The City-County Observer is pleased to announce a meet and greet and book signing with Joe Jack Wallace who has just published his first book “Living Outside the Box” that had its origins in Evansville’s Innovation Pointe.

“Living Outside the Box” debuted on Amazon in mid-April and was named #1 New Edition in three categories including Green Business and Intergovernmental Policy.

Mr. Wallace will discuss the inspiration that launched the book and explains the content of the book from its opening chapters about dispelling myths with science, through the habits that poise people to be highly impactful and how vision followed by execution lead to establishing a state of the art technology center in Greater Palm Springs California.

He currently serves as the CEO and Chief Innovation Officer of the Coachella Valley Economic Partnership.  

Wallace graduated from Stanford University and the University of Evansville with Masters and Bachelor Degrees in Mechanical Engineering.  He also holds certifications in Cybersecurity and The Internet of Things from Harvard and MIT.  He is a sought after speaker on topics from entrepreneurship to politics and will be available to autograph books during this event.

Mesker Park Zoo & Botanic Garden to Host Ribbon Cutting Ceremony

WHO: Evansville’s Mesker Park Zoo & Botanic Garden, Mayor Lloyd Winnecke, Evansville Zoological Society, Evansville Convention & Visitors Bureau, and Southwest Indiana Chamber.

WHAT: Mesker Park Zoo & Botanic Garden opens its new animal habitat, the Budgie Walkabout, with a ribbon cutting ceremony in partnership with the City of Evansville’s Mayor Lloyd Winnecke; Evansville Zoological Society; presenting donor Evansville Convention & Visitors Bureau; and Southwest Indiana Chamber. The Budgie Walkabout is an outdoor walk-through aviary, home to nearly 300 brightly colored Australian birds. Entry into the aviary is free with regular Zoo admission, and guests may purchase feed sticks (2 tokens per feed stick) to enhance their experience.

The Budgie Walkabout is the final project from the Zoo’s first set of capital developments, which includes the Engelbrecht Carousel and Koch Family Event Lodge. The Evansville Zoological Society has launched its second round of fund development for the Zoo’s next endeavor, Penguins of Patagonia.

Father Convicted Of Murdering Children’s Mother Denied TPR Appeal

An imprisoned father who murdered the mother of his children and burned down her home lost his appeal of the termination of his parental rights after an appellate court concluded that the children were better off out of his care.

In September 2016, minor children S.K. Jr., E.K. and M.K. were removed from their father’s care and adjudicated children in need of services after father S.K. was arrested and charged with murdering their mother and burning down her house. He was ultimately convicted of the crimes and sentenced in January 2018 to an aggregate 65 years in prison.

A trial court soon after concluded that efforts to reunify S.K. with his children were no longer necessary pursuant to Indiana Code section 31-34-21-5.6, and DCS filed petitions to involuntarily terminate his parental rights.

The children, who are intended to be adopted by their maternal grandmother, had already been twice removed from their parents’ care and adjudicated as CHINS when S.K. was issued a no-contact order in 2011 and again in April 2016, after he was charged with battery of their mother resulting in bodily injury.

After his murder conviction, Warren Circuit Court concluded that S.K did not have the ability to care for his children and that any sort of visitation or reunification with him would only further traumatize the kids. It also ruled that the reasons for their placement outside of S.K.’s care would not be remedied, and that the termination of his parental rights was in the children’s best interest.

S.K. appealed, arguing an abuse of discretion occurred in allowing the children’s therapist to testify concerning statements they made during therapy, that DCS failed to prove it made reasonable reunification efforts, and that the termination order lacked sufficient evidence.

The Indiana Court of Appeals rejected all of S.K.’s claims in In re the Termination of the Parent-Child Relationship of S.K., E.K., and M.K. (Minor Children), and S.K., Sr. (Father) v. Indiana Department of Child Services, 18A-JT-2200, first finding that there was no inadmissible hearsay in the therapist’s testimony of the children’s fear of and anger with S.K.

Those statements — which would be harmless even if admitted hearsay — were based primarily on the therapist’s observations of the children and the statements made to her during therapy, as well as the treatment plan and the children’s therapy goals, the appellate court concluded.

It further found DCS’s failure to offer reunification services for S.K. and the children was not a violation of his due process rights based on his incarceration, lengthy sentence and the fact that he killed their mother.

Lastly, the appellate court found there was sufficient evidence to support the termination of S.K.’s parental rights. It therefore concluded that termination was in the children’s best interests and was supported by the opinions of their therapist and DCS service providers.

“In this case, Father destroyed his relationship with his children when he murdered their mother and burned down their home. Father caused significant harm and trauma to his children,” Judge Paul D. Mathias wrote. “Even considering the possibility that Father’s convictions might eventually be reversed on appeal, the children require stability immediately. They have suffered long enough.”

Braun Introduce Bipartisan Legislation to Require Warning Labels On Addictive Prescriptions

WASHINGTON – Senators Edward J. Markey (D-Mass.) and Mike Braun (R-Ind.) today introduced two pieces of bipartisan legislation to help combat the opioid epidemic. The first bill, the Lessening Addiction By Enhancing Labeling (LABEL) Opioids Act, calls for labeling prescription opioid bottles with a consistent, clear, and concise warning that opioids may cause dependence, addiction, or overdose.

