IS IT TRUE April 3, 2014

IS IT TRUE that we would like to belatedly congratulate the people of Evansville and the Evansville Sports Corporation on getting a good crowd out for the NCAA Division 2 national championship game at the Ford Center last Saturday?…an announced crowd of nearly 5,000 showed up for the final which is quite excellent for this particular tournament in recent history?…the first two rounds of the tournament as we previously reported had disappointing crowds of well below 1,000 people per session dragging down the overall attendance but the final game made up for it and got Evansville some good national TV exposure?

IS IT TRUE in examining the claims made by Evansville Mayor Lloyd Winnecke about the requirement of the Hilton Corporation to require that a prospective franchisee have final loan approval before being granted a franchise, the CCO took on the task to get a copy of one of the agreements and looked it over?…the document is nearly 400 pages long and rather than spend all night reading it we did a scan and that scan did not confirm the Mayor’s claim?…in the franchise agreement the fees, and estimated cost to establish the brand are all laid out very clearly but there does not appear to be a requirement to prove loan approval?…on the other hand having dealt with banking it would seem very uncharacteristic of any bank to commit to fund a loan without a franchise agreement in solidly in place?…if a bank did not require a franchise agreement to be in place with sufficient covenants and conditions to constitute a proven operating plan they may end up loaning money in expectation of a Conrad Hilton but end up with a Motel 6 as collateral?…the Mayor of course comes from the banking world and should understand such things?…perhaps he just got it backwards?

IS IT TRUE the fact that there is no franchise agreement in place between HCW and Hilton on April 3, 2014 would support the reasonable conclusion that they DO NOT HAVE FINANCING NAILED DOWN?…it has been exactly 24 days since the GOLDEN SHOVEL PHOTO OP when it was clearly stated that they did have financing in place and that the DOUBLETREE (Hilton brand) would be opening in the fall of 2015?…that is conveniently just before the next mayoral election?…today the development agreement has expired without HCW showing the ability to move forward?…we have been down this path three times before with Browning, Woodruff, and Kunkel?…here we go again with a dozen eggs on the face of City officials for FAILING TO VET THIS DEAL?…this agreement needs to be extended if this project is to stay alive?…that will take a public meeting of the Evansville Redevelopment Commission to do that?…the question then becomes how long should the extension be?…we wonder if the 80 days that Mayor Winnecke spoke of is sufficient or if 180 days would be more appropriate?…this is not getting any easier and the powers that be do not seem to be learning from their mistakes?

IS IT TRUE it would be wrong to blame Dunn Hospitality for this delay?…it is distinctly possible that this whole delay came about because of the management of getting a franchise agreement in hand pushed that task to the very last minute?…that the franchise agreement already in place between Dunn Hospitality and Hilton may indeed call for a market study to allow Hilton to grant another franchise that will compete with Dunn’s property?…that even the Hunden study said that any new hotel would be competing for the same business as the other hotels in town?…perhaps this is just the Hilton Corporation doing their job and VETTING THIS DEAL?…even if HILTON determines that they cannot enter a franchise agreement for a Doubletree in downtown Evansville there are other options?…Kunkel was planning to use the Sheraton brand, Browning was going with Marriott, and Woodruff was talking a Hyatt Place?…we were treated to beautiful renderings of each of these?…none of these brands would have a problem with competing with a Hilton brand?…they would all require a market study just as it seems that Hilton is doing?…Evansville is once again sitting in the corner, wearing a dunce cap, and thinking “WE GOTTA START VETTING OUR DEALS”?…this is looking more like Earthcare every day?

McNeil Walk Across The 8th District Getting Attention

Andrew McNeil Freedom, IN- Republican Congressional Candidate Andrew McNeil had a busy week meeting with the voters of the 8th District. With only Sunday off for rest and Monday spent writing letters, Andrew spent every day on the road.

Saturday began bright and early with a GOP breakfast in Warrick County. From there Andrew took the opportunity to visit the Evansville Gun Show at the Vanderburgh fairgrounds. Saturday afternoon was capped off with Andrew speaking with the Vanderburgh Tea Party Patriots at the Evansville Public Library.

Tuesday saw Andrew stopping to visit with the residents of Loogootee and Shoals in Martin County. Many townspeople aired their discontent with the unresponsiveness of Washington. The night ended with Andrew at a Tea Party meeting at Hulman Street Wesleyan church in Terre Haute.

