Governor Pence Statement Following Second Reading of HB 1609

Indianapolis – Governor Mike Pence today issued the following statement after the second reading of HB 1609, State Board of Education.

“For the sake of our kids, education in Indiana must function at the highest levels. Our administration took the first step to restore harmony in education governance by dissolving the Center for Education and Career Innovation, and we called on the General Assembly to give members of the State Board of Education the opportunity to choose their own Chair. By advancing HB 1609 on the House floor today, members of the General Assembly took an important step toward achieving this reform. I applaud Representative Jud McMillin for his efforts in moving this important legislation and urge members to support HB 1609 when it comes to the floor next week.”

This week, President Obama unveiled his budget for fiscal year 2016, which in Washington begins October 1, 2015. Like every Obama budget before it, this year’s offering is crammed full of every tax-and-spend liberal policy you can think of.

Tax hikes? They’re there. More spending? Check. Never-ending deficits? Obama’s got that too. Disastrous debt? It’s there in spades.

Obama even tries to roll back the modest budget caps of 2011, calling them “mindless austerity.” Now, I know he isn’t very well informed but perhaps someone can write a newspaper article telling the President that those “mindless” spending limits were something he has agreed to for nearly four years.

Obama’s 2016 budget would be the most expensive federal spending plan in American history, doling out $4 trillion of hard working American taxpayer’s money through literally hundreds of duplicative, outdated and wasteful government programs.

It would raise discretionary spending — the one-third of spending Congress debates annually — by an unaffordable $75 billion. To pay for it, he plans to tax American businesses and job creators by hundreds of billions of dollars. As if we aren’t taxed enough already.

His budget never gets close to balance. Ever. It runs deficits of over $450 billion forever, ballooning the national debt from $18 trillion today to over $20 trillion by 2016.

The parade of horribles goes on for pages and pages, even including Obama’s amnesty plan for illegal immigrants and his ludicrous plan for more “free” education.

Conservatives across America must mobilize to ensure that this disastrous budget never becomes law.

Republicans in Congress must be held accountable and stand tall for fiscal responsibility by conservatives in order to ensure that they do not cave to Obama and his cheerleaders in the media.

I know, as I’m sure you do, that nobody can last long financially if they are borrowing money to pay their bills. Eventually, you have to pay the piper and the results are never pretty.

If enacted, Obama’s 2016 budget would continue America down the road into an economic time-bomb. The massive deficits and unsustainable debt will destroy the American economy, ruining livelihoods and wrecking the futures of millions of American families.

His tax increases will hurt already struggling small businesses and penalize millions of small business owners with the so-called Buffett Rule.

If Obama’s spending isn’t reigned in, the national debt will make the American Dream unattainable for future generations. Consuming vital national resources as more and more money goes to pay interest rather than funding our military, veteran or the fight against ISIS.

And while Republicans control both houses of Congress, don’t be surprised if the leadership team doesn’t lead from the front when it comes to taking on Obama. If the Republican Establishment has proven anything over the past six years, it’s that they tend to get weak-knee with Obama and Democrats as soon as the liberal media turns up the heat.

America needs an optimistic alternative vision from Republicans in Congress. We must repeal Obamacare. We must stop amnesty. We must cut spending and balance the budget, and we must do it now. President Obama’s budget must be rejected for the dangerous, tired same-old doomed plan that it is.

Families of students attending Oak Hill School have been invited to attend an event celebrating the school receiving a Carol M. White Physical Education Program Grant (PEP).  The event will have a host of information, and activities for children and families showcasing how to build healthy bodies.  The EVSC, for many years, has worked on coordinated school health – as a way to wrap supports around children so that they are healthy both through nutrition and physical activity, and also socially and emotionally.

 

Activities at Oak Hill will include:

  • Health screenings and nutrition education from USI Dietetic students with smoothies to try
  • Grow Your Own Garden information and opportunity for children to plant herbs, hosted by the Master Gardner Association

Defendant must try to prevent crime discovery for statute of limitations to toll

In dealing with an issue of first impression, the Indiana Supreme Court found a robbery charge should be dismissed because it was filed outside of the statute of limitations. The state argued the defendant had concealed evidence of the crime, thus tolling the five-year statute of limitations.

