COA agrees sellers must pay $280,000 in damages for ‘downright dangerous’ home

A couple who sold a house they built themselves that contained numerous structural issues is on the hook for $280,000 to the buyers of the home. The Court of Appeals found that the sellers made misrepresentations on their real estate sales disclosure form.

This is the second time the appellate court has ruled on this lawsuit, David T. Hays and Amanda G. Hays v. Deborah J. Wise, 76A04-1401-PL-43. The first time, the COA reversed the dismissal of Deborah Wise’s lawsuit alleging David and Amanda Hays failed to disclose defective conditions in the home she purchased from them in 2007.

When Wise and her husband purchased the home, the Hayses had completed the sales disclosure form saying they knew of no structural problems with the home, did not make any substantial changes requiring permits and did not receive any notices from governmental or quasi-governmental entities regarding the property.

But the Hayses never obtained the proper permits for the home which David Hays built with four friends. The couple also had worked with the Army Corps of Engineers to address a dredging issue. Although Wise had an inspection completed before purchasing, it did not turn up the numerous issues discovered after moving in. Several inspectors believed the home was nearing collapse and was dangerous. Walls moved, floors could not support weight, and the foundation was not built deep enough.

On remand, the trial court ruled in favor of Wise, ordering the Hayses to pay $281,062.77 in damages, which included attorney fees.

The Hayses don’t deny the home has significant issues, but they claim the evidence doesn’t show that they had actual knowledge of those issues. They also argue against the damages award, saying it exceeds the cost necessary to repair the structural defects the court found the Hayses knew of when selling. The inspectors who looked at the home indicated it needs to be torn down and rebuilt because it would cost too much to attempt to repair.

The judges found that while there was no direct evidence that the Hayses had actual knowledge of the defects, based on the facts and circumstances of the case there was sufficient circumstantial evidence for the trial court to infer that the Hayses had actual knowledge of most, if not all, of the home’s defects or problems beyond just the structural ones. Judge James Kirsch pointed to the interactions with the Army Corps of Engineers, that the Hayses knew the home had to be permitted but “forgot” to do so, and that the couple added additional bedrooms and the building permit required the removal of a mobile home trailer frame, but it was instead used as structural report.

Haier America Announces Tech Center Location in Evansville

Reuse of a Facility with Rich Manufacturing History

Haier America, a division of the multinational home appliance and consumer electronics manufacturer Haier Group, recently announced plans to locate its North American Tech Center in Evansville, creating 50 new high-wage jobs by 2015. Today, Evansville officials are pleased to announce that the 30,000 square-foot research and development tech center will be located at 901 W Pennsylvania Street.

“After a thorough search process we are pleased to have chosen the location for our new Tech Center at 901 W Pennsylvania Street,” said Adrian Micu, president and chief executive officer of Haier America. “We have already begun recruiting a group of highly talented engineers with a wealth of appliance experience and a diverse set of research and engineering skills and experience and the effort will continue over the next several months.”

Known by Evansville natives as the former Coca-Cola Bottling plant and distribution center, Haier plans to invest approximately $2.8 million dollars in renovations to the façade and interior, constructing Class A office space designed to inspire. The historic facility was chosen by the company for its affordability, proximity to Evansville’s urban core, and its flexibility to build out office space and a fully functioning lab and model shop.

“We’re very pleased Haier America is committing to the community both economically as well as embracing a part of our history by locating their tech center in the old Coca-Cola bottling plant,” stated building owner, Ron Bonger. “Haier America will be an excellent addition to Evansville, their people have been tremendous to work with, and we very much look forward to welcoming them as a new corporate citizen to our city.”

With renovations beginning immediately, the new tech center is expected to be up and running by early 2015. Initially, the Tech Center will focus on commercialization of Haier products for the U.S. Market, followed by new product development.

“The opening of a new Tech Center near Downtown Evansville, I believe, is only the beginning of Haier America’s presence in our community for decades to come,” said Mayor Lloyd Winnecke, “The company has already started hiring talent, and success of the Tech Center will set the stage for additional growth and more jobs in the future.”

The economic impact received by the Evansville community, as a result of the high paying new jobs and investment by Haier will total in excess of $10 million a year.

Haier America is currently hiring engineers, designers, lab techs, model makers and other professionals. Since the initial announcement last month, Haier has already made offers to 19 talented individuals with immediate plans to hire an additional 25.

Police investigating shooting death of Evansville teen

Evansville Police are investigating the shooting death of a 16 year old Evansville resident.

Police were called to an apartment in the 2900 block of N. Fulton at 8:30 Sunday night.
Officers located the victim inside the apartment and began treating him for a gunshot wound. The victim was taken to a local hospital where later died.
Investigators have spoken to an 18 year old who was in the apartment with the victim at the time of the shooting. Police are looking into the possibilty that the shooting was accidental.
The investigation is ongoing. No charges have been filed in this case.

Sheriff Dave Wedding got the chance to pay his respects to a group of World War II veterans this past Sunday.Seventy veterans took part in the Indy Honor Flight this past Saturday, departing Evansville Regional Airport for Washington, D.C. The veterans toured the World War II memorial and met with supporters and admirers. The veterans then returned home Sunday to a hero’s welcome at the airport.Indy Honor Flight is a non-profit organization created solely to honor Indiana’s veterans. I often talk local politics with people and many times I hear “Why does it matter who we elect for Sheriff since they do not make the laws, they just enforce them.” Upon hearing this question, I often reply with one recent example to stress the importance of choosing the right person for this job.

