Evansville IN – The Evansville Bar Association and Volunteer Lawyer Program of SW Indiana presented the following awards during their annual joint awards luncheon Wednesday, March 16, 2016.

The law firm of Bamberger, Foreman, Oswald & Hahn, LLP was awarded the Susan K. Helfrich Award for Excellence in Pro Bono Service by the Volunteer Lawyer Program of SW Indiana, Inc.  This award is given annually to the attorney or law firm whose actions exemplify a true commitment to making justice accessible to all individuals, regardless of economic ability. In part, the firm’s long history of accepting pro bono cases and their recent leadership in sponsoring two Talk to a Lawyer nights was noted.

Janet Hagan, of Terrell, Baugh, Salmon & Born was awarded the Florence Britzius Award.  The purpose of the Florence Britzius Award is to recognize the legal secretary who has shown outstanding commitment to the profession and the legal community.

Tracie Whalen of Berry Plastics was awarded the EBA Outstanding Paralegal Award.  This award, established by the Evansville Bar Association in 2009, is to recognize those members of the Paralegal Section who have provided outstanding service to the Evansville legal community through their involvement in the EBA and through their work.  Practitioners also recognize this individual with the formal title of Paralegal.

UE Golf Teams Head To Tennessee to play at Tennessee Tech

 EVANSVILLE, Ind. – A new format will be in place as the University of Evansville golf squads head to Sevierville, Tenn. for the Bobby Nichols Intercollegiate this weekend.

For the first time, three rounds will be played at the event with one round being played each day from Sunday through Tuesday.  The women begin each day with an 8:30 a.m. shotgun start while the men start at 10 a.m. each day.

The women’s field includes: Austin Peay, Carson Newman, Evansville, Florida Atlantic, Oakland, Radford, Southern Miss, Tennessee State, Tennessee Tech, UNC Greensboro, Western Illinois and Youngstown State.  Playing on the men’s side will be: Austin Peay, Carson Newman, Evansville, Jacksonville State, Murray State, Oakland, Samford, Southern Illinois, Tennessee State, Tennessee Tech, UT Martin (individuals only), Western Kentucky and Wright State.

Both teams are coming off of strong Spring Break trips to Jacksonville, Fla.  Rick Voyvodic paced the men in the Bulldog Florida Invitational.  The reigning Missouri Valley Conference Men’s Golfer of the Week recorded a 1-under 71 in the final round to clinch the top spot in the tournament.  His efforts also helped the Purple Aces finish second as a team.

Tyler Gray came home in a tie for 10th place in the tournament while Will Knights placed in a tie for 17th.

Kayla Katterhenry had a great week in Florida for UE.  After winning the Don Benbow Invitational, Katterhenry recorded a second place finish at the Bulldog Florida Invitational.  Katterhenry’s efforts saw her earn MVC Women’s Golfer of the Week honors on March 9 while being named the MVC Scholar-Athlete of the Week on March 15.

Evansville claimed a second place finish in the Don Benbow Invitational in a total team effort that saw three players finish in the top 14.  Katterhenry took the win while freshman Madison Chaney came in 7th, posting a team-low 74.  Giulia Mallmann finished in 14th.

This is a chance for you to hear about Lincoln’s family from a local researcher.  All tri-state residents are encouraged to attend.

Meetings are held the second Tuesday of most months.  Visitors are always welcome, feel free to share the surnames you are researching. We begin with a short business meeting followed by an informative program.

AG Zoeller: New legislation will prevent tax sale fraudsters from victimizing struggling Hoosier property owners

INDIANAPOLIS, Ind. – Indiana Attorney General Greg Zoeller today thanked state lawmakers for passing legislation that aims to prevent tax sale fraud perpetrated against struggling Hoosier property owners.

County auditors and other local officials who work in the tax sale process of homes where delinquent property taxes are owed recently alerted the Attorney General’s Homeowner Protection Unit to this fraud scheme. In the scheme, the fraudsters approach distressed property owners who are delinquent on their property taxes, and deceptively convince them to sign quitclaim deeds in exchange for minimal amounts in order to seemingly make their delinquent tax problem go away.