John Study was charged in August 2012 with multiple counts stemming from the robberies of four Boone County banks. At issue is the robbery charge relating to the robbery of a Key Bank on March 21, 2006. Study sought to have the count dismissed because it was outside the statute of limitations; the state relied upon the concealment-tolling provision to bring the charge.

“Here, the State argues that concealment of any evidence of guilt tolls the statute of limitations. The charging information alleges that concealment occurred when Study concealed his identity by wearing a mask, and concealed the getaway car, clothes worn during the crime, items taken from a victim, the weapon used, and evidence linking the robbery to other robberies,” Justice Steven David wrote. “None of these actions would serve to prevent law enforcement from discovering that a bank had been robbed. The State’s ability to investigate the crime and develop a case was not thwarted. Interpretation of the statute of limitations requires balancing the defendant’s interest in being timely prosecuted and the State’s interest in having sufficient time to investigate and build a case.”

“If concealment of guilt is all that is required to toll the statute of limitations, it is hard to imagine when the concealment-tolling provision would not apply. In almost every criminal case, the offender is going to attempt to conceal that they have committed the offense,” he continued.

David noted had the General Assembly disapproved of the courts’ approach, it has had plenty of time to alter the statutory language. And he also pointed out that since 1882, Indiana courts have continued to hold that concealment tolls the statute of limitations only when there is a positive act performed by the defendant that is calculated to prevent the discovery that a crime has been committed. Study’s attempts to conceal his guilt were not thwarting the progress of the police investigation.

The justices remanded for the trial court to vacate the robbery conviction and sentence. They affirmed his other convictions and noted his new sentence is 53.5 years. They also affirmed a $40,000 fine. The case is John O. Study v. State of Indiana, 06S04-1407-CR-461

Indiana General Assembly adopts resolution recognizing USI athletes

University of Southern Indiana athletes and coaches made a special trip to the Indiana Statehouse Thursday, February 5, 2015, for the presentation of two resolutions by the Indiana General Assembly congratulating the 2014 USI Men’s Baseball team on their NCAA Division II Baseball Championship and Johnnie Guy for his National Title in the Outdoor Track and Field 10,000 Meters.

The resolutions were adopted by both the House and Senate. Athletes and coaches were congratulated by members of the House and Senate and Coaches Tracy Archuleta and Mike Hillyard addressed the General Assembly. In addition, coaches and athletes visited the office of the governor and lt. governor, and had lunch with legislators and other elected officials at Colts Grille.

USI Baseball
The 2014 USI Baseball Team won the NCAA Division II National Championship, the second in five years for USI and the GLVC. USI also was the first conference team to reach the national championship game since they won the title in 2010. USI remains the only team in the state of Indiana to win a national championship in baseball in any division.

During the championship, junior right-handed pitcher/shortstop Matt Chavarria of Carlsbad, New Mexico, was named NCAA Division II National Championship Series Most Outstanding Player as USI finished 8-2 in tournament.

USI also hosted the NCAA II Midwest Regional for the third time in school history, producing a second-straight regional crown. The overall regional title was the third in the history of the program. Senior right-handed pitcher Jonathon Wandling of Newburgh, Indiana, was named the NCAA II Regional Most Valuable Player, and was later signed professionally with the Toronto Blue Jays.

The 49-13 overall mark by the Screaming Eagles set a school record for winning percentage. USI Head Coach Tracy Archuleta was named the American Baseball Coaches Association Division II Coach of the Year for a second time, along with being named the ABCA and National Collegiate Baseball Writers Association Midwest Region Coach of the Year.

Johnnie Guy
University of Southern Indiana sophomore Johnnie Guy of Palmyra, Indiana, fulfilled a dream of becoming a national champion in May 2014 when he ran his way to the NCAA Division II National Championship in the 10,000 Meters.

