U.S. Senator Mike Braun (R-IN) Introduces Reforming Qualified Immunity Act

The vast majority of our law enforcement officers conduct themselves beyond reproach as they execute their duties. Unfortunately, the current interpretation of qualified immunity allows law enforcement in many of the high-profile excessive force and abuse of power cases to avoid civil suits from citizens seeking redress for violation of their legal rights.  

Due to the judicial branch’s overreach of power, government employees have access to an overly broad qualified immunity defense in which protection is extended to those acting under the color of the law, even when they commit egregious acts which deprive fellow citizens of their constitutional and statutory rights.

While qualified immunity originally was intended to defend government employees acting with good faith, the doctrine has expanded to protect those acting well-outside the law if the allegedly deprived right has not yet been “clearly established” in the relevant jurisdiction.

The modern doctrine of qualified immunity has been used to protect law enforcement officers who:

  • Assaulted and consequently broke the collarbone of an unarmed and nonviolent woman.
  • Released a police dog on an unarmed person who had surrendered.

The Reforming Qualified Immunity Act re-instates the original qualified immunity standard. Government employees, including law enforcement officers, would be permitted to claim qualified immunity when sued under 42 U.S.C. § 1983 only when:

  • The conduct alleged to be unlawful had previously been authorized or required by federal or state statute or regulation.
  • A court had found that alleged unlawful conduct was consistent with the Constitution and federal laws.

The bill would also permit a right of action against localities and municipalities under 42 U.S.C. § 1983, ensuring that towns and cities are held accountable for the actions of their employees.

This legislation would permit law enforcement officers who act in accordance with the law as ordained by courts and state or federal legislatures the defense they need to perform their jobs adequately and effectively while removing misguided protection that has been extended to those who act under the color of the law to illegally deprive citizens of the rights, privileges, and immunities secured by the Constitution and our country’s laws.

Additionally, Supreme Court Justice Clarence Thomas and Justice Sonia Sotomayor have explicitly called for the Court to revisit and re-examine the modern doctrine of qualified immunity, the Supreme Court continues to deny review and two days ago Thomas said, “There is likely no basis for the objective inquiry into clearly established law that our modern cases prescribe. Leading treatises from the second half of the 19th century and case law until the 1980s contain no support for this ‘clearly established law’ test.”  If the Court will not correct their wrong, it is up to Congress to re-affirm its intent in the application of 42 U.S.C. § 1983.

“Without any direction from Congress, our judicial branch has unilaterally created and defined qualified immunity. It’s time Congress does their job to establish a qualified immunity law that defends law enforcement while protecting the rights of the people,” said U.S. Senator Mike Braun. “To claim qualified immunity under the Reforming Qualified Immunity Act, a government employee such as a police officer would have to prove that there was a statute or court case in the relevant jurisdiction showing his or her conduct was authorized: a meaningful change that will help law enforcement and the citizens they protect.”

Sullivan: Hoosier Drivers Must Put Down Their Phones While Driving Beginning July 1

Starting July 1, Hoosiers cannot hold handheld cell phones or other electronic devices while driving unless calling 911, according to State Rep. Holli Sullivan (R-Evansville).

Sullivan, who authored the new law, said using hands-free and voice-operated technology like Bluetooth and speakerphone, and having phones mounted on a window or dashboard is still allowed.

“We need a cultural shift in order to stop crashes caused by distracted driving,” said Sullivan, chair of the House Roads and Transportation Committee. “Indiana will be a safer place for everyone if we all put our phones down and focus on driving.”

Currently, Indiana only bans texting while driving, which includes using email. During the 2020 legislative session, law enforcement officials cited the challenges they faced enforcing the law as it is difficult to distinguish texting and emailing over any other cell phone activity.

The National Highway Traffic Safety Administration estimates that about nine Americans die and 1,000 crashes occur each day as a result of a distracted driver.

On July 1, Indiana will join 21 other states with similar hands-free laws, a step supported by the Indiana State Police. By their estimates, roughly 130 lives could be saved each year due to this new law.

Sullivan said under the state’s new hands-free law, those in violation face a Class C driving infraction.

She said the executive branch has committed to a comprehensive and statewide educational campaign to inform Hoosiers about this new law. Those ticketed before July 1, 2021, will not receive points on their license as drivers use this period to adjust to the new restriction.

