City Councilwoman Brinkerhoff-Riley Discusses City Finances
Evansville City Councilwoman Stephanie Brinkerhoff-Riley will appear on CCO and WOODS and WOODS Tri-State Voices TV Show this Sunday to discuss the City of Evansville’s finances. Embattled Mayor Winnecke recently stated through his social media campaign account on Facebook that he was a “Great Mayor who has had to deal with a barrage of false attacks from those trying to distort the record on city finances.â€
Coucilwoman Brinkerhoff-Riley took issue with the Mayor’s campaign statement and released with this statement three (3) graphs related to City finances that pull numbers from the City Controller’s Annual Reports for 2012, 2013 and 2014. The first two demonstrate the declining balances in the City’s general operating account and its parks and recreation fund. Both graphs show an alarming loss of operating capital. The third graph tracks the City’s overall borrowing and demonstrates the debt taken on by the current administration.
“The City is at approximately $515 million dollars in bonded debt, and with the potential of another $80 million in borrowing this year for the medical center, hotel and North Main streetscape, the debt divided per citizen is $5,000 each,†stated Brinkerhoff-Riley.
Brinkerhoff-Riley went on to say, “With the likelihood that the City will have to borrow at least $600 million for water and sewer infrastructure, we need all the cash reserves we can generate to offset our borrowing. Residents cannot afford to foot the bill for these projects solely by increasing the utility rates. We already have the highest electric rates in the region. Adding the highest water/sewer rates will cripple our ability to facilitate economic growth.â€
“With deficit spending on an annual basis now the norm, we are heading in the wrong direction. The City’s financial problems are real, and no problem was ever solved by ignoring it. Our residents demand affordable housing, clean neighborhoods, smooth streets and accessible sidewalks. It’s time to focus on needs versus wants and create a spending plan that gets us back on track†added the Third Ward City councilwoman.

Disbarment order details lawyer’s profane, intimidating rants
Dave Stafford for wwwtheindianalawyer.com
Suspended Fort Wayne attorney R. Mark Keaton for years left profanity-laced voicemails and emails that threatened and harassed his daughter’s college roommate with whom he had developed an intimate relationship a decade ago. He was disbarred Tuesday.
The Indiana Supreme Court’s 12-page disbarment order in In the Matter of: R. Mark Keaton, 02S00-1302-DI-95, includes dozens of examples of what the Indiana Disciplinary Commission discovered – “threatening, abusive and highly manipulative†communications from Keaton to the woman identified as JD. She and Keaton “maintained a tempestuous long-distance relationship (from 2005) until March 2008, when JD permanently ended the relationship,†the order says.
Afterward, the court noted, JD recorded and preserved 90 voicemails from Keaton, and the court notes that from March 2008 to April 2010 at least 7,199 emails were exchanged, the vast majority sent by Keaton.
In a footnote, the court wrote, “One illustrative example among the many similar voicemails left by respondent and preserved by JD is the following:
“(Shouting) Call me the f*** back! I don’t know who the f*** you think you are. But I’ll tell you what, you better f***ing call me f***ing back now! You f*** with me one more time and this time you’ll really f***ing pay for it! And you need to think about it! Now you f***ing quit f***ing with me! I f***ing deal with your f***ing illness so f***ing long, don’t f*** with me another f***ing day! Not another f***ing day! You return my call right now!
“We agree with the hearing officer’s assessment that ‘[t]he true angry, hostile and threatening content and tone present in the voicemails can only be fully understood’ by listening to them. … Quite simply, they are profoundly disturbing.â€
JD obtained a protective order against Keaton in April 2010, and in May of that year, Keaton was charged with felony stalking in Monroe County. “This criminal case, which would prove to be the first of several legal proceedings spawned by (Keaton’s) conduct toward JD, eventually was dismissed without prejudice by the State in April 2011 based on personal privacy concerns raised by JD,†the order says.
Keaton also threatened to post explicit photos of JD, following through on the revenge-porn threat in 2008, when he uploaded images to various adult-oriented websites. In one email, he wrote to JD, “Just so you know, they’ve been up on one site since March 1, when you started this s***. 151 pictures to date; 209,748 hits!â€
The order says Keaton at one point hired a private detective to attempt to get JD’s contact information from her landlord after she changed her phone number.
“Put simply, Respondent engaged in – and continues to engage in – a scorched earth campaign of revenge in the wake of being dumped by JD seven years ago, in March 2008,†the court wrote in a per curiam opinion. “The scores of voicemails and thousands of emails sent by Respondent to JD are abusive, threatening, and extremely manipulative. Respondent exploited financial leverage and threats of violence and self-harm in attempting to coerce JD into communicating or meeting with him, and Respondent repeatedly carried through on his threats to disseminate intimate photos of JD and various unsupported accusations regarding her character to JD’s family, friends, academic and professional acquaintances, and the general public.
“Respondent showed up unannounced at JD’s residence, peeping into her bedroom window. Respondent also confronted JD in her law school library and later impeded her ability to get into her car and leave. After his conduct involving JD gave rise to criminal proceedings and a disciplinary investigation, Respondent filed three separate pro se lawsuits against JD and others, and later made duplicitous statements to the Commission in reference to those related proceedings.
“Most disturbingly, despite the entreaties of JD and several others, Respondent simply has refused to take ‘no’ for an answer. When asked at the disciplinary hearing what else JD might have told Respondent that would have convinced him to leave her alone, Respondent pointedly answered, ‘You know what, [c]ounsel, I don’t know if there is anything she could have ever said or done that would convince me[.]’ … And to this day Respondent refuses to part with the blog or with the explicit photos he continues to hold as leverage against JD; Respondent instead has told JD ‘[y]ou will simply have the mistakes you made plastered all over for all to see for the rest of your life.’â€
In addition to these allegations, Keaton was accused of failing to file an appeal after he collected advance payment from a client seeking to challenge a ruling that the client repay benefits because of unreported income.
Keaton had been under suspension for failing to fulfill continuing legal education requirements, and is disbarred and assessed the costs of the proceedings which determined Keaton had committed violations of five rules of professional conduct.

