Governor Pence Outlines Indiana’s Progress in Combatting Drug Abuse in Advance of Congressional Action on Opioid Legislation

Commends Congressional Delegation for efforts on important legislation

Indianapolis – Governor Mike Pence today sent a letter to the Indiana Congressional Delegation outlining the state of Indiana’s progress in combatting drug abuse in advance of Congressional action on opioid legislation this week. The letter, which can be found attached, includes actions by the Governor’s Task Force on Drug Enforcement, Treatment, and Prevention and legislative agenda items, including Senate Enrolled Act (SEA) 187, which ensures that lifesaving overdose intervention drugs are available statewide by requiring the Indiana State Department of Health to issue a statewide standing order for naloxone. SEA 271, also enacted during the previous session of the Indiana General Assembly establishes the Indiana Commission to Combat Drug Abuse, which will build on the work of the Governor’s Task Force on Drug Enforcement, Treatment, and Prevention and take the lead in coordinating substance abuse policy throughout the state of Indiana beginning in 2017.

 

In the letter, the Governor states, “Like you, at the state level we recognize that this issue is large in scope and severe in its impact on the lives of our citizens.  I commend you for your efforts to move these vital pieces of legislation forward, and I would like to especially thank Reps. Susan Brooks and Larry Bucshon for their leadership in authoring two of the bills that will be voted on this week. Indiana State Police Graduate Four Motor Carrier Inspectors

Indianapolis- Recently, the Indiana State Police Commercial Vehicle Enforcement Division welcomed four new Motor Carrier Inspectors to their ranks. Motor Carrier Inspectors (MCI) serve as civilian employees whose primary responsibility is to enforce state and federal laws, rules and regulations pertaining to commercial motor vehicles, to include inspections and operating scales.

The four MCI recruits began their training on February 8, 2016 and concluded with the academy graduation at the Indiana State Police Commercial Motor Vehicle Enforcement office in Indianapolis on May 6, 2016.

During the academy the MCI recruits received training in multiple disciplines including first aid, defensive tactics, hazardous materials, communications, post-crash inspections, emergency vehicle operations and firearms familiarization. ISP Motor Carrier Inspectors are civilian employees and are not issued firearms. However, they do work closely with troopers so they receive a two day familiarization course on the ISP issued firearms. The recruits also study Indiana State Commercial Motor Vehicle traffic law as it relates to size, weight, fuel tax, International Registration Plan (IRP) and certifications related to Federal Motor Carrier Safety regulations.

Beginning Monday May 9th, 2016 the probationary Motor Carrier Inspectors will report to their assigned scale facilities to begin the 90 day field training process. At the successful completion of their field training process they will be issued a Motor Carrier Inspector vehicle.

Carter named All-GLVC prior to national championships

University of Southern Indiana Women’s Golf senior Anastasia Carter (Granger, Indiana) was named to the All-Great Lakes Valley Conference team for the fourth consecutive year Tuesday. Carter is getting set to compete in the NCAA Division II National Championship May 18-21 at CommonGround Golf Course in Aurora, Colorado.

With scores of 78, 76, and 74, Carter was able to qualify for the event as an individual on a non-advancing team in the East Super Regional last week. Carter, who was the third and final individual qualifier, joins Ali Green of Ashland University and Kasey Frazier of Wheeling Jesuit University as individuals advancing out of the East Super Regional. Teams advancing from the East Super Regional are the defending national champions, the University of Indianapolis, Grand Valley State University, and University of Findlay.

Carter has averaged 78.23 strokes-per-round during her final season that includes four top-five and eight top-10 finishes. Joining Carter on the All-Conference team are the top five finishers from the GLVC Championship and four others as voted on by conference coaches.

As a part of the NCAA II National Championship Festival, Carter’s final event will be a four-round, 72-hole tournament, taking place on the par 72 CommonGround Golf Course in Aurora, a suburb in the Denver metro area. The course has hosted United States Golf Association events in the past, including the 2012 U.S. Amateur Championship.

