What the Heck is a Memorandum of Understanding

The CCO became curious about why a Memorandum of Understanding was the document chose by the Weinzapfel Administration to put a little paper between the City of Evansville and the Kunkel Group. US Legal provides the following definition which sounds more like a pinky ring relationship than a wedding band.

“A Memorandum of Agreement (“MOA”), also known as a memorandum of understanding, is a formal business document used to outline an agreement made between two separate entities, groups or individuals. A MOA usually precedes a more detailed contract or agreement between the parties. This MOA may be used to cooperatively work together on an agreed upon purpose or meet an agreed objective and outline the discussed terms of a new relationship. The purpose of an MOA is to have a written understanding of the agreement between the parties. A MOA usually precedes a more detailed contract or agreement, after a process of negotiations and due diligence. This MOA provides a simple but effective format to enter into a general agreement prior to finalizing a more detailed contract or agreement with a party.”

  1. What if the MOU was signed on the southeast, SE, side of town ? And what if the lawyer who drew it us was named Mickey ?

    The MOU is often the first stage in the formation of a formal contract. An MOU is far more formal then a handshake and is given weight in a court of law should one party fail to meet the obligations of the memorandum.

  3. In this instance a MOU might involve Prosecutor Nick Hermann calling for a Grand Jury to open an investigation of Malfeasance in Office. A majority of the voters in this town decided that a change of party in the control of the Mayor’s Office was in order. The out-going city administration should wake up and smell the upcoming indictment that might arise on the first business day of the Winnecke Administration if Whiny-Zapple tries to cram one more affront to democracy down the throats of the citizens of Evansville. Whiny has sufficiently enriched himself to the point where another $100,000 or so will not significantly increase his bankroll. The time has come for Whiny-Gravel –Voice to flee to Indy and take a shot in stealing from the taxpayers up there for a change.

    • Dr. John, if you believe that the citizens voted for change just because of party status, you are seriously mistaken. All that happened last month was the people of Evansville said they are too happy with status quo and machine politics to truly change to transparency and honesty. Winnecke is an extension of Weinzapfel, not an option from.