The second piece of legislation, the Safe Prescribing of Controlled Substances Act, requires any prescriber of opioid medication to undergo mandatory education on safe prescribing practices. Specifically, it requires all prescribers that are applying for a federal license to prescribe controlled substances, such as prescription painkillers, complete mandatory education that will help encourage responsible prescribing practices. “The path from one bottle of prescription painkillers to addiction needs as many barriers as possible,” said Senator Markey.“We need to ensure that anyone signing a prescription for opioid painkillers understands the full impact that prescription may have on the life of a patient. And then we need to put labels on those prescriptions to caution patients about the dangers of prescription opioids.
Our country is drowning in too many super-charged prescription painkillers, and our families are paying the price with addiction and overdoses. We need to stop opioid abuse and addiction before it takes hold, and these two bills will help doctors and patients make responsible decisions
“President Trump has declared the opioid a national emergency, he has secured $6 billion in new funding to combat the opioid crisis and these two bills will provide him with two additional solutions to fixing this crisis by requiring prescription opioid bottles with a concise warning labels, while also requiring mandatory education that will help encourage responsible prescribing practices,” said Senator Braun.

AG Curtis Hill Warns Hoosiers And visitors To Be Wary Of Scams While Traveling In Indiana

Attorney General Curtis Hill today warned Hoosiers and visitors in Indiana to be on the lookout for scams targeting house rentals this Memorial Day Weekend and during the week of the Indianapolis 500 race.

The Consumer Protection Division is encouraging vigilance by renters, homeowners and those purchasing tickets to the Indy 500 race.

Attorney General Hill urged those attending the Indy 500 to be on alert for fraudulent tickets and other scams related to race weekend. High-profile sporting events are prime targets for scammers.

Here are some tips on avoiding ticket scams:

  • Buy tickets from a trusted vendor or the official website.
  • Only use a credit card to purchase tickets; never use cash or wire money for tickets you’ve found online.
  • Be wary of advertisements with extremely discounted prices. If it seems too good to be true, it probably is.

In addition to ticket scams, those traveling in Indiana should be aware of fake rental listings and always consult Google maps and images to confirm that the rental property you are booking really looks like the photos posted online.

Anyone looking to rent their properties on Memorial Day Weekend should also be on the lookout for scams. The counterfeit check scam is among the most common reported to the CPD. Scammers might contact the homeowner acting as a prospective renter and offer to pay above the listing price, asking the homeowner to transfer any excess amount to a third party. These scammers will provide a counterfeit check, defrauding the homeowner if they agree to forward the excess funds.

The Consumer Protection Division encourages homeowners and prospective renters to follow these steps to avoid rental scams:

  • Pay by credit card for all online transactions. If the listing is fake, you can file a dispute with your credit card provider and receive a refund within 90 days.
  • Do not open links taking you outside websites you know to be legitimate. Scammers will often email links with payment instructions that take you outside of the payment services of legitimate websites with which you are familiar. This is a phishing attempt to steal credit card information.
  • Never pay with gift cards or wire transfers.
  • Search the images of posted rentals on http://images.google.com by clicking the camera icon in the search bar and then pasting the URL of the posted rental image into the search box. Results showing a listing for the same property with a different address may indicate a scam.

Communities Encouraged To Celebrate Downtown Development Week

Lt. Governor Suzanne Crouch and the Indiana Office of Community and Rural Affairs are now accepting applications from rural communities who want to celebrate the second annual Downtown Development Week.

“Visiting downtowns last year during the first-ever Downtown Development Week really highlighted the work that these communities are putting into their main streets,” Crouch said. “I encourage all cities and towns to apply for this grant, as well as participate in October.”

Downtown Development Week is an opportunity for communities across the state to host events and activities within their downtown and commercial districts, spurring economic development and showcasing updates they have made on the downtown spaces. This year, the week will run from Oct. 7 – 12, 2019.

To help provide for a planned event or activity, OCRA will be awarding up to five Downtown Development Week promotion grants of up to $1,000 per application and a 50 percent in-kind or cash match is required. Additionally, the event or activity must take place during the week of Oct. 7–12, 2019, in the community’s downtown area and be open to the public. Applicants are encouraged to contact their respective community liaison to discuss project eligibility and competitiveness.

“With this grant, we want to help with the funding barrier communities often face when planning a special downtown event or activity,” said Jodi Golden, Executive Director of OCRA. “Last year’s events provided a special experience for attendees during the week, so we’re excited to receive new ideas this year.”

Senator Braun & Senator Sinema Introduce ‘Consider Teachers Act’

Following National Teacher Appreciation Week, Senator Mike Braun and Senator Kyrsten Sinema have introduced a bill aimed at fixing a broken system burdening teachers with unfair loans: the Consider Teachers Act of 2019.

The TEACH Grant program provides grant assistance to students who serve four years as a full time teacher in high-need, often underserved communities. However, often due to basic clerical mistakes, thousands of teachers have found their grants converted into loans that must be paid back with interest. The Consider Teachers Act aims to fix this broken system permanently.

“The TEACH grant is an important program to incentivize teachers to serve in neglected communities, but 12 years of poor government management has turned these grants into groans for thousands of teachers,” said Senator Braun. “To show our appreciation for America’s great teachers, let’s get off the sidelines and fix this broken system once and for all.” 

“Arizona teachers use TEACH grants to serve Arizona families in low-income schools. The government made a promise to those teachers, and our commonsense bill ensures the government honors its obligation,” said Senator Sinema.

Aces begin final week of regular season on the road against Belmont

With an emotional series victory over Missouri State in the rear-view mirror, the University of Evansville baseball team hits the road to wrap up the regular season beginning Tuesday evening in Nashville, Tennessee for a non-conference match-up with Belmont.

These two teams were slated to face off in Evansville on May 1, only to have weather washout that contest.

The Aces roll into the Music City having recovered from a four-game downturn by taking two of three games from MSU, and sport a 23-24 overall record. Meanwhile, the Bruins have dropped five of their last six games, including back to back series losses to Southeast Missouri and Mercer, and come into tonight with a 24-26 mark.
