reporting, photography, and videography skills from internships with The Shelbyville News and the Evansville Courier and Press. He also has an understanding of the role of a student publication. “It’s role is to share knowledge – good and bad, be consistent and reliable, preserve history in a modern way, and promote dialogue between it and its readers,” he said.

As to what kind of leader he hopes to be, Vaughn says, “It’s important to be a developmental manager – to help and encourage reporters to develop their strengths and motivate them by providing professional development opportunities on a regular basis.”

Andrea  Smithson served as Vaughn’s supervisor during his internship with The Shelbyville News. She said of Vaughn, “James has a calm demeanor that would serve him well while juggling the stress of managing a student publication and his academic schedule. It’s the same steady nature that would be a benefit when leading other students with less experience.”

USI students vie for big dollars in statewide ag-communications contest

USI

A team of students from the University of Southern Indiana’s Romain College of Business has been named one of three finalists in the “Promoting the Good Works of Indiana Agriculture” competition. Other finalists include teams from Huntington University and University of Indianapolis.

Teams from universities and colleges across Indiana were invited to propose innovative, creative campaigns to connect young adults with Indiana agriculture. 38 teams, representing more than 200 students and 19 institutions, submitted proposals. “I want to thank all the teams their creativity and hard work to prepare very impressive and professional proposals,” said Indiana Lt. Governor Sue Ellspermann. “Selecting the three finalists was challenging for our panel of judges.”

USI’s Team Eagle Ag, including students Tailor Frymire (captain), Amanda Brinkman, Dylan Cox, and Wyatt Newman, will travel to Indianapolis on March 24, 2014, to present their ideas. Their proposal focuses on connecting, educating, and energizing young adults with the impact and innovation that characterize Hoosier agriculture. They proposed a complete rebranding of Hoosier agriculture, an integrated social media strategy, and an emphasis on agricultural career opportunities.

As finalists, Team Eagle Ag will make a 20-minute presentation to a panel of judges at the Indiana State Library on March 24. The winning team, to be announced that day, will receive $25,000, with $10,000 awarded to the university and $15,000 split between the winning team members.

Agency collecting credit card debt not a creditor, COA rules

0

indianalawyer

A debtor’s counterclaim that a collection agency violated the Indiana Uniform Consumer Credit Code by not obtaining a license was rejected by the Indiana Court of Appeals on the grounds that although the agency was trying to recover a debt, it was not a creditor.
Asset Acceptance LLC, a Delaware limited liability company with its principal place of business in Michigan, tried to recover  $6,594.26 from Nathan Wertz, who had defaulted on his credit card from Chase Bank/First USA/Chase.
Wertz claimed Asset Acceptance could not collect on payments for consumer loans debts because it is not licensed under the  IUCCC. Accordingly, Wertz argued Asset Acceptance’s collection efforts violated both the Indiana Deceptive Consumer  Sales Act and the federal Fair Debt Collection Practices Act.
The Indiana Court of Appeals disagreed in Nathan Wertz v. Asset Acceptance, LLC, 71A03-1305-CC-175. The COA affirmed the trial court’s grant of the agency’s Trial Rule 12(B)(6) motion to dismiss Wertz’s counterclaim.
Wertz raised the question on appeal of whether Asset Acceptance “regularly engage(d) in Indiana” in taking assignments   of consumer loans or in the collection of payments from debtors arising from consumer loans as described in Indiana Code 24-4.5-3-502.   If so, then it was required to have a license from the IUCCC.
Citing Sheetz v. PYOD LLC, 3:12-cv-811-JD-CAN, 2013 WL 5436943 (N.D. Ind. Sept. 26, 2013), the Court of Appeals rejected  the argument that the plain language of the IUCCC extends the licensure requirement to entities not physically located in Indiana.
“…Section 3-502(3), which is the licensure requirement relevant here, does not require ‘creditors’ to obtain a license and instead focuses on the actions undertaken by the entity in question,” Judge Edward Najam wrote for the court. “These actions, in particular that of taking an assignment or collecting on a debt, may or may not be the actions of a creditor.”
