City of Elkhart, Martinsville Police Facing Lawsuits After Deleting Facebook Posts

After preventing local residents from commenting on their official Facebook pages, the city of Elkhart and the Martinsville Police Department are being sued for alleged violations of citizens’ First Amendment rights.

The ACLU of Indiana filed lawsuits against the two municipal entities Friday on behalf of Richard Wolf, Elkhart, and Carole Bare, formerly of Martinsville, after they were blocked from the Elkhart city and Martinsville police Facebook pages last year.

Wolf, who the ACLU described Friday as an advocate for people with disabilities, was blocked from the city of Elkhart’s Facebook page in 2015 after he posted concerns on the page about perceived violations of the American with Disabilities Act at the Lerner Theatre in Elkhart. Specifically, Wolf accused the theater of not having enough accessible parking for disabled customers. According to a Friday release from the ACLU, Wolf’s comments were removed and he was blocked from posting on the Facebook page.

Similarly, Bare, who now lives in Sullivan, posted criticism of the Martinsville Police Department on the department’s Facebook page last fall and was subsequently blocked from posting additional comments on the page. Her original post was also removed, according to the ACLU.

In the suits, which were filed in U.S. District Court for the Northern District of Indiana, South Bend division against Elkhart and in the Southern District of Indiana, Indianapolis division against the city of Martinsville, Wolf and Bare contend that blocking them from posting on government-run social media is censorship and is in violation of their First Amendment rights to free speech.

“When a government entity opens up a space for public comment, it cannot regulate those comments based upon someone’s viewpoint,” Jan Mensz, ACLU of Indiana staff attorney said in a Friday statement. “A citizen’s right to criticize their government is at the heart of what the First Amendment is meant to protect, and the municipalities, in these cases, violated that right.”

The ACLU previously filed a similar lawsuit on behalf of Kymberly Quick and Deborah Mays-Miller, two Beech Grove residents whose Facebook posts that were critical of Beech Grove and its police department were taken down. The city eventually settled that suit, with each of the plaintiffs receiving nearly $7,500 each in costs and attorney fees.

Vlado Vranjes, corporation counsel for the city of Elkhart, said Monday that he was aware of the filing, but that the city had not yet been served with the suit. Once Vranjes is able to review the suit, the city will file a response, he said.

Martinsville Police Chief Matt Long, who was sworn in as chief in late September, said he was not aware of the suit. Long said he was familiar with Bare, but had not heard anything about the 2015 Facebook incident involving her since he became chief. Martinsville city attorney Dale Coffey also said he had not seen the suit as of noon Monday.

The cases are Richard Wolf v. City of Elkhart, Indiana, 3:16-cv-00690, and Carol Bare v. City of Martinsville, Indiana, 1:16-cv-2683.

Freedom, IN – We’ve always joked about dead people voting; even when my own campaign team actually proved election fraud in 2004 (several media outlets outside Indiana picked up the story – the Wall Street Journal and Chicago Tribune, for example). Maybe there was some sick humor in that CIA-backed forces and less-covert USA-backed forces are fighting each other in Syria; or that we’re taking opposite sides in all conflicts in Turkey, Syria, and Iraq. Maybe it was dark irony that TE Lawrence warned us about backing the Saudis and fighting everybody else at once.

But now that China passed anti-terrorism legislation that may involve them with Russians against us in Syria, let’s please stop and think.

A dozen US Presidents, starting with our very first, warned us about the entrenchment of crony factions. Several warned us about what Eisenhower called “The Military Industrial Complex” and it’s central banking enablers. General Smedley Butler called it a “racket” a hundred years ago…before the militarization had reached our own streets here at home.

We have no excuses.

WWIII is entirely possible because the corrupt, fear-aggression-syndrome crime ring we call government has flown totally off the rails of law, morality, economics and sanity. And that has been by our own choice. We cannot blame the politicians that we reelect for their service to evil after their first reelection. And over 90% do get reelected, when the lot of them should be fired.

That’s the whole point of Election Day, you know. It’s not to hire people. It’s to fire them..

I’ve sent out dozens of press releases on serious subjects proposing radical changes to reverse our flight off the cliff, and toward peace, prosperity, security and freedom. Only three media outlets have printed or in any way covered my proposals.

I’ve run for office many times; but this is my first candidacy for any office for which there is no debate, no discussion of important topics, no serious job interviews, and the status quo is so obviously promoted by most mainstream media without so much as a tinge of skepticism or curiosity.
I’m disgusted and appalled at our obvious incurious, numb inertia, and tacit approval of destructive corruption, theft and violence up to the edge of catastrophe – societal, economic and military.

