Dr. Bucshon Votes to Overhaul Education System, Empower States and Parents

On Wednesday, the House of Representatives approved the conference report for S. 1177, the Every Student Succeeds Act,  a measure that replaces No Child Left Behind, reins in the federal government’s ability to intervene in K-12 education, restores state and local control, and empowers parents.

 

Eighth District Congressman Larry Bucshon, M.D. released the following statement regarding the passage of S. 1177:

 

“This legislation represents the first major education overhaul since 2002. With it, we reign in federal intervention, restore state and local control, and empower parents to make decisions on what’s best for their children regarding K-12 education. Without it, states and families will continue to be subject to the one-size-fits-all federal approach from the Department of Education that’s not working for students,” said Bucshon. “As a father of four, I understand how critical it is that education policy be set as close to the student as possible.  These common-sense reforms help accomplish that goal.” 

 

S. 1177 passed the House by a vote of bipartisan vote and represents a melding of proposals approved separately by the House and Senate earlier this year.

 

BACKGROUND:

 

Congressman Bucshon recently traveled the 8th District during his “Education Tour,” where he met with area educators to discuss S. 1177 and other issues impacting their ability to teach students.

 

Highlights of S. 1177:

 

·         Places new and unprecedented restrictions on the authority of the Secretary of Education.

·         Prohibits the Secretary of Education from forcing, coercing, or incentivizing states into adopting Common Core. Those prohibitions can be found in sections 8544, 8525A, and 8527 of the legislation.

·         Ends the era of federally-mandated high-stakes testing.

·         Eliminates the federally-mandated one-size-fits-all-accountability system.

·         Repeals 49 ineffective and duplicative federal programs.

·         Provides states and schools with new funding and flexibility.

·         Offers parents more school choice.

USI Women’s Golf signs two for 2016-17

University of Southern Indiana Women’s Golf announced that two incoming freshmen have signed national letters of intent to compete for the Screaming Eagles next fall. Abbey Leighty (Mt. Carmel, Illinois) and Grace Davis (Valparaiso, Indiana) are set to join USI and Head Coach Lu Anne Howerton in 2016-17.

“I am excited to add Abbey and Grace to our 2016 fall roster,” said Howerton. “They have some pretty big shoes to fill with us losing three of our top four players, but I am confident we are building a great future!”

Abbey Leighty is currently a senior at Mt. Carmel High School in Mt. Carmel, Illinois, and is a three-time individual IHSA State Golf Tournament qualifier, finishing third in 2014 and 2015.

“Abbey is consistent and an excellent ball striker,” said Howerton. “She has finished at the top of the leader board in several major tournaments, gaining her the experience she needs to compete at the college level.”

Leighty has been a member of two consecutive Big 8 Conference Championship teams as well as three consecutive IHSA Regional Championships at Mt. Carmel. As a junior golfer, Lighty is a four-time Elks Regional Champion and has multiple Evansville Junior Golf Association victories.

A four-time letter winner at Chesterton High School (Chesterton, Indiana), Grace Davis finished her high school career with a 36th-place finish at the 2015 IHSAA State Tournament as an individual.

“Grace, a long ball hitter, has a great mental game which is hard to find, especially in a freshman.” said Howerton. “Putting together a great work ethic and the willingness to learn, Grace will be a strong addition to the line-up.”

As an individual, Davis finished her senior year with All-Area, All-Conference, and All-State accolades. CHS finished third at the state tournament after winning sectional and regional titles in 2015.

The Eagles resume their 2015-16 this spring.

GOT GNATCATCHERS?

Congress should establish a policy that all grants issued by the Department of Defense must support national security FWS listed the coastal CAGN, a tiny blue-gray bird, as a “threatened” species in 1993. Earlier this year, DOD issued a grant worth $283,500 to survey “at least ten California gnatcatcher (CAGN) pairs in order to determine use throughout each vegetation alliance.” Thankfully DOD provides an explanation for this, which includes monitoring of CAGN nests, the ability of baby CAGNs to learn to fly, and the temperature and availability of food around the nest. The surveyor would also document any instances of cowbirds, another small bird, laying eggs in CAGN nests. (Note: Evidently the Cowbirds tend to do this for some reason.)

In what universe should DOD spend $283,500 to study the day-to-day life of a tiny bird? How is American national security strengthened by this study? DOD should be in the business of defense, not nature conservancy. First, there is an entire federal agency that does things like this: FWS. Second, any project like this, regardless of the agency in charge, should always have to publicly demonstrate the purpose and rationale for any grant, and publicly release the findings afterwards.

Congress should work with DOD to ensure there are no federal restrictions to the Department remaining completely focused on keeping the homeland safe. DOD should not feel obligated to fulfill the mission of other federal agencies. It has a tough enough job already

A $4 MILLION REBEL

Last year, Congress gave $500 million in federal tax money to train and provide equipment for at least 5,400 Syrian rebels fighting against ISIL. Over the next year, DOD spent about half of that amount and managed to train an overwhelming force of 60 fighters. In other words DOD spent about $4 million per rebel.

This resounding lack of success is likely why on October 9, 2015, the Obama Administration announced a “pause” in the program to reevaluate how the U.S. would support those fighting against ISIL. In a press release, DOD announced it would begin to provide equipment and weapons to select rebel leaders instead of training them.

It is good DOD finally recognized that this training and equipping program did not work. However, it should not have taken a year and $250 million to figure that out. DOD should have evaluated this program at every stage rather than wait a year to decide its fate. The federal government absolutely needs to support those who fight on the ground against this terrorist group. But Americans deserved to get more for their tax money. A clear Syria strategy is long overdue from this White House. Americans can see the obvious threat, and most Americans understand that sending 60 rebels into Syria at a cost of $4 million each is not a winning strategy.

