IS IT TRUE the EPD activity report for yesterday is a whopping sixteen pages long?…that the summer of 2012 continues to be a summer of lawlessness in the City of Evansville with more and more crimes being committed?…that fortunately for some but unfortunately for others the crime locations are staying the same subjecting roughly 40% of the City of Evansville to Detroit style crime rates while the remaining 60% is more like a middle class law abiding city?…that how on earth people can find the energy to commit crimes with the temperature at 106 degrees in the Midwestern humidity is beyond comprehension?

IS IT TRUE the United States Supreme Court found a way to uphold the implementation of ObamaCare while declaring the purchase mandate to be unconstitutional?…the way Chief Justice Roberts did this was to declare that Congress has the power to tax and that the roughly $2,000 per year that each person will now owe in taxes for healthcare REALLY IS A TAX?…that the City County Observer published this very argument yesterday before the ruling?…that Justice Roberts had the legal brilliance to find a way to clarify the truth about this TAX and set the stage for an election where we finally have found a difference in the two candidates?…that there will be no more of the statements saying that President Obama and Mitt Romney are two peas in a pod because now a sharp line of distinction is drawn between them?…that two days ago this election was about the President’s performance on the economy and Romney’s criticism of that performance?…today the 2012 Presidential election is about ObamaCare first and the floundering economy second?…that for the first time since 1984 the choices are pretty darn clear and based on simple and easy to understand issues?

IS IT TRUE President Obama said time and again that Obamacare was not a tax?…Justice Roberts took him to school yesterday and declared that the only way this is legal is because it is a tax?…the Chief Justice in a very elegant way repudiated the method by which the Congress and the President “sold” Obamacare to the nation as essentially unconstitutional and fraudulent?…in reality Obamacare is a flat FEE for healthcare that is to be paid annually to the IRS for the privilege living here of roughly $2,000 each?…this is the FAIREST AND LEAST PROGRESSIVE TAX we shall ever see?… Warren Buffet pays $2,000 and so does the poorest of the poor?…we should all say thank you President Obama for sneaking through the fairest TAX that has been passed in the history of the USA?…that this writer’s Cadillac $18,000 per year family policy shall be replaced in 2014 with my decision to elect to pay the $2,000 TAX and take advantage of this wonderful opportunity to save $16,000?…that many people and businesses will do the same throwing the new healthcare funding system into chaos?

IS IT TRUE that all local governments derive their power from two sources?…that the first source as is well known is the power of the budget that in the case of Evansville resides with the City Council?…the other source of power wielded by Mayors across the country is the power to appoint cronies and buddies to do their bidding on public boards?…that one can usually judge a Chief Executive by their appointments?…that the CCO will publish a detailed list in a couple of days of all of the appointments of Mayor Winnecke that we obtained through the Freedom of Information Act?

  1. Is it true that the public mandate part of the Affordable Healthcare Act WAS NOT declared unconstitutional? That the public mandate was declared constitutional under the provisions that allow Congress to tax? That the Affordable Healthcare Act WILL NOT add $2,000 to the tax load of every American taxpayer? Rather that the penalty (ruled to be a tax by SCOTUS) will be assessed thru the IRS only to those individual taxpayers who can afford to purchase health insurance but who choose not to purchase health insurance? Is it true that anyone who misrepresents the facts of the ruling is only repeating the babbling talking points of Tea Party Republican propagandists?

    • That is not true. Government mandating of people to make commercial purchases was indeed struck down under the commerce clause as unconstitutional. The Chief Justice then declared the $2,000 to be a TAX and since congress can tax for the general welfare it was allowed to stand but only as a TAX. Fortunately, the government under this ruling will never be able to mandate a commercial purchase and there is now a Supreme Court precedent to keep them from trying. Next time they want to pull a stunt like this they will have to be honest and call a TAX A TAX. If the Supreme Court had ruled in favor of using the commerce clause to force people to buy things you may be dealing with a mandate to buy Idaho potatoes or even a Chevy Volt. Now that will not be happening.

      • So what you’re saying here is Justice Roberts wasn’t a traitor after all, that he used the liberal Justice’s own votes slyly against them to secure a landmark decision against government mandated purchases of private products? Interesting…

        So essentially, in order to repeal obamacare now, we would first have to repeal the 16th Amendment?

        • I think it is good that the ruling on the commerce clause will prevent the government from mandating that we buy turnips or Chevy Volts. Before yesterday that did not have solid precedent. For that ruling I applaud Roberts. As for parsing words and teaching the congress exactly how to force us to buy things that are deemed to be “common welfare” and therefore they can tax us into buying something, he needs his butt kicked.

          On repealing ObamaCare. Our only option at this point is to elect a President and Congress that will repeal it. Otherwise it stands as a $600 Billion per year tax.

          • But in a way, it illustrates the ultimate point that unapportioned taxation on a Federal level should never have been legalized in the first place, and it can be rightly stated that the year the 16th Amendment was passed, 1913, was the beginning of the century long downhill slide for the United States away from the Republic it once was.