Shame, shame shame.

“Five more weeks before the election. I’m not sure I can survive that long.”
“Ah, yes, you speak of an interesting phenomenon this election cycle, ‘election stress disorder,’ as some therapists refer to it. According to several news reports, our cantankerous election is causing increased irritability, heart palpitations and an inability to sleep in more than a quarter of American adults.”
“You got that right. Trump has been saying nasty things for months. He says Hillary is a corrupt politician and should be in the slammer. Meanwhile, Hillary has accused Trump of being a racist, a sexist and unfit for the presidency.”

To be sure, this election has not been for the faint of heart. But its nastiness is being exacerbated by 24-hour news channels and social media. The vitriol among ‘friends’ on Facebook has reached a fever pitch. Strangers are arguing at restaurants and coffee shops. But Yahoo News offers some tips to deal with the problem.”
“Go to the liquor store and stock up on hooch?”

Actually, the first obvious step is to do what you can to limit your exposure to the noise. One therapist suggests that you turn off cable news and stop checking what your friends are posting on Facebook and Twitter. Go out and do some volunteer work.”

If we become angry and emotional about something a candidate says, is it his or her politics that are setting us off or is it something deeper down that is really bothering us? Maybe the source of our anger is that our job isn’t going as well as we’d like or that we’re experiencing some other unpleasant issue in our lives. By chilling out and thinking things through, maybe this political season isn’t bothering us as much as we think it is.”

“Here’s another tip from the therapist. We’d be better off focusing on the areas in which we and others agree, rather than the areas where we disagree. And we ought to stop taking politics so personally when a friend or neighbor does disagree. The fact is we’re not likely to change anyone’s mind and he or she is not likely to change ours. So chill.”

Black Lives Matter, Obama, and the Race Industry

It is onto Charlotte and beyond for the ever burgeoning race industry lead by President Barack Obama, Hillary Clinton, and the Democrats.  They are joined by their associates in the media, the academy, the “civil rights” caucus, and Black Lives Matter, the racist group that promotes cop killing.

Indeed, the race business in America is thriving. Under our first black President, it has expanded.  Limited before to the inner cities, it has now gone national. Race players on parade everywhere, in our streets, across our TV screens, into every nook and cranny of American life.

And the show never ends.  Indeed, it must go on.  For the show has been very lucrative.  It has given wide notoriety to a host of race hucksters who have benefitted enormously as they pour gasoline on the fires springing up across the nation.  They rub their hands gleefully as black communities burn to the ground in city after city.  And there is always a next attraction to showcase their power, bus in the radicals, anarchists, and Bolshevik thugs, to loot, riot, and shoot cops, all the while blaming racist America.  The charred husks of storefronts, the smoldering ruins, the broken glass of devastated neighborhoods, new Detroits cropping up everywhere, remind us of the race industry’s power, their capacity to wreck cities, undermine law and order, and, perhaps, bring down the country.

For the race industry, there is only one story that matters, the story of American racism, and they have taken that story to the bank.  Legions of administrators, diversity “experts,” bureaucrats, lawyers, government agencies, “civil rights” organizations, “community” groups, street agitators, unions, and politicians, a towering edifice of race mongering, has formed and profited by this story.   Charlotte, Milwaukee, Baltimore, and Ferguson are only the latest symbols, more “moments” to remind Americans that their country is a criminal operation, permanently stuck in the 1950s – and no amount of special pleading, acts of contrition, black success, or other facts on the ground will change that.

Keith Scott, a 43-year-old black man with a long rap sheet, is the newest martyr of the Democrats, the government-run media, and Black Lives Matter.  He had been convicted of assault with a deadly weapon in three states including against a woman and a child, and spent seven years in prison.  His wife had a restraining order against him and warned he was dangerous.  Scott exited his car in Charlotte with a handgun.  He was warned by police to put down his weapon.  Deemed a threat, he was shot and killed by Brentley Vinson, a black officer. The police requested medical assistance. CPR was administered.  He died of his injuries. The firearm was collected.  It was loaded and had his fingerprints.  There is no racism here.

Charlotte is run by liberal Democrats, including the Mayor and 9 out of 11 members of the City Council.  The police commissioner, Kerr Putney, is a Democrat and black.  Nor does Charlotte have a history of racial strife.  In other words, the unrest is fabricated, and Black Lives Matter, Nation of Islam, Communist Party USA, and other despicable, left wing groups, many funded by the Marxist billionaire George Soros, are there to exploit it. Their purpose is to advance the narrative of American bigotry, and to foment anarchy and violence.

