Indiana Department of Homeland Security Receives National Award for Post-Disaster Building Assessment Team

The Indiana Department of Homeland Security has been recognized with a 2016 national award for its team that will rapidly respond to inspect buildings after a man-made or natural disaster.

 

The National Earthquake Conference selected Indiana for a National Award in Excellence in the category of “Multi-jurisdictional Planning” for its Indiana Building Emergency Assessment and Monitoring Team (I-BEAM). The National Awards in Excellence are presented once every four years.

 

“The I-BEAM Team’s ability to rapidly respond and assess building safety is crucial to our state’s response to a disaster,” said Governor Mike Pence. “The team’s work helps identify safe structures, which is critical in reopening essential services, saving lives and helping communities recover and rebuild.”

 

Two aspects that make Indiana’s team unique is that it is self-sustaining and it has the first communications trailer in the nation that is totally wind and solar powered.

 

Partners in the award selection and presentation are the Western States Seismic Policy Council (WSSPC) Board of Directors in partnership with the Northeast States Emergency Consortium (NESEC), the Central U.S. Earthquake Consortium (CUSEC), and the Cascadia Region Earthquake Workgroup (CREW).

 

The Indiana team strives to provide all necessary equipment for the team’s inspectors and command structure in the event of a disaster deployment. This includes all needed mobile command center, command tents, briefing tents, sleeping tents, restrooms, showers, food, water, and cooking facilities. There is also the necessary supporting equipment such as a power generator, heating\cooling and communications.

 

While I-BEAM can respond to multiple situations that would widely affect building safety, the impetus for the team’s formation was the threat of a major earthquake to Indiana due to seismic zones in Indiana, Missouri and Illinois. The New Madrid Seismic Zone is located 180 miles southwest of Evansville, and the Wabash Valley Seismic Zone encompasses parts of Southeastern Illinois and Southwestern Indiana.

 

I-BEAM is comprised of volunteers from around Indiana and personnel from IDHS who have a background in building safety. After any man-made or natural event which may destabilize buildings, I-BEAM can perform structural assessments to determine whether or not buildings are safe to be used again.

 

The National Awards recognize organizations and agencies for their achievements as demonstrated through exemplary programs, projects and products that address earthquake risk reduction within the United States. The awards will be presented at the National Earthquake Conference held at The Hilton Long Beach in Long Beach, California, on May 5, 2016. Two men convicted of robbing a West Lafayette money lending store could not persuade the Indiana Court of Appeals to reverse their convictions.

Landon T. Harbert and Malcolm Smith were convicted based on circumstantial evidence of various offenses, including Class B felony robbery, stemming from the store robbery in 2012. The car that witnesses saw the two perpetrators enter after the robbery belonged to Harbert’s wife and sweatpants found discarded along the side of the road near the robbery contained DNA that matched Smith’s as well as his wallet. Harbert’s wife and her friend, Megan Simpson, initially lied to police about their whereabouts that day and deleted text messages from that day, some of which were to and from Harbert and Smith.

The two men claimed on appeal that the trial court erred by denying their motion to dismiss the charges after a mistrial. The defendants were tried three times and eventually convicted; the first two trials ended in mistrial. In the first trial, a police officer’s testimony included a mention of Harbert’s criminal history, which was barred at the trial. The court immediately granted a mistrial.

The Court of Appeals found double jeopardy principles don’t apply because there is no evidence the prosecutor intended to cause a mistrial, that the prosecutor colluded with the officer or that the officer knew that his comments would cause a mistrial, Judge John Baker wrote inLandon T. Harbert and Malcolm M. Smith v. State of Indiana, 79A02-1412-CR-874.

There was sufficient circumstantial evidence linking the two to the crime, the judges held.

Harbert and Smith raised additional, separate arguments on appeal. Harbert claimed the trial court committed fundamental error by admitting evidence of a statement made by Smith to police officers that Harbert insisted implicated him in the underlying crimes, and that his 20-year sentence is inappropriate. But the statement made by Smith to police about his wallet allegedly being stolen weeks before the crime did not facially implicate Harbert in the crime, Baker wrote. And, given his extensive criminal history, including a conviction for murder, the 20-year sentence for the robbery conviction is not inappropriate, the appeals court held.

Smith maintained his due process right was violated when he was not able to be present at certain pretrial hearings involving Harbert, that the court erred in denying his request for a continuance, and it erred in denying his post-trial motion to correct error based on newly discovered evidence.

The judges rejected all of his claims, noting his presence at hearings on Harbert’s motions did not hamper his ability to defend himself. In addition, Smith was responsible for the trial delays because he did not pay his private attorney and thus needed a court-appointed attorney shortly before his trial was scheduled to begin.

Governor Mike Pence Directs Flags Be Flown at Half-staff for Former Gov. Edgar D. Whitcomb

Indianapolis – Governor Mike Pence is directing flags at state facilities statewide be flown at half-staff to honor former Governor Edgar D. Whitcomb, who passed away today, Thursday, February 4. Flags should be flown at half-staff for seven days from his passing, through Thursday, February 11.

 

Governor Pence also asks businesses and residents to lower their flags to half-staff to honor Governor Whitcomb for his service to Indiana and the nation.

Troopers Arrest Two during Drug Investigation in Mt. Vernon

Posey County – Indiana State Police initiated a criminal investigation last night after receiving information regarding illegal drug activity occurring at 958 Vine Street in Mt. Vernon.  At approximately 10:10 last night, troopers responded to the residence and talked to Katie Gaff, 39 and her visitor, Nathan Crowley, 39, of Evansville. During a search of the residence, troopers found marijuana, several pipes containing meth and numerous plastic baggies containing meth. Troopers also found a ledger indicating alleged illegal drug activity.

Driver and Passenger Arrested for Possessing Marijuana and Meth

Posey County – Last night at approximately 8:05, Trooper Dustan Rubenacker stopped the driver of a 2005 Ford Explorer for having a defective license plate light. The traffic stop occurred in the Huck’s parking lot located at 9th and Main Street in Mt. Vernon. The driver was identified as Kayla R. Rhodes-Powell, 28, of Evansville.  A passenger was identified as Jessy Durham, 28, of Evansville.  While talking to the driver, Rubenacker detected an odor of marijuana inside the vehicle.  A few minutes later, Master Trooper Kevin Waters and his K-9, Andy, arrived to assist. While walking around the vehicle the K-9 alerted to the presence of narcotics.  A search of the vehicle revealed small amounts of marijuana and meth.  Rhodes-Powell and Durham were arrested and taken to the Posey County Jail where they are currently being held on bond.
