Gov. Holcomb Announces Appointments to Various Boards and Commissions

Governor Eric J. Holcomb announced today several new appointments and reappointments to various boards, commissions and councils.

Indiana Commission for Higher Education

The governor made one new appointment and three reappointments to the Indiana Commission for Higher Education.

  • Coleen Gabhart from West Lafayette. Gabhart is a 2018 graduate of Ivy Tech who has transferred to Purdue University to continue her postsecondary education. She will serve as the commission’s student member, with a term expiring June 30, 2020.
  • Christopher LaMothe from Indianapolis. LaMothe is the chief executive officer of Elevate Ventures. The governor has reappointed LaMothe to serve on the commission with a term ending June 30, 2022.
  • Dr. Beverley Pitts from Fishers. Dr. Pitts is president emerita of the University of Indianapolis. She has been reappointed to serve with a term expiring June 30, 2022.
  • Christopher Murphy, III from South Bend. Murphy is the chairman, president and chief executive officer of 1st Source Corporation as well as the chairman and chief executive officer of 1st Source Bank. He has been reappointed to the commission with a term expiring June 30, 2022.

Purdue University Board of Trustees

The governor made three reappointments to the Purdue University Board of Trustees with each reappointment serving a three-year term.

  • Michael R. Berghoff from Indianapolis. Berghoff is founder and president of Lenex Steel Corporation. He will continue to serve on the Purdue University Board of Trustees, with a term ending July 1, 2021.
  • JoAnn Brouillette from West Lafayette. Brouillette is managing partner and president of Demeter LP. She will continue to serve on the Purdue University Board of Trustees with a term expiring July 1, 2021.
  • Vanessa J. Castagna from Dallas, Texas. Castagna is former chair of Mervyns Department Stores and former chief executive officer and chair of JC Penney. She was selected by the Purdue Alumni Association and reappointed by Gov. Holcomb. She will continue to serve on the board of trustees with a term expiring July 1, 2021.

 Indiana State Board of Education

The governor made two reappointments to the Indiana State Board of Education.

  • Dr. David Freitas from Granger. Dr. Freitas is a professor of educational leadership at Indiana University South Bend. He will continue to serve on the board through June 30, 2022.
  • B.J. Watts from Evansville. Watts is a teacher and coach with the Evansville Vanderburgh School Corporation. He will continue to serve on the board through June 30, 2022.

 Indiana Charter School Board

The governor made one reappointment to the Indiana Charter School Board.

  • Dr. Virginia B. Calvin from Granger. Calvin is former chancellor of Ivy Tech Community College North Central campus. Dr. Calvin will continue her duties for the board through June 30, 2022.

Indiana Criminal Justice Institute Board of Trustees

The governor made one reappointment to the Indiana Criminal Justice Institute Board of Trustees.

  • The Honorable Andrea K. McCord from Mitchell. McCord is the Lawrence County Circuit Court judge. She will continue her service to the board through June 30, 2022.

Indiana Department of Financial Institutions Board of Directors

The governor made one reappointment to the Indiana Department of Financial Institutions Board of Directors.

  • Mark A. Schroeder from Jasper. Schroeder is chairman and chief operating officer of German American Bancorp, Inc. He will continue his service to the board with a term expiring June 30, 2022.

 Indiana Parole Board

The governor made one reappointment to the Indiana Parole Board.

Frederick A. Medley from Indianapolis. Medley will continue his service on the Indiana Parole Board with a term concluding June 30, 2022.

State Lottery Commission

The governor made one new appointment to the State Lottery Commission.

  • Norman H. Gurwitz from Indianapolis. Gurwitz is former executive vice-president and corporate counsel for Emmis Communications Corporation. His term expires June 30, 2022.

 

MIKE BRAUN STATEMENT ON OBAMACARE PREMIUM INCREASES

Mike Braun released the following statement in response to the Indiananapolis Business Journal’s report that Indiana’s Obamacare premiums will rise an average of five percent next year.
“I wish I could say I am surprised that costs for healthcare continue to increase – but this has been business as usual ever since Obamacare passed,” said Mike Braun. “Just last week Senator Donnelly bragged about being the vote to pass Obamacare. Sleepin’ Joe should not be proud of voting for premium increases of 74% over the last five years and insurers leaving the marketplace.”
“In my experience in the real world, running a business and creating good jobs for fellow Hoosiers, we haven’t raised premiums for employees in a decade. In the Senate, I will use my business experience and work with President Trump to fully repeal Obamacare and implement free-market solutions that will provide better healthcare for Hoosiers.”