Black Lives Matter, Obama, and the left argue that police shootings of unarmed blacks reflect police bias. They compare the number of blacks killed by police to their number in the population rather than their share of the criminal offender pool.  They also cite statistics regarding incarceration rates, which they allege proves “disparate impact” and “systemic racism” because more blacks than whites are arrested. But the propensity to commit crimes is not randomly distributed.  A 2011 study of California and New York arrest data showed that blacks commit homicide at 11 times the rate of whites.  Such disparities were repeated in city level data.  In 75 of the largest counties in 2009, blacks were 62 percent of robbery defendants, 61% of weapons offenders, 57% of murder defendants, 50% of forgery defendants, but only 13% of population.  (Heather MacDonald)  The data shows that policing, prosecution, and incarceration accurately reflect crime rates not bias.

There is no “systemic” racism in our law enforcement and criminal justice systems.  It is a lie promoted by Democrats to support their destructive ideology and to gain political advantage.  Many if not most of our inner cities have majority or near majority black police officers, black police commissioners, black city councils, and black mayors, all liberal Democrats.  Baltimore, the scene of riots by Black Lives Matter and others over the death of Freddie Gray, has a black mayor, a black police commissioner, and 9 out of 15 black members on its City Council. Its juries, judges, and attorneys are liberal Democrats many if not most black.  Baltimore voted 87% for Obama in 2012.  Is this liberal Democrat stronghold the source for genocidal racist police tactics?

The problem in the black community is not racist cops.  It is black criminality.  Every week blacks, many of them innocent and law abiding, are being slaughtered, robbed, raped, and assaulted by black predator criminals.  America’s largest cities, including Baltimore, Chicago, St. Louis, and Milwaukee, are experiencing spikes in murder rates, most of them committed by blacks against other blacks.  Chicago saw its bloodiest month in two decades last August with 90 murders, 384 shootings and 472 total shooting victims.  Chicago has already had more than 500 murders in 2016 and 3000 shooting victims or 12 shooting victims a day and 59 murders a month.Law abiding blacks want to live in safe neighborhoods, not crime-ridden hellholes.

Why is there so much discussion on alleged racial bias where none exists? To avoid the important question of why there is so much black crime.  Black criminality is the result of the anti-black liberal policies of the last sixty years foisted on black communities by Democrats who control the cities where most blacks live.  It is Democrats who bear responsibility for the disintegration of the black community, the breakdown of the two-parent family, the unemployment, poverty, educational failure, and high crime and incarceration rates that afflict blacks.  If a fraction of the attention given to rooting out fictional police bias had been spent denouncing black crime while restoring the two-parent family, we may have broken the link between black communities and the heavy police presence they now require. If instead of unearthing imaginary pockets of racism we had promoted a strong family and faith culture, had encouraged education, personal responsibility, and ending the cycle of dependency, we may have begun to unravel the destructive web of Democrat social welfare policies that have trapped blacks in misery and dysfunction for decades.

It is the creation of a black underclass through anti-black Democrat Party policies that have damaged the black community, not “racist” police.  It is the inculcation of underclass values that have devastated blacks, not “systemic racism.”  It is the anti-black narrative promulgated by white liberals and the Democrat Party, their insufferable and debilitating message of black failure and victimhood, black grievance and dependency, of “structural” racism and black inadequacy that has broken the black community.

The Democrat Party’s legacy to blacks, beyond their long support for slavery and segregation in the past, is the poverty and dysfunction of the black community today.  It is the hopelessness that comes with the belief advanced by liberal Democrats that blacks are victims and can’t make it in America today; that blacks can’t compete on a level playing field; that blacks require “special” treatment and government assistance.  These are the hallmarks and attitudes of the black underclass the Democrats have created for their own political benefit.  Their ideology promotes moral collapse and disintegration.  Their political fortunes flourish amidst despair and breakdown.  It is time to hang their miserable record around their necks, to embarrass and defeat them for the horrendous abuses and failures of liberalism.

Keith Scott was a violent criminal thug who died as he lived.   Like Michael Brown, Freddie Gray, and so many other “martyrs” of the Democrats, the media, and Black Lives Matter.  Obama, Hillary, and the race industry want more Keith Scotts.  They thrive on chaos and turmoil, and its victims do not matter.  But we demand something better.

