McNamara: Bill to reduce court delays due to mental health evals advances to Senate

STATEHOUSE (Feb. 6, 2024) – The Indiana House of Representatives unanimously approved State Rep. Wendy McNamara’s (R-Evansville) legislation aimed at alleviating legal backlogs when it comes to determining a defendant’s competency to stand trial.

“The process of determining an individual’s competency to stand trial is among the top concerns of Indiana’s criminal justice system,” McNamara said. “Often, defendants facing misdemeanors and level 6 felonies spend more time waiting to be deemed ready to face court than they would in jail after sentencing, which not only hurts their chances of rehabilitation, but also bogs down our state’s judicial resources. The goal of my legislation is to speed up the process for the victim and the accused.”

A defendant must be considered competent, or able to understand court proceedings, before a trial begins. Determining a defendant’s competence to stand trial may require multiple mental health examinations, which may be requested by either the defense or the prosecution. According to data collected by the Indiana Supreme Court, for 1,629 competency cases heard in the state between 2018 and 2022, the average time between when a defendant is charged and when a competency hearing is scheduled is 348 days.

“The length of time these defendants, especially those charged with low-level offenses, spend in jail waiting for a hearing is dictated by the availability of qualified mental health professionals,” McNamara said. “This bill will update the competency process and alleviate the burden on our criminal justice system.”

McNamara, chair of the House Committee on Courts and Criminal Code, said House Bill 1238 would streamline the mental health exam requirements to help expedite justice. For Level 6 felonies, which are the lowest, only one competency evaluation would be required instead of two. However, the bill would maintain two to three evaluations for level 1 through level 5 felonies, which are more serious.

Currently, the list of professionals who can determine an individual’s competency are limited to psychiatrists, physicians and psychologists – all professions experiencing workforce shortages. To help, McNamara said her bill would expand the list to include Advanced Practice Registered Nurses with a certification in psychiatric nursing or physician assistants specializing in psychiatry and mental health.

McNamara’s legislation would also allow a court to dismiss criminal charges against an individual if it is determined they would not regain competency, including after six months of mental health treatment. A judge would be allowed to dismiss if the defendant has certain diagnoses impacting their ability to assist with or understand court proceedings, such as Alzheimer’s, dementia, a traumatic brain injury or developmental disability.

The Indiana Prosecuting Attorneys Council, the Indiana Public Defender Council, the Indiana Sheriffs’ Association and the Coalition of Advanced Practice Registered Nurses support the legislation.

WHEN THE MOON EATS THE SUN: ASTRONOMER AND AUTHOR DR. PHIL PLAIT TO PREVIEW THE ECLIPSE IN EVANSVILLE

Evansville, IN – February 5, 2024 – On April 8, 2024, the United States will be treated to one of the rarest and most spectacular of celestial events: a total solar eclipse.  The shadow of the Moon will fall along a narrow path across the US, including right through the Evansville Region, which will enjoy over three minutes of totality.  During that time the sky will grow dark, the stars and planets will come out, birds will stop singing, crickets will chirp, and residents will be able to see the Sun’s corona, its celestial atmosphere normally far too faint to see from Earth.

Dr. Phil Plait, astronomer and science communicator, will visit Myriad Brewing Company in Downtown Evansville on Thursday, February 29 at 6 PM to present how to safely watch this out-of-this-world event, explain the science, and even debunk a misconception or two about eclipses.  The event is free and open to the public.  A question-and-answer session along with a book signing will follow the presentation.

Dr. Plait has given public talks about astronomy and science education at educational institutions of all levels and community events throughout the United States.  His lively and humorous events have, in the past, included balancing eggs on stage and screening clips from blockbuster movies to point out particularly terrible science.

Plait, known as the ‘Bad Astronomer’ online because of his penchant for calling out misinformation, earned his doctorate in astronomy at the University of Virginia, and worked on the Hubble Space Telescope as a NASA contractor at the Goddard Space Flight Center.  He is the author of the books ‘Bad Astronomy’ and ‘Death from The Skies’ and writes the thrice-weekly ‘Bad Astronomy’ newsletter that keeps subscribers apprised of the latest sky news.  He was the head science writer for “Bill Nye Saves the World” on Netflix in 2017.  He wrote and hosted “Crash Course Astronomy”, a 46-part educational web series that has over 85 million views.

