House strips 2nd sentence from marriage amendment; vote could come as early as Tuesday

INDIANAPOLIS – Amidst a roar of applause from the hundreds of gay rights supporters gathered in a public gallery, the Indiana House voted to strike a provision from a constitutional marriage amendment that would have banned civil unions in Indiana.

Members voted 52-43 – with 23 Republicans and 29 Democrats voting yes – to eliminate the amendment’s second sentence, which would have prohibited lawmakers from creating a legal union similar to marriage for same-sex couples.

The vote likely ensures that the constitutional amendment will not reach the public for a vote until at least 2016 – if at all. A constitutional amendment must be approved by two, separately elected legislatures to be placed on the ballot for ratification.

The amendment had been approved in 2011 with the civil unions language in tact. Removing it starts the constitutional amendment clock again.

“Stripping the deeply flawed second sentence makes a bad amendment better, but we believe this amendment, in any form, has no place in our state’s founding document,” said Megan Robertson, campaign manager for Freedom Indiana, a group trying to defeat the constitutional amendment.

The constitutional amendment’s remaining language defines marriage as the union of one man and one woman. The House could vote on it as soon as Tuesday, which would send the measure to the Senate for consideration.

There, lawmakers could reinstate the second sentence, approve the proposal as is or defeat it.

“I’m confident there will be a vote,” Bosma said. “We haven’t walked away from this issue at any point. My two goals announced on Organization Day and reiterated on numerous issues were, first of all, that every member vote their conscious and that the entire body get to work on the bill together. And that’s exactly what happened.

“I’m just pleased to see democracy at work in a positive way on behalf of the people of Indiana.”

Rep. Randy Truitt, R- West Lafayette, proposed the change approved Monday and it led to powerful speeches from members of both sides of the aisle – and the issue. Lawmakers’ tones were largely respectful and determined.

House Minority Leader Scott Pelath, D- Michigan City, expressed frustration that it took until now for some legislators to realize what he called the gravity of the situation. He pointed to polls that show Hoosiers are dramatically less supportive of the constitutional amendment – and particularly the ban on civil unions – than they had been even three years ago, when the amendment passed easily.

“We said that it was the wrong thing to do then,” Pelath said. “Now, just because the winds are blowing in a certain direction, some more people may have seen the light. But I want the record to show, that the caucus I lead understands that this was the wrong thing to do back when it wasn’t cool.”

Pelath said he wants the people of Indiana to know who has been opposed to the resolution all along.

“I’m going to continue to remind the people of Indiana who’s been with them and who hasn’t,” he said.

Actually, three years ago, a number of Democrats voted for the constitutional amendment. On Monday, all Democrats voted to strip the civil unions language out.

Still, the change could not have passed without the support of Republicans.

Rep. Kevin Mahan, R-Hartford City, was among those who voted for the change, saying he was choosing “to be brave” after conversations with constituents left him with questions and few answers about the amendment’s second sentence.

“It seemed like the majority of those that support this amendment admitted that they wish the second sentence was not even in there,” Mahan said. “However what I do know is that the people from my district simply ask to be able to vote to define marriage between one man and one woman, period.”

Mahan said he will now vote to pass the constitutional amendment, even if it means lawmakers will have to approve it again in 2015 or 2016 to put it on the ballot.

“This is what the majority of Hoosiers want,” Mahan said. “Lets pass the amended bill out of the House and I’ll be more than happy to come back next year to support it again and get it to the voters.”

But Republicans were split. The constitutional amendment’s author – Rep. Eric Turner, R-Cicero – spoke against the language change.

“I know his amendment is well intended and (Truitt) is very much trying to be helpful with this process and move this HJR 3 along,” Turner said. “However I think his method is doing exactly the opposite.”

Turner cited examples from other states that currently have statutes defining marriage as between one man and one woman. He said that in a majority of those states, a second sentence is included to prevent marriage in another name, and that they did not affect civil unions or anything similar.

“This house joint resolution, this constitutional amendment, does not affect that, it hasn’t in other states and it won’t here,” Turner said.

And he said stripping out the second sentence opens the amendment to lawsuits and “just prolongs this debate for another 2 or 3 years.”

“We’ve been debating this for 10 years,” Turner said. “I believe the public in Indiana is very much ready to engage on this, no matter what side you’re on.”

Supporters have said that pushing the amendment debate into future years boosts the chance that it will never be approved. That’s because a number of other states have been moving in the opposite direction – approving laws that legalize same sex marriage, rather than banning them.

Also, public opinion has been steadily moving toward approval of same-sex relationships.

Rep. Woody Burton, R-Whiteland, essentially acknowledged those concerns when he urged his colleagues to leave the constitutional amendment’s language as it was in 2011 so it could go on the ballot this November.

“It’s an issue of letting the people vote,” Burton said. “All it is doing is killing a piece of legislation that we’ve all worked very hard on to accomplish.”

7th Circuit bars Indianapolis’ hour limits on adult bookstores

The 7th Circuit Court of Appeals in Chicago has tossed an Indianapolis ordinance limiting the business hours of adult bookstores from 10 a.m. to midnight Monday through Saturday.

In a five-page opinion issued Friday, Judge Frank Easterbrook wrote for a panel that reversed a District Court ruling in favor of Indianapolis’ ordinance in long-running litigation, Annex Books Inc, et al. v. City of Indianapolis, 13-1500. The panel ordered Judge Sarah Evans Barker of the District Court for the Southern District of Indiana to grant an injunction barring enforcement of the closure ordinance.

Easterbrook wrote the city could no more restrict the hours of an adult bookstore than it could limit the hours during which a Sunday newspaper could be distributed.

