IS IT TRUE June 18, 2013

Mole #3 Nostradamus of Local Politics

IS IT TRUE the City County Observer set internet traffic records yesterday for visits, unique visitors, and Facebook referrals?…while our previous records that were set on the days that the Democrats gathered after a City Council meeting for a good old fashioned booze fest at a well known downtown bar, the former CVB board of directors had their Opus One episode, and the 2011 election night, this was the first time Facebook drove volumes of traffic to the CCO?…by the time the day was over right at 10,000 readers from 42 states and over 50 countries had logged on to read the first-hand accounts of the alleged beating of Robert Evidon by an officer of the Evansville Police Department?…the CCO was the only local publication to publish the official EPD statement in full alongside the Facebook post that described the alleged beating?…we will continue to publish eyewitness, signed, and authorized narratives about this unfortunate situation as we receive them and to reserve judgment or opinion until some trial happens in the future?…there may well be trial as Mr. Evidon has requested a trial by jury?…this is the best way to mitigate what happened as a jury of one’s peers does not cut deals, plead down, or parse charges?…we say let justice be done in a fair and honest manner and let these chips fall where they may?

IS IT TRUE that we were surprised yesterday to receive a statement from Evansville City Councilman Al Lindsey to advise the CCO and his constituency that he will not be attending the gathering of Democrats at Party Headquarters in downtown Evansville tonight?…it seems as though Councilman Lindsey has learned his lesson and will not be attending any future meetings where Indiana Sunshine laws have a high probability of being violated?…to be clear, any time that 5 or more members of the Evansville City Council get together in a non-public meeting that was announced and talk about City of Evansville business then Sunshine Laws are violated?…given the support of the local unions for the two big construction projects being contemplated, the fact that a union boss runs the Vanderburgh Democrat Party, and that a vote to fund these projects by the City Council is needed to move the projects forward, the probability is high that these topics will come up at tonight’s Democrat love fest?…when the allegation of Sunshine Law violations arise, Al Lindsey will not be party to such allegations because this simple man with a boatload of common sense has the good sense to stay out of this fracas?

IS IT TRUE that President Barack Obama and former Vice President Dick Cheney have finally found something that they are in complete agreement on?…the President and Dick Cheney both vehemently defend the federal government’s “right” to spy on every American all day every day in any way they please without regard to a judge’s subpoena, any charges filed, or history of good character?…this position is par for the course for Vice President Cheney but such a profound flip-flop on government surveillance on private citizens by President Obama is astounding to people from the far left to the far right?…the actions of former President George W. Bush in the aftermath of 911 would indicate that he is in agreement with these two politicians as well?

Anonymous Tip Line Launches in Vanderburgh County

0

Nick's HeadshotStarting today, the Vanderburgh County Prosecutor’s Office has launched WeTip, a completely anonymous tip line designed to give callers a chance to report crime.

The phone number for WeTip is 1-800-78-CRIME. Calling this number connects callers to operators available 24/7. When a caller uses the WeTip hotline, the first thing they hear upon making the call is “This is the WeTip crime line, please do not give your name or identify yourself…” From there, the caller is guided through a series of questions designed to get as much relevant information possible.

Once the call is complete, the WeTip operator asks the caller if they would like a reward pending the outcome of their call. If they would like a reward, the caller is given a three part code name. They are able to use this code name to call back at a later date to check the status of the reward. WeTip pays rewards from $20-$1000 depending on the severity of the crime and the outcome pending a future conviction. Callers are instructed where to pick up their reward upon their follow up call.

Prosecutor Nick Hermann believes anonymity is what will help make WeTip an asset to our community. “Citizens are sometimes reluctant to report crime for fear of retaliation. Through use of this anonymous tip line, citizens can take an active role in protecting their neighborhoods from those who break the law and endanger those around them.”

“This tip line allows neighbors to become the eyes and ears of the community. They can aid us in solving crimes, preventing future crimes, and ultimately saving lives.”

According to Evansville Police Chief Billy Bolin “The number one thing we have heard with our own tip line is that people are afraid to call it because they are afraid to call the Police directly.

They don’t want their name in a report that could tie a crime back to them where they may have to testify rather than just giving their information,” said Bolin. “That being said, it’s important to remember that if you are witnessing a crime or having crucial, pressing information, you should still call 911. WeTip is a tip line, not an emergency service.”

“Tip lines are effective when the community has access to the number. You can’t use something you don’t know about,” said Bolin. “This number is important for everyone to have on hand.”

