Former JA chief loses defamation appeal against attorney

0

The former president and CEO of Junior Achievement of Indiana lost a defamation appeal against an Indianapolis attorney Tuesday. The Indiana Supreme Court ruled the complaint was time-barred.

Jeffrey M. Miller named Ice Miller LLP partner Kristine C. Danz in a lawsuit that claimed she defamed him as he was attempting to obtain a job with the city of Indianapolis. Before Danz’s identity was known, Miller had named her “John Doe #8, a partner, employee or agent of Ice Miller.”

Danz was granted summary judgment at the trial court, which the Court of Appeals affirmed. Justices of the Supreme Court agreed, finding that Miller had reason to know Danz’s identity long before she was named as a defendant in one of many suits Miller and his wife, Cynthia, filed.

“Finding that the existence and identity of Kristine C. Danz was not unknown to the plaintiff before he commenced this action, yet he waited until after expiration of the applicable statute of limitations to substitute her name for John Doe #8, we affirm summary judgment in Danz’s favor,” Justice Brent Dickson wrote for the court in  Jeffrey M. Miller and Cynthia S. Miller v. Kristine C. Danz, 49S05-1506-PL-400.

“It is undisputed that all of Miller’s claims against Danz are subject to a two-year statute of limitations. … The parties also agree that Miller’s cause of action arose, at the latest, on March 19, 2010, the day Miller learned through a conversation with Chris Cotterill, then Chief of Staff for the Mayor of Indianapolis, that others had made statements to Cotterill that may have influenced his decision not to hire Miller. Both parties argue in part that Trial Rule 17(F) is limited by Trial Rule 15(C).  We disagree,” Dickson wrote.

“In this matter of first impression, we find Trial Rule 15(C) does not supersede Trial Rule 17(F) nor does it apply to the ‘John Doe’ situation before us and affirm the trial court’s judgment on the proper application of Trial Rule 17(F) alone.”

IU Trustees Request Release of State Appropriation for Evansville Medical Education Facility

0

The Indiana University Board of Trustees has voted to officially request the release of previously appropriated state funds so work on a multi-institutional health education facility in downtown Evansville, Ind., can move forward.

A similar vote is expected by the University of Southern Indiana Board of Trustees for USI’s portion of the project at its July meeting.

“This project will significantly increase the opportunities for medical and health-related education in Evansville and across southwestern Indiana, and we hope also will serve as a catalyst for continued economic development in downtown Evansville,” said Tom Morrison, IU’s vice president for facilities and capital planning. “We are very appreciative of the support shown by the city of Evansville and the General Assembly for this project and are looking forward to breaking ground within the coming months.”

The 145,000-square-foot facility will house expanded IU School of Medicine operations in the city as well as health-related education programs from the University of Southern Indiana and the University of Evansville, with IU using about 87,000 square feet of the space. It is expected to be completed by the start of the 2017-18 academic year.

IS IT TRUE JULY 1, 2015

15

IS IT TRUE the U S ARMY CORP of ENGINEERS just made the City of Evansville remove the unauthorized debris from the ponding area of the Evansville levee which is considered to be a Federal wetlands? …the U  S ARMY CORP of ENGINEERS  not only served Evansville with a cease and desist order to stop dumping but also demand that they remove all the debris they illegally dumped on this site? .. .this wetland is located next to the Evansville City Garage on Waterworks Road? …we wonder how much this unauthorized dumping is going to cost the taxpayers to clean up? …we wonder why the main stream media hasn’t reported this? …C’mon Tim. Where’s the Courier and Press  when you need them?

IS IT TRUE today,  July 1, 2015 the amended local rule of the Vanderburgh Circuit and Superior Courts regarding Conduct, Dress and Courthouse Policies went into effect.  … a copy of this local rule will be available to the media beginning at 8:00 a.m. this date in the Office of Chief Judge Richard G. D’Amour, Civic Center Complex, Court’s Building Room 116?  … the City County Observer shall obtain a copy and post it soon as possible?

IS IT TRUE that the President of the Evansville City Council, Dr. Dan Adams, sent out the following e-mail to the Mayors Chief of Staff? …as of this date Dr. Adams hasn’t heard from the Mayors Chief of Staff? …when he does we shall update you on this issue?

