Another Chance for Animals, Inc., a 501(c) (3), is a network of foster homes, an entity formed to help animals from Evansville Vanderburgh Animal Care and Control.  The animals in our foster care program come directly from EVACC.  ACA does not have a shelter.  When we pull an animal from EVACC, the animal is brought into a loving foster home.  The foster treats the animal as their own, perhaps teaching a dog commands and manners, or showing a cat that living inside is her new way of life.  We love our animals and want each of them to find a perfect “forever home.” ACA does not have a payroll.  All of our volunteers are just that, non-paid persons doing something they love.  A donation to ACA goes straight to the animals to pay for veterinary bills, medicine, grooming and many other expenses.  At the moment, we have more than 50 dedicated foster homes and have rescued and adopted out more than 5500 animals to date.

Results

  • State general fund revenues for July totaled $1,065.6 million, which is $7.4 million (0.7%) below estimate based on the December 17, 2015 forecast, but $23.8 million (2.3%) above revenue in July 2015.
  • Sales tax collections totaled $640.4 million for July, which is $18.0 million (2.7%) below the monthly estimate, but $26.1 million (4.2%) above revenue in July 2015.
  • Individual income tax collections totaled $350.7 million for July, which is $19.6 million (5.9%) above the monthly estimate and $1.2 million (0.3%) above revenue in July 2015.
  • Corporate tax collections totaled $13.1 million for July, which is $10.9 million (45.3%) below the monthly estimate, but $2.3 million (20.9%) above revenue in July 2015.

EVANSVILLE, IN— The State of Indiana’s lone elite junior hockey team, the Evansville Jr. ThunderBolts, continue to attain positive strides in their player roster construction for the rapidly-approaching 2016-17 NA3HL season through their most recent player commitment to hockey-mad Evansville.

On this date, Jr. ThunderBolts General Manager/Head Coach Mark Cody has announced that center/right wing BRANDON ROZEMA will be returning for his second campaign under the ‘Bolts banner.

“Signing Brandon was one of my top priorities going into this off-season,” stated GM/Coach Cody. “Brandon’s love and passion for the game shows every time he touches the ice; whether it be in a game, at practice or helping out with the youth hockey players. I will be counting on Brandon to be a team leader both on the ice and in the locker room. His 100% effort is contagious and will help carry this team to reach its full potential.”

ROZEMA, 19, (ROSE-mah), 19, enjoyed an outstanding initial campaign with the Jr. ThunderBolts, following his acquisition from NA3HL member club, the Wisconsin Whalers on October 21, 2015. The diminutive, dynamic 5-7, 170lb West Michigan native from Grandville, MI finished a lofty fourth in the ‘Bolts individual team scoring derby, registering 25-points in 44-games on 15-goals, 10-assists, while recording 24-PIM. Included in “The Rose’s” point-producing numbers were 3-FG, 1-UG, three 2-goal masterpieces and 1-GWG. His 1-GWG represented an historical achievement of all-time team infamy and immortality for Evansville. It came in his club’s first-ever victory as a bona fide NA3HL elite junior hockey franchise, January 3, 2016 at South Division Champion Point Mallard where the ‘Bolts laid claim to a thrilling come-from-behind 7-4 toast of triumph over the home-standing Ducks.

The relentless, indefatigable ROZEMA on-ice persona grew in extraordinary fashion as the Jr. ThunderBolts inaugural campaign progressed. In fact, through the preponderance of the season’s second half, he emerged as the team’s top point-scoring impresario, equaling the club’s second best point-scoring scourge at 6-games on a streak composed of 4-goals, 5-assists, 9-points stretching from January 16th through February 13th of the current calendar year. Moreover, 9 of his 15-goals were struck abroad while in three more games, he earned a stellar +2 rating.

Today’s signing of BRANDON ROZEMA brings to 8 the total number of players currently listed on the Jr. ThunderBolts roster and the first from last season’s inaugural lineup. Previously, the ‘Bolts announced the additions of newcomers KORY KIFER, ANDREW WARE, LUKE FRY, KYLE GREGORY, JEREMY ROSS, JONAH REYNOLDS and DREW WYNN.

