COA: Man entitled to refund after property reclaimed

The Indiana Court of Appeals reversed a Vanderburgh Superior trial court Friday, ruling a man can claim a refund after the property he bought at a tax sale was reclaimed by the owner due to a clerical error.
Paul Angel bought property at a tax auction for $5,500. However, previous owner Townsquare Media filed a motion for relief from the tax deed order when it found a clerical error resulted in the county assessor’s office sending tax notices to the wrong address, which is why the taxes were not paid. Townsquare’s motion was granted.
Later that year, Angel filed a motion to establish the redemption amount, arguing that he should get a refund from the money he paid for the sale. Townsquare said the motion was final judgment, and he did not submit a timely request for issue of the surplus. The trial court found in favor of Townsquare, and Angel appealed.
Angel argued Indiana Code 6-1.1-25-12 provided he was entitled to recover amounts set forth in the statue and that if he’s not reimbursed, Townsquare would receive an inequitable windfall.
The COA found Angel was a grantee of the deed under the code’s definitions. Moreover, Angel was entitled to recover the amount paid because the code specified as such. The taxes were unpaid at the time of sale and Angel had acquired a lien on the property as grantee of the tax deed.
The court remanded the order to the trial court for a determination of how much Angel should recover. The case is Paul Angel v. Vanderburgh County Treasurer and Townsquare Media LLC, 82A04-1511-MI-1902.

According to Executive Director Scott Schoenike, “It seems like just yesterday we were opening Ford Center’s doors for the first time, and today we are celebrating our two millionth customer.†Craig was awarded a large Ford Center commemorative ticket, a customized Ford Center photo chair, four (4) season tickets to the new Evansville Thunderbolts hockey games for the 2016-2017 season, Four (4) season tickets to the Men’s Purple Aces basketball games for the 2016-2017 season, provided by VenuWorks, Two dozen Just Rennie’s cookies, provided by Just Rennie’s and a large merchandise package from Monster Jam, provided by Feld Entertainment.
Schoenike also stated that the economic impact for Evansville has been calculated to almost 150 million dollars over the past 4 1â„2 years. Ford Center continues to play a vital role in increasing the quality of life and it’s as important to VenuWorks mission as Evansville’s economic impact.

USI’s Guy shatters 5,000-meter mark at Mt. SAC
University of Southern Indiana Men’s Track & Field senior All-American Johnnie Guy (Palmyra, Indiana) shattered the program’s 17-year old school record in the 5,000 meters Friday night at the Mt. SAC Relays.
Guy finished sixth in the Elite Invitational competition with an NCAA Division II automatic qualifying time of 13 minutes, 33.14 seconds, a mark that currently ranks sixth amongst all NCAA divisions and 11th all-time in Division II. His time bested USI Hall of Famer Ben Kapsoiya’s previous school mark of 13:56.10, which was set at the 1999 Penn Relays, and was less than three seconds off Friday’s winning pace of 13:36.83, set by Adams State University’s Sydney Gidabuday.
In addition to Guy, junior Chase Broughton (Marengo, Indiana) posted an NCAA II provisional qualifying time of 8:58.73 in the 3,000-meter steeplechase Friday night. His mark placed him 20th in the Elite Invitational competition and ranks him fourth all-time in USI history in the event.
On Thursday night, juniors Josh Guy (Palmyra, Indiana) and Noah Lutz (Evansville, Indiana) recorded NCAA II provisional qualifying times in the men’s 10,000 meters at the Mt. SAC Relays.
Guy finished 21st in the Invitational Elite race with a time of 29 minutes, 35.88 seconds, while Lutz was fourth in the Open B C/O race with a time of 30:10.05. Guy’s time ranks fifth all-time at USI in the 10,000 meters, while Lutz moves into eight all-time on USI’s Outdoor Track & Field performance list.
The Screaming Eagles return to action Saturday when they compete at the SIU Edwardsville Gateway Invitational in Edwardsville, Illinois.
Eagles Sweep Pumas for Third Conference Win
The University of Southern Indiana women’s tennis team defeated Saint Joseph’s College, 9-0, Saturday afternoon at the USI Tennis Courts. The Screaming Eagles move to 7-10 on the year and 3-1 in Great Lakes Valley Conference action with their fifth sweep of the year.
The Eagles swept doubles with the sophomore tandem of Jennifer Mizikar (Batavia, Illinois) and Haley Jones (Fort Branch, Indiana) opened the match with an 8-2 win at number three singles. The two moved to 3-0 together in GLVC competition. At number-one, senior Elizabeth Wilm (Evansville, Indiana) andBrenna Wu (Evansville, Indiana) also earned an 8-2 victory for win number-ten this season, sending the match to singles play.
Mizikar made quick work of her Puma opponent getting the first singles win in straight sets, 6-0, 6-0. Wilm earned the next victory for the Eagles to give the team their fifth win. At number-one, Wilm defeated SJC’s Clare Kost by a score of 6-1, 6-1. Wu and junior Kymberly Brannon (Louisville, Indiana) earned wins at number three and four with matching scores of 6-0, 6-1. Rounding out singles competition was sophomore Kelsey Shipman (Olney, Illinois) and Jones with 6-1, 6-1 and 6-2, 6-1 wins.
The Eagles will wrap up the regular season on the road next weekend. On Friday, the team will head to Romeoville, Illinois for an afternoon match with Lewis University at 2 p.m. The regular season will end after the Eagles take on the University of Indianapolis Saturday at 10 a.m.

