THE “TIMES ARE CHANGING”!â€¨

The City-County Observer finds the sit-in staged by Democrats in the House of Representatives to be an interesting historical development. What makes that worth noting is that members our staff are divided on the subject of the Second Amendment, and we know that CCO readers are also divided on the issue. Â Our staff, however, is in agreement that the American people deserve a vote, whichever way it goes.

The obvious courage and resolve of the sit-in leader, civil rights icon and United States Rep. John Lewis and the other Democrats who joined him apparently impressed a lot of DC-area residents, too. With short notice, many hundreds showed up to chant â€œDO YOUR JOB”‘ at the exiting Republican House members. The fact that many ordinary people left their dinner tables or cocktail hour to rush to the Capitol to vent their frustrations with the obstructionist Congress tells us a lot about the mood of our county.

Speaker of the House of Representatives Paul Ryan tried to use his gavel to shutdown the demonstration, but thanks to Facebook and apps like â€œPeriscopeâ€ the main stream media got to cover the entire event. It is one more case of modern technology trumping the old rules.

Let us be perfectly clear that we are not endorsing the proposed gun control legislation, nor are we suggesting it should not be passed. We were happy to see the passion and dedication displayed by the Congressmen occupying the well of the House and the chanting of the supportive citizens. We just want to see if the U S Congress has the backbone to do something of significance before the upcoming general election!

We feel that by bringing this and other important, controversial bills to the floor, for full debate and a vote, Congress will give voters something to base their votes on. in the upcoming general election. Â Some feel that this may be very true of our own U S Representative, Dr. Larry Bucshon, Â because so far he hasn’t given the electorate something to hang their hats on to vote for him during this re-election cycle. Maybe the issue of Second Amendment rights could be just that issue.

We, The People deserve far better than we have gotten so far from our “do nothing” Congress. Â We hope it isn’t too late to make up for the last several years of our â€œdo-nothing Congress.â€œ Â We feel that it isn’t too late for Congress to let the voters know they’ve finally heard the message and are trying to do the will of the people.

We predict if, when they returns to session, the Congress doesn’t show that they have awakened, that there will be busloads of citizens from throughout the country chanting â€œDO YOUR JOBâ€ outside the Capitol everyday until they do. We also won’t be surprised to see mass protests staged in every major city similar to what we experience saw in the 60’s. The “Time Are Indeed Changing”!

7th Circuit Reversal: Concur Fraud Victims, Not Creditor, Take Priority

Fraud victims of disgraced former lawyer William Conour have the upper hand over his former law firm creditor who was awarded a judgment of almost $775,000, the 7th Circuit Court of Appeals ruled Thursday, reversing the District Court and signaling too much may have been awarded.

The reversal orders further proceedings in ACF 2006 v. Conour, 1:13-cv-001286, remanding the case to Judge Tanya Walton Pratt in the U.S. District Court for the Southern District of Indiana. Pratt previously ruled that victims who sought to intervene in the case brought by a former Conour creditor could not. Pratt ruled ACF was entitled to the money on a quantum meruit basis from the nearly $2 million in fees attorney Timothy Devereux earned on several cases he won at Ladendorf Law Firm after he left the Conour Firm.

Judge Frank Easterbrook wrote for the panel in ACF 2006 Corp v. Timothy Devereux, 15-3037 and 15-3048, that this is an area of untested law in Indiana, but that victims who were defrauded by Conour should take precedence over a later creditor.Â Conour is serving a 10-year sentence for stealing more than $6 million from clients.

â€œThe norm that victims of a lawyerâ€™s breach of trust have a remedy notwithstanding the later grant of a security interest to a commercial lender is one of long standing and is reflected in Indiana by (Indiana Code) Â§30-4-3-22(c)(2). Section 23-1.5.2-7 tells us that the use of the corporate form to hold assets of a legal practice does not change that norm. It follows that the Victims have priority over the Lender in the funds that the Conour Firm is entitled to receive from (Devereux and Ladendorf). The judgment of the district court is reversed, and the case is remanded for the entry of judgment consistent with this opinion.â€

Davis and Loretta Beals and their daughter Kristen sought to intervene in this case, claiming they were wrongly blocked at the District Court. Conour won a settlement for the Bealses, who were injured in a deadly crash involving a tractor-trailer, but the Bealses are still trying to collect about $500,000 of the money Conour stole from them.

But the 7th Circuit decision also likely will reduce the award Pratt granted. In one of Devereuxâ€™s cases that generated fees of about $1.4 million, Pratt ruled 40 percent should go to the Conour Firm to satisfy ACFâ€™s lien. This despite three witnesses testifying the Conour Firm should be entitled to just 10 percent.

Easterbrook also ruled Pratt erred in awarding prejudgment interest at 8 percent, since the money is held in IOLTA accounts whose interest is not available to the firm, as such interest goes to the Indiana Bar Foundation to fund pro bono legal service. â€œThe award of prejudgment interest was a misstep that must be undone on remand,â€ Easterbrook wrote.
