Vanderburgh County Air Quality Forecast

Air quality forecasts for Evansville and Vanderburgh County are provided as a public service.  They are best estimates of predicted pollution levels that can be used as a guide so people can modify their activities and reduce their exposure to air quality conditions that may affect their health.  The forecasts are routinely made available at least a day in advance, and are posted by 10:30 AM Evansville time on Monday (for Tuesday through Thursday) and Thursday (for Friday through Monday).  When atmospheric conditions are uncertain or favor pollution levels above the National Ambient Air Quality Standards, forecasts are made on a daily basis.

Ozone forecasts are available from mid-April through September 30th.  Fine particulate (PM2.5) forecasts are available year round.

Air Quality Action Days

Ozone Alerts are issued by the Evansville EPA when maximum ozone readings averaged over a period of eight hours are forecasted to reach 71 parts per billion (ppb), or unhealthy for sensitive groups on the USEPA Air Quality Index scale.

Particulate Alerts are issued by the Evansville EPA when PM2.5 readings averaged over the period of midnight to midnight are forecasted to reach 35 micrograms per meter cubed (µg/m3).

Forecast statistics documenting the reliability of these air quality forecasts are compiled on a monthly, seasonal (May through September for ozone), and an annual basis.  Compilations of these statistics are reported in Vanderburgh County Health Department’s Annual Report and available on request.

Current conditions of OZONE and FINE PARTICULATE MATTER are available in near real-time on the Indiana Department of Environment Management’s website.

2016 UE Athletics Hall of Fame Class Announced

Class will be inducted in January of 2017

The third-ever team along with four student-athletes will comprise the newest addition to the University of Evansville Athletics Hall of Fame.

Included in the class is the 1958-59 Purple Aces men’s basketball team, who won the first-ever national championship in program history.  Kate Chybowski (women’s tennis), Jamie Davison (softball), Willie Glen (baseball) and Terra May (women’s soccer) will also be inducted along with women’s soccer player Kayla Lambert, who was officially part of last year’s class, but will be in attendance for this year’s induction.

The induction ceremony is set to take place on Saturday, January 28, 2017 at the Ridgway University Center on the UE campus.  The evening event will feature a full dinner and ceremony.  The inductees will also be recognized on the 29th at the men’s basketball game versus Illinois State.  To reserve your seats, click on the registration link above.

Evansville’s first National Championship Men’s Basketball Team will be the third team inducted into the Hall of Fame, joining the 1964-65 undefeated men’s basketball team and the 1985 men’s soccer Final Four squad.  The team went 21-6 over the course of the season and advanced to the NCAA Tournament for the third year of what would be 10-straight trips to the tournament.

Coached by Arad McCutchan, team members included: Hugh Ahlering, Harold Cox, Walter Deal, Larry Erwin, Harold Halbrook, Tom Hamilton, Mel Lurker, Harold Malicoat, Tom Mulherin, Jim Nossett, Ken Reising, Bob Reisinger, P.M. Sanders, Ed Smallwood, Bill Thurneck and Dale Wise.

Kate Chybowski graduated from UE in 2011 with the most singles wins and combined victories in program history.  She picked up 99 singles and 179 overall match triumphs.  The recipient of the 2010 Ida Stieler Award as the department’s top female student-athlete was an All-MVC player on three occasions.  Chybowski earned COSIDA Academic All-District recognition in 2010 while being named the recipient of the MVC Commissioner’s Academic Excellence Award on two occasions.  She also earned ITA All-America Scholar-Athlete accolades in 2010.

Softball start Jamie Davison is one of just two players in program history to earn three 1st Team All-Conference honors, doing so in 2001, 2003 and 2004.  The 2001 MVC Rookie of the Year finished her Evansville career ranked second in program history with 245 his and second with 124 runs scored.  She also ranks in the top five in RBIs (99), batting average (.350), slugging (.516) and total bases (362).  Her 72 hits in 2001 was the second-most in a single season for UE.

Evansville’s career leader with 22 saves makes his way into the Hall of Fame as Willie Glen made his mark on the program.  Glen also finished with a school record 97 appearances.  He became the first player in MVC history to record at least 20 wins and 20 saves in his career and earned a spot on the MVC All-Centennial Team for his efforts.  A 3-time MVC Scholar-Athlete was named an ABCA All-Region player in 2000 while also garnering All-MVC First Team accolades.  He had an extensive professional career, which saw his jersey retired by the Gary RailCats in 2014.

One of the pioneers of the women’s soccer program was Terra May.  The 2-time MVC Defensive Player of the Year (1996, 1997) led the team to the conference championship in both of those seasons.  The 3rd Team All-Region player in 1997 won the Ida Stieler Award in 1998.  She was named to the MVC All-Centennial Team.

Kayla Lambert, who was voted into the Hall of Fame in 2015, will officially be inducted this year.  She led the women’s soccer program and the Missouri Valley Conference as the leading scorer in the history of both.  She holds the UE records for points (132), goals (50) and assists (30).  The 2008 MVC Player of the Year was the first in program history to earn Academic All-American accolades.  Lambert was also the first Freshman All-American in UE women’s soccer history, earning a spot on the 3rd Team in 2005.