Virtual State Convention –
 Last Thursday, June 18, approximately 40 people attended the VCRP viewing of the first Virtual Republican State Convention.  Attendees watched the live-streamed event while enjoying pizza and light refreshments. Indiana Governor Eric Holcomb delivered the Convention’s Keynote address, while State Republican Chairman Kyle Hupfer served as emcee.  Lt Governor Suzanne Crouch joined the convention from her home in Evansville and spoke of Republican values, the achievements of the last four years, and the promise of the future.  Evansville was also well represented on the Women in the Republican Party discussion panel by State District 78 Representative (and Indiana Republican Vice-Chair) Holli Sullivan, and on the Diversity discussion panel by Alfonso Vidal, President of Vidal Plastics.
Of particular interest to the local gathering was the State Attorney General race.  Delegates listened intently to the arguments made by Nate Harter, Curtis Hill, Todd Rokita, and John Westercamp as to why they would make the best Attorney General nominee. Following the completion of the Convention broadcast a Straw Poll of the Delegates in attendance was taken. While the ballots were being counted, VCRP Chairman Wayne Parke opened the floor to opinions and comments on the Attorney General contest. After a brief, but robust discussion on the merits of the AG Candidates, the results of the Straw Poll were provided to the group.

Scholarship available to seventh, eighth grade students :

Hoosier students completing eighth grade must sign up for the 21st Century Scholarshipprogram by June 30. The scholarship provides eligible students up to four years of undergraduate tuition at public colleges or universities in Indiana. As college tuition rises, this program is an opportunity for many young Hoosiers to afford a college education and achieve their career goals.

Families must meet certain income eligibility guidelines and requirements to qualify for the scholarship. Academically, scholars must also earn an overall high school grade point average of 2.5 on a 4.0 scale and graduate with at least a Core 40 diploma.

Those heading into seventh and eighth grade can apply now, but once in high school, students are no longer eligible to apply. Certain exceptions are made for students in foster care. With the deadline quickly approaching, those who want to save on college costs should apply now. Click here to get started.
Indiana’s Reserves are Protecting K-12 Education from Budget Cuts :  (from 06/19/20 News Update)

The COVID-19 pandemic has had a tremendous impact on our state in many ways. Like the rest of the nation, Indiana’s economy is taking a big hit, and the governor has ordered most state agencies to hold back 15% of their funding for next year. In addition, funding for our higher education state institutions will see about a 7% holdback.

Despite these budget challenges, Indiana’s years of building up “rainy day” reserves means that

we will be able to fully fund K-12 as planned as the upcoming school year begins, though the long-term budget situation is largely dependent upon the performance of the economy moving forward.

In our most recent state budget, I supported a $763 million increase in K-12 funding. With K-12 funding making up half of our General Fund expenses, sparing K-12 schools from budget holdbacks truly demonstrates where Indiana’s priorities lie.

Further, with many schools looking to implement a virtual learning option for those students who would have otherwise attended school in person if not for the unknowns surrounding the coronavirus, I’m pleased to see the governor and legislative fiscal leaders say that they intend to fully fund those students, rather than counting them as virtual students, which are funded at a lower amount. This will also give schools more budget certainty so they are able to continue providing our kids with a great education, regardless of the current difficult circumstances.

Our schools play such an important part in our communities and state, and I’m pleased to know that the plan is to continue ahead and fully fund schools for the upcoming school year.
Last week Indiana Governor Eric Holcomb announced that Indiana will move forward with the planned $183 million increase in K-12 funding.  Watch Governor Holcomb’s announcement HERE.

Indy Lawyers For Black Lives’ ‘Call To Action’ Brings Solidarity

Eyes and ears of those gathered on the Indiana University Robert H. McKinney School of Law lawn Friday were trained on members of the Indianapolis legal community calling for action to push for racial equality.

Indianapolis lawyers Shelley Jackson of Krieg DeVault and Tonya Bond and Ryan Leagre of Plews Shadley Racher & Braun formed the Indy Lawyers for Black Lives organization after pondering the important role attorneys play in fighting systemic racism and racial injustice.

The question of “What can we do?” gave rise to the new organization, the lawyers said. In just two weeks with instantaneous help from the legal community, the three attorneys organized Friday’s “Call to Action” to highlight the role lawyers can play in the push for racial equality.

Indy Lawyers for Black Lives hosted a Juneteenth event Friday afternoon on the north lawn of the law school, providing a space for members of the legal community to mobilize, unite and gather in solidarity for black lives.