This week’s show features Indiana State Police Laboratory Forensic Scientist Elizabeth Griffin.  Griffin discusses the dangers of fentanyl as well as the safety precautions that law enforcement and lab personnel must initiate while interacting with the drug.

7th Circuit Dogs Insurer’s Defense

An insurance company’s argument that a houseguest injured by the family dog was legally responsible was mauled, chewed and spit out by the 7th Circuit Court of Appeals.

David Williams sued his friends, Anthony and Jeanette Van de Venter, after he sustained a shoulder injury while walking their black Labrador, Emma. Williams was staying in the Van de Venters’ home in Monroe County when he took Emma into the backyard. As he held onto the leash, a neighborhood dog’s bark caused Emma to lurch, which pulled Williams to the ground.

The Van de Venters had a policy with American Family Insurance which included personal liability coverage indemnifying the homeowners for compensatory damages for bodily injury and guaranteeing a defense against lawsuits for such damages.

However, American Family argued that the intra-insured provisions in the policy relieved it of the duty to defend or indemnify the Van de Venters. Specifically, the provision stated the company would not cover injuries to any individual it insured which included any person legally responsible for an animal owned by the insured.

The company asserted Williams was legally responsible for the dog when he was hurt and, therefore, was an insured under the policy. Consequently, he cannot turn to the policy for coverage of his claim.

In American Family Mutual Insurance Company v. David Williams, et al., 15-3400, the 7th Circuit rejected that argument. It affirmed the U.S. District Court for the Southern District of Indiana which found in favor of the Van de Venters and Williams.

“AmFam wants us to evaluate in isolation the periods during which Williams accompanied Emma outside, disregarding the rest of their day together,” Chief Judge Diane Woods wrote for the court. “But doing so does not accurately reflect their relationship (or lack thereof). Despite spending all day in the same house, Williams’s only interactions with Emma took place when he twice affixed a leash to her collar, and for a few minutes, accompanied her outside, exercising at most limited control over her movements.”

The Chicago panel pointed out that Indiana law makes two kinds of people legally responsible for animals – owners and keepers. The panel found Williams did not fall into either category. He was not the owner of the dog, he did not harbor the dog and he was not responsible for giving her any food, water, affection or other care.

“…(F)itting Williams’s conduct within the term ‘legally responsible’ would take all the bite out of (AmFam’s) meaning in the policy. If any person exercising any control over an animal were legally responsible for it under the policy, then nearly all interactions with animals would be excluded from policy coverage,” Wood wrote. “The intra-insured provision was not meant to preclude coverage of every guest or business invitee who drops by the house and even momentarily controls the dog.”

Judge David Hamilton wrote a concurring opinion, further tearing apart American Family’s argument on the intra-insured provision.

He noted intra-insured exclusions prevent fraudulent and collusive claims such as by one family member against another, expecting the deep pocket of the insurance company to pay. However, he found that applying the exclusion to Williams’ claim has virtually no precedent and would be contrary to the basic principles of liability insurance.

“The intra-insured exception should not apply to deny coverage to the homeowners on claims by people who might be deemed insureds for such limited purposes and in such limited circumstances”, Hamilton wrote. “The purpose of the intra-insured exception simply does not apply to such people. The broader interpretation advocated by American Family would contradict other purposes and provisions in the policy, such as the liability coverage for injuries caused by domestic employees and the broad coverage that homeowners expect for accidents that injure visitors like Williams.”

USI’s Carpenter promoted to full-time assistant coach

Former University of Southern Indiana Women’s Basketball standout Stephanie Carpenter ’14 has been added to Head Coach Rick Stein’s coaching staff as a full-time assistant. Carpenter, who served as a part-time coach for the Screaming Eagles in 2015-16, will assist Stein in all aspects of the USI Women’s Basketball program.

Carpenter finished her career ranked first all-time at USI in made three-pointers (194) and three-pointers attempted (524). She also finished her career ranked 14th all-time at USI with 1,003 points.

A second-team All-GLVC honoree as a senior in 2013-14, Carpenter averaged 14.5 points per game as a senior.

