The Indiana Supreme Court posted an order this week authorizing e-filing of initial complaints and pleadings in infraction and ordinance violation case types. Those cases can be e-filed using the same interim solutions for the Odyssey and JTS case management systems authorized in April for the e-filing of initial information and pleading in criminal case types. The infraction and ordinance violation filings can begin after civil e-filing has begun in a given county.

The steering committee will terminate the interim solutions once the e-filing manager purchased by the court is able to accommodate initial complaint and pleadings in infraction and ordinance violation case types.

The order also amends Trial Rule 77(B) to no longer require an attorney’s number to appear on the chronological case summary if that information is available elsewhere in the case management system.

The court also announced earlier this week that a seventh e-filing service provider, US Legal Pro, is now certified and available for use by Indiana attorneys.

EPA Recognizes Electronics Manufacturers, Retailers and Brand Owners for Making Electronics More Sustainable

Tomorrow, the U.S. Environmental Protection Agency (EPA) will recognize leading electronics manufacturers, retailers, and brand owners for their significant contributions in diverting electronics from landfills. The winners will be honored during an event at the 2017 Consumer Electronics Show (CES) in Las Vegas.

“The successful practices spearheaded by our Sustainable Materials Management (SMM) Electronics Challenge participants are inspiring examples of how other manufacturers, retailers and brand owners throughout various industries can make their products more sustainable throughout their life cycles,” said Mathy Stanislaus, Assistant Administrator for EPA’s Office of Land and Emergency Management. “I am proud to recognize the awardees and all SMM Electronics Challenge participants who are leading the industry in creating innovative ways to meld environmental responsibilities with sound business practices, which are necessary for future growth.”

“CTA is honored to host EPA at CES 2017 and recognize the winners of the annual SMM Awards Challenge,” said Walter Alcorn, vice president, Environmental Affairs and Industry Sustainability, Consumer Technology Association. “These awards help demonstrate our industry’s focus on advancing sustainable operations to reduce e-waste and our industry’s overall environmental impact. In fact, through the consumer tech industry’s leadership, EPA research shows electronics recycling has increased more than that of any other product stream in the U.S.”

Electronic products are a global economic driver, with supply chains reaching around the world. By designing with the environment in mind and through a lifecycle lens, the product can be made to be more readily repairable and reusable, while toxic materials can be designed out of the product, which extends product life and facilitates recycling.

In the spirit of innovation, the EPA is unveiling a new award this year: The Cutting Edge Award. This award promotes bold ideas that have the potential to make a huge impact on the future of sustainable electronics management across a product’s full supply chain. It is designed to encourage life cycle thinking while creating ambitious and new ideas that have the potential to be game changers in addressing sustainability in electronics.

Leaders from Best Buy (Gold Tier Award), Dell (Gold Tier), LG Electronics (Gold Tier), Samsung (Gold Tier), Sony (Bronze Tier), Sprint (Gold Tier), Staples (Gold Tier), and VIZIO (Bronze Tier) will gather at CES to celebrate their environmental achievements, which include diverting more than 256,000 tons of used electronics from landfills in 2015 – equivalent to taking 129,000 passenger vehicles off of the road for one year. Of the used electronics collected, almost all (more than 99.9 percent) were sent to third-party-certified recyclers, which helps to ensure that used electronics are handled in a manner that protects human health and the environment.

EPA is also honoring Dell, Staples and Samsung as the SMM Electronics Challenge Champion Award winners for exemplifying exceptional leadership and innovation in the sustainable management of electronics. These three companies serve as examples in demonstrating significant environmental, social, and economic outcomes for their organizations and the public that go above and beyond the requirements of the SMM Electronics Challenge.

  • Staples is receiving an award for its “Make More Happen” initiative, an outreach and public education campaign that has provided information on Staples’ Technology Recycling Program to more than 6 million people.
  • Samsung is receiving the inaugural Cutting Edge Award for its Cadmium-free Quantum Dot ultra-high-definition televisions.

Late rally sends Drake to 88-76 win over men’s basketball

Dru Smith has career game in the loss

 DES MOINES, Iowa – Freshman Dru Smith had the best game of his career, finishing with 14 points, but Drake finished the game on an 18-4 run to earn an 88-76 win over the University of Evansville men’s basketball team on Sunday at the Knapp Center.

Smith hit three triples in the game for the Purple Aces (10-7, 1-3 MVC).  Jaylon Brown was the leading scorer for UE, totaling 23 points.  Duane Gibson finished the day with 14 while Ryan Taylor hit double figures with 10.

“Our guys did a good job today, we fought back from an early deficit and took a late lead,” UE head coach Marty Simmons said.  “It is disappointing to come out with a loss, but we will be ready to go at Missouri State on Wednesday.”

