AN ORDINANCE AMENDING CHAPTER 8.05
(HEALTH AND SANITATION)
OF THE EVANSVILLE MUNICIPAL CODE
WHEREAS, the Evansville Water and Sewer Utility recommends that Chapter 8.05 of the Evansville Municipal Code be amended to revise service fees and eliminate certain sections regarding yard waste collection; and
WHEREAS, the City Council of the City of Evansville (“City Councilâ€) wishes to adopt such recommendation by amending Chapter 8.05 of the Evansville Municipal Code.
NOW, THEREFORE, BE IT HEREBY ORDAINED by the City Council of the City of Evansville, Indiana, that Chapter 8.05 of the Evansville Municipal Code is hereby amended as follows:
SECTION 1. AMENDMENT OF SECTION 8.05.050 OF THE EVANSVILLE MUNICIPAL CODE.
Section 8.05.050 of the Evansville Municipal Code shall be amended by deleting said Section as presently constituted and substituting in lieu thereof the following:
“8.05.050 Container regulations.
The occupying owner or occupying tenant of any dwelling unit, apartment house, building, or structure, for which provisions are made for the collection of household refuse at public expense, shall provide the dwelling unit, apartment house, or building with a standard 96 gallon or 48 gallon cart to be supplied by the City. Each occupying owner or occupying tenant of each dwelling unit shall cause to be placed at the curb or at the alley location such 96 gallon or 48 gallon cart. [Ord. G-69-9, passed 2-17-69. 1962 Code § 933.04; 1982 Code § 93.11; 1983 Code § 9.93.11.]â€
SECTION 2. AMENDMENT OF SECTION 8.05.070 OF THE EVANSVILLE MUNICIPAL CODE.
Section 8.05.070 of the Evansville Municipal Code shall be amended by deleting said Section as presently constituted and substituting in lieu thereof the following:
“8.05.070 Definitions.
For the purpose of this article, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
“Refuse†means, by way of example but not limitation, such items as discarded containers, organic matter, paper, and small solid objects, capable of being placed in a standard container as also defined herein, and any other items that might be defined as “refuse†under the terms and conditions of a contract for refuse collection services, which may be entered into by the Water and Sewer Utility Board as authorized herein, which contract shall be on file in the office of the Water and Sewer Utility.
“Residential unit†means an occupied or unoccupied single-family residential dwelling unit specifically including but not limited to a mobile home, and each individual housekeeping, living, or dwelling unit of a multifamily building.
“Standard container†shall mean a leakproof container of either 96 or 48 gallon capacity provided by the City. [Ord. G-89-14, passed 4-3-89; Ord. G-87-9, passed 3-9-87; Ord. G-84-11, passed 3-26-84; Ord. G-81-37, passed 9-30-81. 1962 Code § 926.01; 1982 Code § 93.25; 1983 Code § 9.93.25.]â€
SECTION 3. AMENDMENT OF SUBSECTION (B) (1) OF SECTION 8.05.090 OF THE EVANSVILLE MUNICIPAL CODE.
Subsection (B) (1) of Section 8.05.090 of the Evansville Municipal Code shall be amended by deleting said Subsection as presently constituted and substituting in lieu thereof the following:
8.05.090 Scope of services – Fee – Billing.
“(B) Fees.
(1) Effective Billing Date: January 1, 2010. There is hereby imposed a fee of $11.45 per month upon each residential unit contained in a structure consisting of one to five residential units. (Effective Billing Date: January 1, 2011 – $11.80 per month. Effective Billing Date: January 1, 2012 – $12.15 per month. Effective Billing Date: January 1, 2013 – $10.65 per month.)â€
SECTION 4. AMENDMENT OF SUBSECTIONS (C) AND (D) OF SECTION 8.05.090 OF THE EVANSVILLE MUNICIPAL CODE.
The words “Department of Waterworks†shall be deleted from each of said Subsections (C) and (D) of Section 8.05.090 and the words “Water and Sewer Utility†shall be substituted in lieu thereof.

Section 8.05.160 entitled “Yard waste collection†shall be deleted in its entirety.
SECTION 8. AMENDMENT OF SECTION 8.05.170 OF THE EVANSVILLE MUNICIPAL CODE.
Section 8.05.170 entitled “Recycling bins and recyclable materials – Definitions†shall be re-numbered as Section 8.05.160 and entitled “Recycling carts and recyclable materials – Definitionsâ€, and the word “bin†or “bins†shall be replaced by the word “cart†or “carts†throughout said Section.
SECTION 9. EFFECTIVE DATE.
This Ordinance shall be in full force and effect after its passage by the City Council and signing by the Mayor.