On Wednesday Andrew braved the cold snap to visit businesses in Jasper and Huntingburg. One of the many highlights of the day was a visit to Sturm Hardware, which has been in operation since 1886.

Boonville, Mount Vernon, and Chandler each saw Andrew walking downtown on Thursday. Many enthusiastic Hoosiers came out to meet with Andrew and thanked him for running.

On Friday Andrew traveled back to Newburgh to visit with more businesses. While there Andrew met Dennis Webb, a physical therapist in the area who was closing up his business after more than 20 years operating in Newburgh. Mr. Webb was closing up shop because the new insurance provisions being implemented through Obamacare could no longer sustain his business. Mr. Webb was excited to hear that Andrew is for defunding and repealing Obamacare as soon as he can.

Saturday brought Andrew back to Dubois County for two meet and greets. Azura in Jasper hosted Andrew for lunch and Cool Beans in Huntingburg hosted breakfast. Between meals Andrew again went door to door in the neighborhoods of both cities in the pouring rain.

“I have met so many wonderful people while out traveling. People take great pride in their businesses and love showing them off. They are proud of the work they have put into their businesses and the benefit they have brought to their communities. I am for anything that will promote the strong work ethic and sense of responsibility that I see in Hoosier families—even if that means doing nothing more than stepping out of the way and letting small business owners run their own businesses.”

Recognizing Indiana’s rich agricultural heritage

During session, I make the drive between our Southwest Indiana community up to our State Capitol every week. This drive always presents spectacular views of Indiana’s rich agricultural heritage and the strong economy agriculture brings to Indiana.Every year, Indiana takes a moment to honor this rich heritage through the Hoosier Homestead Award Program. This award recognizes families with farms that have been owned and maintained by the same family for 100 years or more. Last week, I joined the lieutenant governor and the agriculture director at the Statehouse to congratulate the award recipients.The Hoosier Homestead Award Program began in 1976 to acknowledge the contributions these families have made to Indiana agriculture. More than 5,000 farms have been recognized since the program was established. Two awards ceremonies are held each year, in the spring and summer, to commemorate the achievements of the many outstanding Hoosier farmers across the state.

I am happy to say that Posey County had two award recipients this year. The Droege farm owned and operated by Arvin and Anna Droege of Wadesville, Ind., were recognized for the farms sesquicentennial. Arvin and Anna’s family farm has been in operation since 1850. Also, Ann Pfister Scarafia of New Harmony, Ind., was at the Statehouse to be recognized for her family’s farm being owned and operated for 150 years. Both of these family farms should be congratulated for their contribution to Indiana’s agriculture heritage and economy.

Agriculture has always played a significant role in our state’s livelihood, even before its founding. The most valuable crop grown in the U.S. is field corn. Indiana is located in the heart of the Corn Belt and our grower’s rank 4th in the nation for production of corn. According to the Indiana Farm Bureau, Indiana’s largest general farm organization, there are 61,000 farms in Indiana covering about 14.7 million acres.

I spoke recently to two college classes of poli science, political science classes. And one of the things that I found about young people is they don’t have any idea why we think they should be involved in our system. And in talking to them, I said I can think of three really good reasons.

You see at my age it isn’t going to be long and I’m going to retire so I won’t be paying that local option income tax any more. And at my age, it won’t be long and I won’t be looking at a two story home. I’m going to look at a little small one story home that won’t pay big taxes. And at my age I won’t have a mortgage on that house so the banks are not going to be getting my interest on a mortgage.

So we need young people to stay here to pay local option income taxes, to build their homes here, to mortgage their houses here to keep this community moving. This community cannot survive on retired people. We don’t put into the system what we pull out of it. It has to have young people. The only way to get young people here is a firm belief if mine and I happen to know a firm belief of the mayor and the county councils is you have to have the jobs here for them to work. They can’t stay here just because they like it. They’ve got to be able to find a place to work.

We’ve been very, very fortunate in the last few years to bring in PGP to the local VIP park, Wayne Supply decided to not go to Louisville where the owner lives but to expand here in Vanderburgh County, and those are the kinds of jobs that keep our people working here, our people have our career tech centers.

You know it’s really nice to talk about those high tech, good paying jobs, but high tech computer people, do not produce one dime. They support production. We have to have production for those jobs to follow. And those are the Wayne Supply jobs and the PGP jobs and the jobs that are going to come when we continue the expansion of University Parkway up to I-64 and we can pull more business into this area.

