ST. MARY’S MOBILE MAMMOGRAPHY OFFERS FREE MAMMOGRAMS FOR THOSE WHO QUALIFY

St. Mary’s Mobile Digital Mammography is coming to your community soon. St. Mary’s is the only facility in Evansville and the only Tri-State hospital to offer mobile digital mammography. Digital pictures can be magnified, adjusted and previewed to see certain areas that regular film cannot. There are fewer retakes and sharper images. Digital mammograms use less radiation, making them safer for patients.  All screenings include mammograms and education about breast health and early detection of breast cancer.

Participants must meet the following criteria to be eligible:

  • You must be between 35 to 40 years old to receive your baseline (or initial) mammogram.
  • Annual mammograms should begin at age 40.
  • It must have been at least one year since your last mammogram.
  • Medicare, Medicaid, and private insurance are accepted.
  • Assistance is available for those who qualify.

St. Mary’s received the “Sharing the Vision: Early Detection of Breast Cancer” grant from the Greater Evansville Affiliate of the Susan G. Komen For the Cure Foundation, and the Indiana Breast Cancer Awareness Trust “Power of  Hope” grant,  which helps fund the screenings.

The below images are of a suspect in the armed robbery that occurred at the Walgreen’s store located on 925 S. Green River Road.

At approximately 10:30 pm on May 9, 2015, a white male, mid 30’s, approximately 6’00”, weighing approximately 175 pounds entered the store, displayed a handgun, demanded some items and robbed the store.

New Tech Institute Receives Bronze Ranking

New Tech Institute was informed recently that it received a Bronze ranking in the U.S. News and World Report’s “America’s Best Schools.” New Tech is one of only 33 percent of schools across the United States to receive a medal.

U.S. News rankings included data from more than 21,000 public high schools in the United States. Schools were awarded gold, silver or bronze medals based on their performance on state assessments and how well they prepare students for college.

Specifically, the report looked at three main areas. If schools passed one step, they were then evaluated on the next step. The three steps included:

  1. Whether each school’s students were performing better than statistically expected for students in their state.
  2. Whether their disadvantaged students were outperforming disadvantaged students in the state.
  3. College readiness performance using Advanced Placement or International Baccalaureate test data.

Failure to buckle a seatbelt cannot be used to prove contributory negligence

The city of Fort Wayne will not be able to present evidence at trial that an injured passenger in a traffic accident was not wearing a seatbelt. The Indiana Court of Appeals has ruled that a violation of the state’s Seatbelt Act may not be used to prove contributory negligence.

Katie Parrish was an unrestrained front-seat passenger when the vehicle she was riding in was hit by a Fort Wayne Police Department car. She was thrown from the vehicle and sustained physical injuries.

Two years after the accident, Parrish filed a negligence action against the city. In 2014, prior to trial, she filed a motion in limine seeking to exclude any evidence that she had not been wearing a seatbelt at the time of the accident.

The trial court granted Parrish’s motion and the city filed an interlocutory appeal.

Before the Court of Appeals, the city argued evidence that Parrish was not wearing a seatbelt was admissible to prove her contributory negligence to her injuries. In addition the city asserted Parrish was negligent per se because she violated the duty of care established by the Indiana Seatbelt Act.

Section 7(a) of the Seatbelt Act holds that failure to wear a seatbelt cannot be used to prove the negligence of parties that are subject to the Comparative Fault Act. However, the city argued that because it is not subject to the Comparative Fault Act, it may use the Seatbelt Act to prove Parrish had a statutory duty to wear her seatbelt and, thus, was negligent per se under common law.

The Court of Appeals did not agree in City of Fort Wayne v. Katie Parrish, 02A05-1408-CT-359.

“The Seatbelt Act established a clear mandate from the legislature for passengers in passenger motor vehicles to wear seatbelts, but it also stated that its mandate should not be used to demonstrate fault,” Judge Rudolph Pyle wrote for the court. “While this provision does not apply to the City as it is exempt from the Comparative Fault Act, the Seatbelt Act did not expressly establish that its provisions could be used to establish fault outside of the Comparative Fault Act.”

The appellate court found the Legislature did not alter common law because it has not given a clear mandate that violation of the Seatbelt Act may be used to prove fault. Therefore, Parrish’s failure to restrain herself in the vehicle cannot be used to prove her contributory negligence.

Shooting Arrests made by Evansville Police Department

On Tuesday, May 19, 2015 at approximately 4:20 pm witnesses saw three individuals, two adults and one juvenile in a verbal dispute with someone at the residence of 721 E. Blackford Avenue. Soon after the dispute, Clifton Fletcher Jr and Kelly Wickware Jr. were observed shooting at the house and then ran on foot from the area.

Fletcher, Wickware and the juvenile, Deviante Gaines, were located on playground equipment at Bayard Park and then apprehended as the fled from the police. Officers witnessed Fletcher drop a handgun as he ran and another handgun was located on top of the playground equipment were the suspects had been.

Fletcher and Wickware were charged with criminal recklessness, weapons charges, and criminal gang activity. They are being held in the Vanderburgh County Confinement Center.

Gaines was taken into custody for a warrant issued for an armed robbery that occurred in February. He is also being held in the VCCC.

IS IT TRUE we want to thank the Indiana Conservation Officers and Richard Howard, Lead Arson Investigator for the Evansville Fire department in doing an outstanding job in determining the cause and possible motives of the Houseboat fire at Inland Marina that was responsible for $4 to $5 million worth of damage to other property? …we are pleased to see a successful conclusion to the three month investigation and equally pleased to see the alleged offenders arrested?