Evansville, IN – The Pony Express Mustang & Classic Ford Club will host their 8th annual car show at Mesker Park Zoo & Botanic Garden this Saturday, September 15. This car show, sponsored by D-Patrick Ford, will take place from 9:00 am – 4:00 pm on Zoo grounds and in the Bement Ave. parking lot. All visitors must enter through the Zoo’s main entrance and pay regular Zoo admission. Visitors are invited to stroll through the Zoo and over to the Bement Ave. parking lot, while trying to spot animal named cars such as Mustangs, Stingrays, Beetles, Impalas, and Jaguars. All children attending the Zoo during the car show will have the opportunity to vote for their favorite car.

EVANSVILLE, IN – Eastland Mall will host a special Traveling City Hall meeting on Saturday,
September 15, from 10 to 11:30 a.m. near Dillard’s between Fred Meyer Jewelers and Helzberg
Diamonds. Eastland Mall will donate gift cards that will be awarded through a random drawing at the
end of the meeting. Winners must be present during the drawing to receive a prize.
“Eastland Mall hosts many community events,” said Marketing Manager Sean Ferguson. “We feel like
the Traveling City Hall meeting provides a huge benefit for the community. We were pleased to work

USIMichael Strezewski, USI assistant professor of anthropology, will present a lecture on the everyday lives of the Harmonists at 7 p.m. Wednesday at Thrall’s Opera House, 612 Church Street in New Harmony. Strezewski led USI’s Archaeological Field School since 2008. In “A Walk through New Harmony: 1820,” he will combine his research with data from the 1820 census and contemporary maps to construct a picture of the town and its residents in the early 19th century. IS IT TRUE that Roberts Stadium may not have hosted the Shrine Circus last year and it may never host the Shrine Circus again as it did for some 50 years but the CIRCUS IS ALIVE AND WELL IN THE OFFICIAL DISCUSSIONS REGARDING ROBERTS STADIUM?…that Mayor Winnecke is now spinning, rationalizing, and in all probability outright lying about the 400% increase in the price for demolition?…that President Clinton does not have a thing on Mayor Winnecke when it comes to telling a big lie about Ms. Lewinsky?…the Democrat spin machine that has the nerve to tell us all that the country is better off than it was four years ago in utter denial or defiance of hard facts has nothing on Mayor Winnecke’s fairy tale about the cost to demolish Roberts Stadium?…this man must think the people of Evansville are complete imbeciles to try and convince anyone that the City of Evansville clearly believed that the number was $200,000 for this task and intentionally lead the people of this town to believe that $200,000 was a valid and comprehensive quote from Klenck Construction?…given the $1 Million demolition cost and the $8 Million cost for the proposed dog and skateboard park the only logical approach is to auction Roberts Stadium off to the highest bidder even if it only brings $1?…putting Roberts Stadium on the tax roll and into private hands is the only thing that the City of Evansville can afford to do with respect to Roberts Stadium?…that not only should there be an 8th grade ISTEP requirement for the City Council but it should be a requirement for Mayor of Evansville as well?…this is dumber than the Earthcare Energy deal and that one took the cake?…this dog and skateboard park for $10 Million is even dumber than spending $20 Million for 8 little league ball fields that other cities routinely build for $5 Million or less?…that it seems sometimes like the abundance of meth labs in the City of Evansville must be tainting the air for local government?
IS IT TRUE that it’s been alleged that some account balances for the City of Evansville needs to be reconciled. … if this statement is true as many Civic Center Moles are telling us then the City of Evansville may have audit problems with the State Board of Accounts? …if the city of Evansville does not have an accurate check of account balances then how in the world can they craft a detailed city budget for 2013? …there is not even an approved 2012 City of Evansville budget posted on the shiny new website which does have better fluff than the old website even though the substance is still the same?
IS IT TRUE Metro Louisville may be asked to chip in more money to cover debt payments on the KFC Yum! Center?…the Louisville Arena Authority voted Monday morning to alert the city it may need to tap into the city’s maximum contribution of $9.8 million?…the city is currently slated to pay $6.5 million to the Arena Authority?…the reason for the shortfall in Louisville is due to the collections from the TIF district coming up very short with revenue?…looking around at the YUM Center there are a number of businesses that have started up in that TIF district but it still was less than half of the projections used to justify the construction of the YUM Center which houses the #2 men’s college basketball programs in America for both men and women, numerous big time concerts, and other events?…that there are six words to describe the future of the Ford Center in Downtown Evansville which is pretty much a baby brother project in every way compared to the YUM Center?…those six words are tick-tock, tick-tock, tick-tock?…within a year we will all know if the Ford Center will be needing to panhandle into other forms of financing to make ends meet when the debt starts to need servicing?
