Family Day at the Statehouse

I recently invited families from our community to spend the day with me in Indianapolis. They had the opportunity to meet with state leaders and spend time learning about the Statehouse. I was so pleased with the number of families that participated, and I hope they enjoyed this experience as much as I did.

 

The day began beneath the Statehouse rotunda which is where the tour kicked off. During the tour, families visited Indiana’s Supreme Court, learned about the history of the building and got to spend time in both the House and Senate chambers.

 

Later, the House Republican Intern Director discussed student opportunities. He mentioned that any student, 13 to 18 years of age, has the ability to page for the Indiana House of Representatives and see a full day of legislative activity. Parents and students were also informed about the House Republican internship program which offers paid internships in our Member Services, Communications, Technology and Policy departments. This internship provides experience as an active participant in the legislative process while working closely with legislators and developing professional skills. Although this internship runs during the legislative session, which is nearing the end for 2015, this is always something to keepin mind for next year.

 

Family Day was also a great chance for constituents to meet with Indiana Auditor Suzanne Crouch and Lieutenant Governor Sue Ellspermann. With both leaders being from southern Indiana, it was the perfect occasion for both women to talk with Hoosiers from back home as well as discuss their role as an elected official in charge of a statewide office.

 

Lastly, families were invited to watch session from the House gallery. It was particularly special because I was able to present the Evansville Spirit Cheer team, who had also joined us for Family Day, with a resolution on the House floor. Through inspirational cheers, the resolution recognized the members and their coaches for raising awareness about children with disabilities.

 

It was a pleasure to spend the day with both local families and Spirit Cheer of Evansville at the Statehouse. I hope the families that visited enjoyed their time, and I would like to make this day an annual event moving forward. I want to provide our community with every opportunity to learn about state government, our rich history and insight into what I do as your representative. Pence and His Supermajority Really Messed Up

Arrogant and out of touch – that’s the best way to describe Governor Mike Pence, Speaker Brian Bosma, President David Long and the Republican legislative supermajorities. They all received multiple warnings about potential backlash on the so-called Religious Freedom Restoration Act. They all ignored those warnings. And they all blamed everyone but themselves for the overwhelming RFRA uproar.
Statehouse Republicans allowed political ideology to trump Hoosier Hospitality with the enactment of RFRA. Much to their surprise, the people across this state and nation saw through the illusion Indiana Republicans attempted to produce. Their lack of vision shows how completely out of touch their brand of governing is in Indiana.

It’s hard to imagine Gov. Mike Pence handling the past two weeks any worse than he did.
He discounted the readily available signs that Senate Bill 101 — Indiana’s version of the Religious Freedom Restoration Act — came factory-installed with hints and allegations of discrimination against gay and lesbian Hoosiers. When those hints and allegations started turning into nixed development deals and nationwide boycotts — real deals about money, jobs and convention traffic — Pence blamed the media for smearing a law they misunderstood. He continued to listen to inside cronies with easily traceable ties to anti-gay agendas before giving in to adjustments on the law to save face — not to mention the state’s dwindling reputation.

The International Men’s March to Stop Rape, 

Sexual Assault & Gender Violence”

April 7, 2015 at the University of Southern Indiana

Inspired by the old saying, “You can’t understand a person’s experience until you’ve walked a mile in their shoes,” men will literally walk one mile in women’s high heeled shoes on April 7, 2015 on the University of Southern Indiana campus to protest rape, sexual assault & gender violence.  Men, women and children are invited to participate in the Walk planned by Albion Fellows Bacon Center and USI’s Sexual Assault and Gender Violence Prevention Group. Vanderburgh County Sheriff Dave Wedding, Vanderburgh County Prosecutor Nick Hermann, Evansville Police Department Chief Billy Bolin, and other men are going to walk in high-heeled shoes to raise awareness about rape.

Registration for the Walk will begin at 5:00 p.m. at Mitchell Auditorium in the Health Professions building on USI’s campus.  This year’s walk will feature a local male volunteer who will discuss why he has taken the steps he does to help make a difference.  After the walk, Wedding, Hermann, and Bolin will pledge with students and community members to make a difference.  Men, women, and children are invited to participate.

 

The Walk is organized by Albion Fellows Bacon Center and the University of Southern Indiana Sexual Assault/Gender Violence prevention group and sponsored by a number of USI campus organizations, including Fraternity and Sorority Life of USI, USI Student Government Association SOS Grants, and Student Housing Association of USI.  Community sponsors include Holly’s House, Fraternal Order of Police #73, Lampion Center, YWCA, Boyd Electric and SouthWest Graphix among others.

Adult Literacy Program of Gibson County moving to Ivy Tech Princeton Instructional Center

The Adult Literacy Program of Gibson County will now be housed within the Ivy Tech Community College Princeton Instructional Center. Ivy Tech will be providing the space to the Adult Literacy Program at no charge as a service to the Gibson County community. The Adult Literacy Program of Gibson County provides adults with access to free and confidential help with reading, writing, and spelling skills.

 

The public is invited to attend an open house on Tuesday, April 7, at 4 p.m. to celebrate the Program’s new location at the Ivy Tech Princeton Instructional Center, located at 2431 S. Crabtree Drive in Princeton. Refreshments, building tours, and a chance to learn more about the Program and Ivy Tech Community College will be available. The event is free and open to the public.

Reversal: Bank’s refiled foreclosure ‘disingenuous,’ ‘improper’

A bank won summary judgment in a refiled mortgage foreclosure suit against a bankrupt couple after its first complaint was dismissed, but the Indiana Court of Appeals slapped down the trial court ruling Monday and dismissed the case.