Law students, law school professors, attorneys, and families gathered on the lawn together, solidifying Jackson’s statement that the Indianapolis legal community cares and is supportive of one another.

“We knew we had this strong community and we knew we had to get uncomfortable and do things that are scary,” Jackson said to the crowd before her. “Planning this was scary, and I wouldn’t have it any other way.”

The event featured speakers from the law school, the Marion County Bar Association, and private practitioners, as well as Indiana Supreme Court Justice Steven David. Each speaker made specific “asks” of attendees, noting that the real work begins after the event ends.

Indianapolis attorney Mark Nicholson challenged the legal community not only to speak up but continue to put action to words and show up. He urged people to speak up and show up when they see a travesty of justice and to be a voice for the voiceless.

“After 155 years of being told we were free, all black lives still don’t matter in America. But seeing all of you here today, I am confident that back lives will matter, they do matter, here and everywhere,” Nicholson said.

Attorney Howard Stevenson said his hope is for a collective, comprehensive representation of lawyers to confront systemic racism and social injustice.

“We are here to say that Indy lawyers are for Black lives,” Stevenson said. “My ask for you today is that we as lawyers utilize what we have been given in terms of our practice of law in order to mentor minority and black students coming after us.”

“For many of us black people, we came to law school to make a difference because it is a duty we owe our communities that still are not free,” said IU McKinney Student Bar Association president and 3L Bre Robinson. “The easy answer you can do here today is to help black students get into law schools, mentor us, share your connections, and hire us to your firms. But that answer is too easy because, in order to dismantle systemic racism, we must do more.

“As lawyers, we have the power to truly help people and make a change in this country.

We could begin to establish a city of equity with the power and knowledge and intelligence here today, but the reality is that it takes work,” Robinson said. “This is movement, not a moment.”

Project NextDOR Update: Moving to INTIME

Project NextDOR launches the second of four phases on Sept. 8, 2020. What does that mean for you? The biggest impact will be for business customers who pay sales and withholding taxes because they will have to register with the new e-services portal, INTIME.

New Business Customers
After registering with the Secretary of State through INBiz, new business customers will be required to create an INTIME account to securely manage, file and pay their sales and withholding taxes.

Existing Business Customers
Since INtax is moving to INTIME, existing INtax customers will need to migrate their accounts to INTIME as early as Sept. 8 in order to file their business sales and withholding taxes, and continue securely managing their accounts online.

Tax Practitioners
Beginning Sept. 8, practitioners will be able to register with INTIME and import client lists from INtax using a special migration code.

AG Curtis Hill Asks Congressional Leaders To Support Law Enforcement Amid Anti-Police Rhetoric

Attorney General Curtis Hill this week called on congressional leaders to assist in tempering anti-police rhetoric that is endangering officers across the United States.

Attorney General Hill, along with 10 other attorneys general and two sheriffs associations, asked congressional leadersin a letter this week to discourage dangerous disinformation and help restore Americans’ faith in law enforcement nationwide. The letter was sent to House Speaker Nancy Pelosi, Senate Majority Leader Mitch McConnell, Senate Minority Leader Chuck Schumer, and House Minority Leader Kevin McCarthy.

“The tragic and preventable death of George Floyd at the hands of four Minneapolis police officers shined a national spotlight on bad actors within the law enforcement profession,” the letter states. “At the same time, data simply does not support claims that law enforcement is systemically racist or structurally biased.”

Last year, 1,004 civilians were fatally shot by police officers in the United States. The vast majority of those shootings were justifiable, and most involved armed or dangerous individuals, the letter states.

There were nine fatal police shootings of unarmed black people last year. Those deaths represented 0.1% of all black homicide victims in 2019, the letter states. There were also 19 fatal shootings of unarmed white individuals.

Despite this data, radical calls to “defund the police” have grown louder and received support from members of Congress since Floyd’s horrific death. The idea that Americans would be safer with less law enforcement is nonsensical, Attorney General Hill said, and would only lead to increased crime.

“The four officers responsible for George Floyd’s death showed the world that they were unworthy of the badge. But their actions are not representative of the hundreds of thousands of officers who honorably serve and protect Americans every day,” Attorney General Hill said. “We must always strive to improve our policing efforts, but at the end of the day, Americans need police officers. And right now, police officers need our support.”
