Evansville, IN– On the heels of the biggest and best-selling tour of their career, southern rock band NEEDTOBREATHEwill take their music to the fans once again come February, this time in support of their first-ever acoustic live album,Acoustic Live Vol. 1, playing their most intimate theater shows to date.

2019 Indiana Missing Children Poster Contest

The Indiana State Police is proud to partner again in 2019 with the U.S. Department of Justice in promoting the National Missing Children’s Day Poster Contest.  In 1983, President Ronald Reagan proclaimed May 25th as National Missing Children’s Day.  This day is dedicated to encouraging parents, guardians, caregivers and all concerned individuals with the well-being of children to make child safety a priority.  It also serves as a reminder to continue our efforts to reunite missing children with their families and loved ones.  It also serves as an occasion to honor those that are dedicated to this very noble cause.  The National Missing Children’s Poster Contest provides an opportunity for schools, law enforcement, and parents/guardians to discuss and promote child safety.

The state winner will receive a national award certificate from the U.S. Department of Justice and their poster will be selected to go to the national judging competition.  The national winner, along with his/her parents and teacher, along with the state manager will be invited to Washington, D.C. to participate in the U.S. DOJ’s National Missing Children’s Day ceremony.

Some important facts about the contest:

  • There is NO LIMIT on the number of posters a school can submit.
  • Only 1 poster per student is allowed for submission.
  • Students who submit posters MUST be in the 5th grade. 
  • Artwork should reflect the theme “Bringing Our Missing Children Home.” This phrase MUST appear somewhere on the poster.
  • The theme may be depicted in the artwork through one or a combination of illustrations and can be created using media such as acrylics, watercolor, pencils, charcoal, magic markers, spray paint, crayons and pastels. Digitally produced images, collages, cut-outs and stamping WILL NOT be eligible for consideration.
  • The finished poster MUST measure 8 ½ X 14 inches.
  • The poster must be submitted with a COMPLETED application, which includes a description of the poster and a brief biography of the artist.

Expired handgun permit not ‘misuse’ of firearm, COA says

A divided panel of the Indiana Court of Appeals has reversed an order to destroy a man’s handgun, finding the man did not misuse the firearm, despite his expired permit.

In March 2017, an Indianapolis police officer stopped a vehicle for its lack of illumination for the license plate. When asked if there were any guns, knives or other weapons in the vehicle, Marques Trice, the driver, said that he had a handgun in the console.

Upon learning Trice’s firearm permit had expired in 2015, the officer took possession of the handgun and subsequently arrested Trice. He was subsequently convicted of Class A misdemeanor carrying a handgun without being licensed. As part of his sentence, the Marion Superior Court ordered that Trice’s gun be destroyed.

On appeal, Trice argued the trial court erred by ordering the destruction of his handgun. Specifically, his argument in Marques D. Trice v. State of Indiana,18A-CR-697 was that carrying a handgun without being licensed does not amount to “misuse” of a firearm.

The appellate court agreed, finding in its Tuesday decision that the phrase “misuse of a firearm” had not been “legislatively defined in Indiana for purposes of Indiana Code section 35-47-3-2(b).” Looking at the dictionary definition of “misuse,” the appellate court said the word is defined as “incorrect or improper use,” “an occasion when something is used in an unsuitable way or in a way that was not intended” or “the act of using something wrongly or in a dishonest way.”

“The evidence shows that Trice’s handgun was in the console of his vehicle, and the officer became aware of its existence when Trice answered affirmatively and honestly the officer’s inquiry as to whether Trice had any weapons in the vehicle,” Senior Judge Betty Barteau wrote for the court. “However, although Trice possessed the handgun, he did not use the handgun.”

“Therefore, the definitions of the term ‘misuse’ can best be applied here to mean that a conviction for the misuse of a firearm must involve some use of the firearm that is incorrect, improper, or unsuitable,” Barteau concluded. “Trice did not use the handgun; rather, he was merely in possession of it. Thus, it defies logic and relevant precedent to say that he misused the handgun.”

The appellate court ultimately reversed and remanded the trial court’s order to destroy Trice’s handgun.

Judge Terry Crone dissented from the majority, arguing that carrying a handgun without a license is a misuse, just as driving a motor vehicle without a license is misuse of the vehicle.

“Carrying a handgun without a license is misusing a firearm, and thus a conviction for that offense is a conviction for the misuse of firearms,” Crone wrote in a separate opinion.

