COA: Churches aren’t school property; sex offenders can attend

Three convicted Boone County sex offenders can return to their church congregations after the Indiana Court of Appeals determined that churches are not considered “school property,” so state statute cannot prohibit the offenders from going to church, even when children are present.

The appellate court handed down that decision Tuesday in John Doe 1, et al., v. The Boone County Prosecutor, in his official capacity, et al., 06A01-1612-PL-2741. The case dates to 2015, when the Indiana General Assembly passed the “unlawful entry by a serious sex offender” statute, Indiana Code section 35-42-4-14. That statute prohibits “serious sex offenders” from accessing school property.

According to the statute, “school property” is defined as any “nonprofit program or service operated to … benefit children who are at least three years of age and not yet enrolled in kindergarten.” Based on that language, the Boone County prosecutor sent a letter to all registered sex offenders in the county informing them they could only attend church if their churches do not offer classes or services for young children.

But because each of their churches offered children’s programming simultaneously or nearly simultaneously with adult services or Bible studies, three sex offenders known as John Does 1, 2 and 3, filed suit claiming the sheriff’s letter effectively prohibited them from attending church at any time. The Does sought declaratory and injunctive relief, alleging churches don’t meet the definition of “school property,” but the Boone Superior Court denied such relief, finding instead that the churches are only “school property” when children’s programming is in session.

The trial court also rejected the Does’ argument that the statute violates Indiana’s Religious Freedom Restoration Act, which prohibits the government from substantially burdening a person’s religious exercise unless there is a compelling interest and the burden is the least restrictive means of advancing that interest. Though ACLU of Indiana Legal Director Ken Falk, who argued on appealon behalf of the Does, claimed the offenders’ case could be won on the issue of the definition of school property alone, he also told the judges on appeal that if churches are school property, then the serious sex offender statute would violate their rights under RFRA.

The state, however, argued that because church programs operate to “benefit children,” church buildings can be considered “school property” under that statutory language. Further, Deputy Attorney General Aaron Craft said the state had a compelling interest in protecting children from being victimized by sex offenders, and prohibiting those offenders from accessing children at church was the least restrictive means of accomplishing that interest.

The appellate panel consisting of Chief Judge Nancy Vaidik and judges Margret Robb and L. Mark Bailey seemed skeptical of the state’s claims during oral arguments, and ultimately agreed with the Does’ position in Tuesday’s opinion. Robb, who wrote for the unanimous panel, pointed to language in subsection (1)(D) of I.C. 35-42-4-14, which lists programs such as Head Start, preschool or developmental child care programs, as examples of “school property.”

“A common element among these listed examples, as well as the statute as a whole, is the focus on places or entities traditionally thought of and known as ‘school,’” Robb wrote. “Churches and religious institutions are not school, nor do they become so by use of the popular and common name of ‘Sunday school.’”

Robb also noted the statute specifically applies to entities that are required to be licensed under I.C. 12-17.2 or 31-27, which includes day cares, child care centers, foster homes and other similar entities.

While the appellate panel noted in a footnote that it did not reach the RFRA argument because it determined churches do not meet the definition of “school property,” Robb also wrote that if churches did fall under that definition, the statute would not “further the interest it seeks to redress as applied to these three men.” The case was, thus, remanded to the trial court with instructions to enter a permanent injunction prohibiting the state from arresting or prosecuting the Does if they go to church.

Falk told the Indiana Lawyer his office is pleased with the Court of Appeals’ decision, as it pertains to the important right of people to be able to attend church. He said once the case becomes final, the Does will want to return to their churches.

A spokesman for the Indiana Attorney General’s Office did not immediately respond to a message seeking comment on the appellate court’s decision.

UE Chili Bowl Sale set for Thurs. Oct. 26

The University of Evansville’s annual Chili Bowl Sale is planned for October 26 from 11:30 a.m.-1:00 p.m. The event, which is sponsored by the UE Clay Club, will be set up in the area between Hyde and Sampson Halls on UE’s campus. The rain location for the event is Eykamp Hall, Room 253, Ridgway University Center.

Chartwells, the new food service provider at UE, will provide the chili this year.

For $10, customers can buy a one-of-a-kind ceramic bowl and fill it with chili. Styrofoam containers will be available for those who prefer not to put chili in their newly purchased bowls.

Smaller bowls priced at $5 and larger bowls ranging from $15-$50 will also be for sale at the event. There will be a few bowls sold at a Silent Auction as well, ranging in value from $60-$100.

