Election against ex-husband’s will barred due to unresolved marriage status

The purported ex-wife of a now-deceased man cannot proceed with her election against the man’s will because the couple failed to resolve the issue of the legal status of their marriage for more than 40 years, thus barring her claim under the doctrine of laches, the Indiana Court of Appeals has ruled.

One year after their marriage in April 1968, Leon and Milana Riggs separated and were issued a divorce decree in Mexico. The couple stopped living together in 1969, and beginning in 1970, Leon Riggs’ tax filing status was single.

Then in 1973, Milana Riggs filed an Indiana petition to dissolve the marriage, while her purported ex-husband filed a cross-claim seeking the same relief and declaratory judgment as to the validity of the Mexican divorce decree. However, none of those actions were ever resolved, leaving the question regarding the validity of the Mexican decree unresolved.

Milana Riggs then filed a second petition to dissolve the marriage in 2015, but by that point Leon Riggs suffered from dementia and was not competent to participate in the action. He died before the dissolution decree was entered, so the Marion Superior Court dismissed for lack of jurisdiction.

Shortly after Leon Riggs’ death, his ex-wife filed an election to take against his will, claiming she was married to him at the time of his death, renouncing all provisions in his will and electing to take her legal share in the estate. She also filed claims against the estate for compensation.

But Cynthia Hill, Leon’s daughter who had been appointed personal representative of her father’s estate, filed a motion to strike Milana Riggs’ election against the will, which the probate court treated as a motion for summary judgment under the equitable doctrines of laches, unclean hands and equitable estoppel. Hill also moved to strike Milana Riggs’ affidavit and deposition, which the ex-wife had designated in opposition to summary judgment, pursuant to the Indiana Dead Man’s Statute.

Milana Riggs then filed a cross-motion for summary judgment in which she claimed, among other things, that Hill was estopped from arguing the Mexican divorce decree was valid. But in granting Hill’s motions and denying Milana Riggs’ motions, the probate court concluded its role was not to determine the validity of the Mexican decree, but rather whether the parties were barred from seeking or contesting the spousal election. The court then determined Milana Riggs’ claims was barred by the doctrine of laches.

Milana Riggs appealed in Milana Staletovich Riggs v. Cynthia Hill, in her capacity as the Personal Representative of the Estate of Leon O. Riggs, 49A02-1703-EU0458, arguing first that the probate court erred in granting Hill’s motion to strike Milana Riggs’ affidavit and deposition.  But Indiana Court of Appeals Judge John Baker, writing in a Tuesday opinion, disagreed, pointing to the decision in In Re Sutherland’s Estate, 204 N.E.2d 520 (Ind. 1965).

In that case, the Supreme Court determined the “Dead Man’s Statute prohibits the testimony of an alleged surviving spouse about her relationship with the decedent where she is seeking to inherit a portion of the decedent’s estate.” Because the Supreme Court still considers Sutherland to be good law, it was not erroneous for the probate court to grant the motion to strike under that statute, Baker wrote.

The appellate court also affirmed the grant of summary judgment to Hill, with Baker writing that “(46) years is an inexcusable delay for Milana to assert her rights as Leon’s legal spouse” and that Milana Riggs had acquiesced to the legally unsettled nature of her relationship with her deceased husband. Thus, the doctrine of laches applies, the judges held.

Finally, the appellate court declined to apply judicial estoppel against the estate’s argument that Leon Milana Riggs was not married at the time of his death, because no such argument was made. Rather, Hill consistently maintained the validity of the Mexican document was not relevant to the case, Baker wrote.

 

EVSC Schools to Participate in National Walk to School Day Wednesday, October 4

Several EVSC schools will participate in National Walk to School Day tomorrow with organized walks to school. 
 
  • Highland: Students will meet at the Lloyd Pool/Ingelhart parking lot at 7:30 a.m. Students from the University of Evansville will accompany Highland students on their walk. The group is scheduled to begin their walk to school around 7:45 a.m.
  • Dexter students will meet at Lorraine Park at 7:15 a.m. and as a group will walk to Dexter.
  • Stockwell students will meet at the corner of Spring Valley and Green River Road in the former Integra bank parking lot at 7 a.m.
  • Caze students will have the option of meeting at two locations – either at the entrance of Grand Oak Apartments (5010 Cass Avenue) or Vann Park Apartments (3305 Pollack Avenue). Both groups will meet around 7:30 a.m.
  • Fairlawn Elementary School students will meet at the Dollar General Store at the intersection of Pollack and Weinbach at 7:15 a.m.
 
National Walk to School Day is organized by the National Center for Safe Routes to School. The purpose is to empower communities to make walking and bicycling to school a safe, appealing and preferred choice for families. 

Tyler Gray tied for the lead at Butler

Aces in second place 

INDIANAPOLIS, Ind. – University of Evansville senior golfer Tyler Gray is tied for the lead entering the final 18 holes of the Butler Fall Invitational at Highland Country Club.

Gray had a great day on the links, finishing the first two rounds at a 4-under 136.  He started the day with a 3-under 67 before carding a 69 in round two.  He is tied with Graham McAree of the University of Indianapolis for the individual lead.  Nick Bienz of IUPUI is third, two behind the frontrunners.

Cameron Weyer and Noah Reese are tied for 10th place on the leaderboard, each finishing Monday with a 148.  Weyer started with a 72 in round one before posting a 76.  Reese totaled 76 strokes in his first round before lowering that to a 72 in the second round.

Third for the Purple Aces is Matthew Ladd.  After registering a 78 to start the tournament, Ladd saw a nice improvement in round two, finishing with a 2-over 72.  His 150 is tied for 19th.