THE TRUTH IS NOT CHEAP

The cost of telling the truth? Apparently, it is $545,000 at State. In March 2014 State’s School of Leadership and Management sought a contractor to provide training courses to “senior level officials on effective congressional testimony and briefing skills.”  The name of the course? “Communicating with Congress: Briefing and Testifying.  Additionally the contractor would assist with the design of congressional testimony prep classes for individuals who are nominated to be ambassadors and one-on-one classes for individuals set to testify before Congress.

So basically American taxpayers paid more than $500,000 to have a contractor teach people how to sit before a congressional committee and answer questions.

It is understandable that State wants to prepare its witnesses, perhaps to avoid embarrassing situations such as the nominee-to-be Ambassador to China saying, “I’m no real expert on China” or its nominee for the U.S. representative in Norway who testified about the non-existent president of that country. But does the federal government really need to hire an outside contractor to train federal officials and nominees on how to testify before Congress and tell the truth? Surely not.

Congress should use its oversight responsibilities to guide federal agencies (not contractors) to handle training or other internal matters that could be undertaken by staff already on the federal payroll. Another idea is to tell all State Department staff to just honor any mom’s advice, “When in doubt, tell

CAUTION: READ BEFORE EATING!

Allow restaurants and grocery stores to continue labeling food as they do today or list details on their website. You are what you eat, and the Federal Government wants to make sure you know it.  Starting December 1, 2015, an FDA rule will require all restaurants, gas stations, entertainment venues, and grocery stores with 20 or more locations to list the total caloric value of the prepared food and drinks they sell. For example Domino’s Pizza, which already posts its nutrition information online, will be required to develop new labels with caloric values for every pizza sold. Domino’s and Pizza Hut will be forced to label more than five million potential custom pizza options with specific caloric intake information, costing individual stores thousands of dollars.

Grocery stores will also be required to list the caloric values of prepared foods they serve that are intended to be eaten immediately. According to the Food Marketing Institute, this new rule could cost the grocery industry a colossal $1 billion in compliance in the first year alone.  Since these institutions will simply pass along the increased costs to consumers, the immediate result of the new menu labels will be higher food prices for consumers. Families will pay more for food purchased at grocery stores and for pizza they order for dinner.

Trust Americans to pick the food they like and want. Drop the entire labeling requirement. If all of the menu labeling cannot be eliminated, at least consider Rep. Cathy McMorris Rodgers’s (WA) Common Sense Nutrition Disclosure Act of 2015, which will provide flexibilities to restaurants to include either the number of calories contained in a whole menu item or the number of servings and calories per serving. Additionally the Act would allow nutritional information to be provided on an Internet menu for food establishments where the majority of orders are delivery or takeout.

Insurance agents denied summary judgment in lawsuit filed after fire

A man’s lawsuit will continue against an insurance agent and his agency after they insured his rental property but then denied coverage after a fire, alleging the man misrepresented the property’s condition.

Christopher Schmidt allowed his cousin to live in his property in Fort Wayne, but the home ended up being condemned by the health department. Schmidt’s cousin had numerous animals in the property, and the property was covered in excrement, fleas and garbage. The home had to be extensively cleaned and repaired before it was habitable.

Schmidt, at that time, did not have insurance on the property, but arranged for insurance through agent Bart Stith with C&F Insurance Group LLC. There is a dispute as to whether Schmidt signed the application that did not say the property was vacant, uninhabitable, being renovated and intended for rent. Indiana Insurance Co. issued a dwelling fire policy on the property, and the property was destroyed by a fire two months later. The insurance company denied coverage after conducting an investigation, saying the policy contained material misrepresentations.

Schmidt sued alleging Stith, C&F Insurance Group, and Indiana Insurance Co. were negligent related to the contents of the application for the dwelling fire policy and for failing to procure appropriate insurance. The trial court granted summary judgment for the defendants; the Court of Appeals reversed regarding Stith, who has since died, and C&F. In Christopher Schmidt v. Indiana Insurance Company, C&F Insurance Group, LLC, and Bart Stith, 22S01-1507-PL-412, the Indiana Supreme Court agreed with the COA.

Even if Schmidt was truthful and provided complete information regarding the property to the insurance agent, there remains no genuine issue of fact regarding proximate causation, Justice Brent Dickson wrote. No dwelling fire insurance policy would have been issued on such information.

However, summary judgment was not appropriate for Stith and C&F regarding the negligent failure to procure appropriate insurance claim. The two defendants failed to exclude the possibility that other types of fire insurance coverage for the property could have been obtained and issued, Dickson noted.

The justices summarily affirmed the COA as to summary judgment in favor of Indiana Insurance Co.

Governor Pence Urges Congressional Action on Syrian Refugee Issue

Governor Mike Pence today sent a letter to the Indiana Congressional Delegation urging them to pause the Syrian refugee program and enact legislation that will address safety and security concerns so Indiana can renew its participation. The letter in full can be found attached, and excerpts can be found below.

 

“My highest duty and first responsibility is to ensure the safety and security of the people of our state.”

 

“Furthermore, I have not directed that Indiana’s participation in the Syrian refugee program be permanently halted.  This is a suspension of participation that we look forward to lifting once the federal government can make proper assurances to the state regarding the security of the program and addressing the concerns raised by federal officials.”

 

“As our state’s representatives in Congress, I write today to urge you to pause the Syrian refugee program and enact legislation that will address the safety and security concerns so that we can renew our participation.”