This example revolves around Obamacare. In 2009, our former Vanderburgh County Sheriff had moved on to become our Congressman for the 8th District of Indiana. When it came time to vote on Obamacare, this Congressman did not vote with the desires of his constituents. He voted along party lines and to support his boss in the House at the time, Nancy Pelosi. The moral to the story is this: Every vote for every office matters. If that Congressman had not been elected to be Sheriff in 1998, he probably would not have had the opportunity to vote for Obamacare in 2009.

Currently, we have an appointed Sheriff who in 2012 supported a referendum that was defeated by the voters of Vanderburgh County by a margin of 2-1. Given that he has ignored his constituents in the past, do you think that he will properly represent the people of Vanderburgh County if he gets their support on Election Day? If he uses this position as a springboard to a higher office, do you think that he will properly serve us, or will history repeat itself? I appeal to all of the voters in Vanderburgh County to elect a candidate who most closely represents our community—Kirk Byram. Byram is well-educated and highly experienced. He is a loving husband and father. He knows what the people of Vanderburgh county want and will serve them with honor and integrity. Kirk Byram is the man that will be the Sheriff for all of the people of Vanderburgh County.

IS IT TRUE Some additional information about the composite of the funds at August 31, 2013 and 2014 is now presented for analysis?…on Aug 31, 2013, operational fund balances were $2,513,000, but in a year later at Aug 31, 2014, they are negative by $2,965,000?…the capital funds as of August 31, 2013 were $17,415,000, but on August 31, 2014 they are $14,935?…the restricted funds as of August 31, 2013 was $31,011,000, but August 31, 2014 they are $28,612?…Debt Svc at Aug 31, 2013 was $6,251,000 but was $8,236,000 at Aug 31, 2014?…this is due mainly to the principle requirements on the Ford Center coming due. So here’s the following summary of the changes in the accounts during the last year?

Operational = -218.0%

Capital = -14.2%

Restricted = -7.7%

Debt Svc = +31.8%

IS IT TRUE the composite weighted average of declining balances is approximately 15%?… Umbaugh’s assessment at Dec 31, 2013 must not have considered the fiscal year information and deep negative spending trend?…in spite of that Umbaugh’s bought and paid for opinion still acknowledged declining balances and called for a corrective action “sometime”?…This MUST be discussed in tonight’ City Council meeting even if some egg is tossed onto some unknowing faces and some of our elected officials are embarrassed at the simple analysis that show just how fast Evansville is heading toward its credit limit?…it is interesting to see that even Mayor Winnecke is now admitting that the debt obligations of the underperforming Ford Center in the underperforming TIF district that was supposed to pay for it is a big contributor to the city budget problems?…with declining reserves, uncertain revenue, and increasing debt service the City of Evansville had better get its house in order this year because the chickens of no reserves will be coming to roost by this time next year on the trajectory things are on?

IS IT TRUE one member of the Mole Nation who is in the know tells us that the Vanderburgh County Democrat Party has not yet paid the Bauerhaus for the chicken dinner from 2011?.. Some people who felt shame for the party’s dead beat ways have actually paid for what they ate thinking they had paid the party for it?…the financial malaise of the party matches the issues of the city but is actually worse?…if the democrats are planning to mobilize to make a run for Mayor of Evansville in 2015 they had better get their house in order first because that election will cost about a million bucks to run and a group that can pay for a couple of hundred chicken dinners has no business running a million dollar campaign?…if they can’t we may just see a repeat of the 2007 mayoral election where an incumbent mayor runs against a ghost of a candidate and claims of a 80% approval rating because they beat a nobody?

IS IT TRUE the rest of this IIT will be dedicated to the outcome of the City Council meeting?…in spite of the reality that the revenue for the city was overstated by as much as $11 Million your city council approved a budget that was only reduced by about $3 Million?…this happened after Councilman Conor ODaniel proposed a 3/4% cross the board cut that failed to muster enough votes to pass?…it was encouraging to see the nonsensical Roberts Park cut from the budget but that was simply not enough and the reserves will continue to be bled like leaches bled humans in the dark ages?…the day of reckoning is looming and the taxpayers of Evansville have once again been left holding the bag?…we are sorry to see a budget that did not have a defensible revenue stream as the fundamental assumption on which to construct a spending profile?…the party rage on but the people are still getting the shaft?…the depth of that shaft is not yet known as the City Council reversed an earlier decision and voted the compromised budget down 6-3 in general session?…the saga will continue on for several more days?…it will be interesting to see if we have a budget or a real groundbreaking on the hotel first?

Indiana State Police to Host International Police Work Dog Association National Conference

The Indiana State Police K-9 Division will be hosting the International Police Work Dog Association (IPWDA) National Conference from October 27 through October 31, 2014, at the Muscatatuck Urban Training Center in Jennings County.

This annual training is one of the most comprehensive and thorough K-9 training sessions in the nation. Handlers and K-9s from 16 states and two Canadian provinces will be in attendance. During this weeklong event, police work dog teams will participate in search and rescue, utility, explosive, drug, and scenario based training, with certifications to be completed daily.

IPWDA was first formed in 1998 and has since grown to nearly 800 members.

A VIP/Media day has been scheduled for Wednesday, October 29, to begin at 10:00 A.M.
