COA: Standard of care same for all doctors

The Indiana Court of Appeals ruled in a medical malpractice claim brought by a former inmate who had gender reassignment surgery that the standard of care for doctors practicing inside prisons is the same as the standard of care for those practicing outside of prison.

Christa Allen had gender reassignment surgery in January 2002, which included the construction of a vaginal vault. As part of her treatment, her doctor, Alan Neal Wilson, prescribed hormone therapy and the use of a vaginal stent, a soft plastic appliance worn internally like a tampon. The stent keeps the vaginal vault dilated and prevents atrophy.

When Allen first entered the Department of Correction in June 2006, the correction facility allowed her to use the stint. But later the superintendent determined its use was a security breach. The DOC allowed for alternatives, but they caused issues for Allen. After her release in late 2007, Wilson examined Allen and found that because of her inability to use the stent, her vaginal vault had contracted and become unusable. The doctor estimated it would cost between $60,000 and $120,000 to restore Allen’s vagina.

Allen filed her proposed medical malpractice complaint against the three doctors who treated her while in prison. A review panel ruled in favor of the doctors, as did Marion Superior Judge Health Welch. Welch determined that Allen failed to provide expert testimony to rebut the opinion of the medical review panel when she only presented testimony from Wilson. Welch also held that doctors practicing in the prison system have a different standard of care than those practicing in the general population.

In Christa Allen v. Richard Hinchman, M.D.; Richard Tanner, M.D.; and Jeffery Smith, M.D., 49A02-1311-PL-975, the appeals judges disagreed.

“[W]e recognize that medical care in the DOC involves additional considerations not present in a hospital or general care facility. However, we cannot find that physicians practicing in prisons may deviate from the standard of care without reasonable, articulable concerns. In short, we do not find that physicians practicing in prisons may determine the standard of care based on the circumstances and concerns facing them with regard to individual patients, especially when such concerns remain vague and nebulous. To do so would be to empower prison physicians to determine for themselves what standard of care should apply based on each individual case, a practice we will not endorse,” Judge John Baker wrote.

As such, Wilson was qualified to testify as an expert. The medical review panel found the doctors did not breach their standard of care and that Allen’s damages were not causally linked to the care they provided. But Wilson’s expert testimony rebutted the medical review board, so summary judgment was inappropriate.

EVSC Schools to Celebrate Veteran’s Day

Many EVSC schools will host special events this week in honor of Veteran’s Day, including Helfrich Park STEM Academy and the Randall T. Shepard Academy for Law and Social Justice.

Helfrich Park STEM Academy will celebrate Veteran’s Day today with a special reception for local veterans beginning at 1:15 p.m. Then, at 1:45 p.m., the school will host an assembly that will include presentations, speeches from veterans, music and a tunnel for the veterans exiting the program. In addition, the student body will be wearing red, white and blue for a patriotic seating arrangement.

 

Randall T. Shepard Academy to Skype with Staff Sergeant in Afghanistan

Students in Andrea Smith’s class in the Randall T. Shepard Academy for Law & Social Justice will have the opportunity to Skype with Staff Sergeant Jason Ory who is currently serving in Afghanistan. The Skype session came as a result of a care package the class sent to Staff Sergeant Ory. After receiving the care package, Staff Sergeant Ory asked for the opportunity to Skype with the class to personally thank them.

 

The class sent the care package after studying about World War I and some of the things people did on the home front. As a result of their studies, students decided they wanted to do something for our troops serving overseas today.

IS IT TRUE Mayor Winnecke rightfully announced that the water will not be cut off to people who do not spend thousands of dollars on TBD repairs articulated very aggressively in a letter from the City of Evansville to thousands of CUSTOMERS last week?…the Mayor acknowledged that the letter sent out by the Sewer and Water Utility was one that caused much anxiety in the CUSTOMER BASE and asked for patience as the switch over to the Johnson Controls smart meters that former Mayor Weinzapfel shoved down our throats to the tune of nearly $50 Million on his way out the door?…this was essentially the only logical response that Mayor Winnecke could have had and we complement him on doing so?…several of our readers who got these letters are still on pins and needles regarding having their pipes broken by the work crews and in having to eventually pay for repairs caused by Mayor Weinzapfel’s READY, FIRE, AIM present to Evansville?

IS IT TRUE with the revelation that the water bill for the McCurdy was not run up by the Kunkel Group but by the previous owner the CCO is quite interested to see exactly when the refurbishment of the McCurdy will really get underway?…the same goes for the downtown convention hotel that supposedly is going to have the first real work start next week?…if the talking heads can be taken at their words, and that is a very big if, there may really be some construction going on in downtown Evansville in 2015 for opening in 2016?…we don’t really expect either project to stimulate major retail business in the downtown as bigger things have been done that stimulated nothing?…just last week another small downtown business that sold bagels is closing its doors?…the number of businesses downtown has not changed in 20 years even though the churn of businesses seems to be constant?