IS IT TRUE we find it strange that the City of Evansville choose to store the burnt remains of the of the 66 foot house boat owned by William Marver at Hamrick Towing? …the City of Evansville had just previously selected an out of State towing company over Hamrick’s in awarding the recent towing contract?  …then, at the first major incident are forced to call Hamrick’s Towing for their help in recovering the boats and storing them. … we are told that Hamrick Towing did an outstanding job in protecting the evidence.?  …the City of Evansville felt Hamrick’s is obviously the only qualified company to recover and protect the evidence of this crime that resulted in $4 to $5 million dollars of damage but can’t convince the City of their ability to handle a simple towing contract with the city?

IS IT TRUE we a glad that the anti-Gail Riecken forces were dead wrong (as we expected) when they quietly started a whisper campaign that they had something to with the million dollar fire at Inland Marina? …we can’t wait to hear these same people apologize for their thoughtless comments and innuendo’s?

IS IT TRUE we are extremely pleased that City Council took the recommendation of the CCO and tabled the extension of the Homestead Tax Credit for 2016 for a later date? …sources indicate these are the percentages of the Homestead Tax Credits that have been given to us the past few years: 2014-6.66%, 2013-6.16%, and 2012-7.05%?…we are waiting for the City of Evansville Controller to share some light if these figures are correct or not?   …we are also pleased that Chief of Staff, Steve Schaeffer was parading around in the hallway outside Council Chambers complaining that the City Council was actually following the advice of the CCO instead of the Mayor’s Office?

10. On February 13, 2015, Brenda Harris asks Zachary Patrick and Cory Boling to go up on top ofthe boat to flip a breaker. While Cory Boling and Zachary Patrick are outside the boat, Brenda Harris moves the kerosene heater and a jug ofkerosene fuel to the hallway and afire is started and/or

11. Zachary Patrick extinguishes the fire. Cory Boling moved the jug ofkerosene fuel awayfrom the kerosene heater. Approximately ten (10) minutes later, as Cory Boling and Zachary Patrick were outside, sitting on the stairs ofthe boat, Brenda Harris exits the boat and Cory Boling notices that the interior hallway ofthe boat was on fire. Thisfire was much larger that the basketball sizedfire earlier and/or 12. Cory Bolingfurther advises that Brenda Harris stated, “we all need to be telling the same story”, “you understand I did what I had to do”, and “but don’t worry, you will get paid” and/or

13. Brenda Harris and William Marver were on the phone with each other several times during that night and/or

14. Brenda Harris would later tell investigators that she works 1 or 2 days a week at Dollar General Store and that she does cleaning, including cleaningfor William Marver and/or

15. Brenda Harris initially tells investigators that she needed cash and agreed to clean the boat of William Marver to prepare iffor sale and/or

16. Brenda Harris later acknowledges that she really didn’t clean but removed items from the boat and/or 17. Brenda Harris initially denied being on the boat when the fire was re-started. However, when investigators advised they knew she was inside the boat when the fire was re-started, she said, “ok, ok”, and then did not deny being on the boat when the fire was re-started and/or

18. Brenda Harris advised she did not come up with the plan to start the fire and/or

19. An investigation ofthe Marver boat revealed that a one pint metal chemical container had been wedged underneath the safety cage ofthe kerosene heater. Cory Boling was again interviewed and advised that he did not see any articles or items wedged underneath the safety cage ofthe kerosene heater the night ofthe fire and/or

20. On February 16, 2015, William Marver text’s Brenda Harris via Facebook “Love you pumpkin!” and/or

21. On February 17, 2015, William Marver and Brenda Harris communicated via Facebook and William

Marver tells Brenda Harris that he spoke with investigators about the boatfire. William Marver texted Brenda Harris “I did tell them I had agreed to pay you 200 and that Ipaid it cash when I saw you after

the fire…. ” then texted to Brenda “They (investigators) asked ifIwas having you move everything off)) the boat. I laughed. Like you would do all thatfor 200!!” and/or

22. Allstate Insurance Company advises that William Marver has initiated the claim processfor the loss and/or

23. William Marver had shown investigators a hand written list of items ofvalue that were on the boat when it caughtfire which included a $10, 000 installed stereo system and/or

24. Timothy Cummings lived in a house boat located only 75 to 100feetfrom the house boat of William Marver, contrary to the form ofthe statutes in such cases made and provided by l.c. 35-43-1-1(a)(2) and

l.c. 35-41-5-2 and against the peace and dignity of the State ofIndiana.

Junior Achievement and University of Evansville to Announce Details of Partnership at Press Conference Tomorrow, Wednesday, May 20

Junior Achievement of Southwestern Indiana and the University of Evansville will hold a joint press conference on Wednesday, May 20 at 10:00 a.m.to announce the details of an upcoming partnership. The press conference will be held in the Bernhardt Atrium in the Schroeder School of Business on UE’s campus.

 

Theo Boots, president of JA of Southwestern Indiana, and UE president Tom Kazee will both speak at the press conference. Among other things, this partnership will include a free public event featuring a major celebrity in the fall.

 

The press conference will begin promptly at 10:00 a.m. and both Boots and Kazee will be available for media interviews immediately following.

 

The atrium is located just inside the southern-most doors on the east side of the school of business building at the University of Evansville.
