EPA Takes Important Step to Advance PFAS Strategic Roadmap, Requests Public Input and Data to Inform Potential Future Regulations under CERCLA

0

WASHINGTON (April 13, 2023) — Today, the U.S. Environmental Protection Agency (EPA) is issuing an Advance Notice of Proposed Rulemaking (ANPRM) asking the public for input regarding potential future hazardous substance designations of per- and polyfluoroalkyl substances (PFAS) under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), also known as “Superfund.”

“Today’s announcement highlights EPA’s commitment to transparency and the use of the best available science to tackle PFAS pollution and protect people from exposure to these forever chemicals,” said Barry N. Breen, Acting Assistant Administrator for EPA’s Office of Land and Emergency Management. “This is a key commitment under the Agency’s PFAS Strategic Roadmap and will provide an opportunity for a large and diverse group of stakeholders, including the public, state and local governments, Tribes, industry, businesses, environmental groups, and universities, to provide input and help EPA gather the latest science and information regarding PFAS.”

This request for input and information follows EPA’s September 2022 proposed rule to designate two PFAS — perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS), and their salts and structural isomers — as hazardous substances under CERCLA. EPA is currently reviewing comments received on this proposed rule.

Through this ANPRM, EPA is seeking input on whether to propose to designate additional PFAS, including HFPO-DA, sometimes called GenX, and compounds that degrade in the environment by processes such as biodegradation, photolysis, and hydrolysis, to form certain PFAS. EPA is also seeking information on whether some PFAS compounds can or should be designated as a group or category.

PFAS can accumulate and persist in the human body for long periods of time and evidence from laboratory animal and human epidemiology studies indicates that exposure to these compounds may lead to cancer, reproductive, developmental, cardiovascular, liver, and immunological effects. Many known and potential sources of PFAS contamination are near communities already overburdened with pollution.

A Federal Register Notice has been published in the Federal Register at docket EPA-HQ-OLEM-2022-0922 and can be viewed on www.regulations.gov. The ANPRM will be open for a 60-day comment period through June 12, 2023.

EPA intends to carefully review all the comments and information received in response to this ANPRM.

An agency may publish an ANPRM in the Federal Register to seek input and obtain more information. If EPA decides to move forward with designating additional PFAS compounds as hazardous substances under CERCLA, the agency will publish a proposed rule and seek public comment.

EPA is not reopening or otherwise proposing to modify any existing regulations through this ANPRM.

Under the Roadmap, EPA is working across its programs and with its federal partners across the Biden-Harris Administration to develop solutions to the PFAS crisis and protect public health

UE looks for third MVC series win in a row

EVANSVILLE, Ind. – With victories in the last two weekend Missouri Valley Conference series, the University of Evansville softball team looks to build on the momentum with a 3-game road series at Murray State.  Games will take place Friday through Sunday in Murray, Ky.  ESPN3 and ESPN+ will have coverage of the three games.
Looking at the Match-up
– This weekend will mark the first time the Purple Aces and Racers will meet up as members of the MVC
– It will mark the first meeting between the squads since 2016 when they split a doubleheader in Murray; in 2015, the Racers took both ends of a doubleheader at Cooper Stadium
– Evansville took part in MSU’s non-conference Racer Classic in 2018 and 2022 but did not face the Racers in either season
Last Time Out
– Mikayla Jolly tossed five shutout innings while Alexa Davis hit a 2-run double in the sixth inning to seal a 2-0 win at Indiana State on Tuesday
– Jolly earned her fourth victory of 2023 while Erin Kleffman added two scoreless frames to earn her first save of the season
– With two outs in the top of the 6th, Davis drove in the only two runs of the game to give UE its first Valley road win of the season
Making a Statement
– Sydney Weatherford played a pivotal role in UE’s series win over Southern Illinois last weekend
– The sophomore earned two victories as she pitched a total of 10 innings and allowed three runs, two being earned
– With a season ERA of 2.68, Weatherford is 10th in the MVC; in conference games, she has recorded an ERA of just 1.24
– Over her last 40 1/3 innings of work, Weatherford has allowed just seven earned runs while lowering her season ERA to 2.68
– After allowing five runs in 2/3 inning against Indiana on March 11, her ERA rose to 5.33; in total, Weatherford gave up 17 earned runs in her first 22 1/3 innings of 2023
Leading the League
– In the weekend series versus Southern Illinois, Megan Brenton racked up two more saves to improve her conference-leading total to five
– Her ERA of 1.11 continues to pace the conference while her opponent batting average of .188 is 5th in the league
– Brenton registered the save in both wins over the Salukis, combining to toss four shutout frames while giving up two hits and one walk while striking out four batters
– In 50 2/3 innings of work in 2023, Brenton has allowed 12 runs, just eight of which have been earned
– Brenton has fanned 50 batters while walking 33
Taking Control
– One of Evansville’s biggest wins of 2023 saw Jess Willsey take over with her performance at the plate
– In game two against Southern Illinois, Willsey was a perfect 3-3 with four RBI in a 4-0 win for the Aces; the win came less than a day after SIU opened the series with a 17-1 victory
– Her season batting average of .274 has risen greatly over the last three weeks as she is batting .359 (14-39) since March 19
– Willsey is tied for 7th n the MVC with two triples and is tied for 8th with five homers
– Her RBI single against Belmont on April 2 proved to be the game-winner and on April 4 at Indiana State, she hit a solo home run in the 9th inning that temporarily gave UE the lead
– Willsey has five home runs on the season, which leads the UE squad

