Joe Wallace, editor of the City County Observer and the Managing Director of the Coachella Valley Innovation Hub was interviewed by CBS today regarding President Obama’s announcement about establishing an innovation hub in North Carolina.

When asked by the reporter how he felt when he watched President Obama announcing a new program like the one he was the founding managing director for in California, Wallace said, “it was strangely satisfying to see the President of the United States announcing a plan to embark on a program that was established in California over 2 years ago.” Wallace stated that he hopes every innovation hub in the nation achieves the same level of success as the Coachella Valley Innovation Hub.

Councilwoman Riley Encourage Your Attendance At Board of Zoning Appeals Meeting this Thursday at 4 pm in Room 301‏

Dear City County Observer Readers,
3rd Ward City Councilwoman Stephanie Brinkerhoff-Riley
3rd Ward City Councilwoman Stephanie Brinkerhoff-Riley
I ask for your help and attendance at the BZA meeting this Thursday at 4 pm.
Evansville has a half-way house/residential reentry facility located at 811 E. Franklin St., which is in the Third Ward. The facility is operated by the Volunteers of America within strict guidelines set out by both the Bureau of Prisons and Indiana Department of Corrections. The VOA has had the contract with the BOP for the last five years. Their contract expires at the end of February. Pursuant to standard procedure, the BOP issued a Request for Proposals towards the end of 2013. The RFP triggered a flurry of letters from companies outside of Evansville identifying various properties where they intended to open a facility should they win the BOP contract. As you know, this prompted the Area Planning Commission, Dr. Adams and I to amend our zoning ordinances to codify the process that the VOA went through in obtaining the current location. Previously, our zoning code could have been interpreted to allow these facilities on properties zoned R2 and C2. We amended the ordinance to require a zoning of M1, M2, M3 or C4. We also added the requirement that a facility of this nature could not be located within a 1000 feet of a school.
In the last five years of dealing with the VOA, there has not been one cited problem. I met with the staff today and toured the facility. They can hold up to 100 residents from the state and federal prisons and have the ability to double their capacity if necessary. They have a full-time drug counselor, social worker and employment case manager. They are typically at 95% of their residents being employed locally. They do a nice job, and the city has already accommodated this location with a bus stop, and many of the residents work at Tri-State Resource Recovery during their time in the facility.
The bid for the BOP contract is now down to the VOA and a company out of Florida called Transitional Housing. The VOA is an Indiana company. This Florida company has entered a contract to purchase a building at 1227 E. Michigan, JUST 335 FEET FROM JOSHUA ACADEMY. Our ordinance and the policy behind it will be tested this Thursday at 4 pm as Transitional Housing asks for a variance on the 1000 feet requirement. The bus stop for Joshua Academy is directly in front of this address. Joshua Academy has preschoolers who are 3 years old.
This is unacceptable, not just to me as the representative for the third ward but also to the parents and neighbors to Joshua Academy. Please join me and representatives from the Mayor’s office, ECHO housing, Joshua Academy, and the Urban Enterprise Zone as we ask that this variance be denied.
Please let me know if you have any questions, and I hope to see you Thursday.

IS IT TRUE January 15, 2014

IS IT TRUE that the EPD Activity Report for yesterday is a near record 21 pages long and apparently Evansville is being widely victimized by a most unusual fetish bandit?…there are a rash of garbage cans reported stolen in both yesterday and Monday’s reports?…we wonder exactly what in the daylights would possess someone to steal garbage cans which have miniscule value as a recyclable item?…hope fully the Oscar the Grouch imitators will be caught soon and this menace will be put to rest?

IS IT TRUE we encourage all of our readers to circle the date of February 16th on their calendar because that is the day that the soon to be 4th ranked Wichita State Shockers come to Ford Center to play the Evansville Purple Aces?…there is a reasonable probability that the Shockers will be ranked even higher by then and maybe even #1 if Arizona, Michigan State, and Syracuse each lose one game on their difficult schedules between now and then?…the home crowd needs to make an effort to attend this game and cheer the Aces who defeated the Final Four participant Shockers two times last year on against this highly ranked team?…this will be the highest ranked team in a long long time to come to Evansville where the Aces historically have fared well when seemingly outmatched?…this will be a rare treat that we hope the people of Evansville will not miss to sit home and watch the idiot box?

