Traffic Collision Involving E.P.D. Motor Officer – Update

At 11:41 am on Tuesday, July 19, 2016, EPD Officer Allen Gansman stopped to assist a stalled motorist on eastbound Highway 66 (Diamond Avenue) approximately 500 feet west of Kratzville Road. The stalled motorist, a Chrysler minivan, was stopped in the right-hand lane of eastbound Diamond.

Officer Gansman activated the emergency lights on his motorcycle and parked on the shoulder of the roadway behind the van. Traffic began to merge from the right lane into the left lane, yielding to the stopped emergency vehicle.

As Officer Gansman began to push the van off the roadway onto the shoulder in order to clear the traffic lane, a Toyota pick-up truck being operated by a seventeen-year-old was traveling eastbound on Highway 66 in the right-hand lane approaching the area where officer Gansman’s vehicle was parked. The truck failed to slow down and move to the opposite lane, yielding to the emergency vehicle as required by law.

As the truck continued eastbound, it drifted off the roadway onto the shoulder, striking the EPD motorcycle causing it to be propelled forward striking officer Gansman. The impact of the motorcycle then drove the officer into the van.

The investigation revealed that the juvenile driver of the truck was texting when the collision occurred. Neither the juvenile nor the driver of the stalled vehicle were injured in the collision, however the juvenile was transported to the hospital to have blood drawn for testing. The driver of the stalled van was also transported to the hospital for evaluation.

Officer Gansman suffered serious injuries including a number of fractures to his legs. He was conscious and able to speak at the scene of the collision. He was transported to Deaconess Hospital for treatment where he has undergone surgery with more scheduled. Officer Gansman has a long recovery ahead of him, but is in good spirits.

The investigation is ongoing and an evaluation is being done to determine the appropriate charges for the juvenile driver. Traffic Collision Involving E.P.D. Motor Officer – Update

 

ERRORS HALT OTTER COMEBACK

The Evansville Otters suffered a loss in heartbreaking fashion by a score of 7-6 against the Lake Erie Crushers on Tuesday night at Bosse Field. Errors (4) would prove to be detrimental to the Otters, resulting in multiple extra run opportunities. Erie would jump on the board first following an RBI groundout in the third inning. The Crushers would go on to tack on additional runs in the fourth and sixth to bring the score to 3-0. Evansville would muster a remarkable comeback in the latter half of the sixth. Two Otters would reach base via a walk and a double to set the table for Denzel Richardson, who hammered a missile off the right field wall for a triple. Chris Sweeney would go on to drive in Richardson via a sacrifice fly the next at bat, tying the game in the process. Evansville captured the momentum in the seventh following a titanic solo blast of a homerun off of the bat of John Schultz. Unfortunately, the eighth would prove to be disastrous for the hometown team. Four Crushers’ batters would reach base safely before a decisive three-run double put the game seemingly out of reach at 7-4. However, the Otters would fight back in the eighth thanks to a parade of four singles, which brought Evansville back within striking distance at 7-6. The ninth summarized a night filled with numerous almost shots at victory when Chris Breen launched a high flying line drive to left-center field, with a runner at first, that just barely fell short of being a game winning homerun and into the glove of a Crushers outfielder.

         REWARD INCREASED IN SEARCH FOR ANSWERS IN MURDER CASE

The family of slain local DJ Shane Breedlove is searching for answers and increasing a reward for information.

A group gathered Tuesday night at the intersection of Washington and Thompson where Breedlove was found dead last year. His mother announced the $15,000 reward has been increased to $40,000.

Derrick Murray, Bobby Michael Handegard and Bobby John Handegard were arrested August 4th and charged with murder. They were later released due to a lack of evidence.

At the remembrance service, people were not shy about their calls for justice.

 

State Revenue Department Bound By 1998 Ruling

The Indiana Department of State Revenue should have granted a medical equipment company’s request for a sales tax refund, the Indiana Tax Court ruled, finding the department is bound by its published ruling interpreting the exemption at issue.

Fresenius USA Marketing Inc., a Delaware corporation that sells products such as dialysis machines and blood lines, collected sales tax on the medical equipment and supplies it sold in Indiana to medical clinics that provide dialysis to patients. It then sought a refund with the revenue department in December 2007 for sales tax paid between Jan. 1, 2004, to Oct. 31, 2007. The department denied the refund in 2010, leading to this tax appeal. Both parties filed for summary judgment in 2013.

In 1998, the revenue department interpreted the predecessor to the Durable Medical Equipment Exemption to apply to sales of medical equipment made to health care service providers for treating patients with a prescription. In 2008, the department issued two Revenue Rulings that again exempted those purchases. But the department later revoked those 2008 rulings and replaced them with new ones that changed the interpretation of the Durable Medical Equipment Exemption to exempt only sales made directly to patients with a prescription, according to the court opinion.

Fresenius argued that it’s entitled to the exemption because the department is bound to follow the interpretation of the exemption from the 1998 ruling, which was published in the Indiana Register. Because it was published there, the department is bound by it, despites its claims otherwise, Judge Martha Wentworth wrote in Fresenius USA Marketing, Inc. v. Indiana Department of State Revenue, 49T10-1008-TA-45.

“Fresenius designated evidence demonstrating that its facts are substantially identical to those in the 1998 Ruling. Moreover, the Department did not demonstrate that Fresenius’s factual situation varied in some material respect to the facts set forth in the 1998 Ruling,” she wrote. “Indeed, the Department has stipulated, among other things, that Fresenius has facts identical to the facts in the 1998 Ruling. For example, the parties have stipulated that, like the taxpayer in the 1998 Ruling, Fresenius sold medical equipment and supplies to healthcare service providers to treat patients, that the healthcare service providers used the equipment to treat patients with prescriptions for its use, and that federal law required the equipment to be used by licensed practitioners or under a licensed practitioners’ direction.”

Wentworth granted Fresenius’ motion for summary judgment and ruled against the department. She remanded the matter to the department to grant the refund, with applicable interest, after Fresenius provides the department with verification that it has refunding to its customers the full amount of sales tax it erroneously collected from them during the period at issue.