FoxFire here, wanted to let everyone know I am home now and my son on fathers day is helping me nurse my wounds. Team Fly was hired by USI to provide Sculpt EVV with a security watch all night Friday and Hired to set up and produce the stage, lights & sound & fire show for the full day event on Haynies Corner. Our permit was for until Midnight. Our fire show had just ended and Phoenix Down was finishing last song. at 12:08 Officer Mattingly was dispatched to Haynies Corner and asked that we stop the music and our permit was over at 11pm which he was incorrect about. I told him I would go on stage and stop the band, he said no pull the plug right now on electricity or I will write a ticket to everyone here on the corner, I asked him to chill out for a minute while I take care of powering down all the amps properly, then Officer Mattingly proceeded to punch me in the face and threw me on the ground and continued to punch me in the face and legs and back, I never resisted and just kept saying to the officer “I am not resisting” the whole time he was yelling at me to stop resisting, I was just limp and trying to follow directions as the officer continued to beat my head on the pavement and punch me in the back of the head at least 30 times. I was arrested for resisting arrest and taken to the hospital to check out my extensive head & shoulder injuries. The whole time while in hospital, officer Mattingly had me tightly cuffed to the bed and was taunting me for 2 hours. When we arrived at the hospital he told the police officer on staff at hospital quote “I just beat up a hippie on Haynies corner and there were all whole bunch more there, I wanted to taze them, my trigger finger has been itchy lately” then he looked at me and said I know where you live and what you drive, your kind are not welcome here. His brother who is not a police officer was ridding in the vehicle the whole time during this and while in the hospital his brother was taking pictures of me cuffed to the hospital bed, I kindly asked them to stop taunting me and taking my picture but I was completely ignored. I was booked into Vanderburgh county jail and was released today on bail. I have a 1:30pm court date tomorrow Monday June 17th. There were many witnesses and we are asking anyone who witnessed the event and/or took pictures and video to contact us immediately so we can use this evidence to clear any charges against me and to possibly look into suing the city for the huge medical expenses I incurred and damages for missed work due to injuries that may take a while to heal. Thank you for your help… LOL Team Fly…

EPD Response to Alleged Beating of Robert Evidon at Haynie’s Corner Artfest

Robert Evidon
Robert Evidon

At approximately 12:15am on Sunday morning, Officer Todd Mattingly was dispatched to Haynie’s Corner for a complaint of loud music coming from the Sculpt EVV live concert. Officer Mattingly arrived and spoke to Robert Evidon, who was working the soundboard, about the noise. Officer Mattingly asked Evidon if he could turn the volume down because of the neighbors complaining. Evidon told Officer Mattingly that the band was playing one last song and that the concert would be over after that. Officer Mattingly returned to his patrol car and allowed the band to continue, even though the event permit expired at midnight.

While waiting in his car for the music to end, dispatch told Officer Mattingly that another caller was very irate that the music was still going on. Officer Mattingly walked up to Evidon and second time and told him about the latest 911 call about the noise and asked again for him to turn down the volume.
This time, Evidon was told that if he did not turn down the volume, he could be cited under the disorderly conduct law. Evidon, who by his own admission had been awake for two straight days and under the influence of alcohol, told Officer Mattingly “You need to chill the Fuck Out”. Officer Mattingly again told Evidon he would be issued a citation if he did not turn down the music. Evidon replied “Then write me the fucking ticket and go the fuck somewhere else”.

Due to Evidon being intoxicated and disorderly, Officer Mattingly told him he was under arrest. He told him to turn around and put his hands behind his back. Evidon did not comply with Mattingly’ instructions. He told Officer Mattingly to “chill the fuck out” and continued to ignore the instruction to turn around and put his hands behind his back. When Officer Mattingly grabbed Evidon’s arm to gain compliance, Evidon told him to “get the fuck off him”. Evidon then physically resisted arrest and tried to pull away from Mattingly. Mattingly first tried to gain compliance while standing up. When Evidon continued to resist, Officer Mattingly used an arm bar take down to get Evidon to the ground. Once on the ground, Evidon continued to resist arrest. Officer Mattingly used his body weight to control Evidon’s movement. After a brief struggle on the ground, Officer Mattingly was able to gain control of Evidon and get him in handcuffs.

At no time, did Officer Mattingly strike Evidon with an impact weapon, his fist, his hands, his knees, his feet, or any other object. In his Facebook post, Evidon claims officer Mattingly punched him in the face legs and back. Evidon claimed Officer Mattingly punched him in the head 30 times and continually banged his head into the pavement. Evidon claims the arrest left him with extensive head and shoulder injuries.

Evidon was taken to the hospital at his request to be examined. He was treated for a small abrasion on his shoulder that would be consistent with a person resisting arrest on a paved surface while not wearing a shirt. He was released and taken to jail.

While being booked into the jail, he had his picture taken as part of the process. Those pictures show him from the front and the side. There are not any marks, bruises, abrasions, or other injuries consistent with his claims of being punched in the face, or being punched 30 times in the head or having his head continually banged against the pavement.

Evidon also claims that Officer Mattingly and his brother, who was riding with him, took pictures of him while he was handcuffed to the hospital bed. Officer Mattingly and his brother both deny taking any pictures and have asked that any devices they had with them in the hospital be put through a forensic examination to prove that the claim is false.

Evidon has asked for anyone with video or pictures of his arrest to make those images available. We join him in his request. We spoke to a witness to the arrest minutes after it happened. That witness showed the on-duty supervisor the pictures. The pictures showed Officer Mattingly on the ground trying to gain compliance from Evidon. It does not show any of the things that Evidon claims to have happened.

We have not found anything in our investigation that supports Evidon’s claims. On the contrary, we believe the facts available at this time support the information listed Officer Mattingly’s sworn Affidavit of Probable cause and his Use of Force report.