Dale Romans: ‘It’s time for the Baby Invasion to start’

Two-year-old racing again will be a focal point at Ellis Park,
launching 107 graded-stakes winners (18 Grade 1!) since ’99
“We’re getting ready to head to Two-Year-Old Town.”
That’s what trainer Dale Romans calls Ellis Park, which begins its race meet July 1 and where for years he has run most of his 2-year-olds in the summer. The track’s “baby races” no longer rank among racing’s best-kept secrets. The parade of stakes horses coming out of Ellis races has caught the attention of trainers, owners and horseplayers.
Purses in maiden races are a record $42,000 for Kentucky-breds, which account for the vast majority of horses at the track. Ellis again will stage a pair of $75,000 2-year-old stakes on Aug. 19: the Ellis Park Juvenile and Debutante at seven furlongs.
“It’s time for the Baby Invasion to start, and I’ve got a bunch to unleash at Ellis Park,” Romans said. “I won’t take a maiden 2-year-old to Saratoga. If they’re any good, nobody is going to care where they broke their maiden. If they aren’t any good, they’re not going to win at Saratoga anyway.”
Ellis Park’s reputation is growing as the economical alternative to the expense of shipping to upstate New York, with the higher costs of living expenses and running horses at Saratoga’s elite summer meet.
“We have taken in the Dale Romans Kool-Aid,” said Jeff Lifson, head of West Point Thoroughbreds’ Midwest division. “We have a horse that is almost at $200,000 in purses, stakes-placed, just won a (second-level) allowance race at Churchill in powerful fashion and is going on to another stakes — and was an Ellis Park starter last summer.”
That’s Seven Trumpets. He finished fifth in his debut at Ellis Park and in his next start gave Romans a tie with Bill Mott for Churchill Downs’ all-time win lead at 701, a title Romans now holds outright.
“You’ve got to be disciplined to not take your 2-year-olds to Saratoga and puff your chest out,” Lifson said. “But how would you like to puff your chest out at Breeders’ Cup time? Derby time? We love Ellis. The purses have gotten better. And I went up there last year for a $10,000 claimer. I could not believe the transformation of the place from the last time I was there, about nine or 10 years ago. It’s really fan-friendly up there. It’s the best of a summer, county fair-type feel.”
The Romans-trained Brody’s Cause finished eighth in his 2015 racing debut at Ellis Park but went on to win Keeneland’s Grade 1 Claiborne Breeders’ Futurity and Toyota Blue Grass. Also from the Romans barn, Keen Ice lost his 2-year-old debut at Ellis but the next year defeated Triple Crown winner American Pharoah in Saratoga’s Grade 1 Travers Stakes. Not This Time won at Ellis by 10 lengths in his second race in 2016, then captured Churchill Downs’ Grade 3 Iroquois before losing the Breeders’ Cup Juvenile by only a neck.
Storied Claiborne Farm plans to run some of its impeccably-bred 2-year-olds at Ellis.
“You don’t have to go to Saratoga to run a 2-year-old anymore,” said Claiborne president Walker Hancock. “You can stay home and hopefully make some money at Ellis…. The purses are good and the track is safe. We’re looking forward to running there. We like running in Kentucky. We’re Kentucky people, and it definitely saves on costs. It’s a great place to start a horse, get a race in them and see what they can do at Keeneland or Churchill after a good start at Ellis. The boost in purses certainly helps. Training bills are expensive, and it’s hard enough just to break even. It helps make things work.”
Ellis launched 236 graded winners, 37 Grade 1 winners past 20 years
We know that a lot of horses who race at Ellis Park go on to to win graded stakes and do well in Grade 1 races. But what are the numbers?
Thanks to Equibase, official industry data-keeper, we have some stats. Equibase computed how many horses that ran at Ellis Park later won a graded stakes, and how many were in the top three in a Grade 1 event. Equibase also broke the numbers down by age, so we can tell how many Ellis-raced 2-year-olds have gone on to do well in America’s top races.
Since the 1998 meet, 236 Ellis-raced horses have subsequently won at least one Grade 1, 2 or 3 race. A total of 102 horses that ran at Ellis Park went on to finish in the top three in a Grade 1 stakes. Thirty-seven of those won at least one Grade 1 race.
The numbers back up Ellis Park’s burgeoning reputation as a great place to race 2-year-olds with a future. Eighteen of those 37 Ellis-raced horses who went on to win at least one Grade 1 the past 20 years ran at Ellis as a 2-year-old. At total of 107 horses that ran at Ellis at age 2 went on to win a graded stakes since 1998.

Charlie Wiggins Historic Marker Placed In Evansville

State Rep. Ryan Hatfield, the Indiana Racing Memorial Association, and the Evansville African-American Museum have announced that a race-themed historic marker honoring legendary mechanic and race driver Charlie Wiggins will be placed at The African American Museum in Evansville
The Wiggins marker will be unveiled during a ceremony starting at 10 a.m. Saturday in front of the African-American Museum.
“Charlie Wiggins was the star of the African-American racing circuit in the 1920s and 1930s, capturing four ‘Gold and Glory’ races,” said Hatfield. “Wiggins was one of the foremost African-American drivers in an era when racing was still new, safety was minimal, and it took someone without fear to compete.”
Ashley Jordan, Director of the Evansville African-American Museum, added, “Evansville is proud to honor one of our ‘Favorite Sons’ who brought fame to our city and state and to the world of early American auto racing. His dedication to a dangerous sport made him the most successful driver in the history of the ‘Gold and Glory’ race.”
Wiggins is the latest subject to be honored by the Indiana Racing Memorial Association (IRMA), an organization founded by Brian Hasler and Mark Eutsler to memorialize the contributions made by drivers, mechanics, manufacturers, short tracks, and events that made Indiana the “Racing Capital of the World.”
“With the addition of Charlie Wiggins, IRMA will have placed 36 markers across the State of Indiana,” Hasler said. “Our markers and the unveiling events that take place with them have helped educate the public about these contributions to building the sport of auto racing in Indiana, the country, and around the world.”
Hatfield noted, “As a life-long race fan, I am pleased that Charlie Wiggins will receive the recognition he is due with the addition of this historic marker in Evansville.”
“This marker will be a constant reminder of an Evansville resident whose determination and talent made a significant contribution to the sport he loved,” added Jordan.