            Without the power of unapportioned income taxation granted in the 16th Amendment, we wouldn’t be having fights about the Commerce Clause in the first place because the Federal Government would be a heck of a lot smaller.

      • Is it true that the Editor continues to confuse the two parts of SCOTUS’s ruling on the individual mandate in his attempt to simplify it or reduce it to terms compatible with anti-Obama Tea Party propaganda? That the individual mandate was NOT struck down, rather as Chief Justice Roberts clearly concluded in his opinion, the individual mandate “is not a valid exercise of Congress’s power under the Commerce Clause,” but “may be upheld within the power of Congress under the Taxing Clause?”

        Is it true that the Obama Administration’s lawyers were fully prepared to seek such a ruling, as witnessed when the power to impose the penalty was disallowed under the Commerce Clause, Obama’s law team then asked the Court to rule on the individual mandate as imposed under the Taxing Clause? That the Court then did find in its 5 – 4 decision that the individual mandate stood the constitutional test under the Taxing Clause, so the mandate in fact was not struck down?

        Is it true that in spite of the Editor’s continued insistance that the Affordable Care Act’s penalty/tax provision (to enforce the individual mandate) is $2,000 per person for all Americans, the fact is the flat dollar amount per individual is $95 in 2014; $325 in 2015 and $695 in 2016? That after 2016, the flat dollar amount is indexed to inflation? And that there are several exemptions to the mandate including individuals with a religious conscience exemption, applicable to certain faiths; individuals who cannot afford coverage; individuals with a coverage gap of less than 3 months; individuals in a hardship situation; individuals with income below the tax filing threshold; members of Indian tribes; and some other categories?

        Is it true that opinionating with misinformation reduces the credibility of the present opinion and, if done repeatedly, all future opinions?

        • You are trying your best to make it look like that liar in the White House was truthful. Maybe editor was wrong on the amount of tax but he was right about being unconstitutional on the commerce clause. We got tricked by that liar Obama.

  2. I’m not sure how on earth the editor can surmise that there is any difference between Obama and Romney. The only strength Mitt Romney has is that he’s going to be running against someone who is just slightly more discredited than he. Substantively, there is very little difference between the two. Both are for big government solutions to problems. Neither cares for the Constitution.

    • Is Romney going to pull a magic rabbit out of his hat and bring back all the jobs that he helped to oursource? Sure he was a successful business man, but at the expense of the American worker.

      • The POTUS is NOT “Job Creator in Chief”, contrary to popular belief. The job of President is to command the Armed Forces and to sign bills into Law, or veto them. That’s IT. Period. It should be a pretty easy job on the whole.

        On economic issues, all the President can really do is move troops around, i.e. bring them home from 900 bases worldwide if he chose, and use his veto power on budget bills to wrangle Congress into getting a budget in order that makes sense. But Romney hasn’t made ANY indication he intends to do either of those things.

        He will continue the status quo of going to war and borrowing and spending us into oblivion and using government force as a means of protectionism for his chosen corporations – the same thing Obama has been doing for four years, and the same thing Bush did for eight. It’s no accident their Top 5 campaign contributors look very much the same and include the same big banks like Goldman Sachs who got bailed out.

        Applying the same solution to a problem and expecting a different result is the definition of madness…or stupidity.

    • Romney has stated that he will seek to repeal ObamaCare. Obama of course will not. Before yesterday there were few tangible differences. Today there is one and it is a big one.

      • The Editor is mistakenly under the impression that when politicians like Mitt Romney say they are going to do something, they will actually DO it.

        Just a quick survey of the past should make my point more than adequately. We both know that government has been incrementally shredding the Constitution for 100 years, and Mitt Romney will be no exception to this sad, but all too real truth.

        • Oh no, I know there is potential for a lie every time either one of those rascals opens their mouth. That is why I chose to write “Romney has stated”.

          • Yes, but Romney “states” all kinds of things all the time and renegs on them. His word is as good as dirt, I would submit to you, and doesn’t constitute a tangible “difference” of any kind from Obama, whose own word has also proven to be just as worthless.

            • I have more hope than you do that in this matter he will be truthful. If he lies then it is back to peas in a pod as they were on Wednesday.

          • One thing I’ll give Romney… If I don’t agree with him about something, all I need to do is wait a few days and he’ll change his position.

            I guess the next best thing to having a principled and consistent leader would be to have one so spineless and slippery that no one could get a full grasp on him.

  3. In a video taped interview with George Stephanopoulos, available on youtube.com, President Obama was adamant that requiring people to purchase health insurance was not a tax. Yesterday the Supreme Court of the United States informed the President that it was a tax. That is a FACT.

    • YOU say it is a tax!!! What kind of tax ? how is it applied? How much and to whom? Roberts had to say something when he voted and calling it a “tax” that takes your attention away from him and his vote. Again, I ask you, where is the tax. Can anybody supply me with an answer???????