“On the record before us, we find the Bank’s belated waiver argument disingenuous and without merit,” Judge Ezra Friedlander wrote for the panel in Demetrius L. Grant, and Vickie O. Grant v. The Bank of New York Mellon Trust Co., 49A05-1404-MF-139.

The bank’s initial suit against the Grants was dismissed after more than a year passed without prosecution. The Grants, who had lived in the house subject to the suit for more than 30 years, filed a Trial Rule 41(E) motion to dismiss the case, which a Marion Superior judge granted when the Grants appeared for a hearing but bank attorneys did not. The bank was denied a request to reinstate the suit, but two months later refiled a complaint that the appeals panel said restated identical issues.

The trial court granted summary judgment in favor of the bank on its second complaint, but the appeals court called the filing of that suit “improper. … This violated both T.R. 41 and principles of res judicata. Accordingly, the trial court erred when it granted summary judgment in favor of the Bank. The trial court is directed on remand to vacate the grant of summary judgment and dismiss the Bank’s complaint,” Friedlander wrote.

Under Trial Rule 41(B), the panel wrote in a footnote, “Unless the court in its order for dismissal otherwise specifies, a dismissal under this subdivision or subdivision (E) of this rule … operates as an adjudication upon the merits. In this case … the dismissal of the First Foreclosure Action was with prejudice.”

The panel of Friedlander and Judges Terry Crone and James Kirsch also took the bank to task in a footnote for citing to inapplicable authority.

“In support of its waiver argument, the Bank relies on a number of cases applying Indiana Appellate Rule 46(C), which provides that no new issues shall be raised in a reply brief. This rule applies to appellate briefs and, of course, has no applicability to trial court filings. We are perplexed by the Bank’s reliance on these cases with respect (to) the Grants’ summary judgment filings,” the panel concluded.

Special Presentation on Autism Planned at the University of Evansville

A special presentation on autism, “Rethinking Autism: Wretches & Jabberers,” is planned for Wednesday, April 15, at the University of Evansville. The event is scheduled from 4:30-6:00 p.m., in Room 170 (Smythe Lecture Hall) in the Schroeder School of Business Building. The presentation is being hosted by Optimal Rhythms, Inc., and is free and open to the public.

This autism awareness event will feature Tracy Thresher and Larry Bissonnette, stars of the highly acclaimed autism documentary, Wretches & Jabberers, along with their support team Harvey and Pascal. Clips from the documentary will be shown, followed by a question and answer session.

IS IT TRUE the City Controller stated he “requested the Evansville Water and Sewer Utility prepay the 2015 PILOT in December 2014 which the Utility Board and management approved”?  …the City Controller made this statement in an e-mail he recently sent to John Friend and others that we posted in todays CCO Feature article section?  …last night City Councilman John Friend sent us many months of official minutes of the Evansville Water and Sewer meetings?  …our staff have read over these minutes like a fine tooth comb and could find no reference of any official approval by the Water and Sewer Board and Management giving a $2.5 million dollar prepayment from the PILOT fund to the City in December 2014?

IS IT TRUE City Controller Lloyd didn’t explain in his e-mail to Mr. Friend and others why the City needed a $2.5 million prepaid advancement from the 2015 PILOT fund?  …could it be that Mr. Friend was correct in saying that the City General Fund was broke and needed this advancement?  …we urge Controller Lloyd to back up his claim concerning the $2.5  advancement to the city from the PILOT fund by sending the CCO official copies of the minutes of the Water and Sewer Department stating such?

IS IT TRUE our Parks Department is funded as a separate taxing entity? …that part of our property tax bill shows the Parks Department as “Special Taxing District”? …elected officials can’t cut the Parks Department budget?  …the City of Evansville help with the additional funding of the Parks Department budget by taking money from the General Fund?  …there’s a really simple solution for increasing the funding for our parks and that is raise the “Special Tax District”?  …if the individuals running for City Council believe we should improve the city parks they should announce that they want increase the rates in the “Special Taxing District”‘ to properly fund our parks?

IS IT TRUE we hear that Earthcare, LLC may had filed bankruptcy in recent months?  …if this rumor is correct it looks like the tax payers of Evansville may have just got fleeced out of an $200,000  unsecured no interest development loan granted to them by the Winnnecke administration?

IS IT TRUE we just heard that an out of town business just purchased a downtown establishment with their own funds?  …we were just informed that officials from DMD  convinced the new owners of this downtown establishment to accept a $150,000 low interest loan to do some renovations? …that government shouldn’t do for business that they can and should do for themselves?

IS IT TRUE we hope that Mayoral candidate Gail Riecken will make the loans and direct grants giving practices of the DMD a major campaign issue?  …we have been told  that the DMD loan and grant program have become a major “pork barrel and political patronage”  vote getter for the Mayor? …we know once all the information concerning DMD grants and loan activities are made public the business community and taxpayers will be up in arms?

IS IT TRUE people are saying that Missy Mosby and Jonathon Weaver have cause a major split in the Democratic party?  …other people are saying the only thing they did to the Democratic party was abandon it for the Republican party?

IS IT TRUE we read that Police Chief Billy Bolin Public Relations guy Sgt Jason Cullun has created a “Police Gallery” for people being arrested for drunken driving?  …we look forward to Sgt. Cullum providing information On the  “Police Galley” to the CCO so we can post the information on our site? …we are very appreciative that both the EPD and the Vanderburgh County Sheriff Office sends us daily arrests reports and police calls?