The bowls are being made this year by members of the Clay Club and other UE students, faculty members, alumni, and members of the community.

Part of the proceeds from the sale will be donated to At the Cross Mission in Mount Vernon, Indiana, which is a meal kitchen for the less fortunate. The rest will go to the Clay Club to be used to fund attendance at conferences, visiting artists, and studio/gallery visits.

IS IT TRUE that the House of Representative of the United States has many doctors who have given up their life’s work to run for elected office and Southwest Indiana is not without and example of such an official?…Dr. Larry Bucshon was a respected doctor before turning in his medical practice to run for congress?…the newly acknowledged issue with nationwide opiate addiction is just the kind of problem that congressional doctors should be taking on and Congressman Bucshon has stepped up to contribute?…Bucshon was in town last week to meet with the Vanderburgh County Substance Abuse Council?…while doctors are now grabbing the headlines to find ways to reduce drug addiction, they were also a significant part of the cause of the opiate epidemic when they were writing prescriptions for painkillers like they were handing out vouchers for happy meals?…in return for handing out vouchers for opiate based drugs like Percocet and Oxycodon, physicians across the country were being courted and rewarded by drug companies with trips, awards, and fancy titles?…many of the doctors in congress have been the recipients of campaign contributions from the very companies that manufacture the opiates that the doctors wrote prescriptions for?…today we are all aghast at the 55 deaths in little Evansville this year from heroin overdoses?…exercising a little knowledge and common sense could have gone a long way toward preventing the mass addiction problem that the United States is faced with today?…the question is, “should we trust the architects of the addiction problem to find a cure?

IS IT TRUE that a website known as Niche.com that tracks the cost of living across the United States has just named the Indiana cities of Fort Wayne, Evansville, and South Bend as the cheapest places in the country to live?…the City County Observer is confident that no one who contributed to this article has ever faced a utility bill from Vectren with respect to local earnings or an ever increasing (unreasonable) bill from the City of Evansville Sewer and Water Utility?…when digging an inch below the surface one finds that Niche.com only considers housing, food, fuel, and property taxes?…property taxes are by definition 1% of the market value of the house so cheap houses means low taxes?…with the always under attack HOMESTEAD TAX CREDIT there are some homeowners who pay nearly no property taxes at all?…fuel may be cheap in Evansville but it is always cheaper across the money saving bridge in Kentucky or down at Marina Point?…food is and always has been reasonably priced in Evansville but part of that is because locals tend not to be willing to pay for designer brands and have an appetite for very inexpensive fast food from a drive up window?…Niche also excluded the cost of healthcare which is quite high due to the high levels of obesity, smoking, sedentary living and abuse of alcohol?…while Evansville is not even close to the cost of places like San Francisco, it is far from the cheapest place in the United States?

 Evansville City Council approves a set of rules creating guidelines for spending money from the Affordable Housing Trust Fund.

This comes after council voted against transferring $100,000 into the fund a few weeks ago.

The new set of guidelines approved by city council will allow the board to have a say in how the money in the fund is spent.

The reason is to become more transparent.

“Council should have the right to know what’s being funded,” said councilwoman Missy Mosby. “And what’s going on.”

Before the approval of the ordinance, the AHTF could be used within Vanderburgh County. It’s been changed to only allow the funds to be used within Evansville city limits.

These changes will not affect the process people or Community Development Corporations (CDC) must go through to apply for the money.

City Councilwoman Connie Robinson was the lone ‘no’ vote against the ordinance.

Sullivan Named Aviation IN State Representative Of The Year

Doug Joest, Aviation Indiana president and executive director of the Evansville-Vanderburgh Airport Authority, presented the award to Sullivan at a Southwest Indiana Chamber of Commerce event in Evansville.

“Representative Sullivan was instrumental in passing legislation that created a dedicated fund for airports in the state,” Joest said. “By having a state-dedicated fund that matches grants from the Federal Aviation Administration, airports across the state can better plan federal projects. We think that by having these funds in place, Indiana airports will be in a better position to receive additional federal discretionary funds. She understands the important role aviation serves in helping local businesses connect to their customers. By being connected, this creates jobs in our communities. We appreciate all of Holli’s hard work so that airports can continue to help Hoosier businesses grow.”

Sullivan serves on the House Committee on Ways and Means, which reviews all revenue-related policies and is the primary architect of the state’s biennial budget.