Men’s basketball hosts Bradley on Wednesday

 EVANSVILLE, Ind. – After earning its third consecutive Missouri Valley Conference win on Saturday at Valparaiso, the University of Evansville men’s basketball team looks to continue its streak on Wednesday against Bradley.  Tip is set for 7 p.m. CT with ESPN+ and the Purple Aces Radio Network having the coverage.

Last Time Out

– Eleven lead changes ensued before the Purple Aces fended off a late challenge to earn a 63-62 road win over Valpo on Saturday

– Up by two in the final seconds, UE sent Valpo to the line where the final free throw fell short giving Evansville the win

– Kenny Strawbridge Jr. led the Aces with 14 points and 2 steals while Yacine Toumi and Antonio Thomas posted 10 apiece

– As he continues his return from injury, Ben Humrichous has seen his workload increase in each game

– Josh Hughes converted a pair of second-half triples that were pivotal in Saturday’s road win at Valparaiso

Ivy Tech Plans Free Pancakes & Ivy Event for the Community February 17

Evansville, IN – Ivy Tech Community College Evansville has organized a community event that incorporates a free pancake breakfast, along with learning about Ivy Tech, and an opportunity to “try out” a sampling of free college classes. This family-friendly event – Pancakes & Ivy — is planned for Saturday, Feb. 17, from 8-11 a.m., in the Koch Student Center on campus.

Attendees will be able to take part in a pancake and sausage breakfast, and children under 10 can have fun in a bouncy house, coloring tables, and other assorted games. Tours of the building will be offered, and a sampling of several college classes.

Classes to be offered from 10 to 10:30 a.m. include a few offerings from each of our eight schools:

Swim and Dive were selected as Fall Scholar All-America Teams from CSCAA

EVANSVILLE, Ind.- University of Southern Indiana Men’s and Women’s Swimming and Diving squads were named to the College Swimming and Diving Coaches Association of America Fall 2023 All-America teams. The women were one of 181 to earn the honor while the men were one of 117 among NCAA Division I schools to make the list.

“We are excited for another season that our team has achieved the prestigious CSCAA Scholar All American Team honor,” says Head Coach Cameron Kainer. Not only does it show the hard work our student athletes put in their sport but what they strive for as students. The team has raised the bar yet again by moving up in cumulative GPA and we are pleased to help represent our University, Athletic Department, and the Summit League conference with this honor.”

The qualifications require each program to hold a GPA of 3.0 or higher as a team. The women’s side held an impressive 3.28 grade point average in the fall among 24 members. The men had 27 members that finished the fall with 3.32 average.

The Screaming Eagles have now received this honor two years in a row. The women’s team was one of six Summit League representatives that made the list. The men’s side also had six schools making the list from the Summit League.

What’s Next
USI swim and dive continues to train for postseason play in the Summit League Championships. The entire regular season leads up to the ultra-competitive event in Minneapolis, Minnesota. The event runs from February 21-24 at the Jean K. Freeman Aquatic Center.

UE’S SCHERRY AMONG D1BASEBALL.COM’s TOP 50 SHORTSTOPS

EVANSVILLE, Ind. – For the second time in a week, the University of Evansville baseball team had one of its players rank among D1Baseball.com’s Top 50 positional rankings on Monday, as senior Simon Scherry (Santa Claus, Ind./Heritage Hills) was tabbed as one of the nation’s top shortstops.

Scherry ranks 22nd among the country’s top shortstops according to D1Baseball.com, one of the premiere collegiate baseball websites.  Scherry was an honorable mention all-MVC selection a year ago after hitting .267 with 12 doubles, three triples, three home runs and 23 RBI.  He was also considered one of the nation’s top defensive players at any position a year ago, as he led all of Division I baseball in Defensive Runs Saved among infielders at 12.7, per 643 Charts & Synergy, and finished as runner-up for the MVC Defensive Player of the Year while posting a .973 fielding percentage and ranking second in the Valley in total defensive assists with 173.

Scherry joins teammate Chase Hug on D1Baseball.com’s Top 50 positional rankings entering the 2024 season, as Hug was ranked 29th in the nation at first base on Friday.  D1Baseball.com is currently releasing positional Top 50 rankings at every position on the diamond on its website.
