The Executive session to oust Evansville City Councilwoman Stephanie Brinkerhoff-Riley  is being question by media law attorney and Indiana Public Access Counselor Luke Britt concerning the open meetings statute  used by the City of Evansville Council is opened to interpretation.  Also the attorney for the Hoosier State Press Association  has a similar interpretation of the closed Executive session to oust Ms. Riley from her Vice Chairman position on the Evansville City Council.

BELOW IS THE PROPOSED AGENDA TO OUST COUNCILWOMAN  RILEY FROM HER VICE CHAIRMAN POSITION ON CITY COUNCIL.

The City Council will hold an Executive Session on Thursday, May 29, 2014, at 12:10 p.m. in Room 301 of the Civic Center Complex, 1 NW Martin Luther King Jr. Blvd., Evansville, Indiana.

This Executive Session will be held for discussion of a member’s alleged misconduct pursuant to Indiana Code 5-14-1.5-6.1(b)(6)(A).

The City Council will hold a Special Meeting on Thursday, May 29, 2014 immediately following the Executive Session in Room 301 of the Civic Center Complex, 1 NW Martin Luther King Jr.

Blvd., Evansville, Indiana to discuss the position of the City Council Vice President.

There will not be a City Council meeting on Monday, June 2, 2014.

The next City Council meeting will be Monday, June 9, 2014 at 5:30 p.m. in Room 301 of the Civic Center Complex, 1 NW Martin Luther King Jr. Blvd., Evansville, Indiana. Committee Meetings will begin at 5:15 p.m.

  1. Got it. So basically Mr. Not My Friend is just wasting everyone’s time then. He should remember what the farmer does to the squawkiest chicken.

    • Good chicken analogy, “lets”!
      Where is Scott Danks in all of this? Maybe he is too busy with the renovation of his great bargain building to render an opinion on this. It seems he was worried about a group of Councilpersons all being in someone’s office at the same time just a few months back.

        Danks acknowledge meeting is about SBR and her VP position in one paragraph.

        In next paragraph, Danks says council members will receive information after doors are closed, but will not reach a conclusion there.

          • it seems that a lot of the problem started when danks and friend took over leadership of the council. there were never any complaints of closed door meetings under Hamilton.

          • John Hamilton is an outstanding attorney. He did a good job and was ethical and honest IMHO. I know him personally and have worked with him on legal matters so I have first hand knowledge of how he works. And from what I saw of him on TV during city council meetings he appeared to be a good attorney. If he didn’t know something he would go find out the information later and come back armed with the new information.

            Another attorney who I use for financial purposes advised me that he would not do a certain thing but advised me that I might go to Woods & Woods or Danks to get that job done. I did hire Woods once but they didn’t get the job done. I ended up going to court on my own and I won. Woods lost out of some money in that case. 🙁

        • Thanks for the info! This whole thing just goes further beyond the pale every minute it lasts. Does anybody know yet how many votes are required for “Fiend” to exact his revenge?
          I figure Fiend, the Beav, and Princess Mosby will definitely vote to remove SBR from the VP position. I’ve heard rumors that Dr. Adams will join them, as he wants to return to a leadership position. That is, I hope, an underestimation of the Dr. and his ethics. I have always thought him to be a much better person than that.
          If the rumor about Dr. Adams is true, that would leave a 5 vote majority in the hands of Dan McGinn. He might be wise to not show up for this meeting, because it would put him in a “no win” position. Afterall, who wants to put himself in the boat with Fiend, Beav, and Missy? The best way I can figure this is that if it takes 6 votes, Fiend’s vendetta will fail, and 5 may be “iffy.”

          • Better question yet is will SBR be allowed to vote on this matter or not? Their must be some rules to follow for these city council public meeting when it comes to voting someone out of an official office. Roberts Rules of Order would seem to me to be the rules to follow but I’m not sure if that the legal standard or not. Surely after this country being around for over 200 years someone has written down the rules of democracy that we should be required to follow according to the laws.

          • moveon you would think so, but something tells me Roberts Rules gets circumvented by codes they slip in when no one’s looking, such as Indiana Code 5-14-1.5-6.1(b)(6)(A).
            Try looking that up in the code book that is thousands of pages long…..

  2. The council is very foolish for doing Winnecke’s bidding and letting him feast on the internecine fighting. A faction with maybe enough numbers is going after someone who tried to shine some light on the city’s financial shape rather than cover it up, as is the norm. They’ve become a gong show, an embarrassment to Evansville and the very concept of an independent city council.

    Looks more and more like some money is missing. I’d watch that SBOA guy Paul Joyce, he was awful quick to call for prosecution of SBR, although no offense requiring any sort of prosecution seems to have occurred. At least on her part. Prosecution is a strong word to use when referring to an infraction that barely rises to the level of a minor traffic ticket. We need more such infractors. The SBOA has missed their chance to issue their audit report in a timely manner. Anything they come up with now will be highly suspect.

    I see where in the Indiana Code that they can go into executive session to discuss employ discipline. Good find!

    I’m use to looking up things in the Code of Federal Register and the Indiana Code. I use to do that for a living for a long time.

  4. Never a fan of city government which seems can morphine into whatever seems fit for the agenda, unlike county government which is run by state statues.

    Appears that a close door meeting with the council president and attorney, with “one” council member
    at a time for “information only” would be the correct way to go.

    Closed door “information” seems unnecessary for the whole group at one time, unless it is being used for a “mob” brow beating with a agenda.

    If one thinks that it is necessary for the “acting” mayor to be 100% cozy with each and every one of the council members should then also would agree that it is not necessary to even have a city council if they are there to rubber stamp and be a boot licker to the acting mayor!

    • good point, since when is it a requirement for the council to have the mayors trust. it should be the other way, if the mayor needs some money, it is up to him to work with the council to try and get it.

    • Serial meetings for a single purpose are a blatant violation of Indiana’s sunshine laws. It happens all of the time in Evansville but it is illegal none the less. Maybe this media circus that Councilman Friend and Scott Danks have orchestrated will be a catalyst to end this good old boy bullshit once and for all.

    • No you got your first sentence wrong. The city council is breaking the law to punish one of its members for breaking a law they wish was real. Such a pack of bitch jackals they are. They are all under the spell of the alpha jackal Mr. Danks who is the real president of the Evansville City Council.

      Ab-so-freaking-loutely! It may be an urban legend about our Fall Festival being the second largest street festival in the US, but this may well be the biggest “jackass festival” in the world.
      The civic leaders want this place to be known for something besides being fat, miserable, and meth-head ridden, and then they do things like this!