Three individuals took to the course, led by Gabe Rohleder.  He notched a 1-over 71 in the opening round before finishing the day with a 74.  His total of 145 is tied for 5thplace.  Spencer Wagner’s scores checked in at 76 and 77.  His 153 is tied for 27th.  Robert Waggoner also had a solid day.  He notched an 80 before lowering his round two score by six strokes to a 74.  His 154 is tied for 32nd.

Indianapolis has the team lead with a 577.  The Aces are just five behind as they enter Tuesday’s final round.  UE is 12 strokes ahead of 3rd place.

Tomorrow, the final round of action will take place in Indianapolis.

IS IT TRUE Dr. Richard Moss claim that 8th District Congressman Larry Bucshon (R) family now lives in Washington, DC is really getting political traction?  …Dr. Moss claims that last year Congressman Bucshon sold his expensive family home in Newburgh and purchased a new family home in the Washington, DC area?  …Congressman Bucshon also has a condo in Newburgh which he calls his official residence?
IS IT TRUE the City of Evansville don’t have a revenue problem but they do have a spending problem?
IS IT TRUE the best way for Evansville City Council to balance the budget is make budget cuts not increase taxes?

IS IT TRUE that the Evansville City Council seems to be providing protection for the Vanderburgh County Council from a political perspective when it comes to raising the Local Option Income Tax hike by $8 Million per year?…this move is bordering on political suicide to run interference for the County Council who should be forced to vote on a tax increase on the people they were elected to serve?

IS IT TRUE Mole #3 tells us that in spite of the assertions that all of the proposed Local Option Income Tax dollars will be used for public safety equipment, raises and health insurance only may not be totally truthful?  …could the real truth be that the some of the proposed Local Option Income Tax dollars will be quietly earmarked to expand the Vanderburgh County jail? …maybe the City is taking this issue on because the majority of criminals are from the City and the County doesn’t want to pay for the criminal habits of City dwellers?…on the other hand the City Council may just be going through a bout of hubris?

IS IT TRUE that the Gallup rankings on community exercise are out and to many people’s surprise greater Evansville is doing much better after sinking to the bottom of the barrel less than 10 years ago?…Evansville is the highest ranking city in the State of Indiana for community exercise with a national ranking of #125?…other metro areas checked in at #162 (Indianapolis), #168 (Fort Wayne), and #160 (South Bend)?…Evansville checks in at second in Indiana on healthy eating behind only South Bend at #117 in the nation?…when it comes to overall well-being (the criteria that Evansville was dead last in the country for just 7 years ago), River City is up to #145 from #189 (last) a short time ago?…Evansville trails both Fort Wayne and South Bend in overall well-being but came up ahead of Indianapolis who at #164 is sinking toward the bottom 10 nationwide?…the City County Observer would like to thank and congratulate all those who have altered their lifestyles to get us out of the cellar for well-being?…we also must consider that we were wrong to make fun of the silly chicken fat video that Mayor Winnecke and his supporters made?…we attribute the positive changes to the chicken fat video inspiring the populace to exercise more and eat less?…speaking of eating less it is Fall Festival week so go enjoy yourselves and do the chicken fat dance next week to get rid of that fat?

IS IT TRUE that the top ten cities nationwide for exercise are Boulder, CO; Fort Collins, CO; San Luis Obispo, CA; Greely, CO; Santa Rosa, CA; Honolulu, Hilton Head, SC; Anchorage, AK; Clarksville, TN; and Chico, CA respectively?…seven of these cities are in states where marijuana is legal?…the bottom ten cities for exercise are Roanoke, VA; Rockford, IL; Gulfport, MS; Spartansburg, SC; Buffalo, NY; Toledo, OH; Montgomery, AL; Cedar Rapids, IA; Akron, OH; and Hickory, NC?…not a one of these cities that fight exercise like a cat fights a bath has legalized marijuana?…if you want to blame something on the legalization of dope, then blame the exercise craze because these results correlate too well not to have some relevance?

CHANNEL 44 NEWS: New Food Booth At Fall Festival Raises Money For Educational Foundation

Everyone has their Fall Festival favorites, but there are some new booths on the Munchie Map this year. The West Side Sportsman’s Club is one of the new booths hitting Franklin Street, raising money for their educational foundation.

Philly Cheesesteaks are one of their biggest menu items, along with polish sausages, pronto pups, and lemon shake-ups.

The booth captain says, although it’s their first year, they’re hoping to keep their spot for years to come.

West Side Sportsman’s Club Ron Duncan said, “It takes a long time. There’s a waiting list it’s probably hundreds of people waiting to get a spot at this place. We’re just fortunate enough to be one of them. So we’re happy.”

CHANNEL 44 NEWS: Hyatt Place Hotel Gets Confirmed To Undergo Construction In Evansville

Downtown Evansville will soon see a new development after its approval by the Site Review Committee. The Hyatt Place Hotel is about to be built between the intersection of South East Second Street and Chestnut Street. The hotel is expected to generate more income and increased tourism after its completion.

The vicinity will take up 84 thousand square feet, 5 stories high with 139 rooms. Some of the amenities include a swimming pool, a bar, an outdoor patio and a Bistro restaurant which is expected to be open to the general public. John Whinery, who is a lawyer for Frick Powell across the street mentioned how excited he is for the new landmark. Whinery said, “It was a total surprise when it was announced several months ago. It’ll increase the value of our property we think and plus we can go across the street and have lunch now.”

Groundbreaking for construction will begin by the end of this year. The hotel is expected to be completed by December 2018.