High-Five Celebration at Lodge

Encouraging students to succeed is so important and on Monday, community volunteers will travel to Lodge to give high-fives as a way to encourage students to do their best on ISTEP. At 7 Monday morning, city officials, community leaders, business owners, and more will come together to high-five students as they enter the building and begin preparing for the second round of ISTEP testing.  Some of the volunteers that will be at the school Monday include: Fabulous after 30, 98.5 Magic, The Bridge, YMCA, various city officials, uniformed officers, community leaders and business owners, plus the Commission of the Social Status of African American Males, Tri-State Glitter, and many others.
Three Aces homer in 4-3 loss to Bradley
Korbin Williams hit his third home run in two days and two of his teammates would also leave the park, but the University of Evansville baseball team was otherwise unable to score as the Purple Aces dropped a 4-3 decision to Bradley at Charles H. Braun Stadium.
“We were trying to play catch-up from the very start today, and we just couldn’t get past their starter,†UE head coach Wes Carroll said. “He did an absolutely fantastic job. We didn’t really get anything going until the last inning, and then we couldn’t deliver the big hit. We have to be ready tomorrow, and it will be a big opportunity for us in the grand scheme of things. It’s a chance to win a second series in Missouri Valley play, and that could be pivotal for us.â€
Williams, who hit a walk-off homer in Friday’s win over the Braves, found himself in a similar position Saturday. The Newburgh native had already opened the Aces (19-14, 3-2 MVC) scoring with a second-inning blast, and he represented the game-winning run in the bottom of the ninth once again. He would make contact once again, as BU shortstop Tyler Leffler dropped a pop fly to put two runners on for UE, but Braves closer Nathan Stong bounced back with back-to-back strikeouts to end the threat and hand UE its first loss in five games.
UE starting pitcher Brandon Gomer was pegged with the loss after allowing all four runs over the game’s opening five innings. He gave up four hits and struck out four in the contest while dropping to 1-4 on the season.
Meanwhile, his BU (16-13, 2-2 MVC) counterpart, Cameron Roegner tossed 8.1 innings while allowing six hits without issuing a walk. He moved to 4-3 on the season.
After pushing three runs across in the first frame, Williams cut the deficit to two with his homer, but the Braves responded immediately by scratching across a score in the third to make in 4-1.
Billy Lipari and Trey Hair would follow in the fifth and sixth, respectively, with solo round-trippers, but that would be it for UE as the team finished the game with six hits.
The Aces will return to action on Sunday with a rubber game against BU, and first pitch is slated for 1 p.m.