That is the number one job of government. Not to provide a job for you but to provide an environment where a job can grow in your community. That is exactly what these county commissioners are working on right now. What we continue to work on. We have so many things in the pipeline. I am so excited about what’s going to happen in Vanderburgh County in the next few years with the leadership of our mayor and the leadership of the county council and county commissioners that are in there right now.

You will see an Evansville in the next 10 years that you won’t recognize. You will say my gosh why didn’t we get there before now. We didn’t get there before now because you didn’t have good solid republicans running it but you’ve got ‘em now. So let’s go forward and I appreciate your vote May 6.

Vernon Rd reference a fight in progress. Upon arrival I met with the victim, Jeffrey Goff. Goff informed me he was helping do some work around the house when Steven Soell arrived. Soell came over to speak to his ex-girlfriend, Theresa Blake. At some point, Soell became agitated and began to fight with Goff. Goff stated Soell struck him in the face and then ran off. Deputies drove around the area and went to an address nearby where he was believed to be staying, but did not locate Soell. Goff informed me he had no intentions of pursuing charges and wasn`t really worried about what happened. It was discovered Soell had been told he was not allowed on the property at a previous date so a barred/banned alert was placed on him. Goff did not appear to have any injuries and he stated he did not need any medical treatment. Blake was told about how to obtain a protective order due to her not wanting Soell on the property. The message read “Please let my son know how much I love and miss him. send me some pics ok, Thanks.” This active Protective order clearly states that Tierra is not to have any contact with Mr. Gore. Charles did not have any information on Tierra`s whereabouts, or any further information to assist deputies in locating her. I advised Charles that I would complete a case file to present to the prosecutor, if I was unsuccessful locating her. I was unable to make contact with Tierra, a case file will be completed. TRAFFIC-ACCIDENT HIT & RUN /UNATT/PROP [BM]Case Number: 1461838Victim: BRENNAN JOSEPH REESELocation: 5404 PEARL DR, EVANSVILLE INOn 04/01/14 at approximately 1927 hours I was dispatched to 5404 Pearl Dr in reference to a hit and run. I arrived and spoke with Brennan Reese who stated he had parked his Ford F150 in the parking lot at Buffalo Wild Wings earlier in the evening. Reese said his truck was unattended and was apparently struck in the parking lot by another vehicle. The truck had scratches and a dent on the drivers side rear bed side. Next, I spoke to witnesses Danielle Bloebaum and Donna Mathena. They were together and were in the parking lot. They both said that they observed a red or possibly maroon mini van, possibly a Pontiac, that had struck Reese` at around 1915 hours. They said the driver of the van was out of his vehicle and was physically pulling the bumper of his van off of the truck. They said the man then threw the bumper in the van and left the scene. Bloebaum said she believed the plate on that vehicle to be either 704 BJB or 407 BJB. When those plates are run through Indiana, they do not come back to a vehicle matching the description given by the witnesses. The two went to Buffalo Wild Wings and had the restaurant page the owner of the truck. That is how Reese was advised of the situation. I also spoke to juvenile EK. EK said he was in his vehicle in the parking lot. EK said once he realized what was going on, he took out his cell phone and began taking pictures of the mini van. EK said he would email me those pictures as soon as possible and I provided him with my email address. I do not believe anyone actually observed the collision between the two vehicles, only the events that took place after. Upon my arrival there, I spoke to Caroll Kissinger who stated her credit card had been stolen and used several times with out her permission. Kissinger said the last time she used her card was on 02/03/14 at Rural King at 2800 N Saint Joseph Ave. Kissinger said she is unsure if she dropped it in the parking lot there or how someone else may have gotten it. She stated she was unaware the card was stolen until 03/30/14 when a subject named John contacted her and told her he had her card and that he had found it on the ground on the east side in a parking lot. Kissinger said she met John and that he drove a red Dodge Ram truck. She said he told her he had been a victim of a similar crime before and just wanted to return the card when he found it. Kissinger has contacted her bank and they are currently taking care of many of the charges on the card with no expense to Kissinger. It is unknown at this time if Kissinger will incur any debt as a result of this act but the financial institution has a clear loss. Kissinger has no suspects at this time. Upon arrival I spoke with the reporter Eric Hazlett. Hazlett advised he and his family recently returned from Panama City Florida. Hazlett advised when he returned, he found someone had used his account to make fraudulant purchases in El Darado Arkansas and Bernice Louisiana. Hazlett advised he had not been in any of those cities nor did he make any purchases in those cities. Hazlett advised he had already contacted his bank, to which they advised they would cancel the account and reimburse the funds. Hazlett advised he needed a report filed for the bank. Upon arrival, I spoke to the victim, Adeina Rae Mars. Mars told me she found a large scratch on the passenger rear quarter panel of her 2003 yellow Dodge Neon this afternoon at approximately 1700 hours. Mars said she knows the scratch was not there at approximately 1600 hours on 03/3014, but had parked her vehicle at the “back side” of her apartment building(904-B McDonald Ln) last night. There is no suspect information at this time. It should be noted the word “whore” is scratched into the paint of the vehicle across the hood and on every door. THEFT-FROM MOTOR VEH [DF]Case Number: 1461808Victim: JOHN ALBERT BIVINSLocation: 6018 LOCUST DR, EVANSVILLE INOn 03/31/14 at approximately 1608 hours I was dispatched to 6018 Locust Dr on a theft report. Upon my arrival I spoke with John Bivins who stated his prescription medicine had been stolen out of his work vehicle. Bivins said he parked and locked his JE Shekell service van in his driveway on 03/30/14 at approximately 1900 hours. He said he heard nothing through the night and when he went to his van at about 0650 hours on 03/31/14 he noticed nothing to be out of place and all doors to the van were locked. Bivins said his first run of the day was to Casino Aztar, now Tropicana, and that his van was parked there right in front of the security office and locked. Bivins said he went back to the van around 1200 hours to get one of his pills and realized that they were gone. Bivins showed me that he hides his pills in a drill bag and under his uniforms in the front area of his van. He said he had “torn the van apart” looking for them and he was confident that they had been stolen. Bivins was adamant that the van was locked at all times and said he was not sure how entry was made. He did say that on Chevy vehicles it is common for keys from other Chevy`s to fit and work in the door locks. I checked the van over well and found no evidence of forced entry. The teacher’s goal is to introduce the students to as many different kinds of technology as possible. Before spring break the class had its 1st Military Technology Field Day. The National Guard brought a Humvee and Howitzer Cannon over for the students to check out. There was also a WW2 military jeep on display and the ROTC from Harrison High School came over to talk to the kids about educational opportunities in the military. The 2nd Annual Agricultural Field Day will give students a chance to see how advanced technology is used in farming. There will also be a pulling tractor for the students to investigate. The different technology advancements they observe are discussed. This and other field days planned by this teacher essentially bring the field trip to the school and every student who wants to be involved, has the opportunity because it is during each class free time and recess.