IS IT TRUE Illinois residents John Kraft and Kirk Allen, who run an anti-corruption non-profit called the Edgar County Watchdogs, have waged a campaign against crooked public officials over the past two years, forcing resignations from 102 bureaucrats and politicians and at one point placing an entire park district board under citizen’s arrest?…with four former governors having served time behind bars, Illinois’ government is widely-viewed as being riddled with corruption?…through a combination of public pressure, Freedom of Information filings, lawsuits, and media exposure, they have created a system that deeply threatens Illinois’ corrupt, entrenched political establishment?…they operate a blog called Illinois Leaks that exposes corruption at the state and local levels?…after a 10 year period in which 2 governors of Illinois were convicted and imprisoned, recently defeated Pat Quinn set the bar low by managing to serve his time in office without heading to prison?…we have one expectation of the new republican governor elect of Illinois and that is for him not to wind up behind bars in a state that seems to set the standard for corruption in politics?…you can read the story about the two veterans who are taking on corruption in their hometown in Illinois on the following link?

COUNCILMAN FRIEND ATTACKS CITY WATER METER REPAIR REPLACEMENT PLANS

Allen,

During one of our recent City Council meetings, the overtime apparently caused by the methodology Hydromax in the replacement process resulted in major damage to the plumbing both on the city and customer sides. I have had much testimony from utility employees who are eye witnesses to these events.  Last Tuesday evening one employee came up to me and indicated that he was sent back out to a customer’s home just to turn on the water after Hydromax installed the new meter…this was on the Westside of town.

It is NOT the FAULT of the utility customers that the Johnson Control contract was so poorly drafted. If you recall, the Council was prepared, 0-9 to reject the original contract and the Winnecke Administration supposedly re-negotiated with Johnson Controls.  How the utility overlooked the fact in the replacement process that damage would occur and who was responsible is egregious.  To demand that the utility customer fork out (the estimates given to me between $1,400-$4,300) is preposterous.

This is NOT an option as for as this council is concerned.  With this said, please be available this coming Monday evening to address plan B.

Arrests Made after Victim Struck Repeatedly with a Handgun

On Sunday, November 09, 2014 at approximately 6:30 pm, the Vanderburgh County Sheriff’s Office responded to an address in the 2000 block of Evanston Drive in reference to an assault involving a weapon.

The victim advised that she was attacked by a female suspect who struck her in the head several times with a handgun. When the victim’s husband tried to intervene, a male suspect threatened him with a handgun.

Both suspects then fled in a vehicle. Deputies quickly located the suspect vehicle turning into the driveway of a nearby address. Two occupants of the vehicle were arrested and taken into custody. Two handguns were recovered from the vehicle.

The victim was transported to Deaconess Hospital by ambulance for non-life threatening injuries. The investigation is on-going.

Analysis: Democrats have big legislative hole to climb out of

INDIANAPOLIS – So what’s the importance of a few more legislative seats when you already have a supermajority?

When Republicans added two more seats to their already huge majority in the House last Tuesday and three more to their huge majority in the Senate, they didn’t gain any real advantage in passing bills or supporting the GOP governor’s agenda.

They already had those tasks well in hand.

Instead the larger majorities simply make it tougher for Democrats to regain a foothold in either chamber. Republicans all but ensured it will take years for Democrats to regain real clout – let alone a majority – in the House or Senate, unless Republicans just absolutely outrage voters.

Already, the supermajorities mean that Republicans can do business without Democrats. That’s because Republicans have enough members in both chambers to have a quorum even if no Democrats show up.

That was true after the 2012 election in the House and has been true for several years in the Senate. Democrats had hoped to pick up a few seats – particularly in the House – to at least eliminate those supermajorities. Instead, the GOP only added to their margins.

Republicans now control the House 71-29 and the Senate 40-10. That’s right. Three out of every four Indiana Senate districts are represented by Republicans. And there are more Republicans in the 50-member Senate than there are Democrats in the entire General Assembly.

House Minority Leader Scott Pelath, D-Michigan City, said the numbers are a disappointment. He and his leadership team had hoped to start eating away at the GOP majority in the 2014 election. It’s a job he acknowledges will take time, which means every single election is important.

This year, Democrats took a step back, he acknowledged, despite what he said were good candidates and good organization. But Pelath said given the “carnage” for Democrats nationwide, it’s the results in Indiana may not have been so bad.

That’s certainly true. Democrats lost control of the U.S. Senate while Republicans added to their majority in the House. The GOP picked up three more governor’s seats and gained control of eight more legislative chambers.

Of course, 2016 could be much different. There will be a presidential race on the ticket. And a governor’s race in Indiana. And those are types of races that bring out more voters. Pelath said the 2016 will provide “an entirely different universe of voters.”

But now, Democrats have an even bigger hole from which to climb. They need to win back five seats simply to end the GOP supermajority in the House and seven seats to prevent a quorum in the Senate. That’s particularly tough since Republicans drew the currently legislative district maps.

And speaking of those maps. Unless Democrats manage to win 22 seats in the House in the next six years and 16 seats in the Senate, the Republicans will draw those maps again in 2021, which would likely wipe out any Democratic gains.

It’s not impossible to imagine that Democrats could make a comeback in the House. They controlled the chamber back in 2010. It’s been much longer since Democrats had a majority in the Senate.

But House Speaker Brian Bosma, R-Indianapolis, reminded his caucus on Wednesday that anything can happen. He said that 1905, Republicans held an 85-15 majority in the House. But by 1913, politics shifted and Democrats held a 95-5 advantage.

“I don’t know what happened in those seven years,” Bosma said. “But I’ve cautioned our team we don’t want it to happen again.”