“The difference lies in the content of the reading material. Indianapolis likes G-rated newspapers but not sexually oriented books, magazines, and movies,” Easterbrook wrote, noting that in two precedent-setting U.S. Supreme Court rulings, neither “permits units of government to stop the distribution of books because their content is objectionable, unless the material is obscene.”

“Indianapolis does not contend that any of the plaintiffs sells obscene  material; it  follows that  objection to the plaintiffs’ stock in trade cannot justify closure,” the panel held.

The city failed to persuade the court that the ordinance was justified because of claims of fewer armed robberies near adult bookstores during the times they were closed.

“The current justification is weak as a statistical matter,” the panel held, noting the city didn’t control for other potentially important variables such as nearby late-night taverns. In any event, Easterbrook wrote, “The change in the number of armed robberies is small; the difference is not statistically significant. The data do not show that robberies are more likely at adult bookstores than at other late night retail outlets, such as liquor stores, pharmacies, and convenience stores, that are not subject to the closing hours imposed on bookstores.”

Evansville Police arrested 23 year old JACOB EGAN for Criminal Recklessness after he fired shots in the 2800 block of E. Oak St.

Officers responded to the call around 9:30pm on Sunday.
The first officer on scene saw Egan come out of 2813 E. Oak armed with a handgun. Egan placed the gun to his own head and ignored the officer’s instructions to put the gun down. As other officers arrived, Egan continued to ignore instructions and began waiving the gun around in the air.
After several minutes, the officers were able to deescalate the situation and Egan dropped the gun. After dropping the gun, Egan still refused to cooperate with officers and was taken into custody after being subdued with a Taser.
Egan was given a mental health evaluation before being taken to jail on the listed charge.

Knox County – Last night at approximately 8:43, Sergeant Bill Gadberry was patrolling Hwy 50 near Wheatland when he observed a suspicious vehicle with only one headlight pull out of the Wheatland
Co-Op. The driver of the 2000 Oldsmobile Alero continued west on Hwy 50 and was clocked by radar at 71 mph. Sergeant Gadberry activated his emergency lights and stopped the vehicle on Marchino Road just north of Hwy 50. As soon as the vehicle stopped the driver fled on foot. Two passengers inside the vehicle, Eric Boger, 28, and Kolbie Staley, 22, both from Vincennes, were detained. During a search of the vehicle officers found methamphetamine and drug paraphernalia. Boger and Staley were arrested and taken to the Knox County Jail. Knox County Sheriff’s Deputies searched the area for approximately three hours before finding the driver nearly two-miles away walking on Summers Road. The driver was identified as Shawn Crouse, 29, of Vincennes. He was arrested without further incident and taken to the Knox County Jail where he is currently being held on bond.

IS IT TRUE it is being reported that as of Sunday morning, it does not appear that proponents of the constitutional marriage amendment have the votes necessary to pass the legislative package on Monday in the Indiana House (Howey, Howey Politics Indiana)?…there appears to be a growing segment of the House Republican caucus who will oppose HJR-3 and the companion HB1153 due to the second sentence which would make civil unions and domestic partnerships illegal in Indiana?…the first head count indicators when the House debates the measure – expected to begin Monday afternoon – will likely come on amendments that will seek to remove the second sentence?…ff that were to occur, the amendment process would have to restart and the amendment would not appear on the ballot next November?…it will be an step forward from an unnecessary abyss of unconstitutionality to see this quixotic quest come to an end before Indiana rushes down a gauntlet of wasting money to lose in a higher court?…according to a comment he posted in the CCO even Vanderburgh County Republican Chairman Wayne Parke sees HJR-3 and HB1153 as fool’s errands even though his expressed beliefs are otherwise?

IS IT TRUE that gangland shots rang out in downtown Evansville again this weekend leaving one hospitalized and several on the local most wanted list for attempted murder?…this is the fourth such instance in the last few years starting with at drive by shooting at 2nd and Main, followed by two 100 person plus brawls in parking lots, and finally with this weekend’s shooting?…we can build lofts, bars, temples to entertainment, and hotels until the sky burns and unless this kind of behavior is ceased or moved out of the downtown it will not be a desirable place to recreate or live for most people?…perhaps the signs warning of petty crime that were installed last year should have included a warning to watch out for drive-by shootings?…if parts of Evansville continue to behave like Compton it will turn to Compton?…let this be a word to the wise?…little has changed the race to the bottom?

IS IT TRUE Dexter Elementary School is closed today because of water main breaks?…we have to ask if we should be ringing the “fix the infrastructure” bell any louder to get our local government to table the fund and games and use what few dollars we have left to start fixing things like sewers, water distribution, sidewalks, and roads?…there are things that cities are supposed to do and they are not getting done?…there are things that cities that already have working infrastructure sometimes choose to do and that is about all the seems to occupy the minds of local officials?

IS IT TRUE that the State of the Union address is tomorrow night and President Obama will be addressing the American people about the state of our union in his perspective?…as his speechwriters are putting the final touches on the speech the following indisputable facts should be included to accurately reflect the true state of our union on January 28, 2014?…6.5 Million people have thrown their hands up in despair and left the work force leaving work force participation at an all time low and still shrinking?…food stamp use had increase by 46% since 2009?…poverty has increased by 23% since 2009?…transportation (gas) has increased in price by 79% since 2009?…the federal debt has increased by 55% since 2009?…an old adage says that when one realizes one is in a hole it is time to stop digging?…no matter what the employment statistics that have been rendered moot by the exit of 6.5 Million people from the workforce say, America is still in a hole?…it is time to stop doing the same things we have been doing?…platitudinal talk of income inequality only serve to fan the fires of envy and stifle the entrepreneurial spirit which is about the last hope this economy has?…we hope the President concentrates his words on unleashing the innovative power of American ingenuity and dispenses with the slogans of class warfare?