New PSA begins airing statewide as part of Alcohol Awareness Month

Indiana Attorney General Greg Zoeller teamed up with Olympic figure skater Ashley Wagner in a new public service announcement (PSA) to ask children to say “yes” to a healthy lifestyle and “no” to underage drinking.

 

Zoeller said the PSA, which will begin airing statewide this month, is part of a national awareness campaign called Ask, Listen, Learn: Kids and Alcohol Don’t Mix. The message is timed with April’s designation as Alcohol Awareness Month and supported by the Foundation for Advancing Alcohol Responsibility – formerly known as The Century Council.

 

“It is my hope that this message will kick start conversations between parents and children about the dangers of underage drinking,” Zoeller said. “While children look up to professional athletes and others as role models, parents play the biggest role in keeping their child on the right track.”

“April is alcohol awareness month and we want to remind parents to continue to talk with their kids about the dangers of underage drinking,” said Ralph Blackman, President and CEO of The Century Council. Zoeller continues to promote Indiana’s Lifeline Law which encourages young people to call 911 if someone is suffering alcohol poisoning and makes the caller immune from criminal charges related to underage drinking. This year, the law was extended to include immunity from prosecution if underage callers seek help for other types of medical emergencies such as concussions, or are a victim of a sexual assault, or witness and report a crime. Measles and Whooping Cough Making a Comeback

Two serious diseases are making a comeback thanks to persons refusing immunization against these easily preventable infections. The diseases are measles and pertussis (whooping cough.) Measles is a respiratory disease caused by a virus and is highly contagious. The disease of measles and the virus that causes it share the same name. The disease is also called rubeola. Measles virus normally grows in the cells that line the back of the throat and lungs.

About one out of 10 children with measles also gets an ear infection, and up to one out of 20 gets pneumonia. About one out of 1,000 gets encephalitis (brain inflammation), and one or two out of 1,000 die. Measles still kills an estimated 164,000 people each year around the world. Measles can also make a pregnant woman have a miscarriage or give birth prematurely.

