CITY SWIM MEET

The 2013 City Swim Meet will be held on Saturday, July 13th and

Sunday, July 14th at Garvin Park Pool. All Neighborhood Pools, with the exception of Rochelle-Landers, will be closed both days in order for staff to help out with the Swim Meet.

Rochelle-Landers will be open normal business hours from 11:00 am â€“ 5:00 pm on Saturday and 12:00 noon to 8:00 pm on Sunday. Hartke Pool will also be open normal business hours from 11:00 am â€“ 8:00 pm on Saturday and from 12:00 noon â€“ 8:00 pm on Sunday. In addition, Lloyd Pool will be open normal business hours from 12:00 noon to 8:00 pm on Saturday and 12:00 noon to 5:00 pm on Sunday.

The preliminaries for the City Meet will start at 9:00 am on Saturday and the finals will start at 10:00 am on Sunday.

There are close to 500 participating in the City Swim Meet ranging in age from 4 to 65 plus. Everyone is urged to come out and root for their favorite team.

Federal judge rules Apple Inc. colluded to raise E-book prices Indiana joins DOJ and 32 other states in declaring victory

INDIANAPOLIS â€“ A federal judge ruled against Apple Inc. Wednesday for conspiring with major U.S. publishers to artificially raise the retail prices of electronic books (E-books).

The ruling stems from a multi-state lawsuit filed by Indiana Attorney General Greg Zoeller, 32 other states and the U.S. Department of Justice in April 2012. The U.S. District Court for the Southern District of New York found that Apple â€œplayed a central role in facilitating and executingâ€ the conspiracy to raise E-book prices, and that â€œAppleâ€™s orchestrationâ€ of the conspiracy was necessary to its success.

â€œFederal and state laws are designed to ensure the market remains competitive and fair,â€ Zoeller said. â€œThis ruling emphasizes the importance of accountability in the E-book marketplace and highlights how the states and the federal government can work together to protect consumers.â€

Zoeller said damages for consumers will be determined during a separate trial.

The U.S. Department of Justice, other states and Indiana already settled with five major U.S. publishers including Hachette Book Group Inc., HarperCollins Publishers L.L.C., Penguin Group (USA) Inc., Simon & Schuster Inc., and Holtzbrinck Publishers LLC d/b/a Macmillan for allegations relating to the same conduct. Zoeller said together those settlements will result in Indiana consumers receiving $2.7 million in refunds and more than $166 million for consumers nationwide. The multistate lawsuits against Apple and the publishers came after a two-year investigation by the U.S. Department of Justiceâ€™s Antitrust Division and attorneysâ€™ general offices.

For years, retailers sold e-books through a traditional wholesale-retail distribution model under which retailer outlets like Amazon or Barnes & Noble set prices. In 2010, before Apple entered the e-book market, bestsellers cost $9.99 which was a price set by Amazon.

According to the investigation, publishers conspired with Apple to shift their distribution model to allow publishers to set prices and sell e-books directly to consumers. This change artificially increased prices which accounted for the new bestseller pricing of $12.99 and $14.99.

The complaint said the publishers and Apple relied on contract terms that forced e-book retail outlets to sell their products at the same price therefore eliminating price competition. Under the agreement, Apple was guaranteed a 30 percent commission on e-books sold through its iBookstore.

Taps Berry Plastics CEO to give testimony on a national manufacturing competitiveness plan

(Washington, D.C.) â€“ Representative Larry Bucshon (R-Ind.), Chairman of the House Subcommittee on Research and Technology, will hold a hearing on the need for strategic planning for national manufacturing competitiveness on Wednesday July 10th at 2:00pm.

Specifically, the hearing will focus on H.R. 2447, the American Manufacturing Competitiveness Act of 2013, legislation that would require the National Science and Technology Councilâ€™s Committee on Technology to develop a strategic plan to advance national manufacturing competitiveness every four years.

Bucshon selected Dr. Jonathan Rich, Chairman and CEO of Berry Plastics Corporationâ€“ an Evansville, IN based company, to provide comments and recommendations on the development of this national strategic plan.

