Tomorrow’s Brown Bag Performance Cancelled

Landowners not prejudiced by approval of wind turbine project

The Indiana Court of Appeals affirmed that landowners in Wells County who lived next to property that will house wind turbines were not prejudiced by the zoning decision to allow the project to proceed.

In James E. and Tamara L. Dunmoyer, Jr., Linus and Karen Harrold, Theron and Clara Miller, et al. v. Wells County, Indiana Area Plan Commission, Wells County Wind II, LLC, et al., 90A02-1407-MI-460, James and Tamara Dunmoyer and other landowners appealed the grant of summary judgment in favor of the county and the wind turbine developers regarding the landowners’ request for judicial review of a zoning decision by the Indiana Area Plan Commission. The commission approved a petition for the development of a large wind energy conversion system filed by a group collectively referred to as Apex; the wind turbines would be placed on land adjacent to that of the landowners.

The zoning ordinance in Wells County outlines what parameters a group must meet in order to be allowed to construct a large wind energy conversion system, which includes Article 14 on development plans and Article 15 on development criteria for a WECS project.

The plan commission ultimately approved Apex’s WECS petition to place the wind turbines on land zoned Agricultural-1. The landowners then filed their complaint. In Count I, the landowners sought judicial review of the zoning decision; in Count II, they sought a declaratory judgment that the reciprocal setback provision in Article 15 of the zoning ordinance was invalid and should be stricken because it constituted a taking of private property without just compensation.

The defendants – the plan commission and Apex – alleged the landowners lacked standing in Count I because they failed to allege facts showing they are aggrieved by the approval of Apex’s plan. The trial court ruled in favor of the defendants on Count I, effectively upholding the plan’s approval.

The General Assembly has decided that a plan commission has exclusive authority to approve or disapprove a development plan for real property located within the plan commission’s jurisdiction, Judge James Kirsch wrote.

“The circumstances about which Landowners contend they have been prejudiced, their proximity to the wind turbines and its resultant noise and shadow flicker plus a decrease in the value of their land, were circumstances created not by the Plan Commission’s approval of Apex’s Development Plan, but instead, by the legislative body’s enactment of Article 15. By reaching this conclusion, we are not diminishing the concerns of Landowners regarding the placement of wind turbines in their community. Instead, we are recognizing the power our legislature has given to the Wells County legislative body to determine the uses that will be permitted in various zones of the county,” he wrote.

The trial court granted the landowners’ petition for declaratory judgment as to Count II and ordered that the reciprocal setback provision in Article 15 of the ordinance is invalid and should be stricken from the zoning ordinance, which was not appealed by either of the parties. The trial court also remanded the development plan to the plan commission to review the plan again to make sure it complies with Article 15. The COA remanded this appeal to the trial court to remand the development plan to the commission so that the commission follows the instructions set forth in the trial court decision.

Eastern World Culture Fair

For the first time ever, students have researched and designed displays on Africa, Asia, the Middle east, and the Pacific and will have food samples from these locations, as well as other artifacts and music.

UE Ranked Among Best Colleges for Intramural Sports

The University of Evansville was ranked among the best colleges for intramural sports by www.BestColleges.com. Criteria for the ranking included variety, leadership, and facilities.

Seth Woodason, assistant Director of the Fitness Center, says the ranking is a reflection of what is important to UE students. “We’re a very active, health-focused university,” Woodason says. “Year after year, we consistently have around 75 percent of the student body active in at least one intramural sport.”

UE has men’s, women’s, and co-recreational teams in a variety of sports and activities at every ability level. The most popular sports are soccer and basketball, but there are a wide range of individual and team sports to choose from.

“One unique sport we offer is inner tube basketball,” says Woodason. “Players sit in an inner tube in the shallow end of the pool and try to get the ball in the basket. It’s entertaining to watch and the students love it!”

Day 2: Governor Pence Meets with High-Level Government Leaders & Highlights Indiana-Made RVs in China

Indianapolis – Governor Mike Pence spent the day in Beijing meeting with high-level Chinese government officials and promoting Indiana-made recreational vehicles (RV) at a reception attended by more than 100 business officials at the U.S. Embassy.

 

“Northern Indiana is the epicenter of the RV industry. That becomes apparent when you travel all the way to China and find Hoosier-built RVs on the road,” said Pence. “Thousands of Hoosiers are building RVs that are then sold globally, including in China. And with the current popularity of RVs in China, tonight was a great opportunity to discuss how more Chinese people can fully enjoy the open road and the great outdoors with an Indiana-made vehicle.”

 

The reception, co-hosted with the Recreational Vehicle Industry Association, showcased three Indiana-made RVs and highlighted the great potential China holds for both domestic and American RV manufacturers. China is the second largest market in the world for U.S. RV exports, with Chinese consumers spending $68 million on U.S.-built RVs in the last two years. In his remarks, the Governor highlighted that almost 85 percent of the 350,000 RVs shipped just last year were built in Indiana as part of an industry that employs nearly 300,000 Hoosiers.

 

Earlier in the day, the Governor met with Vice Premier of the People’s Republic of China Wang Yang, responsible for commerce, industries, agriculture and trade and a member of the ruling Politburo, as well as several high-ranking Chinese government leaders at the Ministry of Commerce and China Investment Promotion Agency (CIPA). Indiana Secretary of Commerce Victor Smith and CIPA Director General Liu Dianxun signed a memorandum of understanding reaffirming joint exploration of economic growth opportunities.

Indiana counts China as its fifth largest export partner, with exports totaling $1.4 billion last year. Hoosier companies with Chinese operations include Allison Transmission, Dow AgroSciences, Eli Lilly, Hillenbrand and Cummins. Tomorrow the Governor will visit Columbus, Indiana-based Cummins’ joint venture, Beijing Foton Cummins Engine, before the delegation departs for Zhejiang Province, Indiana’s Chinese sister state.

IS IT TRUE that the Indiana General Assembly graciously bestowed upon our fair City $25.2 million for a new I U Medical School and in return the taxpayers of Evansville are required to drag their credit card to the tune of $57 million dollars?

IS IT TRUE that the Indiana Senate’s love for Evansville’s Ivy Tech is less then stellar and in the wake of their academic elitism, sliced 1,700 Ivy Tech medical professions students from the Indiana University Medical School?  …that our quiet little City on the banks of the Ohio finds that 50,000 square feet has been eliminated from this project?  … that the taxpayers of Evansville will still fork out $57 million dollars towards this project or will be subsidizing 70%  of the project even after cutting the size of the building?

IS IT TRUE that Mr. Winnecke deflected the failure of making IVY Tech a part of this project by saying, “Ivy Tech has issues at the State level” ?  …additional research would had discovered that IVY Tech has an outstanding job placement record of Medical students after graduation?

IT IS TRUE that if the Indiana University Medical School  project is reduced from 170,000 square feet to 120,000 square feet the City’s contribution should be reduced accordingly?

IS IT TRUE that once this fabulous facility becomes reality, the City of Evansville will NOT own the I U Medical School property?  …Its alleged  that local contractor Shanska-Evansville will have 100% ownership in this project after its built?   …its been alleged that Indiana University will pay rent each month on a building financed and paid for by the City of Evansville and the State of Indiana for the next 25 or 30 years to the local Build/Developer?  …does this transaction make any sense at all?
