Change in tax law allows profitable retailer to receive refund

A ruling from the Indiana Tax Court has positioned a retailer who recorded a banner year in sales and growth in 2003 to get a tax refund from the state of Indiana.
In 2003, Rent-A-Center East, which includes the stores in Indiana, filed an Indiana corporate adjusted gross income tax return reporting zero AGIT liability and requesting a nearly $500,000 refund. The Indiana Department of State Revenue countered the retailers owed $513,272.60 in AGIT, penalties and interest for the 2003 tax year.
The dispute first came before the Indiana Tax Court in 2011 where summary judgment was granted in favor of RAC East. However, the Indiana Supreme Court reversed and remanded.
Again, the Tax Court has granted summary judgment in favor of RAC East in Rent-A-Center, Inc., v. Indiana Department of State Revenue, 49T10-0612-TA-000106.
“While the Court is aware that a taxpayer may use its business structure and transfer pricing policies to lower its state income tax liability, the evidence designated in this case simply does not indicate that RAC East has engaged in any improper tax avoidance measures,†Judge Martha Blood Wentworth wrote.
The revenue department contended that RAC East spread its revenue around to the other corporate divisions, RAC West and RAC Texas, in order to reduce its Indiana taxable income to zero. RAC East, the department argued, should have filed a combined income tax return with its two affiliates.
In particular, the revenue department pointed to the results from 2003 and argued RAC East’s separate return did not fairly reflect its Indiana source income. RAC East enjoyed a record-setting year because its Indiana property, payroll and sales factors all grew and the Indiana operation contributed more than two-thirds of the $2.2 billion revenue increase within the entire RAC company.
The Tax Court acknowledged the growth and revenue results do not facially support the retailer’s zero tax liability. Yet, the Tax Court pointed to a change in Indiana’s corporate income tax laws between 2002 and 2003 which limited companies to only paying AGIT.
“Indeed, the designated evidence reveals that RAC East requested a refund because it had overpaid its Indiana income tax liability by making estimated tax payments in both 2002 and the first two quarters of 2003,†Wentworth wrote. “….In this case, therefore, the amount of RAC East’s 2003 profits, the fact that its 2003 Indiana AGIT liability was zero and its nearly half-million dollar refund request do not show that its separate return failed to fairly reflect its Indiana source income.â€

IS IT TRUE other Governmental entities the Teamsters Local #215 deal with in Vanderburgh County  are the Highway Dept.,  Burdette Park,  the Centre, Vanderburgh County Sheriff’s Office Detention Officers and Civilian Support Staff,  Evansville Housing Authority Maintenance, Evansville Vanderburgh Building Authority,  and the Evansville Vanderburgh Airport Authority?
IS IT TRUE we wonder why the above contracts are regularly negotiated  by the Teamsters Local #215 with the above Government entities with very little controversy?  …why are the Teamsters Local #215 are having  problem with EVSC?

IS IT TRUE that about 7 individuals employed with the EVSC make more than the Mayor of Evansville?
IS IT TRUE we recommend that you don’t write an OP-ED article to the local newspaper about the EVSC School Board activities? Â …if you do, Â you can expect EVSC School Superintendent Dr. David Smith to call and invite you to lunch so he can explain why all the comments in your article were wrong?
IS IT TRUE we wonder when will the EVSC School Board members realize that they are in charge of deciding the future direction of the School System and not the Superintendent of Schools?

Dr. Bucshon Releases Statement Supporting Gov. Pence’s Letters on Iran Deal
(WASHINGTON, DC) – On Tuesday, Eighth District Congressman Larry Bucshon, M.D. released the following statement in response to letters sent by Governor Pence expressing his disapproval of the Iran Deal negotiated by President Obama:

“This deal threatens the security of Americans at home, our allies around the world, and the sovereignty of states, like Indiana, that have put in place sanctions against Iran,â€Â said Bucshon. “Our state, and others across the country, should not be coerced by the federal government to do business with the world’s leading state sponsor of terrorism. I share the concerns of Governor Pence and intend to continue my work to stop this bad agreement.â€
Governor Pence and 14 other governors sent a letter to President Obama in opposition to the Iran Deal and to ensure state-level sanctions are not superseded by the federal government. Governor Pence also sent a letter to the Indiana Congressional Delegation urging a vote against the deal. The House is expected to vote this week on H. J. Res. 64, a resolution disapproving of the agreement transmitted to Congress by the President on July 19, 2015, relating to the nuclear program of Iran.

USI Art alumni send postcards to their alma mater for exhibition
Wish You Were (Still) Here: An USI Art Alumni Exhibition opens at the McCutchan Art Center/Pace Galleries on September 13 and runs through October 25. It features art postcards created by USI art graduates and is a USI 50th anniversary event.
Art alumni were asked to produce postcard-sized works of art including information on what they’ve been doing since graduation on the back. The definition of “postcard†was a broad one, and included a variety of art media including small three-dimensional “postcards.â€
An artists’ reception will be held from 7 to 9 p.m. Friday, September 18 at the McCutchan Art Center/Pace Galleries, located in the lower level of the Liberal Arts Center on the USI campus .The reception is free and open to the public. Refreshments will be served.
