Board of School Trustees of the Evansville Vanderburgh School Corporation Meeting

The Board of School Trustees of the Evansville Vanderburgh School Corporation will meet in executive session at 3:30 p.m. on Monday, August 10, 2015, in the John H. Schroeder Conference Centre at the EVSC Administration Building, 951 Walnut, IN 47713, Evansville, IN. The session will be conducted according to Senate Enrolled Act 313, Section 1, I.C. 5-14-1.5-6.1, as amended. The purpose of the meeting is for discussion of collective bargaining, (2)(A); initiation of litigation or litigation that is either pending or has been threatened specifically in writing, (2)(B); purchase or lease of property, (2)(D); and job performance evaluation of individual employees, (9).

The regular meeting of the School Board will follow at 5:30 p.m. in the EVSC Board Room, same address

Failure to read contract no protection against liability

A coal mine superintendent failed to convince the Indiana Court of Appeals that he should not be held liable because he did not understand the contract he signed.

M & M Pump & Supply Inc., filed a lawsuit against Lily Group and its superintendent David Smith after the latter company defaulted on payment. Green Circuit Court granted summary judgment in favor of M & M and held Smith liable for $63,913.26.

Before the Court of Appeals, Smith asserted the trial court erred when it rejected his argument that he did not know he was signing a guarantee. Smith signed the credit agreement with M & M in August 2011. The contract included a provision that stated the individual who signed personally guarantees to pay M & M if Lily Group fails to pay.

The appellate panel found Smith’s mistake would not preclude summary judgment. Citing Clanton v. United Skates of America, 686 N.E.2d 896, 899-900 (Ind. Ct. App. 1997), the Court of Appeals noted a person is presumed to understand the documents he signs and cannot be released from the terms because he failed to read it.

The case is David Smith v. M & M Pump & Supply, Inc., 28A012-1502-CC-57.

Public Nudity Arrest

On Tuesday, July 29, 2015 at approximately 4:00 p.m. a subject was driving a blue, Ford Mustang Convertible in the parking lot of Eastland Mall exposing his genitals.

The incident was first reported by a 16 year-old female. The juvenile’s mother posted a description of the subject and the vehicle on a website called Evansville Watch. A second female victim who had her 7 year old daughter with her also reported that the subject exposed himself to her as they left the mall.

As a result of the posting on the website, a concerned citizen saw a vehicle matching the description and took a photograph of the license plate. That plate was turned over to EPD investigators. Snyder became a person of interest as a result of that information.

On Friday, July 31, Snyder spoke with an investigator from the Evansville Police Department and made some admissions. On Monday, August 3, photographs of Snyder’s vehicle were released to the media. As a result of that media release an additional victim contacted investigators with information.

As a result of the public indecency charges a PTR (Petition to revoke) warrant was issued for Snyder from a previous, unrelated charge. He surrendered himself to the VCSD on Tuesday, August 4, 2015 and is currently in custody. Kent Joseph Snyder – DOB: 08/10/1985 is being charged today with two counts of Public Nudity (Class B Misdemeanor) and one count of Public Indecency (Class A Misdemeanor).

Response to last Wednesday’s unsigned Editorial By The Evansville Courier and Press Titled “Rural residents Chose To Pay More”

First, all the residents of Vanderburgh county voted to defeat the ill fated Consolidation plan several years ago, in fact the anonymous author seemed to fail to remember that 59% of the city residents voted to defeat this plan. Should they then pay extra for their sewers?

Second, there was a section in the plan (7.2.1) indicating a pledge to  equalize  the sewer rates over a three year period  but suffice it to say the people have heard promises from politicians before and this was just another promise in this document that the voters did not believe in.

The fact is that rural residents that are connected to the sewer system pay higher rates because the State law allows it, the City run public utility asked for it, the City appointed utility board passed it, and the City elected City council voted for it. Do you see a pattern here? All City appointed or elected people decided to charge more for a public utility to a group of people who have no power to remove them from their position. Sounds like “Taxation without representation”

To make matters worse the State government which allows this to happen also allows the Evansville Sewer system to operate unregulated by the IURC (Indiana Utility Regulatory Commission).  So when the State law says ” the burden of proof to demonstrate that the proposed rates and charges are nondiscriminatory, reasonable, and just is on the municipality”  (IC8-1.5-3-8 Sec 8.3g), the State should regulate that condition. I don’t think the State legislators would approve of using the median income of the rural residents being higher than the median income of city residents,  as a demonstration of reasonable or just cause for increased sewer fees (City council meeting Oct 28, 2013).

Finally, if you look at the proposed remediation plan that the city has proposed as I have, you will find that of the some $540 million dollars planned to be spent on the remediation of the Evansville sewers and not one penny of it is being spent outside the city limits of Evansville. With friends like this who needs enemies.  First they charge you more money for the same service as city residents then vote to make you pay more to fix the problems that reside only within the city and more specifically within the area of the city that has combined storm and sanitary sewer systems. I thought we were all one big happy community?

I challenge the rural residents to contact your State legislators and the IURC and demand to stop this nonsense and change the law to prevent this from happening again. If the State is going to pass a law, then they should be required by that law to enforce its conditions. Residents of the rural community are willing to pay their fair and equal share but should no longer stand still while the public utility discriminates against them with unreasonable and unjust sewer rates.

ST. MARY’S TO HOST  AARP SMART DRIVER PROGRAMS

Driving helps older adults stay mobile and independent. However, the risk of being injured or killed in a motor vehicle crash increases as you age. Approximately 500 older adults are injured every day in crashes, according to a 2011 NHTSA report. Thankfully, there are steps that older adults can take to stay safer on the roads.

St. Mary’s Health will host the new AARP Smart Driver Program in three separate four-hour classroom refresher courses:

  • Wednesday, August 19, Noon to 4:00 p.m. in Meeting Room 2, St. Mary’s Health, located by taking the elevator to the lower level of the main hospital.
  • Monday, September 14, Noon to 4 p.m. in Meeting Room 2, St. Mary’s Health, located by taking the elevator to the lower level of the main hospital.
  • Tuesday, October 13, 12 Noon to 4 p.m. in Meeting Room 2, St. Mary’s Health, located by taking the elevator to the lower level of the main hospital.

The course will not require seniors to drive or take tests. Attendees will learn how to adjust driving due to age-related changes in vision, hearing, and reaction time. The course will also include information on aggressive drivers, defensive driving techniques, new traffic laws, latest safety technology, distracted driving, and more.

Auto insurance multiyear discounts may apply to AARP Driver Safety Program graduates.  Attendees should consult their vehicle insurance agent. If eligible for insurance discounts, attendance for one full four-hour program is mandatory.

The fee is $15 for AARP members and $20 for non-members and includes a workbook and course certificate of completion.
