0

The Vanderburgh County Sheriff’s Office graduated eight (8) new confinement officers from theJail Officers Course this past Friday, April 24th, 2015. Officers from both Vanderburgh and Spencer county completed the Basic Jail Officer’s Course.

In 2006, the Indiana Law Enforcement Training Board approved the Vanderburgh County Sheriff’s Office as a regional training site for this forty (40) hour course, which is required of all newly hired jail officers during their first year. The new officers were instructed in subjects such as: ethics, tactical communication, report writing, jail operations, physical security, searches, evidence gathering, booking and admissions, blood borne pathogens, cultural awareness, suicide prevention, mental illness and legal issues.

The regional officers returned to their respective agencies this week in order to continue additional facility specific training. Vanderburgh County Sheriff’s Office confinement officers will spend the next two weeks attending additional classroom and practical training, which will include topics such as: housing unit supervision, gang identification, defensive and physical tactics, record keeping and practical scenarios.

Upon completion of the classroom training, each new Vanderburgh County Sheriff’s Office confinement officer will be assigned to a Field Training Officer (FTO) for an additional eight (8) weeks before being permitted to work alone.

At any given time the Sheriff’s Office houses over 500 inmates and nearly 100 work release participants within the confines of a 156,722 square foot facility. As an Indiana Law Enforcement Academy accredited provider, the Sheriff’s Office accepts applications from outside agencies to attend the Confinement Officer Training School at our facility.

Woman’s battery conviction reversed due to fatal variance

Jennfer Nelson for www.theindianlawyer.com

A couple arrested after they screamed and resisted arrest at a local Department of Child Services’ office after learning their child was being removed from their care had all but one of their convictions from the incident upheld by the Indiana Court of Appeals Monday.

Adegoke Adetokunbo and Grace Itaniyi have a child together and were the subject of a DCS investigation, leading to the conclusion the child needed to be removed from their care. After learning the child would be taken away, Itaniyi began screaming and the DCS security guard, Luis Flores, and Indianapolis Metropolitan Police Department officer Perry Renn intervened.

When the couple refused to hand over the child, a scuffle ensued in which Adetokunbo punched Flores and Itaniyi pushed Renn away. Adetokunbo stiffened his arms when Renn tried to handcuff him, and Itaniyi, once handcuffed, tried to kick the officer.

They were both convicted of Class A misdemeanor resisting law enforcement, Class B misdemeanor battery, and Itaniyi was also convicted of Class B misdemeanor disorderly conduct. They both appeal their convictions in Adegoke Adetokunbo aka Robert Adesanoye, and Grace Itaniyi v. State of Indiana, 49A02-1407-CR-511.

The judges found sufficient evidence to support both of Adetokunbo’s convictions and two of Itaniyi’s convictions. But they reversed her battery conviction based because the charging information said Itaniyi touched the security guard. The state failed to present any evidence she made any contact with Flores, but there was testimony she pushed Renn.

The state argued this was an immaterial variance, but the judges disagreed. In this case, it was necessary for the information to name the correct victim. This is a material, fatal variance under Indiana Supreme Court precedent, therefore her conviction must be reversed and vacated, the COA held.

IS IT TRUE APRIL 28, 2015

IS IT TRUE  on April 9, 2014, the City of Evansville was served with a TORT CLAIM NOTICE against the Evansville Police Department? …this notice states that you are hereby notified that Angel Santiago Pedrosa, does hereby make claim against the Evansville Police Department, unknown Officers, and other agents, and other representatives, and the City of Evansville for violations of his civil rights, harassment, and damages as the result of the Evansville Police Department’s unprofessional misconduct, and abuse of power? …this TORT CLAIM NOTICE also alleges that on April 2, 2015, Mr. Pedrosa was pulled from a vehicle he was a passenger in by numerous officers with the Evansville Police Department? …Mr. Pedrosa was repeatedly tazed, struck and punched by officers who kept shouting for Mr. Pedrosa to stop resisting? …the other passenger in the vehicle with Mr. Pedrosa was able to record the incident, with his cellular phone, and the recording clearly shows Mr. Pedrosa was not resisting, and that Mr. Pedrosa was the victim of a vicious, unprovoked, attack by the officers? …that this TORT CLAIM NOTICE further alleges that the acts of the Evansville Police Department were criminal, willful, wanton and malicious, as those terms are contemplated by 1.c. 34-13-1 et. seq., and were contrary to the written policies of the Evansville Police? …in addition, the conduct of the Evansville Police Department violated Mr. Pedrosa’s constitutional rights? …the amount of damages sought by the claimant is $700,000? …that well known and agressive trial lawyer Mark K. Phillips of Boonville represents Mr. Pedrosa in this TORT CLAIM NOTICE?

