Death Row Inmate’s Habeas Petition Denied By 7th Circuit

The man who brutally raped and murdered a teenager in Spencer County in 2001 will continue to sit on death row after the 7th Circuit Court of Appeals affirmed the denial of his petition for habeas corpus relief.

Ron Ward knocked on the door of the home of 15-year-old Stacy Payne. After she let him in, he assaulted her and injured her so severely she eventually died from her injuries. An officer responding to the scene caught Ward standing in the home and took him into custody.

He was convicted of murder and sentenced to death but that verdict was overturned because the Indiana Supreme Court believed Ward was denied the right to a fair trial when his trial was moved. At his second trial in Vanderburgh County, he pleaded guilty to murder and rape. One of his attorneys, Lorinda Youngcourt, was overworked as she was handing other capital cases at the same time. As a result, mitigating evidence wasn’t prepared as intended and the attorneys decided to tell the jury that Ward was a psychopath and shouldn’t be put to death because he is insane.

The jury recommended the death penalty, which was imposed by the special judge. Ward exhausted his state court appeals and turned to the federal court for relief, but the district court denied his petition for habeas corpus.

“Even assuming that Ward’s attorneys performed deficiently when they pounded into the jury’s mind the idea that Ward is a psychopath — not merely someone suffering from severe antisocial personality disorder — we cannot say that the state court’s conclusion that there was no prejudice was unreasonable,” Chief Judge Diane Wood wrote.

The judges found the Indiana Supreme Court reasonably applied Strickland v. Washington, 466 U.S. 668 (1984).

Wood also noted that Ward was not prejudiced by his counsels’ performance because of the mountain of evidence against him.

The case is Roy L. Ward v. Ron Neal, superintendent, Indiana State Prison, 16-1001.

Man Arrested after Beating and Pepper Spraying his Pregnant Girlfriend

On Monday, August 29, 2016 the Vanderburgh County Sheriff’s Office arrested a man who allegedly beat and then pepper sprayed his pregnant girlfriend as she drove a vehicle on US 41.

At approximately 4:00am this morning sheriff’s deputies responded to a report of domestic violence in the 18,000 block of North US Highway 41. Responding deputies found the victim lying in the roadway near her vehicle and was being attended to by other motorists.

The victim reported having been assaulted by her boyfriend during an argument that took place as she drove south on US 41. The victim explained that her boyfriend began striking her in the face with his hands and feet, after which he sprayed her in the face with pepper spray. The victim also reported to sheriff’s deputies that she is pregnant with her boyfriend’s child.

The suspect, who was identified as Mr. John Nathan Bartlett, had initially fled the scene on foot but returned just prior to the arrival of responding sheriff’s deputies. Mr. Bartlett was placed into custody and transported to the Vanderburgh County Jail.

In addition to charges related to domestic violence, Mr. Bartlett was also served with a probation revocation warrant related to a 2015 possession of methamphetamine arrest.

ITT Tech Stops Enrolling Students

 ITT Technical Institute has stopped enrolling students altogether at its campuses.

This comes less than a week after the U.S. Department of Education banned the Indiana-based company from accepting new students who use federal financial aid.

Analysts say the ban is a likely death sentence for ITT, which received 79% of its cash receipts last year from the Federal Student Loan program.

The department also placed several other sanctions on ITT, including a freeze on executive compensation and an order that it increase its surety funds in 30 days.

ITT Tech operates more than 130 campuses in 38 states.

EPD Foundation Appoints New Executive Director

 The Evansville Police Department Foundation appoints a new Executive Director.

Jan Davis will be taking over the leadership roll.

The EPD Foundation exists to award financial grants to the department for specialized equipment, education, collaborative community programs and for the support of its personnel.

A private reception in her honor will be thrown in to celebrate Davis Tuesday.

Only local dignitaries, the EPD Foundation Board of Directors and Board of Governors, donors, and friends of the Evansville Police Department will all be in attendance.

Petition Started to Extend EVSC Lunch Periods

 Some local parents are joining forces, hoping to make a change to lunch periods in the Evansville Vanderburgh School Corporation.

Two moms go together and started an online petition to try to extend the now 20-minute lunch period.

They started it after realizing their children were coming home from school hungry, and saying they don’t have enough time to eat.

EVSC Superintendent Dr. David Smith says if there’s ever a child that can’t finish their meal, they will give them extra time.

But, with 1,800 signatures on their online petition, the moms say it isn’t just a few children who can’t finish their lunch in time.

“And it’s very sad to watch kids put some food in their pockets, or standing over the trash can shoving more food in their mouth,” said Tiffanie Wolf, EVSC parent, helped start petition. “And it’s like sometimes, this is the only decent meal some of these kids are gonna get and they’re taking it from them. and then they’re going back to class hungry.”

The moms plan to take the petition to the next school board meeting, September 12th at 5:30, hoping they’ll consider extending the lunch periods to at least 20 minutes and a reworking of the schedule to allow kids enough time for both lunch and recess.Â
