BREAKING NEWS : Cheryl Musgrave’s Statement on the Misuse of Taxpayer Funds for Political Activities

Evansville, IN- (March 5, 2024) – In a resolute stance against the misuse of taxpayer funds for political activities, Cheryl Musgrave, President of the Vanderburgh County Board of Commissioners, declares: “I will not vote to use taxpayer funds to pay for political activities.  I have been asked to support giving tax dollars to big corporations to fund their political activities. I won’t do it. It is wrong in every way to allow tax dollars to be spent on political candidates for public office or non-partisan candidates such as school board or judicial candidates.  It is wrong to allow direct or indirect use of taxpayer funded staff and equipment to be used for political candidates or purposes.”

The annual Evansville Regional Economic Partnership (“E-REP”) service agreement is an action item on the County Commission Tuesday, March 5, 2024, agenda.

In a time when transparency and accountability are paramount, it is crucial to uphold the integrity of public funds and ensure that they are not diverted towards partisan interests. The trust placed in elected officials to act in the best interests of the public must be honored and using taxpayer money for political purposes undermines this trust.

Musgrave firmly believes that taxpayer funds should be allocated towards essential public services, infrastructure, and programs that benefit the community as a whole, rather than being channeled into political activities that serve the interests of a select few.

As a staunch advocate for fiscal responsibility and ethical governance, Musgrave stands firm in her commitment to uphold the principles of fairness and accountability in the allocation of taxpayer funds.  By refusing to support the use of public money for political activities, Musgrave reaffirms her dedication to serving the public interest above all else.

Background:

The Commissioners have annually supported E-REP with $300,000 taxpayer dollars to be used to support economic development efforts. This year, the Commissioners have been presented with two different versions of the annual agreement with E-REP.

The first version, supported by Commissioner Cheryl Musgrave, prohibits E-REP from engaging in any partisan or non-partisan political activity as follows: “E-REP further agrees that there shall be no partisan or non-partisan political activity whether performed by E-REP or anyone acting on behalf of E-REP while receiving and utilizing taxpayer funds.”

A second version, proposed by E-REP, enables certain partisan and non-partisan political activity as follows: “…via its separate affiliated registered JPAC entity to recruit and endorse candidates for State and Local Offices, but not candidates for County Board of Commissioners, County Council, Mayors or City or Town Fiscal bodies.”

E-REP was created by merging the Evansville Chamber, the Growth Alliance for Greater Evansville, and the Economic Development Coalition.  Assurances were given that the Chamber’s Political Action Committee known as J-PAC would be disbanded and no further activity of this type would take place in the new organization.  The organizers embodied this promise in the E-REP By-Laws, which state:

Section 5.6 Endorsement and Politics.  No individual or agency of this Corporation shall be permitted to use the Corporation in such a way as may be construed to give endorsement to any private or corporate enterprise or promotion for profit.  The name or influence of the Corporation shall not be used directly or indirectly in support of any person who is a candidate for political office.

By-Laws can be changed at any time by the E-REP Board of Directors; by placing the prohibition in the Vanderburgh County Board of Commissioner’s Service Agreement, taxpayer funds are protected from misuse through political activities.

JOHNNY KINCAID IS THE CCO NEW STAFF REPORTER

The City-County Observer is pleased to announce the addition of a new reporter, Johnny Kincaid to our staff.  Kincaid will cover the Evansville City Council, E-REP, and DMD meetings.  He will also cover various events in and around Evansville.

Johnny Kincaid is the former morning radio personality who spent 27 years waking up the good people of the Tri-State. He came to Evansville in 1987 to take on the morning show on WKDQ. When Kincaid added the program director to his job duties, he led the station to ratings success and brought one of the Freedom Festival’s most successful events. The first Mike Harvey sock hop from the Evansville riverfront drew 18,000 fans, establishing an annual tradition of dance parties with Harvey.

During the first Gulf War, Kincaid heard about a giant flag made in Evansville. The Great American Flag was sewn together at Anchor Industries in 1980 and at the time, the 7-ton flag was the largest in the world. The flag had been sitting in a warehouse in the DC area for years until a group that included Kincaid was able to get the flag displayed at the base of the Washington Monument on Flag Day. A busload of Evansville residents went to DC to assist in unfurling the flag.

