COA affirms propane company must pay customers’ attorney fees

The Indiana Court of Appeals agreed with a trial court that a propane company is on the hook for two customers’ attorney fees after it failed to deliver prepaid propane gas under an agreement with the couple.

In July 2013, John and Leola Caffrey signed an agreement with South Indiana Propane Gas Inc., paying $1.28 a gallon for 300 gallons. The agreement said the Caffreys agreed to pay all costs incurred by SIPG if it had to enforce any terms of the agreement, including attorney fees, but there was not a similar provision for the Caffreys.

In the third week of January 2014, John Caffrey called SIPG and sought delivery of the prepaid gas. The company’s agent told him that due to the national propane shortage that winter, the company was not sure what it was “going to do” with its prepaid contracts. Leola Caffrey also followed up, but was unable to receive a response from the company.

They and several other people complained to the Indiana Attorney General’s Office, which sent SIPG a civil investigative demand seeking information on the matter. The AG’s office closed the investigation in December 2014 without taking action.

The Caffreys hired an attorney iand filed a complaint in small claims court Feb. 26, 2015, for breach of contract. SIPG’s attorney contacted the Caffreys’ attorney and said that customers who had not received their prepaid gas could do so under former agreement rates until March 31, 2016. This was the first time the Caffreys learned they could call and place an order at the same price they had paid in 2014.

The small claims court decided in May 2015 that SIPG had fulfilled its obligation under the agreement and only ruled on the attorney fees matter. The judge awarded the couple $756, finding that SPIG “settled” in its March 2015 letter by agreeing to perform the contract under its original terms. The judge used March 12, 2015, as the cutoff date to award the fees.

SIPG appealed, claiming the court erred in finding that SPIG’s defense to its liability was unreasonable, groundless or in bad faith. SIPG asserted that its defense that it was not required to pay the Caffreys’ attorney fees under the Agreement was worthy of litigation. The company also claimed it did not act with “obdurate, vindictive[,] or untruthful behavior” because it delivered the propane within 30 days of “learning about the problem.”

The appellate court noted that the trial court did not order SIPG to pay the attorney fees accrued by the Caffreys litigating the attorney fees issue. It is clear that the award was based on the company’s” continued unreasonable, groundless and/or bad faith defense that it was not liable under the contract due to the national propane shortage, not its defense that it was not liable for attorney fees under the Agreement,” Judge Rudolph Pyle wrote.

The judges also noted that SIPG did not perform under the agreement for 14 months and never made an attempt to perform or notify the Caffreys that it was unable to perform under the agreement. That as a result “had the effect of perpetuating its defense that it was excused from performance by the propane shortage,” he continued.

“We are not convinced that this delay and SIPG’s continuance of its defense that it was excused from performance for such an extended period was not unreasonable, groundless, or in bad faith.”

The case is South Indiana Propane Gas, Inc. v. John Caffrey and Leola Caffrey, 19A05-1506-SC-716.

Trainer Ian Wilkes thought Marylou Whitney Stable’s 4-year-old colt Gorgeous Bird had considerable talent but just wasn’t quite getting it all together.
That changed in Saturday’s $50,000 Don Bernhardt Memorial Stakes at Ellis Park, when the gray colt exploded through the stretch under Chris Landeros for a half-length victory over Black Bear. It was the first stakes triumph and fourth victory in 14 career starts for Gorgeous Bird.
“That was impressive,” Wilkes, who had three horses in stakes at Indiana Grand Saturday night, said by phone. “He’s always been a talented horse. I just had to get him to come back and mentally get it together. Hopefully we can go on this  year and have a lot of fun with him.”
Landeros took advantage of the swift pace set by Mr Business, who was pressed by Tanner’s Popsicle, at 16-1 the second-longest shot in the field of eight under 2015 Ellis riding champ Didiel Osorio. Gorgeous Bird and the Jesus Castanon-ridden Black Bear stalked the pace and both horses fanned wide on the turn. But Landeros split horses late in the stretch to secure the victory, covering 6 1/2 furlongs in a good 1:14.70. Gorgeous Bird paid $15.80 to win.
Gorgeous Bird was coming off an eighth-place finish in a 1 1/8-mile allowance race at Churchill Downs. He tipped his hand with a huge five-eighths of a mile work in 59 seconds for the Bernhardt.
“I expected a big run from him today,” said Landeros, who married Wilkes’ daughter, Shelby, two days after the Kentucky Derby. “I’ve always liked the shorter distance with him. He seemed to be a little keen going a route, and I thought this 6 1/2 distance would let him back off a little bit with the faster fractions in front of him. That happened. He took a breather for me. We had a great trip, and he kicked in when it mattered.”
Tanner’s Popsicle, claimed two races earlier for $40,000 by trainer Kim Hammond, did well to hang on to third, 1 1/2 lengths behind the Randy Morse-trained Black Bear, himself a $62,000 claim in his last start but a horse with considerable back class.
The big disappointment was heavy favorite Barbados, a graded-stakes winner who ran in the Breeders’ Cup Sprint last fall. He was never in the hunt and wound up beating only the tiring longshot Mr Business.
Gorgeous Bird, a son of Unbridled’s Song, was on the Kentucky Derby trail last year after winning a mile allowance race in his third start. However, a fifth place in the Fountain of Youth and sixth in the Blue Grass sent Wilkes in a different direction. But when, off a six-month layoff, Gorgeous Bird finished a good third in a mile allowance race at Churchill Downs, Wilkes tried him again at a longer distance.
“He ran a really good race going a mile first time back, which I thought was a real tremendous race,” Wilkes said. “I ran him a mile and an eighth, and maybe it was just too far for him. I wanted to shorten him back up, because he’s a naturally fast horse. I wanted to see what we had.”
Whitney and her husband, John Hendrickson, live in Saratoga Springs, N.Y., and Gorgeous Bird could have earned a shot at the elite summer meet at Saratoga Race Course. “If we can do good,” Wilkes said. “It’s a big step up, too.”

EPD K-9 Unit Takes Top Four Spots at U.S.P.C.A Refion 5 Field Trials

The Evansville Police Department’s K9 Unit sent four of our K9 teams to the United States Police Canine Association (USPCA) Region 5 Field Trials being held in Lexington, Kentucky this past week.

The USPCA Region 5 is comprised of law enforcement K9 units that serve in Indiana, Ohio and Kentucky. The handlers and their canine partners are tested on and compete in the following disciplines:
Obedience
Agility
Evidence Search
Suspect Search
Criminal Apprehension

EPD K9 teams had an outstanding showing at the field trials and swept the overall top 4 winning place positions. In addition to winning the top four positions, EPD teams finished first in every individual discipline.
Representing the EPD were the teams of Zach Elfreich and K9 Axel (1st Place overall), Nick Henderson and K9 Qaos (2nd Place overall), Jason Thomas and K9 Abot (3rd Place overall), and Doug Buetel and K9 Gero (4th Place overall). This was the third consecutive year that Officer Elfreich and his partner Axel won the trials.

This showing reflects proudly on the hard work, dedication, and work ethic that the EPD’s K9 Unit puts forth in their service to the community.