Dear Steve,
Please provide the City Clerk for all City Council members (and Scott Danks too, please) with an e-copy of the downtown hotel materials that were submitted recently to the State, so that they can
included with the contents of the electronic packet for us all on the Thursday pm transmission. I would trust that a hard copy of the executive summary would be in our packets for Friday pickup. It is my recollection that you promised us at the last meeting that you would do this chore for us. I thank you in advance for your kind diligence.
Dan

IS IT TRUE we are hearing that local political party members are going to be very diligent in watching every move that certain city employees make to insure sure they don’t politic on the job in the upcoming city election?  …it was alleged In the last Mayoral election, there were widespread reports about city employees politicking during work hours.?   …we are told that  the Police Chief,  City Controller,  Fire Chief and DMD Director political activities will be closely monitored?

IS IT TRUE we reported yesterday that At-Large City Council Candidate Alex Burton was approached by a member of the “Weaver For Council” campaign committee to have a joint campaign fundraiser? …we stand by that statement? …we reported it would be the smart political move for Mr. Weaver to also include City Council President Dr. Dan Adams in this fundraising event? …we just heard from our Westside “MOLE” and indeed that was exactly what happened? …Burton. Adams and Weaver shall be hosting a joint golf fundraiser in the very near future? … this event may be the first time that Mr. Weaver won’t be in a political picture with Mayor Winnecke? …Or will it? …perhaps Mayor Winnecke will join them at their event?  … we understand that BJ Watts (a Republican Governor Mike Pence) appointee to the Board of Education, and the entire Mosby clan will be involved in promoting this event?  … there is talk about a future run for office by the family for a County Council seat?

IS IT TRUE we just added a new addition to the CCO?  …after many months of working on adding a Cause of Death Report  generated from the Vanderburgh County Health Department, we finally did it?  …we urge you to take time and read this section because we have additional information that the local media don’t report in their Obit section?  …at this time we are going to test our Cause of Death section to see  how well its received by our readers.  …If our readers respond in a negative way we shall do away with it?

Please take time and vote in today’s “Readers Poll”. Also we just posted the current City County Observer TRI-STATE VOICES TV show for you’re viewing pleasure. Don’t miss reading today’s Feature article because it’s always an interesting read.  New addition to the CCO is the Cause of Death report generated by the Vanderburgh County Health Department. Indiana First Lady Completes China Cultural Exchange

0

Indianapolis – Indiana First Lady Karen Pence completed a book and music exchange today between The Indianapolis Public Library and the Hangzhou Public Library, which is located in Zhejiang Province, Indiana’s sister state.

“It was an honor and a pleasure to visit the beautiful Hangzhou Public Library. Especially endearing to me on this visit was the opportunity to continue the cultural relationship Indianapolis enjoys with our Sister City, Hangzhou. Hangzhou is also the capital of Indiana’s sister state, Zhejiang Province. This relationship has been cultivated by Jackie Nytes, CEO, Indianapolis Public Library, and Mr. Chu, Director of the Hangzhou Public Library,” said First Lady Karen Pence. “It gives me great pride to present to Jackie today on behalf of Mr. Chu the collection of books entitled, The West Lake Literature Anthology. This collection is comprised of local annals, operas and novels that feature West Lake, the beautiful area that surrounds Hangzhou.”

During the Governor’s trade mission last month to China, Mrs. Pence presented Hangzhou Public Library’s director, Mr. Chu Shuqing, with music recordings of the Indianapolis Symphony Orchestra’s performance of Nico Muhly Cello Concerto as well as a book entitled “Hoosiers, A New History of Indiana” by James H. Madison. In exchange, the Hangzhou Public Library gave her a collection of books about Hangzhou’s West Lake as well as an engraved stone seal, which she presented today to Jackie Nytes, chief executive officer of The Indianapolis Public Library.

“We give tremendous credit to Mrs. Pence for strengthening our Library’s sister-city relationship with the Hangzhou Public Library and for furthering our ongoing exchange of cultural programs and materials that benefit the citizens of each city,” said Jackie Nytes, chief executive officer of The Indianapolis Public Library.

The exchange was kicked off in April when Jackie Nytes, chief executive officer of The Indianapolis Public Library, presented Mrs. Pence with the music recording and book to bring with her to China to present to Mr. Chu.

In addition to furthering the Hoosier State’s ties with its sister-state of Zhejiang Province, the exchange also strengthens the ongoing sister-city relationship shared between Indianapolis and Hangzhou. The Indianapolis Public Library has an ongoing relationship with the Hangzhou library and has historically participated in ambassadorial exchanges of library staff, with Hangzhou Public Library and The Indianapolis Public Library alternating sending staff to spend time in the other’s library programs.