Justices: Motel Room Used For Sting Operation Was Not ‘Place Of Detention’

The Indiana Supreme Court has upheld the admission of incriminating statements made in a motel room during an undercover drug investigation after finding the motel room was not a “place of detention” requiring an electronic record of the statements. The court also created a test for analyzing whether a location can be considered a “place of detention” under Indiana Evidence Rule 617.

On June 18, 2015, Aaron Fansler accepted a Facebook friend request to connect with a user named “Kenzie Allen,” a fake name used by a Grant County drug task force team to facilitate a controlled drug buy. Communicating first through social media and then through private text messages, Fansler agreed to sell two-tenths of a gram of heroin to Kenzie at the Hart Motel in Marion.

The next day, Fansler visited Kenzie’s motel room, where he was greeted by Detective Wesley McCorkle, a member of the Joint Effort Against Narcotics (JEAN) team who posed as Kenzie’s brother.  The detective told Fansler Kenzie would return to the room shortly, so Fansler, who was acting visibly nervous, chose to wait outside. While outside, a second officer approached and arrested him.

After reading Fansler his Miranda rights in the motel room and searching his person, police found over a dozen pills, drug paraphernalia, cigarette packs and more than $250 in cash. Fansler then made two incriminating statements to the officers that became relevant at his trial and on appeal.

First, when asked “where the two points of heroin were,” Fansler told officers the drugs should have been located in the baggies. Officers then found another bag containing a substance that tested positive for heroin, and Fansler told them he had not informed them of that bag because he did not want to “get caught with it.”

After he was charged with numerous drug offenses, Fansler filed a motion to suppress his incriminating statements, which the Grant Circuit Court died. Then, during his jury trial, Fansler admitted possession but denied intent to deliver and raised an affirmative entrapment defense.

The jury found Fansler guilty on all four counts after officers testified to his two self-incriminating statements. He was sentenced to 13-years for dealing, with ten years executed the Department of Correction and three years suspended and also received concurrent sentences of two years executed for possession of heroin, one year executed for possession of a controlled substance and one year executed for possession of paraphernalia.

In a unanimous August 2017 opinion, the  Indiana Court of Appeals upheld Fansler’s conviction, finding that while the trial court erred in admitting Fansler’s statements without an electronic recording, any error was harmless because of Fansler’s own admissions at trial and the generally uncontested nature of his possession of heroin. The Court of Appeals also found the trial court did not abuse its discretion in not considering his proposed mitigating factor – that “Kenzie” had induced or facilitated the offense.

The Indiana Supreme Court heard argument in Fansler’s case in November, then ruled on Thursday the trial court did not err in admitting the incriminating statements made after Fansler was of his Miranda rights.

“Under Rule 617, officers must equip facilities serving the functional equivalent of a station house with recording devices, but a motel room used sporadically to carry out a sting operation is simply not the type place the rule was meant to reach,” Justice Steven David wrote Thursday.

In reaching that decision, the unanimous justices developed a three-part test for determining when a location meets Rule 617’s definition of a “place of detention” requiring an electronic record: analyzing the control law enforcement has over the premises, the frequency of use to conduct custodial interrogations and the purpose for which law enforcement uses the space.

Here, David said law enforcement did not have “control” over the motel room because the room was used for its intended purpose when law enforcement was not there. Further, David said police used the room only sporadically to perform sting operations, and the primary use of the motel room was surveillance.

“A motel room, as used by law enforcement in this case—to carry out an undercover investigation and to search a suspect incident to his arrest—is not a place of detention as defined by Indiana Evidence Rule 617,” he said.

The justices also summarily affirmed the Court of Appeals’ ruling regarding Fansler’s proffered mitigator.

The case is Aaron L. Fansler v. the State of Indiana, 27S02-1710-CR-672.

The reptile roundup kicked off this morning, where kids got the chance to meet live animals. Kids got up close and personal with snakes, lizards, turtles, and other reptiles. The hands-on activities allowed kids to get over their fears and enjoy the cold-blooded creatures.
“A lot of people say Oh, I’m scared of snaked or oh, lizards are weird and slimy. We want to debunk those myths and give adults and kids those opportunities to get up close and meet all kinds of reptiles,” said Elaine Edwards, the Wesselman Woods Communication Director.

Wesselman Woods teamed up with the Tristate herpetological society to make this happen.

It was also free for members and included admission to the Nature Center.