Reed Timmer led the Bulldogs (4-12, 2-2 MVC) with 28 points.  He was a perfect 8-8 from the free throw line.  Timmer was one of five Bulldogs to hit double figures.  Ore Arogundade notched 17.

Out of the gate, the Bulldogs scored the first four points and hit 4 of their opening 5 buckets on their way to a 10-2 lead.  Dalen Traore came in off the bench with an and-one to get UE back within five.

After UE finished off a 5-0 rally to make it a 10-7 game, Drake responded with a run of their own, scoring 11 of the next 16 points to take their biggest lead of the half at 21-12 with 11:27 left in the period.  Evansville fought its way back in the final moments before halftime, clawing its way within a point at 33-32 on a Traore free throw before the Bulldogs pushed their lead back to four at the break, 38-34.  Jaylon Brown led all players with 15 tallies through the first 20 minutes.

Drake registered the first five points out of the locker room to match their largest advantage at nine points before the Aces changed the course of the game with a response of their own.  Trailing 51-45, the Aces notched nine in a row to take their first lead of the game.  With 14:05 remaining, a short jumper courtesy of Ryan Taylor gave UE a 52-51 edge before a Dru Smith bucket capped off the 9-0 stretch.

The lead swapped five times over the next eight minutes as Smith’s career effort continued.  With the Aces down 64-63, Smith’s third trey of the day put UE back on top.  After a Bulldog layup tied the score, Ryan Taylor connected on his first triple to give UE a 69-66 advantage.  Four in a row by Drake saw them take a 70-69 lead with just over four minutes left but Taylor connected from long range again as Evansville took a 72-70 lead inside of four minutes remaining.

A triple by Ore Arogundade was part of a 14-0 run that made the difference in the game.  Over three minutes, the Bulldogs turned a 2-point deficit into an 84-72 lead.  Drake hit five shots in a row.

Evansville outshot Drake, 48.3%-45.9% in the game, but the Bulldogs had a 36-30 edge on the boards.

Missouri State is up next for the Aces as they head to Springfield on Wednesday night at 7 p.m. to take on the Bears.

The plan was codified into law in 2016, ensuring more than 370,000 Hoosiers have access to affordable and quality health care in a program based on personal responsibility and empowering people to take ownership of their health care choices.

 

 

3) Fiscal Integrity, Expanding Educational Opportunity // Governor Pence worked with the Indiana General Assembly to craft an honestly balanced budget that maintained strong reserves for the state and continues to generate a surplus. This fiscal discipline helped Indiana maintain its AAA credit rating and earn a global reputation as a great place to do business. During his tenure, Governor Pence also expanded school choice, increased educational opportunity for families by signing into law the first state funding for pre-K education in Indiana, and addressed Indiana’s skills gap by making career and technical education a priority in every high school.

 

 

4) Building a State That Works // Because of the hard work of Hoosiers across our state, over the last four years Indiana secured commitments from companies that represent more than $15 billion in capital investment throughout the Hoosier state and more than 90,000 new jobs in the coming years. Indiana set a new record for private sector employment, the state’s economy has added more than 165,000 new private sector jobs, and since Governor Pence took office our state’s unemployment rate has been cut in half. Indiana’s labor force participation rate has also outpaced the national average for more than two years running.

 

 

5) Combatting Addiction, Mental Health // Governor Mike Pence created the Governor’s Task Force on Drug Enforcement, Treatment, and Prevention to combat the scourge of drug addiction in Indiana and, based on their recommendations, supported and signed legislationto come alongside Hoosiers struggling with addiction. During his tenure as Governor, Pence unveiled plans for a new state-of-the-art mental health hospital, called the Neuro-Diagnostic Institute and Advanced Treatment Center, to improve the way mental health issues are treated in Indiana.

 

 

 

6) Supporting Hoosier Veterans // A strong supporter of the military, Governor Mike Pence made a priority of reducing veteran unemployment, and Indiana more than doubled funding for the Indiana Department of Veterans Affairs during his tenure as governor.

 

Hustler Hollywood sues Indianapolis over zoning roadblocks

Hustler Hollywood, which wants to open a retail store in Castleton, is suing the city of Indianapolis over a zoning denial that the company says is infringing on its constitutional right to operate a business.

Beverly Hills-based Hustler Hollywood, which operates more than 20 stores around the country, is part of Flynt Management Group. Founder Larry Flynt is an well-known proponent of First Amendment free-speech rights.