IS IT TRUE that the Democratic Central Committee met last night to discuss which candidates should file against the Republicans in upcoming County wide elections? …we hear that former City Councilman and Evansville Fire Chief Keith Jarboe is considering running for the County Commission seat held by Marsha Abell?

IS IT TRUE that we wonder why past Vanderburgh County Sheriff and 8th District Congressman Brad Ellsworth has been attending the last several Democratic Party Central Committee meetings? …that Mr. Ellsworth is the new Division President of Vectren which is well known as the most Republican based corporation in Indiana?…that the new Vectren Division President Brad Ellsworth’s involvement in local Democratic back room political decisions is extremely confusing? …we believe that Division President Ellsworth would better serve Vectren and it’s customers by staying politically neutral?

IS IT TRUE that Mike Duckworth’s newest political patronage job title with the City of Evansville is called Evansville Water Superintendent? …he was the field rep. for U S Senator Richard Lugar…Duckworth was a past Vanderburgh County Deputy, past Superintendent of the County Garage, past Superintendent of City of Evansville Department of Transportation Services and presently a member of the Vanderburgh County School Board?

IS IT TRUE that Vanderburgh County Sheriff Eric Williams just selected Steve Bagby a retired City of Evansville police officer, past 2nd Ward City Councilman, present paid member of the Evansville Safety Board and presently employed as counselor for a company that receives some public funds that serves drug users? …Steve Bagby’s new political patronage job in the Vanderburgh County Sheriff Department is the Director of Community Corrections?

IS IT TRUE we hope that the voters will make political patronage and nepotism employment a major campaign issue in this coming County and City elections.

IS IT TRUE that late night satirist Bill Maher will be coming to town to do a show at the Victory Theater on March 29th at 8 PM?…this is the guy who openly makes fun of Christians and conservatives as mindless tools on a regular basis as the main part of his shtick?…we wonder if Mr. Maher has any idea what he is getting into with his upcoming trip to Evansville?

Rockport plant opponents appeal quick permit extension

1

indianalawyerby Dave Stafford for theindianalawyers.com

Environmental groups opposed to a controversial coal gasification plant proposed for southwest Indiana have asked for state administrative review of a permit that was extended without a hearing on the day it was set to expire.

The Sierra Club and Valley Watch, Inc. filed a petition for administrative review of the Indiana Department of Environmental Management’s permit renewal because they say it was done without public hearings. The groups contend those hearings are required under the state’s administrative code. The petition is filed with the Indiana Office of Environmental Adjudication.

IDEM more than 18 months ago issued a “Prevention of Significant Deterioration New Source Construction/Part 70 Operating Permit” for the facility proposed to be built in Rockport by Indiana Gasification, LLC, a subsidiary of hedge fund Leucadia National Corp. The Rockport plant project manager is Mark Lubbers, a one-time aide to former Gov. Mitch Daniels, who championed the project.

The permit issued in June 2012 was set to expire Dec. 26, 2013. The petitioners say 326 IAC 2-2-8(a)(l) stipulates such permits “shall become invalid” if construction hasn’t started within 18 months. IDEM renewed the permit on that date, the same day Indiana Gasification filed a permit amendment application, according to the petition. It says IDEM violated its rules in doing so.

“IDEM’s failures to follow public notice procedures or provide a justification for the extension in the Permit Amendment not only renders the Permit Amendment invalid and the PSD Permit expired, but they deprived the Petitioners their right to know and to comment upon the basis for IDEM’s decision,” the petition concludes.

IDEM spokesman Dan Goldblatt said the agency was formulating its legal response Tuesday, but that under the federal Clean Air Act, the agency was not required to conduct hearings on an extension that did not constitute a modification of the existing permit.