IS IT TRUE here is the report from Evansville Watch that a CCO blogger just posted about the above event? …this post states- “Assault behind United Caring Shelter on NW 6th St. Male subject has been stabbed in the head. EPD on scene, AMR & E1 en route”. ‪#‎ewatch‬?  …*UPDATE 3:50pm: “Apparently the victim in this was not stabbed, but was beaten by the suspect. At this time, police are calling it a Battery w/ Serious Bodily Injury”?  …we want to thank the poster called Justplaindumb for this additional information?

IS IT TRUE it’s about time the Evansville City Council address the use of City Fire trucks at political picnics and rallies? …last Saturday “Evansville’s First Lady” McClintock posted on her Facebook that the Lorraine Park Picnic hosted by Missy Mosby and Laura Brown Windhorst was a great event? …only a few area residents (around 15 people) attended this event? …Evansville Fire Station #16 was in attendance at this poorly attended event? …the Mayor and “First Lady” McClintock were the only invited special political guests at this event?

IS IT TRUE that months and months ago Jeffrey Fisher was named General Manager of WEVV.? … when Bayou Broadcasting purchased the station they promised they would bring back a local news program each night on CBS44 and possibly FOX44? …the station’s sale has been finalized, Fisher is now General Manager replacing Tim Black and still there is no local news show? …what are we waiting for? … we encourage Jeff to get started immediately and enhance the local news competition in the Evansville area?

IS IT TRUE you need to take time and go to our Tri-State Voices TV Show posted in todays City County Observer video section? This weeks program features City Councilwoman Stephanie Brinkerhoff-Riley giving us an extremely investing presentation a the looming city debt facing the taxpayers of this community? … we agree with Brinkerhoff-Riley statement that professional services contracts should be bid out? …if this happens the taxpayers would save millions of dollars every year?

WARRICK COUNTY PROSECUTOR PROMISE TO CATCH COMPUTER CRIMINALS

3

In the interest promoting trust and sharing information between the residents of Warrick County and the Prosecutor’s Office, we offer the following press release:

Shortly after taking office, I became aware of a possible breach of computer security that occurred in the Prosecutor’s Office sometime in March or April of 2014. This breach was the result of email that was infected with something known as a “cryptolocker virus.” This type of Vins infects a servers’ files, and encrypts them so that they are no longer useful. A secondary aspect of this particular virus IS a message from the originator of the virus that for a certain amount of “cyber” money (e.g. bitcoin), the encryption would be reveÆed and the files restored.

Some of the files that were included in this security breach were those in the Child Support Division, which include potential personal identifiers such as Social Security NumbeÆ, Names, Addresses, Personal Tax information, etc.

The duties and responsibilities of this office mandate that the elected Prosecutor immediately notify certain government agencies of a suspected breach, including the IRS, the Federal Social Security Administration, and the State Child Suppor Bureau (among otheB). After a thorough investigation, it was determined that such notification was never done. In fact, during this investigation, it was discovered the elected Prosecutor at the time, Ms. Joann Krantz, not only failed

to notify any of the respective agencies, she issued express orders to all employees that this matter was not to be discussed with anyone. This directive was contained in an email that stated, “Important reminder- “what happens in Vegas stay’S in Vegas”- including issues/problems we might have with software and equipment.” (See attached).

Conversely, upon receipt of the information of the security breach, I immediately notified the District 8 Regional Child Support Representative of the suspected breach. ‘Illis individual in turn, notified the State ffild Suppor Bureau, who then began an exhaustive investigation into this matter, which included cooperation among the Warrick County Prosecutors Office, the Federal SSA, the IRS, and members of the State ffild Support Bureau.

Several points of emphasis were gleaned from this investigation. First, under the dirction of the elected prosecutor, the child support staff were improperly scanning Title IV-D cases and

storing them in an unsecured fashion. Secondly, the elected prosecutor failed to fulfill the duties and obligations of her office by reporting the suspected breach and instead elected to suppress this information, which action hindered the subsequent efforts to determine if any personal information had been illegally obtained.

Finally to the best information that all the invested parties to this investigation can determine at this date and time, there appears to not have been any personal and identifying information obtained by impermissible parties as a result of this breach. All available resources have been maBhaled to ensure that future breaches will be next to impossible. We, as law enforcement officials are more than aware that Identity Theft is a very serious, and ever increasing crime. The Warrick County Prosecutor’s Office assigns the protection of an individual’s personal, identifying information as a highest priority. If, however, by some illegal method, the computer servers of this office are invaded by some outside source, we can assure the general public that all appropriate authorities will be notified, all steps will be taken to protect the identities and identifying information of individuals who may have such on file with our office, and all individuals responsible for these criminal actions will be prosecuted.

Ve sincerely,

Michael J. Perry,

Warrick County Prosecutor
