MEDICARE SEMINAR  SET FOR TUESDAY, JULY 14TH

(Evansville, IN) – St. Mary’s Senior Connection will hold a Welcome to Medicare seminar Tuesday, July 14 at 4:00 p.m. at 951 S. Hebron Ave., Suite C (between Bellemeade and Washington Ave.) adjacent to the Senior Connection Office.

When individuals and their families are new to the federal Medicare program, it can be confusing and frustrating at first glance. This program will help you better understand the many different parts of Medicare and what your options are when you enroll.

This is an informational program only. No specific plans or companies will be discussed. The seminar will be presented by Gina Downs, Director of St. Mary’s Senior Connection. The Evansville-Vanderburgh County Traffic Safety Partnership, the Governor’s Council on Impaired & Dangerous Driving and the Indiana Criminal Justice Institute (ICJI) would like to remind all Indiana motorists to celebrate the Fourth of July responsibly by driving safe and sober.Sheriff David Wedding stated, “This Fourth of July family and friends will come together and celebrate Independence Day. With your mind on the celebrations, you may be tempted to ignore or overlook a friend who is about to drive away intoxicated. Please don’t rely on someone else to say something. Only you can prevent a tragedy.” Sheriff Wedding added, “If you know you will be drinking, make plans now to get a safe ride home.”

During the 2014 July Fourth period from July 3 through July 7 there were over 1,400 traffic collisions in Indiana. Of those, at least 96 were alcohol-related. In total, six (6) Hoosiers lost their lives as the direct result of an impaired driver.

Evansville Police Chief Billy Bolin stated, “Over the years both of our agencies have tried our best to get the message out that drinking and driving destroys lives. Education is only effective with those drivers willing to heed the message.” Chief Bolin explained, “Unfortunately for those motorists who still elect to drive impaired, an arrest for DUI is the only way to prevent them from killing themselves or an innocent person.”

Vanderburgh County sheriff’s deputies and Evansville police officers will be aggressively looking for drunk drivers and will arrest anyone caught driving impaired. If you have any doubt about your sobriety, please do not get behind the wheel. If you do choose to drive impaired, expect to be arrested. No warnings. No excuses.

Funding for local impaired driving enforcement is provided by the Indiana Criminal Justice Institute (ICJI) through a grant from the National Highway Traffic Safety Administration(NHTSA).

7th Circuit slams lawyer, sets new law on fees

An Indianapolis attorney who appealed a class-action lawsuit seeking a share of his clients’ compensation on top of a statutory award of fees was called out by the 7th Circuit Court of Appeals, which denied his appeal and affirmed the judgment of the U.S. District Court for the Southern District of Indiana.
The court also used the opinion to draw a new line on attorney fees in class action suits.

Ronald Weldy represented a class of 741 former Visteon Corp. workers. They successfully sued after Visteon failed to timely notify workers of their rights to extend insurance coverage through COBRA when they were laid off. Weldy was paid $302,780 as class counsel, but in this appeal sought a share of the compensation clients received – $1,250 each following Visteon’s bankruptcy reorganization.

“(E)ven if it were sometimes appropriate to give a lawyer a slice of the class’s recovery on top of a fee-shifting award, this would not be the case to do it in,” Circuit Judge Frank Easterbrook wrote for the panel in Darryl Pierce and Sharon Pierce, et al. v. Visteon Corp. and Visteon Systems, LLC, 14-2542.

“We’ve mentioned two reasons: Weldy bungled the appeal, costing the class an opportunity to seek greater compensation, and his demand for fees from the class goes directly against his clients’ interests, yet he did nothing to help them protect themselves,” Easterbrook wrote. “And this isn’t the only respect in which Weldy has tried to undermine his clients’ interests. The lead argument in his brief is – that some members of the class will get too much money! … (I)t is unfathomable that the class’s lawyer would try to sabotage the recovery of some of his own clients.”

Easterbrook continued, “The brief’s writing is careless to boot; it conveys the impression of ‘dictated but not read.’ Here are two sentences: ‘This Court should be entered a high daily statutory penalty in this matter. Respectfully, the award of the District Court to the contrary law and an abuse of discretion.’ There’s more, equally ungrammatical. Weldy is in no position to contend that his compensation is too low.’”

The panel also used the case to fix new law concerning fees.

“We suggested in Evans v. Evanston, 941 F.2d 473, 479 (7th Cir. 1991) that clients should not be ordered to pay counsel who are compensated under a fee-shifting statute; today, that suggestion becomes a holding,” Easterbrook wrote.

IS IT TRUE that EVSC Superintendent Dr. David Smith informed Brad Byrd during an interview on WTVW/WEHT on July 1, 2015 that the EVSC Board selected an out of town attorney negotiator to represent them in Union contract talks with the Teamsters Local 215 after the EVSC’s local attorneys chose not want to represent the EVSC in such discussions due to potential political concerns? …we wonder if the local attorney Dr. Smith talked about this issue being political was Pat Shoulders? …Pat Shoulders is the Attorney of record for EVSC?

IS IT TRUE we wonder why EVSC Superintendent Dr. David Smith would admit that the discussions between EVSC and the School Board has the potential of being political on TV? …discussions between EVSC and the Teamsters should be about contractual agreements, employee benefits, work place safety, retirement and other employments issues but not political concerns?

IS IT TRUE we would like to apologized to one of our readers that proved us wrong concerning EVSC School Superintendent Doctoral Degree? …we said that Dr. Smith has a Doctoral Degree from Harvard? …our reader was correct that Dr. Smith Doctoral Degree was from Oakland City University, Oakland City Indiana and not Harvard? …we must have been hoping for a Superintendent with Harvard-like qualifications.

IS IT TRUE we wonder why the EVSC School Board meets in Executive Session before every school board meeting? …we wonder why the Executive Session last 2 to 2 1/2 hours and the regular school board meeting last about an hour? …is it possible these Executive Sessions follow the letter of the law and comply with why an Executive Session is necessary and also that NO votes are taken and NO consensus is reached? …why have these Executive Sessions at EVSC has never been questions by the Courier and Press when ever other unit of government had been questioned about this?

IS IT TRUE we read in yesterday’s Courier and Press and found that ECHO HOUSING CORP Director Stephanie TenBarge’s statements interesting? …she feels if the city spends about $15 million of our hard earned tax dollars on the North Main project, it with attract many developers and businesses to locate on North Main? …is this the same Stephanie TenBarge that convinced the Director of the DMD to fund a $35,000 plus painted Mural on the side of building behind McDonald on North Main Street? …she believed that by painting this Mural on the side of a building it would encourage economic development? …we are finding out that some people in local government find it extremely easy to spend other people’s money? …your tax dollars at work under the Winnecke administration.

IS IT TRUE would it be better use of the North Main TIF money to go into the surrounding neighborhoods repairing streets, sidewalks and tearing down dilapidated houses? …these improvements would make a difference, not bike paths and murals?

IS IT TRUE we wonder how the North Main TIF Fund is going to pay $15 million dollars for renovation of that area when the fund has only $3.5 million in that account? …the Mayor is planning to borrow the additional $11.5 million dollars to fund that project? …again, pass it along to the taxpayers?

IS IT TRUE that Mayoral Candidate Gail Riecken’s campaign will be focusing on taking the message of the Winnecke administration’s lack of sound fiscal responsibility and total transparency to the voters.

IS IT TRUE the recent announcement about Gail Riecken’s new campaign Director shows she is ready to launch an extremely aggressive and sophisticated campaign for the office of Mayor of Evansville? …better get ready for an extremely interesting campaign because this is gonna be a good one folks?
