Judge orders early satellite voting precincts for Marion County

0

Dave Stafford for www.theindianalawyer.com

A federal judge Wednesday ordered Marion County to establish at least two early satellite voting precincts in time for the November general election, though the court refrained from requiring them in time for the May 8 primary election.

Senior Judge Sarah Evans Barker issued an injunction in a suit brought by Common Cause and the NAACP. The suit filed in 2017 alleged that the county election board’s decision in recent years to permit early voting in just one location countywide provided unequal access to the ballot and violated voting rights in Indianapolis, particularly for minority voters.

Barker’s injunction was issued contemporaneously with a 48-page order that found that there was too little time before the May 8 primary to order early voting precincts, creating too great a burden on the Marion County Election Board.

“The benefits to Plaintiffs at this late hour, meanwhile, would be comparatively modest. Finally, while the character and magnitude of Plaintiffs’ injury does not vary with the type of election (primary or general), the public’s interest in an electoral market free from arbitrary governmental interference in favor of one political party over another is less impaired in the primary-election context. And the public, too, would be ill served by last-minute upheaval and confusion in the administration of the May primary,” Barker wrote in Common Cause Indiana, et al. v. Marion County Election Board, et al, 1:17-cv-1388.

“As to the November general election, however, we find that the balance of equities tips in Plaintiffs’ favor,” Barker wrote. “… Plaintiffs’ fair likelihood of success on the merits, and the constitutionally fundamental nature of their asserted injury, justify the imposition of this reduced burden. “Both Plaintiffs and the public are positioned to enjoy the full benefits of (early in-person) voting restored to its 2008 levels, while the public will suffer minimal disruption to any ongoing election preparation efforts, and will reap the harvest of an electoral contest conducted without a governmental thumb on the scale.”

The Election Board in earlier years offered early in-person voting in two to four locations. In 2008, the county established early-voting sites at North Central High School and at the Southport Government Center. But in more recent years, the Election Board voted against satellite early voting facilities, so early voting was available only at the County Clerk’s office in the City-County Building.

While Barker’s order puts the force of law behind requiring Marion County to provide early in-person voting locations, the board previously indicated it would expand early voting in 2019.

Walsh Baking Company by Pat Sides

0

When William P. Walsh built his baking company at 400 North Main Street in 1910, Evansville’s city directory listed thirty bakers and five wholesale bakeries that served a population of about 86,000. The business was prosperous from the start, as the numerous horse-drawn delivery vehicles indicate. Saso Bread was the company’s chief product, and a local newspaper reported that the demand for it had “grown phenomenally,” necessitating an addition to the factory shortly after it opened. In that decade, Walsh baked about 18,000 loaves of bread a day. Despite its early success, the company succumbed to the Great Depression in the 1930s, when many businesses closed; the building was razed in 2002 to make way for Turoni’s parking lot.

Eagles baseball explode in nightcap to get split

0

EVANSVILLE, Ind. – The University of Southern Indiana baseball team explode for 22 runs in the nightcap to get a split with McKendree University on Senior Day Sunday afternoon at the USI Baseball Field. The Screaming Eagles lost the opener, 10-9, before getting a 22-1 win in the nightcap.

USI watched its record go to 25-18 overall and 12-8 in the GLVC, while McKendree ends the day 8-34, 3-16 GLVC.

Prior to the doubleheader, USI honored its seven seniors – infielder Sam Griggs (Evansville, Indiana); infielder/pitcher Nick Gobert (Jasper, Indiana); pitcher Devin Williams (Evansville, Indiana); outfielder Buddy Johnson (Shelbyville, Kentucky); pitcher Kyle Griffin(Morganfield, Kentucky); pitcher Nick Coudret (Newburgh, Indiana); and outfield/infielder Drake McNamara (Mt. Vernon, Indiana).

Game 1:
The Eagles left the tying run on third base and lost the opening game, 10-9. McKendree scored all 10 of their runs on four home run, including three three-run blasts.

After the Bearcats plated six runs in the first on a pair three-run shots, USI cut the lead in half with three runs in the third to make the score, 6-3. McKendree re-extended the lead to six with three more in the fifth before the Eagles pulled to within four, 9-5, with a pair in the fifth on a RBI-single by senior rightfielder Buddy Johnson and a RBI-ground out by junior designated hitter Jayden Beshears (Evansville, Indiana).

The Bearcats got the eventual deciding run in the top of the seventh with a solo shot to put the margin at 10-5. USI tried to comeback in the bottom of the seventh senior first baseman Nick Gobert started a four-run frame with a home run to seventh, his second of the season.

