We are less than two weeks away from the start of our 93rd Season of Live Racing!
Live racing starts on July 2nd, 2016! We have 30 days of Live Racing this season with lots of great events scheduled!
Gates open at 11 a.m (CT) each day during live racing. Post time 12:50 pm (CT). Both dirt and turf racing is conducted in the summer and the meet is annually highlighted by the Groupie Doll Stakes (GIII) August 6th, 2016.
We will race 30 days starting on Saturday, July 2nd, 2016 & ending on Labor Day, Monday, September 5th, 2016. We will run Friday, Saturday, Sunday & Holidays, Friday, July 4th & Monday, September 7th. Our first post begins at 12:50PM (Central Time).

First Lady Karen Pence Will Award $52,500 in Grants to 57 Organizations from Across Indiana

Indianapolis – On Tuesday morning, First Lady Karen Pence will host a reception at the Governor’s Residence for 57 organizations and charities that serve Hoosier families and children across Indiana. There, First Lady Karen Pence will award each organization with a check ranging from $500 to $1,000 in grant money from the Indiana First Lady’s Charitable Foundation.

First Lady Karen Pence started the Indiana First Lady’s Charitable Foundation in August of 2013 as a way to recognize and lift up organizations and charities across the state. At the inaugural First Lady’s Luncheon held in April 2014, the Foundation awarded its first major grant of $100,000 to the Art Therapy Program at Riley Hospital for Children.  The second year’s luncheon, the Foundation awarded the second major grant of $65,000 to Feeding Indiana’s Hungry, which supports food banks and food pantries in all 92 counties. Last year, the third year, $100,000 was awarded to Indiana Bicentennial Commission for interactive “Treasures of the Statehouse” display at the Indiana State Library

Throughout the year, the Foundation will award smaller grants to organizations across the state. This reception is the seventh of its kind.

Camp Chewza Nah-2-Luza Media Day

The Evansville Police Department—in conjunction with the Fraternal Order of Police Lodge #73, Vanderburgh County Sheriff’s Office, and Vanderburgh County Prosecutor’s Office four years ago created a summer law enforcement experience to give interested students the unique opportunity of stepping into the shoes of a police officer. The program is designed to encourage teamwork and a healthy sense of self-esteem while reinforcing the benefit of choosing the right path and making good choices. Since the camps inception it continues to grow with se attending wishing they could return for another session.

The media Is invited to visit the camp on Tuesday, June 21st at 11:00a. The camp is held at the Fraternal Order of Police P.A.L. camp located at 5417 N. Happe Road. Campers as well as the officers working the camp will be available to discuss the camp with the media.

7th Circuit Cuts Attorney Fees In Indy Skyline Photo Case

The 7th Circuit Court of Appeals found the District Court did not calculate attorney fees correctly in a dismissed copyright lawsuit and remanded the case so the correct amount could be awarded.

Richard Bell brought a copyright lawsuit against Charles Lantz and 46 other defendants alleging each of them violated the Copyright Act in using a photo of the Indianapolis skyline on their websites. After interrogatories it was confirmed Lantz did not violate the copyright and the District Court granted Lantz’s motion to dismiss the claim with prejudice.

Lantz then filed a motion as the prevailing party for costs and attorney fees under the Copyright Act. Bell did not challenge the fact that attorney fees should be awarded, but challenged the amount of fees.

In the decision written by Circuit Judge Ilana Rovner, the panel said the District Court incorrectly calculated the attorney fees that were awarded Lantz. Fees of $250 an hour should have been awarded, not the $410 that was awarded by District Judge Tanya Walton Pratt, who found there was no evidence for the $250 fee. Rovner wrote evidence was submitted for the $250 rate, but it was under seal, so Pratt may not have noticed it.

The evidence included an engagement letter from Overhauser Law Office LLC to Lantz confirming the engagement of the firm in the case at $250 per hour. It also said the firm would direct its invoices to LegalShield “for now.” There were also many invoices with the $250 rate on them that Bell submitted as evidence.

Lantz argued the $250 rate invoices were those sent to LegalShield and copied to him because LegalShield’s hourly cap was $250, and Lantz was liable for the rest of the fees up to $410 an hour, but the 7th Circuit did not accept this argument. The engagement letter said Overhauser would direct his invoices to LegalShield, and if there were more to pay, Overhauser would have sent invoices to Lantz directly. Also, invoices showed the $250 rate and not the $410 rate.

Bell also argued that the District Court erred in refusing to reduce the fee award based on Lantz’s failure to mitigate his own costs and fees. However, the 7th Circuit noted there was no factual basis for this allegation and dismissed it. The 7th Circuit also rejected an argument that fees spent by defense counsel defending the fee petition should not be charged.

The case is Richard N. Bell v. Charles Lantz,15-2341.
