Mom and pop store can’t proceed pro se in Coach trademark lawsuit

The owners of a southern Indiana general store accused in a federal lawsuit of selling knockoff high-end Coach-brand products may not represent pro se their incorporated general store named in the suit.

New York-based Coach Inc. sued Dyer’s General Store and Outlet in Worthington, also naming its owners, Kimberly and David Dyer. The suit, filed three months ago, claims an investigator hired by Coach purchased a counterfeit wristlet bearing a Coach trademark at the store and observed handbags and accessories that “had trademarks for high-end brands including, but not limited to, Coach.”

The suit seeks damages and fees for alleged Lanham Act violations including trademark counterfeiting, trademark infringement and false advertising; common law trademark infringement, unfair competition, forgery, counterfeiting and unjust enrichment.

“Coach is suffering irreparable injury, has suffered substantial damages as a result of Defendants’ activities,” the suit alleges. The case in the District Court for the Southern District of Indiana, Terre Haute Division, is Coach, Inc. and Coach Services, Inc. v. Dyer’s General Store and Outlet, Kimberly Dyer, and David L. Dyer, 2:13-cv-0411.

David Dyer filed a pro se response in which he said Dyer’s doesn’t deny the allegations but believed the products it bought and sold were “designer inspired” and that the store has since removed the items and worked with Coach “with the desire to resolve all concerns with promptness and diligence.”

But District Judge Jane Magnus-Stinson on Tuesday ordered the corporate entity to appear by counsel and file an answer to Coach’s complaint by March 13.

“The Court notes that corporations cannot appear pro se, but must appear through an attorney,” she wrote, citing Nocula v. UGS Corp., 520 F.3d 719, 725 (7th Cir. 2008). The Dyers may represent themselves, but “Dyer’s General cannot represent itself and the Dyers cannot represent Dyer’s General either.”

Dyer’s is the latest Indiana retailer sued in federal court as Coach pursues an aggressive defense of its intellectual property, asserting in the suit that its marks “are widely recognized and exclusively associated by consumers, the public and the trade as being high quality products sourced from Coach, and have acquired a strong secondary meaning.”

Since 2009, Coach has filed at least 21 lawsuits against retailers in Indiana federal courts. Just two, including the suit against Dyer’s, remain open.

Rep. Bacon sponsors bill concerning mental health witnesses

STATEHOUSE — State Representative Ron Bacon (R-Chandler) has sponsored a piece of legislation to allow psychologists to testify in criminal courts as mental health witnesses. Senate Bill (SB) 88 passed the Indiana House of Representatives on 3rd reading today unanimously.

 

Under current law, a psychiatrist must be used in any criminal cases involving an insanity defense. SB 88 provides that in insanity hearings not involving a homicide, the court shall appoint two or three competent and disinterested:

* Psychiatrists;

* Psychologists endorsed by the State Psychology Board; or

* Physicians who have expertise in determining insanity, at least one of whom must be a psychiatrist or psychologist.

“The court system generally prefers a psychiatrist, however availability has become an issue,” said Rep. Bacon. “By allowing psychologists to do this work, we will make the judicial process more efficient and expeditious. This will also reduce local expenditures by reducing the amount of time a defendant, who utilizes an insanity defense, spends in jail while the court looks to appoint a psychiatrist.”

 

In insanity hearings that do involve a homicide the court will have the same criterion by which to appoint mental health experts, however in this case, when appointing physicians who have expertise in determining insanity, at least one of them must be a psychiatrist and at least one of them must be a psychologist.

The bill will now go back to the Senate for concurrence because it was amended in the House.

IS IT TRUE today is the day that the $200,000 loan that Mayor Winnecke and the Loan Administration Board sneaked to Earthcare Energy LLC is due and payable in full?…the balance is now $186,000 and will be a welcome addition to the coffers of the City of Evansville?…there are some CCO Moles that have told us that the City of Evansville may still consider Earthcare Energy as a viable option for a manufacturing attraction project?…upon hearing that resurrecting this deal was in the cards we did a little research and learned that the website for Earthcare Energy LLC is no longer functional?…we also learned that Mr. Ken Haney, Steven Geldmacher, Ervin Washington and the crew that was well VETTED by City Councilwoman Stephanie Brinkerhoff-Riley back in 2012 has renamed the enterprise as ENVIRO ENERGY LLC?…we also saw that the website is the exact same website as the Earthcare Energy LLC site and still has the same news releases about meetings with the Department of Energy and an Indonesian business?…all of the articles about Evansville including the announcement that they were ready to start hiring 120 people are missing?

IS IT TRUE even some halfway intelligent people who are irrationally exuberant may get fooled once by failing to VET, but only a complete fool falls for the same trick twice?…it is time to collect this debt and put this money to some good use like a free dental clinic to serve Evansville’s poor?…the reaction of the Mayor and the Loan Administration Board at Monday’s 3:00 meeting will be very interesting to watch?…one would think that having handled snakes once and being bitten would be a sufficient lesson for one with even a shred of wisdom?

IS IT TRUE we were surprised to learn in our recent Freedom of Information Act request that the law firm that employs former Mayor Jonathan Weinzapfel has been cashing checks of over $900,000 per year since the Winnecke Administration occupied the Civic Center?…prior to Winnecke becoming mayor this law firm was billing the City of Evansville less than half of that amount?…we wonder why the business of this firm with the City of Evansville doubled right after the former Mayor became employed there?

W0038933-1_144503Paul Joseph Bitz, of Evansville, Indiana passed away peacefully on Friday, February 21, 2014, at home.

 

Paul was a graduate of Reitz Memorial High School and Evansville College/University of Evansville.  During World War II he served in the 1877th Engineering Battalion in India.  Shortly after his return to civilian life, he married Margaret Ernestine Mills (Tena), a union that created nine children.