Measles is highly contagious and can be spread to others from four days before to four days after the rash appears. Measles is so contagious that if one person has it, 90% of the people close to that person who are not immune will also become infected with the measles virus. The virus lives in the mucus in the nose and throat of the infected person. When that person sneezes or coughs, droplets spray into the air. The droplets can get into other people’s noses or throats when they breathe or put their fingers in their mouth or nose after touching an infected surface. The virus can live on infected surfaces for up to 2 hours and spreads so easily that people who are not immune will probably get it when they come close to someone who is infected. Measles is a disease of humans; measles virus is not spread by any other animal species.

In 2013, there were 189 cases of measles in the US, the second largest since the disease was declared officially eliminated in 2000. About 28% of these people got measles in other countries. They brought the disease to the United States and spread it to others. This caused 11 measles outbreaks in various U.S. communities, including the largest U.S. measles outbreak since 1996 (58 cases).

Measles was declared eliminated from the United States in 2000. So, the disease no longer spreads year round in this country. But it is still common throughout the world, including some countries in Europe, Asia, the Pacific, and Africa. Anyone who is not protected against measles is at risk of getting infected when they travel internationally. They can bring measles to the United States and infect others. Unvaccinated people put themselves and others at risk for measles and its serious complications.

Pertussis, a respiratory illness commonly known as whooping cough, is a very contagious disease caused by a type of bacteria called Bordetella pertussis. These bacteria attach to the cells that line part of the upper respiratory system. The bacteria release toxins, which damage the cells and cause inflammation (swelling). Pertussis (whooping cough) can cause serious and sometimes life-threatening complications in infants and young children, especially those who are not fully vaccinated. Complications include pneumonia, convulsions, stopping breathing, brain inflammation and death. Teens and adults can also

get complications from pertussis. They are usually less serious in this older age group, especially in those who have been vaccinated with a pertussis vaccine. Complications in teens and adults are often caused by the cough itself. For example, you may pass out, fracture a rib or lose control of your bladder during violent coughing fits. Worldwide, pertussis causes 16 million cases of illness and 195,000 deaths per year.

The best way to prevent contracting these potentially deadly diseases is to get vaccinated. Pertussis usually requires a booster every 10 years to ensure maximum immunity. More and more individuals are refusing vaccination for themselves and their children making them more vulnerable and increasing the likelihood of spreading the diseases once they are contracted. Many people still harbor the mistaken belief that childhood vaccines contribute to autism and related disorders. In 2004, a comprehensive review by the Institute of Medicine (IOM) concluded that there is not a causal relationship between certain vaccine types and autism. In the last 10 years, additional peer reviewed articles have repeatedly examined the relationship between vaccination and autism and arrived at the same conclusion.

No medical treatment is 100% safe. However, the risks of not receiving vaccines against common diseases far outweigh any potential complications.

Law school ranking rumble

University of Notre Dame Law School Dean Nell Jessup Newton admits she has mixed feelings about the annual law school rankings compiled and published by U.S. News & World Report.

On the one hand, the rankings provide some good consumer information to students thinking about getting a legal education. But on the other hand, Newton said, the rankings have too much influence on the choices made by students, hiring practices of law firms and even the behavior of law schools in general.

Since the different groups do pay attention and blogs spotlight even the slightest movements on the list, law school deans cannot ignore the rankings no matter how much they may disparage them. Commonly, deans complain the comparison by U.S. News focuses on things that have little impact on the quality of education and do not measure the elements that schools value.

Austen Parrish, still in his first semester as dean of Indiana University Maurer School of Law, holds a tempered view of the survey. They are what they are, he said, and smart deans do not run their law schools based on the U.S. News evaluation.

Still, Parrish acknowledges deans are not immune to the excitement or disappointment caused by a high or low ranking.

“I think as much as deans rail against it,” he said, “if they move up in the ranking, they celebrate pretty hard.”

For the 2015 U.S. News Law School Rankings, Notre Dame placed at No. 26 and Indiana University Maurer School of Law shared the No. 29 slot with the University of Georgia. Indiana University Robert H. McKinney School of Law tied for No. 87 with six other schools including Michigan State University and the University of Louisville.

Valparaiso University Law School retained its listing as “rank not published” because its placement fell below the cutoff line. The Indiana Tech Law School was not part of the rankings because it has not been accredited by the American Bar Association.

How it works

Each year the news magazine issues its best graduate schools lists, ranking law schools, medical schools, engineering schools, business schools, and undergraduate programs, among others. For law schools, the annual list has a great impact because U.S. News is about the only organization that reviews the accredited law schools in the country. The legal blog, Above the Law, created its own Top 50 law schools list last year based on different criteria, mostly employment outcomes.