Local road projects receive state funding boost

STATEHOUSE (April 13, 2023) – Vanderburgh County and the city of Evansville are set to receive over $1 million to complete much-needed road projects, according to area legislators.

Funding is available through the state’s Community Crossings Matching Grant Program, which can be used for road and bridge preservation, road reconstruction, intersection improvements and other items. In total, 224 towns, cities and counties will receive over $133.4 million in state matching grants.

“This program allows communities large and small to address their immediate infrastructure needs and make plans for future projects,” said State Rep. Wendy McNamara (R-Evansville). “These grants allow local governments to improve the lives of residents across our area, and I’m excited to see more improvements coming our way.”

Area grant recipients include Vanderburgh County ($590,023) Evansville ($493,462).

“Indiana’s fiscal strength continues to give us opportunities to improve our overall quality of life and bolster our economy,” said State Rep. Tim O’Brien (R-Evansville). “It’s great to see our local communities continue to compete for and receive these grants.”

To qualify for the competitive grant, smaller municipalities provide a 25 percent match in local funds, while large communities provide a 50 percent match. State law requires 50 percent of the available matching funds be awarded annually to communities within counties with a population of 50,000 or fewer. Since 2016, Community Crossings has awarded more than $1.27 billion to improve local roads and bridges.

“Investments in infrastructure are critical to helping our communities thrive,” said State Rep. Matt Hostettler (R-Patoka). “This program is a great example of state and local governments working together to ensure our roads are maintained.”

A list of all communities receiving matching funds in the latest round is available here. Visit in.gov/indot/communitycrossings to learn more about the Community Crossings Matching Grant Program and the next call for projects opening in July.

Multiple Agencies Respond to Overnight Standoff with Barricaded Gunman in Kendallville

(Kendallville, IN) At roughly 7:30 pm yesterday evening, the Kendallville Police received a report of shots being fired at an apartment complex on Berry Lane near Drake Road on the south side of Kendallville. Officers from KPD and ISP responded immediately, and upon their arrival, an unidentified male suspect began shooting at them from a second-story apartment balcony at 645 Berry Lane.  There was an exchange of gunfire between the suspect and the officers.  The suspect retreated into the apartment and continued firing multiple rounds at officers from inside the apartment.

Numerous officers from multiple agencies continued responding to the scene and were met with continuous and indiscriminate gunfire.   SWAT personnel and armored vehicle assets from the ISP, Auburn PD, Allen County PD, and Fort Wayne PD, along with FWPD’s Air Support Unit responded to the scene to provide a coordinated tactical response. Once armored vehicles were on the scene, officers were able to begin systematically evacuating the adjoining apartments and the neighboring apartment buildings, and then moving those residents to safety.

During the standoff, attempts to establish a line of communication with the suspect were unsuccessful, and the suspect never responded to officers’ loudspeaker (PA) announcements and commands.

At approximately 6:05 am, nearly eleven hours after the incident began, SWAT officers made entry into the apartment.  The suspect was taken into custody without further incident.  He was found suffering from an injury, but the extent of the injury was not known.  He was immediately attended to by on-scene paramedics, however, all life-saving measures were unsuccessful.  He succumbed to his injuries and was pronounced dead at the scene.

Moving forward, the Indiana State Police will be the primary investigating agency.  Although the immediate incident has been resolved, this is an active ongoing criminal investigation.  Currently, there is no further information to release.  Once the Noble County Coroner has confirmed the identification of the suspect, an update to this release will be sent out.

When the investigation has concluded the full report will be turned over to the Noble Count Prosecutor for review.

At the time of this release, residents of Drake Terrace Apartments and surrounding homes were being allowed to return to their homes.