The company has filed suit against the consolidated City of Indianapolis/Marion County as well as the Metropolitan Board of Zoning Appeals and the Department of Business and Neighborhood Services. The suit was filed late Thursday in U.S. District Court for the Southern District of Indiana in Indianapolis.

Hustler Hollywood wants to open a store at 5505 E. 82nd St., between Allisonville Road and Interstate 465. The area is zoned C-3, a classification in which adult-oriented stores and entertainment businesses are not permitted. City zoning officials last month struck down the company’s latest attempt to open the store.

The retailer’s plan drew stern opposition from neighborhood groups and City-County Councilor Christine Scales — especially after they learned the site is next to Chuck E. Cheese restaurant.

In its suit, Hustler Hollywood says the city is incorrectly classifying the store as an adult business and has denied it the permits that it needs in order to open. The plaintiff also says the city’s actions are depriving it of both its First Amendment right to free expression and its 14th Amendment right to equal protection of law.

Early in 2016, the lawsuit says, Hustler Hollywood talked with city officials so it could understand what it needed to do to avoid being classified as an adult establishment under local zoning laws.

According to the zoning rules, a business is considered an adult bookstore if 25 percent or more of its retail floor space, stock or weekly sales are from adult products, including sexually-oriented media, devices and other items. The rules also define an adult services establishment as one in which “a preponderance of services” involve specified sexual activities or display of specified parts of the body.

In its suit, Hustler Hollywood says it “analyzed its projected inventory, floor space and revenue, determining that it would easily operate below the threshold for triggering a designation of an adult entertainment business.” The plaintiff also noted that it operates stores in other locations that have zoning laws that are more restrictive than the ones in Indianapolis.

In July, the plaintiff signed a 10-year commercial lease for the 5505 E. 82nd St. property. In August, it filed applications to remodel the store’s interior and hang exterior signs at the location.

The sign permit application was denied on the grounds that it would require a variance, and the remodeling permit was denied because the city “needed confirmation of an approved use of the premises before granting such a permit,” the suit says.

In September, the plaintiff submitted information about its projected inventory, floor space and revenue. Initially, the suit said, this information contained projections for Hustler Hollywood’s other store locations, and its online sales, but the plaintiff later submitted new projections for the Indianapolis store only.

The plaintiff filed an appeal with the Metropolitan Board of Zoning Appeals, but the board denied that appeal by a 5-0 vote at its Dec. 6 meeting.

In its lawsuit, the plaintiff says that the inside of the Indianapolis store would not be visible from outside the premises, and that a wall inside the store will separate the general merchandise from the adult-themed merchandise.

Hustler Hollywood also says it will not offer in-store demonstrations, videos or workshops related to its adult merchandise, so it should not be classified as an adult service establishment under city ordinances.

The Indianapolis location has been renovated and is stocked with merchandise, but cannot open for business because of the city’s actions—causing the defendant to suffer financial harm, the suit says.

The suit asks the court to declare the city’s zoning regulations, and their application in this case, to be in violation of the First and 14th amendments. It also asks that the defendants be prohibited from enforcing the “adult” provisions of the zoning regulations against the plaintiff.

The plaintiff is also asking for monetary damages for lost profits, loss of goodwill, remodeling and maintenance costs, and “deprivation of constitutional rights.” The suit does not specify a dollar amount for these damages.

Attorney Donnie Morgan, the city’s chief litigation counsel, said Friday morning that the city has not yet been served with a copy of the lawsuit.

Morgan declined to comment on the case in general, saying that the city’s policy is to refrain from talking about pending litigation.

Arrest Made after Allegations of Child Sexual Abuse in North Side Home

The Vanderburgh County Sheriff’s Office has arrested a man on multiple counts of Child Molesting following an investigation into allegations of inappropriate contact between the man and two alleged victims, ages 10 and 11. The victims had disclosed to family and a counselor that the abuse had been occurring.

The investigation began at Holly’s House where both victims were interviewed by a forensic interviewer. Both victims gave detailed accounts of multiple incidents of sexual abuse by the suspect, Luther Vincent Peckinpaugh. Peckinpaugh also made numerous attempts to expose both victims to commercial pornography. The abuse was alleged to have occurred during overnight visits to his north side home.

On January 6th, detectives with the Sheriff’s Office executed a search warrant on Peckinpaugh’s residence and recovered several computers, multimedia devices and an item of clothing described by the victims that corroborated their accounts of the abuse. Peckinpaugh was taken to the Command Post for an interview. Peckinpaugh denied the allegations.

Peckinpaugh was arrested and charged with four counts of Child Molesting as Level 6 Felonies. He is being held in the Vanderburgh County Jail on a $50,000.00 cash only bond. There were allegations of physical abuse as well and the case is still under investigation.