Arrests made in Thursday night shooting on east side

Evansville Police have arrested 3 suspects in connection with the November 8th shooting that injured Odie Carrier. The shooting happened at 3421 Wood Duck Dr just after 9:00pm.
Police have arrested CONNOR JOHNSON (18), XZEREUS DLAMINI (19), and a 17 year old female. All three are charged with Robbery with Serious Bodily Injury and Burglary with Serious Bodily Injury.
Police believe the 17 year old female went to Carrier’s apartment to have sex with Carrier. Based on text messages recovered from Carrier’s phone, he was going to pay her for the encounter. Although police had the messages, they did not have a verified name associated with the phone number Carrier was exchanging texts with.
Police believe that JOHNSON and DLAMINI came to the home with the female with the intent to rob Carrier. During the robbery, JOHNSON shot Carrier. All three suspects then fled the scene.
At 2:30am on Friday, patrol officers conducted a routine traffic s top in the 800 block of S. Elliott. All 3 suspects were in the vehicle at the time of the stop. During the stop, drugs and a gun were seized, but there was nothing that connected the vehicle or the occupants to the earlier shooting on Wood Duck. JOHNSON and DLAMINI were arrested on misdemeanor drug and weapons charges. The female was cited for a license violation and released.
As the shooting investigation progressed, information was uncovered that connected the occupants of the car stop to the shooting. The unverified phone that had been involved in the shooting was found to belong to the female who had been cited and released from the car stop. JOHNSON was interviewed and implicated himself in the robbery/ shooting.
JOHNSON and DLAMINI have remained in the jail and were charged in the shooting. The female suspect was located and arrested on the Robbery and Burglary charges. She is being held at a secure juvenile facility at this time.

We hope that today’s “IS IT TRUE” will provoke honest and open dialogue concerning issues that we, as responsible citizens of this community, need to address in a rational and responsible way?

IS IT TRUE we were told that members of the Winnecke Administration talked with the leadership of the Evansville EPD & EFD unions concerning their contracts for 2019, 2020 and 2021 budget years?  …that this contract is dubbed the 4-4-4 plan? …that 4-4-4 means the members of the EFD and EPD will receive a 4% increases in salaries for the next three years (2019 to 2021)?

IS IT TRUE we were told that a member of the Winnecke Administration gave a verbal commitment to City Council during the 2019 Budget Hearings that they will pay a portion of the negative balance in hospitalization before the end of 2018?  …we are told as of today the City Council haven’t seen any evidence that this has been done?

IS IT TRUE we would like to personally thank the owners of Simple Cremation for sending us an obituary last week? …that Simple Cremation is new to the area and are offering cremation services at extremely affordable prices? …we are very impressed that they reached out to us to post a no-cost funeral announcement concerning the passing of an individual with local family ties? …if you would like to know more about Simple Cremation- Evansville please texted them at www.SimpleCremationEvansville.com.

IS IT TRUE we ready appreciate that At-Large City Councilman Dr. Dan Adams for taking the bull by the horn and finally getting the City Controller to publically explain the reason for making late operating payments (2017 and 2018) of the Victory Theater?

IS IT TRUE we are told that the Indiana State Legislature is moving quickly to approve “Sports Book Gaming” in Indiana?  `…the projection is that this legislation should be approved in January?

IS IT TRUE that earlier this year an official representing Echo Housing alleges that “all donor funds that have been given to ECHO Housing Corp. have been accounted for”?  …we wonder if the official did a forensic audit of all the funds earmarked and collected on the 66 properties that ECHO owns in Evansville; the proposed $6.1 million dollars 27-unit homeless housing complex and the $8 million dollars 44 unit Garfield Commons project that just opened a couple of months ago?  …we also wonder if this financial review included the payroll and travel vouchers of the former Executive Director and her administrative staff during the last 3 years?

IS IT TRUE it seems like the EPD felt that ECHO Housing Corp. declaration that all the funds given to the ECRO Housing Corp were all accounted for needed to be verified by a third party?  …that EPD decided to an extensive external Forensic audit of ECHO Housing Corp that covered a period of several years?…we are told that this audit may have been completed and that the findings are extremely interesting?

IS IT TRUE we recently did an extensive search to locate a list of current ECHO Board of Directors members but couldn’t find any?  …can anyone help us to identify the current members of the ECHO Housing Board Of Directors?

IS IT TRUE that last year Deaconess Hospital and Henderson Community Methodist Hospital formed a group called an “ACO?”  …that “ACO” is where referrals are preferably kept within the group and only certain doctors at Deaconess and Methodist are invited to be a part of that group?  …we wonder how the “ACO” referral group created by Deaconess Hospital and Henderson Community Methodist Hospital is currently doing?

IS IT TRUE during his last year in office City Councilman John Friend, CPA sponsored a “separation of funds ordinance” in order to ensure that the City Controller would not manipulate general fund balances?  … upon the urging of the City Controller and the former City Council Finance Chairman, Dan McGinn the newly elected City Council voted to repeal this ordinance?  ...we hear that the money collected from all income sources are now put into one (1) fund account which makes it extremely hard to track on how much money is in each city account on a weekly basis?  …could this be the main reason why key fund accounts haven’t been balanced for 10 out of 11 months last year?

Army Specialist Drew Watters Remains Arrive On Veterans Day

Saturday night in Evansville, one veteran’s remains were escorted from Indianapolis to Evansville. Army Specialist Drew Watters remains made it to Evansville in the early hours of Veterans Day.

There’s been an outpouring of support from friends and family of Army Specialist Drew Watters. He died in a training exercise in Washington state. His body was returned to Indianapolis Saturday night and came home to Evansville under a police escort. His remains were delivered to Browning Funeral home around 1 in the morning on Veteran’s Day.

Visitation for Specialist Watters will be Tuesday at the Christian Fellowship Church on Millersburg Road from 2 P.M. to 8 P.M. Funeral services will be held for Army Specialist Drew Watters on Wednesday at the Christian Fellowship Church as well.