Carpenter, who was a four-time Academic All-GLVC honors as well as a CoSIDA Academic All-District performer, earned her bachelor’s degree in criminal justice studies from USI in 2014. She also earned the GLVC Council of President’s Academic Excellence Award, which is given to student-athletes who have exhausted their eligibility and recorded a 3.5 or better cumulative grade point average.

“I am excited to have Stephanie continue her career with our program,” Stein said. “She has been an important part of our program as a four-year player and last year as an assistant coach.

“Stephanie has been a part of our USI family for many years and her commitment, loyalty, enthusiasm, and passion for our team, USI Athletics, and the University are things that show in her on and off the court work every day,” Stein concluded.

 

USI Baseball inks seven transfers for 2017

 University of Southern Indiana Baseball announced the signing of seven transfers for the 2017 season. The Screaming Eagles and Head Coach Tracy Archuleta have signed a total 14 new players for the 2017 campaign.

Transferring to join the Eagles are junior infielder Brodie Brown (Carmi, Illinois); junior infielder Angel De Jesus (Yabucoa, Puerto Rico); junior left-handed pitcher Konner Eck (Vincennes, Indiana); senior infielder/right-handed pitcher Nick Gobert (St. Joseph’s, Indiana); junior infielder/catcher Nathan Kuester(Rockport, Indiana); junior outfielder Grant Malott (New Castle, Indiana) and senior right-handed pitcherJustin Watts (Bryan, Ohio).

“These seven transfers will give us the needed experience that we lost after graduating 11 seniors last spring,” said Archuleta. “I look forward to working with these young men and welcoming them to the USI Baseball family.”

Signing with the Eagles during the early period last fall were freshman right-handed pitcher Tyler Hagedorn (Evansville, Indiana); freshman outfielder Aaron Euler (Evansville, Indiana); freshman infielderTrevor Ricker (Evansville, Indiana); freshman right-handed pitcher Grant Ellis (Terre Haute, Indiana); freshman left-handed hitting infielder/outfielder Bryce Krizan (Mt. Brown: Played two seasons with Rend Lake College…batted .341 as a sophomore with three home runs, 34 RBIs, and 13 stolen bases…began his collegiate career by hitting .214 with a home run and 19 RBIs as a freshman…was a letterwinner in baseball, basketball, football, and cross country at Carmi High School (Carmi, Illinois)…named CHS Most Valuable Player and to the Indiana All-South Team in 2014.

De Jesus:  Played last season for New Mexico Junior College…hit .412 with 56 runs scored, 48 RBIs, and 10 home runs in 51 games as a sophomore.

Eck: Pitched the last two seasons for Lincoln Trail College…recorded 81 strikeouts in 22 games and 68.1 innings of work…posted a two-year 4.67 ERA and a 2-6 record at LTC…was 1-6 with a 5.47 ERA as a sophomore, striking out a team-high 62 batters…lettered in baseball and track at South Knox High School (Vincennes, Indiana).

Watts: Transfers to USI after one season at Lincoln Trail College (2015) and two years at Northern Kentucky University (2016)…finished his two years at NKU with a 3-9 record and a 6.57 ERA, posting 89 strikeouts in 100 innings of work…had a 2-6 record and a 6.37 ERA as a sophomore at NKU in 2016, striking out 62 batters in 65 innings of work…had a 1-1 record with a 5.84 ERA and one save as a freshman at Lincoln Trail in 2014…lettered in baseball at Bryan High School (Bryan, Ohio).

 

Ford Center’s Five Year Anniversary Celebration Has Officially Began!

It was not the typical night in downtown Evansville when Def Leppard, REO Speedwagon and Tesla made a stop at Ford Center. Ford Center packed the house at their first of many concerts that are lined up for its five year anniversary. Tesla started the night, followed by REO Speedwagon who ended their set just in time for fans to watch Lilly King take the Olympic gold for USA in the 100-Meter race. Just as soon as the lights went down for REO Speedwagon’s last song, you saw the community pride as the fans for all three bands and Lilly King ran to find the closest TV so they could witness USA winning another metal in Rio.

Def Leppard kept up the high energy from the night singing all the fan favorites. “It’s always great when there is a packed house. With the continued community support, more acts of this level will look to perform at the Ford Center,” stated Ford Center’s Executive Director, Scott Schoenike.