The NCAA II Festival will kick off with its opening ceremonies in Denver on Sunday, May 15 at Mile High Stadium, home of the 2016 Super Bowl Champion Denver Broncos. The Festival, which is sponsored by the Denver Sport Commission, will host the NCAA II Men’s and Women’s golf, Men’s and Women’s Tennis, Women’s Lacrosse and Softball Championships.

Carter will start her first round of the women’s golf national championship on Wednesday, May 18, with the final round being played on May 21.

State seeks new judge after surprise ruling in IBM case

Lawyers representing the state in its ongoing lawsuit against IBM over a canceled $1.3 billion welfare privatization contract have asked for a new judge in the case and moved to void his latest ruling that said the state wasn’t entitled to damages for breach of contract.

Marion Superior Judge David J. Dreyer on Friday issued an order on remand from the Indiana Supreme Court, which on that same day certified its decision from March 22. “The Court largely finds the State fails to prove damages by a reasonable certainty,” Dreyer wrote. “The evidence is insufficient because of its hearsay and speculative nature.”

In a statement Monday, Barnes & Thornburg LLP said Dreyer’s ruling was premature. The firm representing the state in the six-year-old case responded to the ruling with motions filed in court to remove Dreyer from the case and to set aside his ruling.

“This order was issued without any hearing, briefing, argument or notice to the State, and before the State’s counsel had even been notified by the Supreme Court that its decision had now been certified,” the firm said in a statement. The firm said the state should have had 10 days after certification of the Supreme Court ruling to move for a mandatory change from the current trial court judge.

Indiana Trial Rule 76 (C)(3) sets the requirement for a period between the Supreme Court’s certification of an opinion and further action by the trial court on remand. It reads, “if the trial court or a court on appeal orders a new trial, or if a court on appeal otherwise remands a case such that a further hearing and receipt of evidence are required to reconsider all or some of the issues heard during the earlier trial, the parties thereto shall have ten [10] days from the date the order of the trial court is entered or the order of the court on appeal is certified” to seek a change of venue or a new judge.

“Respectfully, we believe the trial court’s surprise order Friday morning was mistaken and also exceeded its jurisdiction,” said B&T partner Peter Rusthoven, who argued the state’s case against IBM before the Indiana Supreme Court. “We are confident that this latest ruling, like the earlier rulings ordering that (former) Gov. (Mitch) Daniels be deposed and then holding that IBM had not materially breached its contract, will not be allowed to stand.”

Justices in March reversed Dreyer in a 4-0 opinion that found IBM had materially breached its contract as a whole. “(W)e remand to the trial court for calculation of the parties’ damages consistent with this opinion, including any appropriate offsets” in favor of the state, the court ordered. Justice Mark Massa, a former Daniels advisor, did not participate.

The Supreme Court affirmed damages of about $50 million in favor of IBM but also said the trial court must determine any amounts the computer giant owes Indiana. The state claims damages of about $175 million.

The Supreme Court found Dreyer’s prior determination that IBM didn’t breach the contract “ignored uncontroverted evidence and made several legal errors. These errors include: a) failing to consider the State’s dissatisfaction with IBM’s performance as required by the (master services agreement); b) determining that IBM’s payment of liquidated damages excused IBM’s performance in contravention of the MSA; c) adopting IBM’s excuses for non-performance; d) considering the State’s motives for terminating the contract; and e) determining that because the State benefited from the MSA, IBM’s breach could not be material.”

Though the Supreme Court ruled benefits the state received do not ameliorate a material breach of the agreement by IBM, Dreyer wrote in his Friday order that the state had derived benefits from its contract with IBM that included streamlining welfare-to-work efforts, reducing fraud and administrative cost savings, and improved technology, among other things.

Dreyer’s order also says IBM’s performance was harmed by the economic downturn and natural disasters – factors the Supreme Court also expressly wrote had no impact on its material breach analysis.