He became the fifth Screaming Eagle to earn an individual NCAA national championship and the second in men’s track and field. In all, he is a combined seven-time All-American in cross country and track. He’s also won six GLVC titles, including two cross country championships, one indoor track title and three outdoor track crowns.

Guy was the 2013 GLVC and Midwest Region Cross Country Runner of the Year as well as the USTFCCCA National Runner of the Week. He has earned nine All-Midwest Region awards and six All-GLVC honors and was USI’s Student-Athlete of the Year in 2013-14.

As a junior in fall 2014, Guy helped lead the Eagles to their 10th-straight Great Lakes Valley Conference championship and 22nd conference title. The 22 league crowns are the most conference championships by any program in any sport in conference history. The USI cross country program also advanced to the 2014 NCAA Division II National Championships last fall where it placed seventh nationally.

IS IT TRUE the interest and filings for seats on the Evansville City Council is hitting a fever pitch that has not been seen in River City for many years?…a 25 year old named David Ballard is taking on 5 term incumbent Connie Robinson in the 4th Ward, and schoolteacher Jim Brinkmeyer has filed to oppose incumbent Al Lindsey in the 6th Ward Democrat primary?…all of these candidates tossing their hat into the ring will not only spice up the primary season, it has the potential to promote a healthy dialog about the problems that plague our city?…maybe some of the promises unfulfilled by the victors of 2011 like an Angel Network, Technology Transfer, eradication on meth making materials, and transparency will take some real root with some young ideas tossed into the mix?

IS IT TRUE the recent news that Vanderburgh County had slipped to 3rd in Indiana in meth lab busts from it’s longstanding place at the top must not have been about the amount of meth being made as it was revealed today that about 40 people have been arrested after a two-year investigation into a drug trafficking operation with it’s main operation in Vanderburgh County?…the FBI, DEA and IRS all worked together over a period of 2 years to track and bust what is basically a locally run international drug ring for distribution of meth?…74 pounds of crystal meth, $400,000 in cash, 20 guns and two cars were seized seized by the feds when the bust went down?…it was also reported by the authorities that six arrests for attempted murder were also connected to this drug ring?…there will be more arrests?…this is the first giant international drug bust made in Evansville since mid 2006 when a meth manufacturing and distribution operation was discovered in the basement of the Orr Iron Building which housed the small business incubator before it was relocated to Innovation Pointe and shifted it’s focus to technology?

IS IT TRUE it has been said that Evansville is to meth as Napa Valley is to wine and this big time bust and the search for the rest of the operation members serves to reinforce that dubious distinction?…some local leaders have been looking for a brand and until they can find a way to tame the “Breaking Bad” image, t-shirts and videos will not succeed in putting forth a positive spin?…it could be spun that these industrious alleged criminals are entrepreneurs at heart and that Evansville needs entrepreneurs and funding?…maybe we will see some “HEISENBURG FOR MAYOR” signs and shirts on the walkway soon?

IS IT TRUE a Kentucky House committee has approved a bill to increase the state’s minimum wage?…the bill was passed by the House Labor and Industry Committee and is similar to last year’s proposal that passed the House but died in the Senate?…the bill proposes to incrementally raise the minimum wage from $7.25 an hour to $10.10 per hour in July 2017?…only about 400,000 Kentuckians (less than 10% of the population)currently earn less than $10.10 an hour, and a large number of those are teenagers in entry level service jobs?…the proposed bill exempts retail stores, service businesses, hotels, motels and restaurants with annual gross sales under $500,000 per year?…business representatives predictably said the bill would be a hardship for employers, even with enough exemptions to limit the overall impact to the total wages paid?…this is a step forward and will put Kentucky with it’s low cost of living way ahead of liberal progressive cities like San Francisco which is ratcheting the minimum wage up to $15 per hour in spending power from minimum wage jobs?…Kentucky still has opportunities for housing that can be bought or rented for about 30% of the gross monthly earnings for minimum wage workers while San Francisco’s entry level apartments cost more that the entire monthly gross earnings of minimum wage earners?
