Drawing close to the 2015 legislative session

With the end of session drawing near, there are still many bills going through the legislative process and making their way to the governor’s desk. Many important pieces of legislation like the Indiana budget requires extensive discussion and debate and will not be finalized until the very end of our time here.

There are many factors to consider when crafting the state’s spending and savings plan for the next two years. Overall, our goal is to pass an honestly balanced budget with no tax increases that funds our state’s priorities, mainly education and public safety. While the budget includes additional funding for several public safety initiatives, I was also proud to work on several bills this session towards this goal.

Currently, Senate Bill (SB) 532, which works to combat human trafficking, is making its way through this process. As House sponsor, SB 532 would establish the Human Trafficking Prevention and Victim Assistance Fund by utilizing funds acquired from crimes involving human trafficking. Creating this fund will not only help provide victims of human trafficking with specialized services, but also works to reduce the amount of victims trafficked in Indiana.

TeamHealth Honors Emergency Physician Otto Charles Susec Jr., MD, at St. Mary’s Health

Otto Charles Susec Jr., MD, medical director of the emergency department at St. Mary’s Health in Evansville, Indiana, and St. Mary’s Warrick in Boonville, Indiana, was recently named Medical Director of the Year for TeamHealth’s Emergency Medicine Central Group. The awards ceremony was held April 15 in Dallas, Texas, during TeamHealth’s National Medical Director Leadership Conference. Selected by TeamHealth’s operating presidents, Dr. Susec is among nine individuals out of more than 750 clinical leaders across the country who were recognized for excellence in physician leadership.

“We are pleased to announce and honor our 2015 Medical Directors of the Year,” said Miles Snowden, MD, chief medical officer for TeamHealth. “These distinguished men and women personify physician leadership as they provide compassionate, high-quality care for patients, excellent service for our hospital partners and outstanding leadership for their respective clinical teams.”
“Dr. Susec understands the importance of everyone on the team,” said Nancy McCleary, Executive Director Emergency Department for St. Mary’s Health. “He graciously recognizes associates for their effort, is insightful into their strengths, and quickly recognizes others for their contributions.”

St. Mary’s is part of Ascension, the nation’s largest Catholic and non-profit health system.

Justices affirm LWOP sentence, admission of suicide note

A southern Indiana man challenging his robbery and murder convictions and sentence to spend the rest of his life in prison lost his appeal before the Indiana Supreme Court Thursday. The justices rejected the man’s claim that his sentence should be reduced to a term of years.

Charles Stephenson was sentenced to life in prison without parole for the 2012 robbery and murder of 67-year-old Leigh Jennings in Aurora. Stephenson, who was heavily in debt, had borrowed money from Jennings in the past, who distrusted banks and kept her money at her house. She was found brutally bludgeoned to death in her kitchen. Several days after her body was discovered, police went to Stephenson’s home and found he had attempted suicide. A suicide note denied any involvement in the murder.

Stephenson raised multiple claims in Charles Stephenson v. State of Indiana, 15S00-1401-LW-40, including that the physical evidence had to show that the violence against Jennings was part of a plan to take her property and not just part of the murder; and that evidence regarding his attempted suicide should not have been admitted at trial.

“There is no evidentiary support for the defense theory that the defendant first murdered Jennings and only thereafter decided to take her property,” Justice Brent Dickson wrote. “To the contrary, the evidence and its reasonable inferences show that the defendant, deep in debt, distraught, and desperate for cash, (1) went to Jennings home purposefully to obtain money and, either in response to her refusal to give it to him or in the absence of such refusal, (2) struck her in the head multiple times, killing her, and then (3) took cash from her safes. Obtaining Jennings’s money was the defendant’s objective. Whether the murder was committed in the course of the robbery or after its completion does not undermine the correctness of the robbery conviction.”

Stephenson argued the attempted suicide evidence was inadmissible because it wasn’t relevant to Jennings’ murder, and even if it was, it should have been excluded under Ind. Evidence Rule 403 because any probative value was outweighed by the prejudicial impact.