According to U.S. News, the methodology behind its rankings measures 12 separate elements and then applies a weighted average so all the elements do not have an equal impact on the overall score. The 12 factors include assessments by law school deans as well as lawyers and judges, median LSAT score and median undergraduate GPA of the incoming class, expenditure per student, and bar passage rates, along with employment rate for graduates nine months after completing law school.

Bob Morse, director of data research for U.S. News & World Report, explained the rankings include budget, job placement and prestige because the focus is from a student perspective. The survey does not measure faculty achievement or scholarly activity but instead concentrates on the factors that students can understand and use.

“Our intent isn’t to be a powerful force with the rankings,” Morse said. “U.S. News did not start doing the rankings with the goal of becoming an influential force in law school policy.”

However, Morse pointed out that of all the academic disciplines ranked by the magazine whether medicine, library science or any of the others, the strongest reaction to the listing comes from the law schools. One reason is because the other schools are critiqued by a couple of different organizations, but among law schools, U.S. News holds almost a monopoly on the survey.

At Notre Dame’s Mendoza College of Business, Dean Roger Huang agreed the rankings from U.S. Newsdo not hold as much sway with business schools.

Yet, he said if his college would drop in the rankings, he would reassure the alumni that the decline was not the result of something the college did or di

d not do. In addition, Huang would emphasize the institution was sticking to its mission of educating the hearts and minds of the students to be ethical and use business in the proper way.

“We do not run our program to conform to the rankings,” Huang said.

Newton, Parrish and Andrew Klein, dean of the Indiana University Robert H. McKinney School of Law, echoed Huang. In addition, they all maintained the U.S. News survey does not give a complete picture of their schools, and they questioned the magazine’s methodology.
As an example, Klein pointed out that a small two-point move in a school’s median LSAT can cause a dramatic swing in the rankings but have zero impact on the quality of education.

Parrish attributed IU Maurer’s slip in the rankings to a drop in the school’s job placement. The Bloomington law school declined four places in the 2015 listing to No. 29 because, he explained, personnel problems in the school’s placement office lowered the employment rate for students in the class of 2012. Since then, the law school has hired a new assistant dean of career and professional development, and the employment rate for the class of 2013 is 11 percent higher than for 2012.

“A one-year blip isn’t any concern to me at all,” Parrish said.

At Notre Dame, Newton has counseled students who enroll in programs solely based on the rankings. She has seen students forgo scholarships from law schools located in the area of the country they want to practice and instead pay full tuition and go someplace they don’t intend to stay just to attend an institution that is one or two slots higher in the rankings.

Despite her concerns about the influence the rankings have and the lack of transparency behind the calculations, Newton has never contacted U.S. News to discuss the situation. The rankings are a website, she said, that does not draw on the expertise of journalists, statisticians or social scientists.

“I don’t respect them enough to engage with them,” she said. “I don’t think they are going to listen to me.”

Morse said U.S. News does not tailor the rankings in response to law schools’ complaints and criticisms. Consequently, the rankings have credibility, he said, because the magazine is an independent judge.

He then noted what he called the hypocrisy of the law schools. For all the griping law schools do, 66 percent of the deans respond when U.S. News requests information.

Law schools do have the option of not providing data and assessments to the news magazine, but Newton compared that option to the prisoner’s dilemma. Unless all the schools refuse to participate, those that do not return the forms will be punished with a lower ranking.

As such, Newton said she would not stop participating because she does not want Notre Dame to fall in the rankings. She does not want to hurt the students and alumni by having the school’s reputation downgraded.

Former IU McKinney dean Gary Roberts did not respond to U.S. News data requests for several years. When Klein became dean, the law school resumed submitting the data.

In fact, when Klein was interviewed for the dean position, he was asked about the rankings. He replied although the school was forced to pay attention to them, he would be ethical in reporting the data and not fudge it. He also asserted he would not make any changes that he thinks would diminish the program for the students just to do better in the rankings.

Klein agrees with Roberts that the rankings do not present an accurate portrayal of the quality of education offered at IU McKinney, but there is the need to be pragmatic because people pay attention.

“There are many flaws in the rankings,” Klein said. “I don’t think that U.S. News does a very good job of measuring the quality of an institution’s education. But, unfortunately, some people pay attention to the rankings. We were doing a disservice to our law school by not participating.”•
