HABLA SE WHAT?

During the Vietnam War I served my country in the United States Air Force. As the other branches sometimes say, being in the Air Force is almost like being in the military. I respond, well, I went where they sent me and did what they told me. Was it my fault they sent me to Indiana University and told me to learn Hungarian? That’s right, Hungarian. Hey, if you’ve been in the service you understand. I guess I should be grateful they didn’t want me to learn something useless, such as Vietnamese.

However, the reason I bring up the Air Force is that’s where I met Joe Smith who was from Florida. I had never been to Florida nor known any Floridians. On a map of the United States it looked to me like Florida was a southern state. So I asked Joe, “Why don’t you have a southern drawl?” Heck, my southwestern speech patterns learned in Oklahoma sounded more like Gone With the Wind than Joe’s. He sounded like he was from Ohio.

Joe said, “Florida is not a southern state.”

“Well, is it an eastern state?” I asked.

“No, it is just Florida.”

That was fifty years ago, before every New Yorker who could migrated south and every Cuban who could migrated north. Today Floridians do not speak just some odd variety of Italian, Yiddish or Spanish, Floridians speak Floridian. Ohio has been ousted.

While there are a few people who aren’t old in Florida, most Floridians speak not only some weird language of melded or elided vowels, they also speak old person.

Old person must be spoken loudly and at the same time others are speaking. A typical Florida conversation at the retirement condominium complex where Peg and I are spending two weeks includes references to the Great Depression and the way that Obama fellow plans to steal from social security so he can pay for health care for lazy bums who won’t work. Doesn’t he know we need those social security checks to keep our swimming pool open and pay illegal aliens to mow the grass?

Another staple of old person speak is the requirement that no matter what the first old person says, the second old person must correct it. For example, one might hear, “Cigarettes cost twenty cents a pack during the war (WW II)!”, then a retort of, “They cost nineteen cents and you needed a ration coupon!”

“A ration coupon! Those were for tires and sugar, not tobacco!”

Or perhaps someone might refer to the distance from the retirement complex to the nearest Winn Dixie grocery store: “It’s a mile and a quarter to Winn Dixie!”

“Nope, it’s exactly a mile and three eights!”

Such conversations seem to occur quite often between old married couples, each of whom knows exactly what occurred fifty years ago. Unfortunately, each person’s memory of the event is just slightly different and, for some reason, converting one’s partner to one’s own version is worth hours of loud debate.

As for me, I will settle for knowing I am right and Peg is wrong about the important issue of how often I had to stop for “gas” on the way to Florida. It was not six times as she asserts, but only five. So, there!

In creating this survey, I have made a concerted effort to seek your opinions on a wide variety of topics that will likely be discussed this coming session. These are topics that will have a direct impact on our community and our state as a whole.

Please keep in mind that the presence of an issue on the survey does not necessarily indicate my support for the issue. This is simply an opportunity for your voice to be heard.

Filling out this survey in a timely manner is the best way to ensure that your opinions reach me before I start voting on legislation. The survey can be completed by mailing it back to me or by filling it out online. Please note that you should only fill out one survey. To complete the survey online, please click here.

ALJ’s numerous errors require denial of benefits reversed

Jennifer Nelson for www.thrindianalawyer.com

The 7th Circuit Court of Appeals reversed the decision of a federal judge to uphold the denial of a man’s request for disability insurance benefits. The appeals court held that an administrative law judge made a number of errors when considering the record.

Daniel P. Minnick sought Social Security benefits due to several serious medical problems, including fibromyalgia, chronic obstructive pulmonary disease and degenerative disc disease. The Disability Determination Bureau denied his claim and an administrative law judge determined he is not disabled within the meaning of the Social Security Act. Since the Appeals Council denied his request for review, Minnick sought review in the District Court, which affirmed the ALJ’s decision.

In making her decision, the ALJ discredited one of Minnick’s treating physicians after finding he rendered inconsistent assessments. She also relied on a vocational expert’s testimony that Minnick could work in various unskilled sedentary occupations.

In Daniel P. Minnick v. Carolyn W. Colvin, acting commissioner of Social Security, 13-3626, the 7th Circuit judges pointed out that the ALJ offered a perfunctory analysis in determining Minnick’s degenerative disc disease did not meet or equal Listing of Impairments 1.04 involving spinal disorders.

“The ALJ dismissed the possibility of Minnick’s degenerative disc disease meeting or equal[ing] Listing 1.04’s criteria in two sentences. Beyond these two sentences, she provided no analysis whatsoever supporting her conclusion,” Judge William Bauer wrote.

They also found the ALJ erred by assessing a residual functional capacity assessment that was not supported by substantial evidence. She discredited Minnick’s testimony using “the type of boilerplate language that we have consistently criticized,” Bauer continued. The ALJ discounted the doctor’s opinion due to internal inconsistencies and because his opinions regarding Minnick’s ability to bend and twist were unsupported by the record. But they were supported by the record, the judges pointed out. They remanded the case for further proceedings.

Evansville Police arrested two people on various charges, including child neglect, after the couple allowed a 12 month old girl to play with a .40 caliber handgun.
Police arrested 19 year old Michael Barnes on Thursday night after he had agreed to meet with someone to sell a handgun. Barnes had an active warrant for Armed Robbery. Unbeknownst to Barnes, the person he had agreed to sell the handgun to was an undercover officer. When Barnes arrived at the meeting location across from Delaware Elementary School, he was approached by officers and tried to run. He was caught by a Vanderburgh County K-9 Unit a short distance away. The gun he had agreed to sell was found at the scene of his arrest. He was arrested for Resisting Law Enforcement with a Weapon, Carrying a Handgun without a Permit, and Carrying a Handgun without a Permit within 500 Feet of a School.
During the follow up investigation on Friday, detectives with the ATF/EPD Task Force were examining Barnes’ cell phone for evidence related to the attempted sale of the handgun. Investigators found two videos on the phone that showed a 12 month old boy playing with a handgun that appears to be the same one that was recovered from Barnes during his arrest. Barnes can be heard telling the child to say “pow” on multiple occasions while the child plays with the gun. The video also shows the child placing the muzzle of the gun in his mouth. At no point does Barnes try to stop the child from playing with the gun.
Investigators determined the child’s mother, 22 year old Toni Wilson, was present when the video was made. Wilson had been with Barnes during his Thursday night arrest, but was released at the scene. She denied knowing Barnes had a gun at that time.
Investigators went to Wilson’s home at 920 N Elliott on Friday afternoon to speak with her. When confronted about the video, she claimed it was a pellet gun.
Wilson was arrested for Child Neglect, Criminal Recklessness with a Deadly Weapon, and Allowing a Child to Possess a Firearm. Barnes is also facing those charges in addition to his original charges from his Thursday night arrest.
The 12 month old and two 1 month old twins were placed into emergency care. Barnes is not the father of the 12 month old, but is the father of the twins.