“We decline to find that the mere existence of an attempted suicide, without more, is relevant evidence of a person’s guilty conscience about committing a charged crime, especially a charged crime which the person expressly disavows when the suicide is attempted. Because we conclude that the attempted suicide evidence was relevant to the issue of motive for the ensuing robbery and murder, however, its tenuous use as evidence of consciousness of guilt does not undermine its admissibility,” Dickson wrote.

The high court found the circumstances of the crime support the sentence of life without parole and refused to reduce Stephenson’s sentence to a term of years.

BREAKING NEWS: EVANSVILLE BAR ASSOCIATION PRESENTS JAMES BETHEL GRESHAM FREEDOM AWARD TO THE HONORABLE JUDGE RICHARD YOUNG

 judge YoungThe Evansville Bar Association recognized Hon. Richard Young by presenting the James Bethel Gresham Award to him on Friday, April 24, 2015, at the annual Law Day dinner hosted by the organization.

Judge Young began his legal career in 1980 at the firm of Hayes and Young.  During that period he served as Corporation Counsel for the City of Evansville and as a Public Defender in the Vanderburgh Circuit Court. He was a member of the House of Delegates of the Indiana State Bar Association, and served on the Board of Directors of the Evansville Bar Association, serving as its president from 1994-1995.

Judge Young was appointed District Court Judge for the Southern District of Indiana in March 1998, and has served as Chief Judge since November 2009.  Prior to his appointment, he served as Judge of the Vanderburgh Circuit Court for eight years.

He is currently serving as the elected Seventh Circuit District Court Judge Representative to the Judicial Conference of the United States, and also served on its Committee on the Administration of the Magistrate Judges System. He is a member of the Board of Visitors at the Indiana University Maurer School of Law.

Judge Young is a regular speaker and panelist at federal and state law seminars and trial advocacy programs.

The James Bethel Gresham Freedom Award was established by the Evansville Bar Association to recognize and honor individuals who have distinguished themselves in activities or careers which have elevated respect for the law, promoted freedom, or otherwise furthered the ideals for which Law Day is recognized and celebrated. The purpose of Law Day is to remind people throughout the country of the importance of the law and the role that it plays in our lives and in the basic freedoms which we all cherish and enjoy.  This award is named in honor of James Bethel Gresham who lived in Evansville from 1901 to 1914 and is believed to have been the first American soldier to have given his life in combat during World War I.

I am confused about this morning. I spoke to you Friday morning, and you were 99% sure that the DMD was applying for a TIGER grant. You seemed excited about the project.

This morning, you reported that the grant application is scrapped, you only had a 2% chance of getting the funds and you met with neighborhood stakeholders to tell them. When did that happen?

I spoke with Marianne from Donnelly’s office this morning. She said she would never have told you 2% or any percentage. She recounted her conversation with you last week as positive. Who did you talk to that told you that we had no chance?

IS IT TRUE hats off to the Honorable Judge Les Shively for receiving  clearance from the Indiana Supreme Court to have Thursday’s Residence Ordinance hearing televised on WNIN-PBS9?  …this special en banc session made it possible for seven judges to sit in the Civic Center Council chambers to hear the administration attorney Bob Burkart and City Council Attorney Scott Danks make impressive legal arguments concerning the city residence ordinance?  …we can’t wait to hear what the Judges ruling in this case will be?  …we feel this issue will be decided on law and not politics?

IS IT TRUE our most recent “Readers Poll” voters believe that Cheryl Musgrave is indeed a true Republican by a vote of 95 to 15 (86% vote margin)?

IS IT TRUE Pollock Avenue Southeast side streets are in much disrepair?  …these side streets should be in good shape since sewer lines have been installed over the last couple of years?  …we don’t understand why the city has failed to re-install the sidewalks and curbing and do some needed street paving in that area in a timely manner?  …it looks like a $160 million dollars doesn’t buy much anymore?

First Street in the Historic District?  … we wonder why Winnecke campaign signs are so popular in the 500 and 600 blocks of that  area?  …. could it be that the Mayor donated $150,000 from the City Engineers Street Repair Fund to help subsidize the Historical street lighting project in that area?  …we hear that people living in the other 26 blocks of the downtown TIF District are very upset?  …. they feel the city should had subsidized period lighting or use the fund to pave city streets in their area?