The Eagles closed the gap to one, 10-9, after senior third baseman Sam Griggs drove in a run by reaching on an error and freshman centerfielder Bryce Krizan (Mt. Vernon, Indiana) plated a pair with a two-single to right center. USI’s rally, however, stalled with the tying run on third as McKendree closed out the 10-9 win.

On the mound, senior right-hander Kyle Griffin started and took the loss for the Eagles. Griffin (3-3) allowed six runs on six hits and two walks, while striking out five in 3.1 innings of work.

Game 2:
USI second baseman Jacob Fleming hit for the cycle and the Eagles blasted five home runs to pound McKendree, 22-1, in the nightcap. The Eagles’ offense scored in each of six at-bats, including a 10-run third inning that saw USI send 14 hitters to the plate.

Fleming became the first Eagle to hit for the complete cycle in a game, going four-for-five in the nightcap. The junior second baseman homered in his first at-bat of the nightcap before getting a single and two-run triple in the third inning and a two-out double in the fourth inning.

In addition to Fleming’s first round-tripper of the year, the Eagles also got game-two home runs from senior leftfielder Drake McNamara, his eighth of the year; junior first baseman Jayden Beshears, his third of the year; junior leftfielder Spencer Deom (Tell City, Indiana), his first of the year; and freshman shortstop Ethan Hunter (Terre Haute, Indiana), his first of the year.

On the mound, junior left-hander Chase Partain (Evansville, Indiana) posted his third win of the season. Partain (3-1) threw six innings, allowing one unearned run on four hits and two walks and striking out one.

Next up for the Eagles:
The final regular-season home game is Tuesday when the University of Missouri-St. Louis visits USI for a 6 p.m. non-conference contest at the USI Baseball Field. The Eagles lead the series with UMSL, 53-42, after defeating the Tritons in March, 16-5, on the road.

USI finishes the 2018 regular season next weekend when it visits the University of Indianapolis for a Friday and Sunday four-game series. The first half of the series was moved up from Saturday to Friday due the UIndy graduation. First pitch for Friday and Sunday is slated for 11 a.m. (CDT) each day.

The Eagles lead the all-time series with the Greyhounds, 54-52, after sweeping a four-game set at the USI Baseball Field in 2017.

McKendree spoils USI Softball Senior Day

0

EVANSVILLE, Ind.—University of Southern Indiana Softball dropped both ends of its Great Lakes Valley Conference doubleheader to No. 25 McKendree University Sunday afternoon at the USI Softball Field.

The Screaming Eagles (27-22, 15-13 GLVC), who lost both games by matching scores of 6-3, honored their four seniors—outfielder Olivia Clark-Kittleson (Carbondale, Illinois), first baseman Mena Fulton (Bloomington, Indiana), third baseman Marleah Fossett (Brownsburg, Indiana) and infielderAlex Logan (Carleton, Michigan)—following the games as part of their Senior Day festivities.

Despite the losses, USI secured a berth in the GLVC Championship Tournament, which is May 3-5 in East Peoria, Illinois. Although the official bracket announcement will not be made until later this evening, the Eagles will likely be the No. 6 seed and face the No. 3 seed, University of Indianapolis, in the opening round.

Game 1: McKendree 6, USI 3 (Box Score)
The Eagles saw a 2-0 lead evaporate as McKendree scored six straight runs to earn the 6-3 victory in the opener.

Junior catcher Lindsey Barr (Whitesville, Kentucky) put the Eagles on top with a two-run single in the bottom of the second inning, but McKendree answered with a solo home run off the bat of senior catcher Rebecca Franke in the top half of the fourth frame.

The Bearcats (37-14, 20-8 GLVC) erupted for four runs in the fifth inning to take a 5-2 lead before adding a tally in the seventh to increase their advantage to 6-2.

Junior second baseman Claire Johnson (Pittsboro, Indiana) had a sacrifice fly in the seventh to cut the deficit to three runs, but USI could not get anything else going as it suffered the loss in game one.

Sophomore pitcher Jennifer Leonhardt (Louisville, Kentucky) took the loss for the Eagles after giving up five runs, three earned, off six hits in 5 2/3 innings of work. Leonhardt (14-11) breezed through McKendree’s lineup the first time around, retiring 10 straight with six strikeouts before the home run by Franke broke up the perfect-game bid.

Game 2: McKendree 6, USI 3 (Box Score)
McKendree, once again, rallied from a 2-1 deficit with a four-run inning to earn the 6-3 win in the second game.