During July, over a span of just 18 days, EFD will lose 76 years of valuable experience due to the retirements of Captain James â€œJimâ€ D. Blanford, Jr. and Battalion Chief James â€œJimâ€ A. Fuchs, Jr.

Blanford retired July 3th after 33 years on the department, serving as Captain since 1984. He has been at Station#17 on the northside since 1998, although he served at Station #15 on the southeast side 14 years previously. Blanford said â€œThe Fire Departmentâ€™s all Iâ€™ve known my whole lifeâ€ referring to the fact that his dad, James Blanford, Sr. joined EFD when Jim was just 2 years old. Jim Sr. retired in 1993. Jim is looking forward to his retirement by camping, going to â€œmoreâ€ NASCAR races and spending time with family.

Fuchs will retire July 21st after nearly 43 years â€œon the jobâ€. Fuchs has been a â€œChiefâ€ since 1980 when promoted to Fire Prevention Coordinator (School Safety Liaison Officer) as a District Chief. Fuchs was promoted to Battalion Chief in 1986 and became the Chief Inspector (Fire Marshal) for the City. Fuchs has served in a number of capacities including the Chiefs of Training, Administration and Health & Safety and was the Assistant Chief under Mayor Weinzapfel. Jim is also looking forward to retirement citing his 4 grandkids as one of the main reasons, which will help â€œoccupy his timeâ€.

EFD wants to wish both men a long and happy retirement.

IS IT TRUE Mayor Winnecke met yesterday with some of the young professionals who make Evansville their home to learn what it is they want to be more satisfied with the â€œquality of lifeâ€ challenges that Evansville faces?…this is not the first such meeting that has been held in the last 10 years regarding the problems of â€œbrain drainâ€ and dead end careers that have plagued Evansville for many decades now?… Mayor Winnecke himself has been to countless seminars, sister city visits, and inter-city visits to discuss the same issues ad nauseum yet things just do not change?…former Mayor Weinzapfel took the same trips and talked to the same groups like Rotoract and YEP (Young Evansville Professionals) and heard all of the same critiques but not a thing has been done to advance the concerns of young professionals to the next level?…there was even a seminar called Smart Cities in 2010 paid for by private money to address these issues and only one elected official saw fit to attend and didnâ€™t stay for the whole discussion?…we at the CCO hope that this old dog Mayor learns this time since he has heard these lessons many times before and done nothing to effect change?

IS IT TRUE the #1 complaint among young single professionals is that the dating pool is littered with half wits, morons, rednecks, and others deemed to be unfit to consider for marriage or decent conversation?…a little known secret is that the same situation contributes to brain drain for the older professionals who are single too but that is a discussion for another day?…the #2 thing on the list for young professionals is to be able to find a career track employment opportunity that is upwardly mobile so they can provide for their families if they are lucky enough to form one?…it is not just about JOBS as it was 30 years ago, it is about GOOD JOBS that challenge ones abilities and utilize ones academic training?…Evansville for a few people does offer good jobs but the density of these jobs is so sparse that job mobility is essentially non-existent for young professionals who find themselves in a challenging career?…the lack of JOB MOBILITY leads to depressed wages and a plateau for what could be good and lucrative careers?

IS IT TRUE that the last thing on a young professionals list of needs is a downtown hotel, an arena, or loft apartments in a dead location?…these are things that are attractive to young professionals that have the dating issues and the career issues in the rear view mirror?…those numbers are small here in River City?…young professionals do not give a rats arse about the Shrine Circus, dog parks, skateboard parks (with the exception of non working slackers), or the zoo?…these are only icing on a cake but do not constitute cake at all?…contrary to what some older Evansvillians claim this place is not closer to a positive tipping point than Detroit or downtown St. Louis are?…it is unfortunate but meeting after meeting that happen year after year with no tangible results just drive off the best of our young professionals to other locations that meet their needs without asking?

IS IT TRUE there is one class of young people in Evansville that we canâ€™t seem to get rid of and that is the group that are uneducated, have no respect for education, and no ambition?…we have thousands of these?…this group is part of the reason that our valuable young professionals continue to high tail it out of town at the first opportunity?…there has not been a Mayor or City Council person in the last half century that is even close to understanding the dilemmas faced by young professionals who want to make Evansville their home?…as long as the person in the Mayorâ€™s office thinks a convention hotel is the answer the brain drain will continue?…young professionals donâ€™t even like conventions?…that is much of the reason why out of touch arcane ideas like convention hotels and ball fields are fodder for ridicule and laughter among the younger generation?