Dreyer declined to comment when reached Tuesday.

EVSC Awards Two With May Cause for Applause

Jennifer McCutchan and Jerry Dennis, both EVSC bus drivers, were named the May winners of the EVSC’s Cause for Applause award. The award seeks to recognize individuals who go above and beyond their normal job responsibilities.

Dennis, who drives a route for North High School and Delaware Elementary School, was nominated by Delaware Principal Nathan Steele. In his nomination letter, Steele said Dennis, who is also a mechanic in the EVSC garage, is always so patient and kind to students.

“Mr. Dennis took pictures of our students’ artwork at the recent North District Art Show, got the pictures developed, and distributed them to our students so they would have a picture of their artwork displayed at the show,” Steele said as part of his nomination letter.

In addition to Dennis, the EVSC also presented the May Cause for Applause award to fellow driver Jennifer McCutchan. McCutchan was nominated by EVSC’s Senior Chief of District Operations Rick Cameron who cited McCutchan’s commitment to students as the reason for nominating her for the award.

On a recent Saturday, McCutchan drove a group of Caze students to a fitness run to help them train for a Triathlon. According to Cameron, not only did she drive them, she also ran with them. After speaking with Caze Principal Jared Turney and Caze teacher Brian Nelson, they said: “Jennifer was a great addition for us last Saturday! We have several different levels of athletic abilities within our training group and having another encouraging adult, like Jennifer, during their training, is very beneficial for us at all levels of work.”

USI BB Lucas Barnett named GLVC Pitcher of the Week

University of Southern Indiana junior right-hander Lucas Barnett (Sellersburg, Indiana) was named the PNC Great Lakes Valley Conference Baseball Pitcher of the Week. The weekly GLVC honor was the first of Barnett’s career at USI.

Rockhurst University junior outfielder David Stober joined Barnett in the weekly awards by being named the Player of the Week.

Barnett posted his sixth win of the year and helped USI to the GLVC East Division title with a complete game victory at the University of Indianapolis. He allowed one run on five hits, while striking out four in the complete game victory.

The junior right-hander is the second-straight Screaming Eagle to win the weekly pitching honor with USI’s senior right-hander T.J. Decker (Brazil, Indiana) taking the award last week. USI also has had a pair of Player of the Week honorees this season — senior catcher Ryan Bertram (Zionsville, Indiana) and senior shortstop Kyle Niemeier (Evansville, Indiana)

The Eagles start GLVC Tournament action on Thursday at 6 p.m. when they play William Jewell College in the first round. The GLVC Tournament runs through Sunday at Grand Park in Westfield, Indiana.

Dalen Traore signs with UE men’s basketball

Traore will be a junior at UE next season

  University of Evansville men’s basketball head coach Marty Simmons has announced the signing of Dalen Traore to join the Purple Aces next season.
Traore, a 6-9 forward, joins the program after spending the last two seasons at Miami Dade College where he starred for the Sharks over the last two seasons.  He will have two seasons of eligibility with the Aces.

“We are very excited to welcome Dalen to our program.  He is a hard worker who will bring a great attitude to our team,” Simmons commented.  “He is a warrior on the boards who will add some nice depth inside for us.  Dalen also brings a nice touch for someone his size.”

Originally from the Ivory Coast, Traore finished his high school career at Northwood Temple Academy in Fayetteville, N.C.

“Aside from his work in school, we are also very excited about Dalen’s international experience.  That type of experience is priceless and has helped him become a better player,” Simmons added.

That international experience came in the 2013 FIBA U19 World Championship where he finished as one of the top players in the tournament.  Playing for his native Ivory Coast, he was the #2 scorer and rebounder in the tournament.  He posted 12.7 points per game throughout the event while hauling in 10.5 rebounds.  The tournament, which was played in the Czech Republic, also saw Mislav Brzoja play for Croatia.