Typically the homeowners don’t know they are legally entitled to receive the surplus between the tax owed and the price the house sold for at auction. Because of this swindle, some victims were entitled to surplus amounts upwards of tens of thousands of dollars that they lost out on. This surplus may be considered a rough equivalent to their home’s equity, but by the time the fraud was discovered, some of the victims were both out their home and out the surplus money to which they were entitled.

Last month, the AG’s Office filed a $9 million lawsuit against various entities for allegedly perpetrating this scheme against at least 48 vulnerable Hoosiers, swindling them out of amounts ranging from $2,000 up to $900,000.

After uncovering this widespread fraud scheme, Zoeller worked with members of the Indiana General Assembly to pass legislation to close gaps in Indiana code and better protect Hoosier property owners.

“This is a scam that has occurred in urban areas such as Marion County and Lake County, as well as more suburban or rural areas such as Johnson County. Homeowners who were already in a difficult bind financially have been harmed by these scam artists who promised an easy way out. While my office continues to investigate this scheme and hold violators accountable, legislators took quick action on a bipartisan basis to stop this fraud from occurring in the future and make sure homeowners receive the surplus owed to them, which may be enough to help them get back on their feet,” Zoeller said.

Senate Enrolled Act 355 addresses gaps in state law to prevent homeowners from being cheated out of surplus tax sale amounts to which they are entitled. It would ensure that any entity that purchases a property with a tax sale surplus must pay the full surplus amount – in addition to the amount of taxes owed – in order to redeem the property, so that the surplus gets returned to the original property owner.

Today at the Statehouse in Indianapolis, Zoeller formally thanked State Rep. Bill Fine (R-Munster), State Sen. Rick Niemeyer (R-Lowell), State Rep. John Price (R-Bargersville), State Rep. Cherrish Pryor (D-Indianapolis) and State Rep. Hal Slager (R-Schererville) for their work on this legislation during the recent session.

“Senate Enrolled Act 355 will protect homeowners, who are struggling not to lose their property, from being victimized by unscrupulous, property speculators,” Rep. Pryor (D-Indianapolis) said. “The bill also will assist local county officials in dealing with problems associated with tax sales. It is a good bill that received bipartisan cooperation and support.”

“I commend the attorney general for being proactive in protecting taxpayers from fraud, which has become a real area of concern for Hoosier homeowners who are unaware they are entitled to a surplus from difference of the taxes owed and the price of the house they bought,” Rep. Price (R-Bargersville) said. “This act also incorporated a portion of House Bill 1318, which I authored, that gives the attorney general the power to enforce current law, which regards agreements for compensation to locate, deliver, recover or assist in the recovery of money deposited in the tax sale surplus fund.”

SEA 355 has passed the Indiana General Assembly and awaits consideration by the Governor.

“I am extremely pleased with the overwhelming support that Senate Enrolled Act 355 received from the Indiana General Assembly and the Attorney General’s Office,” Sen. Niemeyer (R-Lowell) said. “This bill gives the attorney general the power to enforce current laws pertaining to tax sales, helping ensure that Hoosier homeowners are protected against fraud.”

“I appreciate the attorney general working quickly to help Hoosiers around the state and in Lake County who have fallen victim to tax sale scams,” Rep. Slager (R-Schererville) said. “The updates to our code implemented in SEA 355 should prevent this from taking place in the future.”

“I commend the attorney general and my colleagues who worked so hard on this legislation,” Rep. Fine (R-Munster) said. “This proposal will save Hoosier taxpayers money while giving the attorney general a powerful tool to protect homeowners from tax sale fraud.”

Zoeller added the AG’s Office’s investigation into this fraud scheme continues. Homeowners who suspect they have been defrauded are encouraged to file a consumer complaint with the Attorney General’s Office at www.IndianaConsumer.com or by calling 1-800-382-5516.

To avoid being defrauded, Zoeller urges any distressed homeowner facing a tax sale due to unpaid property taxes – or foreclosure due to unpaid mortgage payments – to first seek legal advice from a qualified attorney before engaging in any quitclaim deed or other legal transaction.