After spotting the Bearcats a run in the top of the fourth inning, the Eagles answered with an RBI-single from Fossett in the home half of the fourth inning. Fulton, who was at first base when Fossett recorded the hit, advanced to third; then scored the go-ahead run on an errant throw by the right fielder.

Despite retiring nine straight to start the game, junior pitcher Haylee Smith(Florence, Kentucky) ran into the same issue Leonhardt did in the fifth inning. McKendree scored four times off four hits to retake the lead and put the Eagles into a 5-2 deficit heading into the sixth inning.

Fulton’s RBI-single in the sixth inning cut the Bearcats cushion to 5-3; but McKendree took advantage of an error in the seventh to score another run before closing the door on a USI comeback in bottom of the seventh inning.

Smith (5-5) was charged with the loss after giving up five runs, four earned, off five hits in 4 1/3 innings of work. Leonhardt gave up one unearned run off one hit in 2 2/3 innings of work and finished the day with a combined 11 strikeouts.

EVANSVILLE, Ind. – The University of Southern Indiana baseball team hit four home runs and swept a doubleheader McKendree University, 16-2 and 4-3, Saturday afternoon at the USI Baseball Field. USI watched its record go to 24-17 overall and 11-7 in the GLVC, while McKendree ends the day 7-33, 2-15 GLVC.

USI and McKendree conclude the four-game series with noondoubleheader Sunday at the USI Baseball Field. Sunday also is Senior Day for the Eagles, who will honor its seven seniors – infielder Sam Griggs (Evansville, Indiana); infielder/pitcher Nick Gobert (Jasper, Indiana); pitcher Devin Williams (Evansville, Indiana); outfielder Buddy Johnson (Shelbyville, Kentucky); pitcher Kyle Griffin (Morganfield, Kentucky); pitcher Nick Coudret(Newburgh, Indiana); and outfield/infielder Drake McNamara (Mt. Vernon, Indiana).

Game 1:
The Screaming Eagles hammered out 17 hits, including three home runs, in rolling by the Bearcats, 16-2, in the opening game. USI had an early 1-0 lead through five innings before scoring 15 times in its final three at-bats (seven in the sixth, one in the seventh, and seven in the eighth) to seal the victory.

Leading the USI hitters were junior designated hitter Jayden Beshears (Evansville, Indiana), senior third baseman Sam Griggs, and junior catcher Logan Brown (Mt. Vernon, Indiana). Beshears was three-for-four at the plate with two runs scored, a home run, and a team-high five RBIs.

Griggs and Logan were three-for-five with two runs scored, a home run, and three RBIs each. Senior leftfielder Drake McNamara and junior second baseman Jacob Fleming (Evansville, Indiana) also had a pair of RBIs in the victory.

On the mound, junior right-hander Austin Krizan (Mt. Vernon, Indiana) posted his first victory since March 2 and five-straight no-decisions. Krizan (2-2) allowed two runs on 10 hits and two walks, while striking out six in eight innings of work.

Junior right-hander Ryan Gulledge (Evansville, Indiana) worked a scoreless ninth inning, setting down the final three batters after loading the bases.

Game 2:
USI senior third baseman Sam Griggs completed an unassisted double-play to preserve a 4-3 victory in the nightcap. Griggs snagged a liner with one out and dove to third base to get the potential tying run and end the McKendree rally in the final frame of the seven-inning game two.

After the Eagles and the Bearcats battled to a scoreless draw through three-and-a-half innings, senior first baseman/pitcher Nick Gobert hit his first home run of the season to give the Eagles a 1-0 lead in the bottom of the fourth.

McKendree tied the game in the top of the fifth before USI rallied to take the lead for good with a three-run bottom half of the frame. Junior second baseman Jacob Fleming ignited the game-winning rally with an RBI-double off the left field fence.

Senior leftfielder/first baseman Drake McNamara followed with a double to left center to score Fleming to give USI a 3-1 advantage. McNamara would cross the plate with the eventual game-winning run when Gobert reached on an error.

The Bearcats scored once in the sixth and seventh and had the tying run on third to set the stage for Griggs’ heroics.

USI senior right-hander Nick Coudret (Newburgh, Indiana) picked up the win in relief, while Gobert closed out the game for his second save of the game. Coudret (4-2), who moves into a tie for the team-lead with four wins, allowed two runs on two hits and struck out one in 1.2 innings. Gobert closed out the seventh, getting the final two outs for the save.

Senior right-hander Devin Williams (Evansville, Indiana) started and got the no-decision after going the first 4.2 innings. Williams allowed one run on six hits, while striking out one.