First Lady Karen Pence Hosts Second Annual “Indiana First Lady’s Charitable Foundation Luncheon” to Promote and Support Hoosier Agriculture

Awards $65,000 to Feeding Indiana’s Hungry

Indianapolis – First Lady Karen Pence today hosted the second annual fundraising luncheon to support the Indiana First Lady’s Charitable Foundation, which strives to support and recognize communities and organizations that promote the well-being of Hoosier children and their families.

 

“We started the Foundation to shine a light on the people and organizations that are working every day to benefit our children and Hoosier families. Our hope is that by promoting these organizations, we can help them further their efforts and reach more families across Indiana,” said First Lady Karen Pence.

 

“The First Lady’s Luncheon is a culmination of our efforts and serves as the primary fundraising event for the Foundation,” said the First Lady. “I am so pleased and honored that Judy O’Bannon, former First Lady of Indiana, was able to be a part of this special day.”

 

The First Lady’s Luncheon, “Hoosier Home Grown,” held at the JW Marriott in downtown Indianapolis, was attended by more than 600 people, including statewide elected officials, Lieutenant Governor Sue Ellspermann, State Treasurer Kelly Mitchell State Auditor Suzanne Crouch, and Superintendent of Public Instruction Glenda Ritz.

 

“This event and the fundraising success we have had with the Foundation is a testament to the hard work and the amazing talents of my board of directors who guide our efforts at the Foundation. I especially want to thank the committee of women who planned the luncheon and made this dream a reality,” said the First Lady.

 

The luncheon was filled with many surprises for guests, including entertainment provided by 6th Season Winner of The Voice, Josh Kaufman, and a check presentation to Feeding Indiana’s Hungry. First Lady Karen Pence presented a check to Feeding Indiana’s Hungry in the amount of $65,000 to Emily Weikert Bryant, the organization’s Executive Director. Mrs. Pence will be donating potted flowers from the luncheon to Indiana FFA as well as Keep Indianapolis Beautiful.

 

“I’m thrilled to be working with this important Hoosier charity, and I’m so thankful for the work of Feeding Indiana’s Hungry in the lives of Hoosiers across the state,” said First Lady Karen Pence. “On behalf of the Indiana First Lady’s Charitable Foundation’s Board and Luncheon Committee, we are extremely thankful for the generous hearts of today’s sponsors and attendees that make it possible to present the major grant award of $65,000 to Feeding Indiana’s Hungry. I am confident they will continue to touch and bless many Hoosier children and families.”

 

“We are so grateful for the support and work of First Lady Karen Pence toward ending hunger in Indiana,” said Emily Weikert Bryant, Executive Director of Feeding Indiana’s Hungry. “With the help of the First Lady’s Charitable Foundation our network will be better able to serve the more than 1.1 million Hoosiers who rely on food banks, pantries, soup kitchens, and other programs so that hard working Hoosier families, seniors and children have enough food on their tables to live a healthy and productive life.”

 

Each year the Indiana First Lady’s Charitable Foundation selects a different charity as a major grant recipient to highlight at the First Lady’s Luncheon. The Foundation also awards smaller grants throughout the year.

 

“We are very excited to soon begin announcing the recipients of our grants for 2015. There are so many worthwhile organizations doing wonderful work across Indiana. In 2014, we were thrilled to award grants to 83 organizations and charities across Indiana impacting 68 counties. It was an honor and a pleasure to be able to support them and to share their good stories through the Foundation,” the First Lady said.

About the First Lady’s Luncheon

The Indiana First Lady’s Luncheon, which serves as the primary fundraiser for the Indiana First Lady’s Charitable Foundation, is modeled after the U.S. First Lady’s Luncheon held every year in Washington, D.C. and includes similar features, such as a surprise guest entertainer, center pieces, linens and bags made specifically for the event, and a showing of bipartisan support.

 

Luncheon co-chairs Patti Coons and Jennifer Ping hope the First Lady’s Luncheon will become a valued tradition for Indiana for many years to come. Indiana is the only state to have a First Lady’s Luncheon.