Aces Wrap Up MVC Individual Championships

UE Finishes Tournament With Several Positives

Diana Tkachenko and Nicoli Pereira each earned top three finishes as the University of Evansville women’s tennis team completed the 2016 Missouri Valley Conference Individual Championships on Monday at Wesselman Park.

Tkachenko battled Illinois State’s Marcia Tere-Apisah to the end, but fell in the championship match of #2 singles, 6-3, 7-6 (6).  She earned a second place finish in her inaugural conference outing as a freshman at UE

Pereira came out victorious in her 3rd place match at flight six singles.  She defeated Savanna Hunt of UNI, 1-6, 7-6 (3), 10-4.  Theodora Soldatou came home in fourth place in the fifth flight, falling to the Redbirds’ Valerija Gercar, 7-6 (5), 6-3.

All three doubles teams for UE took fourth place in their respective flights.  Tkachenko and Pereira were defeated by Missouri State’s Alye Darter and Phoebe Boeschen, 8-6, at the top flight.  At #2 doubles, Chieko Yamada and Soldatou fell to Jana Kustkova and Jelena Karla Vujicic from ISU, 8-4.  Bradley’s Malini Wijesinghe and Alexa Brandt earned the win over Daria Pentsova and Andjela Brguljan, 8-6.

Gray near the top as Aces rank third in North Carolina

One more round set for Tuesday

 MORGANTON, N.C. – Tyler Gray and Zac Turi were the top performers as the University of Evansville men’s golf team completed the first day of the Donald Ross Intercollegiate at Mimosa Hills Golf and Country Club.

Coming off of a win in last week’s Butler Invitational, Gray continued his solid play.  In the first round, Gray notched a 1-over 71 before notching one of the lowest rounds of the day with a 2-under 68.  He sits in a tie for 4th place with a 139.

Turi also continued his high level of golf.  The sophomore started the day with a 1-under 69 before carding a 73 in round two.  He ranks tied for 11th with a score of 142.  One behind him was Wil Pahud.  Sitting in a tie for 15th place, Pahud notched rounds of 71 and 72 and enters the final 18 holes at 3-over par.

Jon Pick and Cameron Weyer are tied for 47th with totals of 152.  Pick’s rounds finished up at 77 and 75 while Weyer checked in with scores of 73 and 79.

Matthew Ladd showed nice improvement as the day went along.  Playing as an individual, Ladd opened with a 77 before recording a 70 in the second round.  Noah Reese notched rounds of 73 and 78 and stands with a 151.

Leading the way for the individuals was Zach Weaver of Pfeiffer University.  He began the day with an even 70 before shooting a 4-under 66.  His 136 is one ahead of High Point’s Brendan MacDougall.  Towson’s Dylan Stein is third with a 138.  Tyler Gray is three off the lead.

On the team side, High Point notched the lowest two rounds of the day, shooting scores of 281 in each round.  Their 562 is nine ahead of second-place Towson.  Evansville is one shot out of second place.

Tomorrow, the squads complete play with a final round of 18 holes.

Aces Volleyball falls on the road at Missouri State

UE stays on the road Saturday at SIU

SPRINGFIELD, Mo. – Mildrelis Rodriguez posted a team-best eight kills as the University of Evansville volleyball team fell by a 3-0 final at Missouri State on Monday evening.

Rodriguez led the offense with eight kills while Rocio Fortuny had five for the Purple Aces (4-17, 0-8 MVC).  Jelena Merseli led the way with 12 assists while Rodriguez paced the defense with 11 digs.  Lily Johnson was the top performer for the Bears (14-7, 5-2 MVC), posting 14 kills in 27 attempts.  Simone House finished with ten kills.0

Game one saw the Bears open up with a 25-10 win.  Up 4-3, the Bears changed the tempo and went on a 14-2 run to take an 18-5 advantage.  They cruised from there to take a 1-0 lead.  Another game-changing run for the Bears came with them also up by a 4-3 tally in the second game.  They scored eight of the next ten points to take a 12-5 lead before winning by a final of 25-12.

Evansville played much better in the third game.  After falling behind by an 0-2 score, the Aces were paced by a Mildrelis Rodriguez kill, which was part of three consecutive points by UE to take a 3-2 lead.  Missouri State was able to find its groove, taking a 5-4 lead before extending it as the frame went along to finish off with a 25-15 win to clinch the match.

A trip to Southern Illinois is next up for UE as the Aces and Salukis will tangle on Saturday evening in Carbondale.