Free legal advice is available from the Indiana Foreclosure Prevention Network at www.877gethope.com or from Indiana Legal Services, which recently received a grant from the AG’s Office to support this type of counseling.

EVANSVILLE, IN – The Fort Wayne Komets shut out the Evansville IceMen 4-0 Thursday in a game riddled with 141 penalty minutes on St. Patrick’s Day at the Ford Center.

 

Fort Wayne scored the game’s first goal, when Louis Belisle jammed a loose puck behind the left skate of IceMen goalie Scott Greenhammidway through the opening period. The Komets outshot Evansville 14-4 in the frame.

 

The Komets made it 2-0 when Jamie Schaafsma through a puck to the front of the net from behind the cage, and it ricocheted off of the skate of an IceMen defenseman before trickling into the net. Greenham was replaced after the goal by Christoffer Bengtsberg. There were 114 combined penalty minutes and five ejections in the second period due to a melee during a media timeout at 8:01.

 

Daniel Barczuk deflected in a power play goal to extend Fort Wayne’s lead to 3-0 just 3:37 into the third period. Then Shawn Szydlowskiripped a shot over Bengtsberg’s glove 49 seconds later to complete the scoring. Nagle posted a 25 save shutout, while Greenham took credit for the loss as he stopped 14 of 16 shots. Bengtsberg made 10 saves in relief. The two teams meet twice more at Memorial Coliseum in Fort Wayne on March 26 and April 3.

 

The IceMen travel to Toledo Saturday for a 7:15pm EST battle with the Walleye at Huntington Center in the final meeting of the year between the teams. Evansville then wraps up the weekend at home against the Cincinnati Cyclones at 5:15pm Sunday at the Ford Center. Season ticket holders and Blizzard Buddies will have the opportunity to skate on the ice after the game.

Aces softball splits doubleheader against Racers

UE will open home schedule on Saturday

MURRAY, Ky. – In one final tune-up before Missouri Valley Conference play begins on Saturday, the University of Evansville softball team split a doubleheader on Thursday at Murray State.  The Purple Aces fell by a 3-1 final in the first game before rebounding for a 5-4 win in the second.

“We finally were able to make some good adjustments offensively to get some runs on the board,” Aces head coach Mat Mundell said.  “Our pitching staff did a tremendous job.  We are excited to take this momentum into conference play.”

Game one was a pitcher’s duel as the game was scoreless over the first four innings.  Amanda Blankenship did the work in the first three innings, striking out four while not allowing a hit.  Murray State was able to break through with three runs in the bottom of the fifth and that would be enough for the win.  Evansville came back with a run in the top of the sixth as Chandra Parr hit a solo shot, but MSU hung on for the 3-1 win.

The second game looked like it would be another duel in the circle as the game was scoreless over the first three frames.  That changed in the top of the fourth in a big way as the Aces saw five runs cross the plate.

Danielle Freeman got it started with a single to right field.  She moved to second as Hayli Scott reached on an error to bring Susan Norris to the plate.  Norris delivered as he single brought Freeman home.  Samantha Fleming grounded out to third to plate the second run of the inning before the final three score with some two-out magic.

With the bases loaded, Chandra Parr recorded yet another big hit.  A bases-clearing triple by Parr saw the Aces reel off five runs to take a 5-0 advantage.  Murray State got on the board with an unearned run in the bottom of the fourth.  Making the start once again, Blankenship gave the Aces four strong innings with that unearned run being the only blemish.

The Racers got close in the bottom of the 5th with three runs off of Emily Lockhart.  That brought Morgan Florey into the game as she pitched the final 2 1/3 innings to seal Evansville’s 11th victory of the season.  Scott and Freeman each notched a pair of hits in the game while Parr led the way with three RBIs.  Blankenship was credited with the win, her third of the season.

On Saturday, the Purple Aces will play at home for the first time this season, opening conference play on Saturday with a 12 p.m. doubleheader against Drake.