 

He became active in the Veterans of Foreign Wars, serving as Post 1114 Commander for five years, as 8th District Commander, and in several state positions with the organization.  He received numerous honors from both the VFW and Disabled American Veterans of Indiana.

 

Paul also began pursuing his passion for public service.  He was elected as Indiana State Senator in 1954 and re-elected in 1958. His legislative accomplishments included: property tax exemptions for seniors, the visually and hearing impaired; an employer requirement to grant military leave for reservists; and righting a legal wrong by finally giving people with epilepsy the right to marry.

 

Paul remained active in local and national politics following his State Senate terms.  He was regional campaign manager for President John F. Kennedy and Senator Robert Kennedy.  He helped head up campaigns for local, state, and national candidates, including Senator Vance Hartke.  He was a stalwart of the local Democrat Party, President of the Roberts Stadium board for six years, and head of Voter’s Registration for eight years.  He was a devoted member of St. Benedict’s Cathedral.

 

Paul and wife Tena (deceased) were proud parents of nine children: Mike Bitz (deceased), Greg Bitz, Cindy Korff, Bonnie Reinhart, Karen Stewart, Kevin Bitz (deceased), Kim Patrick Bitz, Terence David Bitz, and Roger Bitz (deceased).

 

Paul was blessed with 16 grandchildren: Tammy, Tracy, Jennifer, Dale, Darcy, Dawn, Tim, Andrew, Kevin, Heather, Holly, Julie, Jocelyn, Matthew, Ryan, and Douglas, plus 18 great-grandchildren and one great-great grandchild.

 

A memorial mass for Paul will take place in the mausoleum chapel at St. Joseph Cemetery on Saturday, March 1st, at 9:00am. In lieu of flowers, donations in his name may be made to St. Benedict Cathedral or the VNA.  Condolences may be made online at www.browningfuneral.com

RIECKEN’S INFANT MORTALITY REDUCTION GRANT ADOPTED BY HOUSE

INDIANAPOLIS-The Indiana House today adopted a proposal by State Rep. Gail Riecken (D-Evansville) that will begin to fund solutions for the best practices to decrease the high number of child fatalities in our state.

Riecken authored an amendment to Senate Bill 408 which included a new Infant Mortality Reduction Grant Fund.

Currently, Indiana ranks fifth in the nation in child deaths, with the top two causes of infant mortality being babies born too small and too early.

“The amendment calls for the interest on the money in the Indiana checkup plan to be transferred to the new Infant Mortality Reduction Grant Fund,” said Riecken. “It also specifically states that the money in the newborn screening program cannot be transferred, assigned, or otherwise removed from the fund by the State Board of Finance or any other state agency, as has been done in the past.”

Riecken noted that of the 292 children in Indiana who died in 2011, substance abuse was found to be a factor in 43% of the cases. One study found that in cases of Neonatal Abstinence Syndrome, the infants are 19% more likely to have low birth rate and 30% more likely to have respiratory complications.

Neonatal Abstinence Syndrome refers to the effects in newborns that have been exposed to addictive illegal or prescription drugs while in the mother’s womb. These substances pass to the baby during pregnancy, resulting in the baby becoming addicted along with the mother.

“The Commission on Improving the Status of Children determined that one of their priority areas this year would be to create policies to improve child health indicators such as infant mortality rate,” said Riecken. “This amendment advances the commission’s strategy as well as the Governor’s strategy to take action in protecting these infants.

“I am proud of the bipartisan support to protect young Hoosiers and will continue to work to ensure that the safety of our children remains a priority in the legislature,” she concluded.

Senate Bill 408 is now eligible for final consideration on the House floor. If it gets final approval, the measure will return to the Senate for concurrence with the changes made in the House.

 

House passes lifeline law expansion, study of sex assaults

INDIANAPOLIS – The Lifeline Law that gives immunity to intoxicated minors who call 911 could be expanded under a bill that unanimously passed the House on Wednesday.

Senate Bill 227, authored by Sen. Jim Merritt, R-Indianapolis, would extend immunity to minors reporting any medical emergency, as well as minors who are reporting – or are victims of – sex crimes.

“It’s not too often you get to pass a bill that actually saves lives,” said Rep. Jud McMillin, R-Brookville, who sponsored the bill in the House.

The Senate already has passed the bill. “Our laws need to make it clear that when mistakes are made and lives are at risk, calling 911 is a no brainer,” Merritt said.

The bill was amended in the House to create a commission a study to examine the growing problem of sexual assault of minors. Rep. Christina Hale, D-Indianapolis, authored the amendment and said that one out of every six Hoosier girls are raped or sexually assaulted before graduating high school.

Rep. Linda Lawson, D-Hammond, called that number “very, very high.” She said that’s especially because, in her experience, only 10 percent of sexual assaults are actually reported.

“Until we really deal with the sexual assault issue, we’re not going to have a whole society,” Lawson said.

Emergency first responders would also be allowed to carry and administer drugs that temporarily reverse the effects of a narcotic overdose, allowing the victim to be transported to the emergency room.

The bill also gives courts more discretion to be lenient when sentencing minors who were the subject of the emergency call.

Other provisions in SB 227 urge the creation of a study of violent crime in Indiana. Rep. John Bartlett, D-Indianapolis, said the study is especially needed to confront this growing issue. He said there were eight murders in Marion County alone last Friday.

The bill orders a third study to evaluate sexual violence against children and the impact of new technology – including social media and wireless communications – on crimes against children.

SB 227 now returns to the Senate where House Minority Leader Scott Pelath urged lawmakers to concur with changes made by the House.