IS IT TRUE several of the comments in the City County Observer and the Courier & Press yesterday asserted a claim that is so vile and so backwards that the CCO while allowing the posts to stand out for a while out of respect for the 1st Amendment does not believe is even possible in modern America outside of the confines of an utterly corrupt environment?…these assertions coming from several people were that certain members of the Evansville City Council and other former elected officials are extended the courtesy of being allowed to drive while intoxicated under the protection of the Evansville Police Department?…knowing many police officers and Evansville Police Chief Billy Bolin the CCO does not believe these assertions to be true and even though we regularly question the sanity of things that originate in the Civic Center we in no way accept that such an archaic and utterly corrupt practice would be attempted or tolerated in 2013 in Evansville, IN?…such corruption has of course happened in other places back during Prohibition and other such times when organized crime infiltrated politics and law enforcement?…movies have long liked to perpetuate the old boy style of corruption in the Old South with characters like Boss Hogg, Governor Howie Long, Porkyâ€™s, or Walking Tall?…there is most likely a historical grain of truth to the preferred and powerful getting a pass from law enforcement but this practice is one that we are certain has been eradicated in Evansville by now?…what is disturbing is that it is believed by several citizens that Evansville practices such things today?…such practices should never ever be tolerated at any level?

IS IT TRUE that in the CCO Readerâ€™s Poll about support for the unanimously passed Johnson Controls Deal that our readers rejected the will of the Evansville City Council by a 5 to 1 majority?…the comments on the CP were equally as vicious toward the contract and the City Council?…one thing we are curious to learn is what the cost breakdown of each of these nearly $1,000 water meters is?…traditional water meters are a fairly inexpensive item some selling for under $100 each?…we would like to see a breakdown of the cost of this deal on a per meter basis on a materials, labor, maintenance, profit, and administrative overhead breakout?…we would also like to see the contract amended to mandate competitive bidding open to all for the installation of these meters which should be a fairly easy task to complete?…this whole deal from former Mayor Weinzapfelâ€™s cram through, to the months of posturing by the City Council before unanimously capitulating to the Mayorâ€™s will, to the uncompetitive secrecy surrounding the installation has been a disgusting way to provide stewardship over taxpayer dollars?

IS IT TRUE that well placed moles have told us that the Office of the Mayor and the Office of the Evansville City Controller have had the McGladrie study in hand for a while now?…this study has been withheld from the City Council during that time?…the City Council in spite of having this important financial information intentionally withheld consented to vote on and pass a $45.3 Million funding resolution for non essential items?…the next thing we know they will be rolling over and scheduling a vote on the $37.5 Million corporate welfare hotel, a $10 Million dog park, and other assorted items of no urgency?…before it is all said and done it is clear that the goals of this administration and its puppet are to pass about $100 Million in unnecessary spending without the releasing the McGladrie Study or getting the 2012 SBOA Audit results?…this is the height of irresponsible management of taxpayer dollars and each and every perpetrator of this blind following the blind scenario should be purged from office for playing along with this twisted spending spree?

IS IT TRUE that true to form and living up to the expectations of the CCO ObamaCare is imploding daily?…during the last four days we have learned that after 4 years the infrastructure has not been established to manage the law?…to date BIG COMPANIES and SMOKERS have seen their penalties deferred for at least a year and the FINANACIAL REQUIREMENTS for GETTING A SUBSIDY have been altered to require NO VERIFICATION?…in spite of the goodness or ineptness of the law itself it is now obvious that the Obama Administration is incapable of executing even the simplest things?…every one of these three deferred items could simply have been a couple of lines on a form?…this should be a strong lesson that bills need to be read before they are passed in every instance?…2014 is shaping up to be an interesting election year and the first real opportunity to clean every last member of the House of Representatives who voted for this turd out of office?…this is a shame because it could have worked well if our leadership had taken some time to think?