Legislation protecting Hoosier homeowners signed into law
STATEHOUSE – Legislation authored by State Representative Ron Bacon (R-Chandler) regarding mine subsidence insurance was signed into law by the governor.
House Enrolled Act (HEA) 1021 raises the maximum amount of available mine subsidence coverage to $500,000 per structure. Under current law, the Department of Insurance limits coverage to $200,000.
“This legislation is particularly important in southwest Indiana where many homes and businesses sit atop formerly mined property,†said Rep. Bacon. “Currently, structures valued at more than $200,000 cannot be insured for their full worth. This can lead to out-of-pocket expenses for homeowners and was an issue I felt we could easily address without having a significant fiscal impact on the state.â€
The Mine Subsidence Insurance Fund has a current balance of $5.2 million. Between fiscal years 2011 and 2013, approximately $2.6 million in claims were paid out from the fund.
HEA 1021 will go into effect on July 1, 2015.

IS IT TRUE APRIL 22, 2015

Does anybody see some challenges ahead of this City? Â Of course, there are some projects omitted from this list.
IS IT TRUEÂ at the last City Council meeting Alan Mounts stated that the missing $400,000 from the Evansville Water and Sewer account cited in the 2013 SBOA audit review matter has now been taken care of? Â …we look forward to Mr. Mounts providing the CCO details how this matter was resolved? Â …if this matter wasn’t resolved in the proper manner then it looks like we have yet another campaign issue for the Mayor to defend?
IS IT TRUE it has been brought to our attention that Judge Shively has donated substantial funds to Lloyd Winnecke’s campaign both as a judge and a private citizen? …that documents show that Judge Shively before taking office in what is to be a nonpartisan position as judge, donated to Winnecke personally and through his law practice?  … that later this week Judge Shively and 6 other Judges will be hearing oral arguments in the City of Evansville Residency case?  …we want the people of Evansville to have not only receive a fair and impartial legal opinion based on law and not partisan politics? …yesterday we received a phone call from a legal friend who ask us to do additional research concerning if Judge Shively has any possible conflict of interest issues pertaining to the upcoming Residency hearing?
IS IT TRUE the CCO did additional research on this issue and found the following information? …in 2014  Judge Shively was on the ballot.  …the Code of Judicial Conduct allows a Judicial Candidate to engage in campaign activity which includes fundraising and attending political events starting one year before the election?  … in 2014 he attended political functions of  both Democrats and Republicans?  … he made contributions not only to the Mayor but also to Democrats Stephanie Brinkerhoff-Riley,  Jonathon Weaver, and Kathryn Martin.? . ..Judge Shively disclosed these contributions to the lawyers in the pending Residency  case on 2/10/15 in open court and none of the lawyers objected to his involvement in hearing this case? …Judge Shively also disclosed to Evansville City Council Attorney Scott Danks the above information and Mr. Danks had no objections?  …Its important to point out that Mr. Danks also served on Judge Shively  election committee?
IS IT TRUE we now believe that the Honorable Judge Leslie Shively has no potential conflict of interest in the pending Residency case given his track record of striving for, and apparently achieving  judicial excellence not only as an attorney in private practice but also as a Superior Court  Judge?
IS IT TRUE that we are pleasantly surprised to see the local Democratic Party Chairman, Rob Faulkner finally come alive by writing in your face letters to local Republicans about bad decisions being made on the State level? …we been telling for months that Mayoral candidate Gail Riecken is bringing splinter groups back together into the Democratic party?
IS IT TRUE the Vanderburgh County Republican Party’s Lincoln Day Dinner is scheduled for tonight?….the Lincoln Day dinner has traditionally been the party’s largest fundraiser of the year?….tomorrow’s dinner is scheduled for 7pm with a VIP reception beginning at 6:00pm?….the event will be held at Old National Events Plaza (formerly known as the Centre)?….we hear that there are plenty seats available and if anyone is interested in the Lincoln Day Dinner, they may call Republican Party headquarters at 812-425-8207.