When KDQ switched from oldies-based to country music, Kincaid moved to 106.1 WJPS. 

Kincaid decided to move away from radio and went to work for the University of Evansville as director of Smokefree Communities and eventually persuaded city and county leaders to adopt a law to eliminate smoking in workplaces.

He left U of E and went back on the radio on 105.3 WJLT. When the Evansville Police launched Coffee with a Cop, Kincaid decided to broadcast the morning show live from the event. He broadcasted from Coffee with a Cop every month. 

After leaving radio, Kincaid was hired by Vincennes University to be an instructor in training classes for corporations. The job morphed into teaching job skills to incarcerated men in Brachville Correctional Facility. He still volunteers for ministry weekends at Wabash Valley Correctional Facility.

Last year, Kincaid decided to enter the world of podcasting with “This Week in Evansville,” a 30-minute weekly show that gives in-depth coverage of the news and interviews with newsmakers. He has recently teamed up with the City-County Observer to post his latest episodes on the CCO webpage. 

Kincaid has a life-long interest in politics. “I voted in my first presidential primary in 1976. I voted for Ronald Regan, who was running against President Gerald Ford.” Kincaid said. As a morning show entertainer, he avoided tipping his hand about his political beliefs and will continue to do so at the City-County Observer.

Captain Robbie Hahn Is Retiring From The EPD After Serving 35 years

Captain Robbie Hahn is retiring from the Evansville Police Department after serving 35 years and 13 days. Hahn started his law enforcement career with the Vanderburgh County Sheriff’s Office for 3 years before getting hired on EPD. Hahn has worn many different hats throughout his many years in law enforcement.
After spending several years in motor patrol, Hahn transferred to the Narcotics Unit. He was fortunate enough to serve as the Drug Detection Canine Handler for 10 years with 2 great dogs, Brodie and Rowdy. His first K9 partner Brodie, died in the line of duty.
Hahn was eventually promoted to the rank of Sergeant and served as a supervisor in both Patrol and Narcotics until he was appointed to Assistant Chief in 2004.
Hahn held the position of Assistant Chief for 8 years. During his time as Assistant Chief, Hahn was one of the founding members of the Evansville Police Foundation and served on the board for several years.
After his time as Assistant Chief, Hahn was promoted to Lieutenant and became the supervisor over Investigations. In 2023, Hahn was promoted to the rank of Captain and was assigned to the Personnel & Training Unit.
Hahn has been a proud member of the West Side Nut Club since 2019. He has spent many hours working at the Fall Festival over the years as a police officer and Nut Clubber!
Hahn will be spending his retirement time with his family and his new dog, Sammy. He also enjoys competing in BBQ contests and plans to spend more time winning! Captain Hahn wanted to extend his thanks to all and said he was able to live his dream.

SERGEANT ANNE GRAY IS TRANSITIONING IN NEW POSITION WITHIN EPD

Good afternoon everyone,

I wanted to let you all know that I am transitioning into a new position within EPD.  I will be heading to the Adult Investigations Unit.  Sergeant Trudy Day will be taking my position as the new PIO.  She will have my work cell (812) 568-9515 and office phone (812) 436-5744.  Her email is tday@evansvillepolice.com.  Officer Taylor Merriss is still the Special Projects Coordinator and will continue to assist with PIO duties as well.

Just to give a little background on Sgt. Day, she has been with EPD for the past 24 years.  Sgt. Day has been a detective in both the Juvenile Investigations Unit and Financial Crimes Unit.  Sgt. Day was promoted to the rank of Sergeant in 2012.  She spent time in Records as the Supervisor and was the EPD Grant Writer. Sgt. Day spent the last 3 years as a Motor Patrol Supervisor for the 3rd shift motor patrol.  Sgt. Day will be shadowing me for the next week and my transfer will likely occur next week. Please add Sgt. Trudy Day to your contact list as she will be the point of contact from this time forward.  It has been a pleasure working with you all in the capacity of my PIO position.  I will still be around to help out when I can and I will likely be assisting with PIO duties when Sgt. Day and Officer Merriss are unavailable.

His warnings would seem appropriate to us Americans today!

In the January 2024 edition of The New Harmony Gazette, two questions were posed to Posey County Prosecutor Thomas Clowers; 1) Has incarcerated murder suspect Austin Kusturin been injured in any way at the Posey County Jail and what is his present state of health? Prosecutor Clowers did not answer that question, he would only describe Publicly Paid Defense Attorney Glenn Gramp’s state of health. 2) Was it a shotgun that was used to kill Elizabeth and John Hall? Prosecutor Clowers flatly refused to answer that question behind Indiana Code 5-14-3-4(b)(1). That same question was posed to Prosecutor Clowers a year before and he didn’t give any answer to it.

Now, I find in the public court record that Mr. Clowers states on February 23, 2024, and requested the following: That in the Court’s (Judge Goedde’s) Preliminary Instructions (To The Proposed Jury) (“To Strike”) No. 9 and No. 10, paragraph 4 of each, that the wording “while (defendant) armed with a deadly weapon and it results in serious bodily injury to a person (Elizabeth and John Hall) other than a defendant” be stricken.

As a Layman observer of the proceedings that have gone on for the past more than two years, I find this development outside my realm of understanding! If this means that the jury is not to be told that the defendant was armed with a deadly weapon, then how was he supposed to have murdered Elizabeth and John Hall, I wondered? It would seem to me that if Austin Kusturin did commit the murders, as he is charged, how did he do it?

Prosecutor Clowers has already offered the defendant several plea deals for Life Without Parole in this case, dropping the Death Penalty threat, on three separate occasions, July 25, 2022, September 14, 2022, and January 18, 2023, without an acknowledgement from the defendant.

And now, it seems, Prosecutor Clowers is asking Judge Goedde to keep the jury uninformed about the use of a deadly weapon. Does he think that can get a conviction on his charge of murder without the jury knowing that the defendant was armed with a deadly weapon, I thought?

If so, and without a deadly weapon, then how did the murder happen? Why did Prosecutor Clowers make such a proposal to the Circuit Court Judge? It looks like we may all have a lot to learn!

I wrote a letter to Prosecutor Clowers regarding my lack of understanding regarding this matter and here is what we said:

Dear Prosecutor Clowers: February 27, 2024 “It has come to my attention that with the upcoming proposed Jury Trial of Austin Kusturin a new development has taken place from your office that I need to clarify before I do my next story on this case. It is always my objective to offer you the opportunity to make a clear statement on any new development before a story is written and published for the public’s perusal.

“I am advised that you have requested from Circuit Court Judge Craig Goedde to “Strike” from the Court’s Preliminary Instructions to the Jury, instructions 9 and 10 of Paragraph 4 of each, that the wording “While Armed with a Deadly Weapon and it results in Serious Bodily Injury to a a person other than the defendant” be made.

“Is it True? Will the jury be denied the information regarding the use of a deadly weapon by the defendant in these two horrendous murders?

“Do you expect to get a murder conviction in this case without the jury knowing how they were slain? “If not a shotgun, then please explain to me how exactly they were killed?”

On February 28, 2024, Prosecutor Clowers responded to my inquiry, he said: From Prosecutor Thomas Clowers, To Dan Barton:

“The changes to the jury instructions you reference will NOT have any impact on what evidence is presented to the jury. The changes simply bring the instructions in conformance with what the law requires.

“The jury will also be instructed on all other charges filed against Mr. Kusturin, including multiple counts of Murder, Burglary, Robbery Resulting in Serious Bodily Injury, Unlawful Possession of a Firearm by a Serious Violent Felon, as well as the following sentence enhancements: Life Without Parole, Habitual Offender and Felony Firearm Enhancement.

“You should review the instructions in their entirety to have a better understanding.”

As this case is still in the pre-trial phase The New Harmony Gazette is taking steps not to

involve Judge Craig Goedde in this discussion, but to simply put before the reading public the

conversation on the matter that took place between Prosecutor Clowers and Publisher Dan

Barton.

After the trial is completed, if it seems necessary, The Gazette will then contact Judge Goedde

for the jury instructions that Prosecutor Clowers refers to. It’s a learning process for most of us,