Kohl’s Joining Indiana’s Logistics Industry With New E-Commerce Distribution Center

Plainfield – Kohl’s (NYSE: KSS) will begin renovations later this year on a new e-commerce distribution center in Indiana, creating up to 300 new full-time jobs by 2018. The company is the latest addition to Indiana’s thriving logistics sector, which today includes approximately 5,700 businesses across the state.

“As the Crossroads of America, Indiana continues to prove why it is a national logistics leader,” said Governor Mike Pence. “From Kohl’s to the thousands of other logistics operations that are thriving across Indiana, Hoosiers play a crucial role in helping customers receive the goods they need in all corners of the world. With Indiana’s affordable, low-tax environment, our state has added nearly 150,000 new jobs just since 2013, and we’re excited to be adding even more jobs from a national company like Kohl’s.”

The national retailer headquartered in Menomonee Falls, Wisconsin will purchase, renovate and equip a 937,000-square-foot facility at 9998 All Points Parkway in Plainfield. The company plans to begin renovations in 2016 and operations are expected to begin in late 2017. The new facility will serve as a fulfillment site for Kohls.com purchases and support additional fulfillment capacity required to serve the company’s online customers quickly and efficiently.

Kohl’s currently operates 39 stores throughout Indiana. In addition to the 300 new full-time jobs planned, the company also plans to add 600 new part-time positions with benefits as the facility reaches full capacity. The Indiana Economic Development Corporation offered Kohl’s Department Stores up to $1.2 million in conditional tax credits based on the company’s job creation plans. These tax credits are performance-based, meaning until Hoosiers are hired, the company is not eligible to claim incentives. The town of Plainfield approved additional incentives at the request of the Hendricks County Economic Development Partnership.

Indiana is a national logistics leader, earning its status as the Crossroads of America. The state is home to a central U.S. location, more pass-through interstates than any other state, the world’s second-largest FedEx hub and the third most total freight railroads in the nation. The state’s logistics industry has earned an A grade from Conexus Indiana and Ball State University’s Center for Business and Economic Research for the past five years.

University of Southern Indiana Volleyball suffered a 25-14, 25-11, 25-8 setback to No. 13 Winona State University Friday afternoon in its first match of the Augustana Invitational.

The Screaming Eagles struggled offensively as they were limited to a negative .035 attacking percentage for the match.

Winona State (6-0) established control early in the contest as it hit better than .400 early in the first set to grab a commanding 12-2 advantage.

USI grabbed an early lead in the second frame, but an 8-2 Winona State run gave the Warriors a 9-4 lead. The Warriors continued the onslaught later in the stanza, using a 10-3 run to build a 20-8 advantage before concluding the set on a 4-0 spurt.

Winona State, which hit .310 for the match, opened the final frame with a 6-0; then used another 6-0 outburst to forge a commanding 19-5 advantage.

Sophomore libero Shannon Farrell (Munster, Indiana) and senior setter Quin Shoultz led the Eagles with 23 and 10 digs, respectively.

USI returns to action today at 7 p.m. when it takes on No. 22 Augustana University. The Eagles conclude the Augustana Invitational Saturday with matches against Winona State (10 a.m.) and Chadron State College (3:30 p.m.).

First Lady Karen Pence Offers Remarks at Opening Ceremony of Bicentennial Torch Relay

Indianapolis – Today, First Lady Karen Pence, Indiana’s Bicentennial Ambassador, joined Lieutenant Governor Eric Holcomb,  co-chairs of the Indiana Bicentennial Commission, Lee Hamilton and former Lieutenant Governor Becky Skillman, former First Lady Judy O’Bannon, and representatives from the Indiana Office of Tourism Development and the Indiana Bicentennial Commission to offer remarks at the Opening Ceremony of the Bicentennial Torch Relay.  There, the First Lady spoke on her travels around the state, including her many school visits and her role in various Bicentennial Legacy Projects. The Torch Relay began in Corydon and will culminate in Indianapolis on the Statehouse Grounds on October 15.

“What an exciting morning it has been to be with such wonderful people in our first state capitol, Corydon, celebrating  the beginning of our Bicentennial Torch Relay,” said First Lady Karen Pence.  “I am proud of the hard work from everyone represented here today and their teams.  I was thrilled Indiana’s own and my very dear friend, former First Lady Judy O’Bannon, was our first bicentennial torch bearer. Blessings to all those who light the bicentennial path across all 92 counties in celebration of Indiana’s 200th Birthday.”

The denial of a woman’s request to set aside her divorce decree nearly 20 years after the end of her marriage because of fraud on the part of her ex-husband has been upheld by the Indiana Court of Appeals.

In the case of Julie R. Waterfield v. Richard D. Waterfield, 92A03-1511-PL-1968, Julie Waterfield petitioned the Whitley Superior Court to re-open her divorce settlement agreement – which was entered into in 1997 – after coming to the conclusion that he ex-husband committed fraud and forced her into an agreement that was more than $80 million less than what she was entitled to.

In May 1997, Julie Waterfield filed for divorce and agreed to a settlement of $20 million, including almost $19.5 million in cash and a lake cottage on Clear Lake near Fremont in December of the same year.

While negotiating the settlement, Richard Waterfield produced a disclosure statement listing the property that was part of their marital estate. Julie Waterfield’s attorneys advised her against settling until they conducted a detailed discovery into the estate her ex-husband had presented.

Julie Waterfield ignored that advice and chose to settle without the discovery, but one month later told her attorneys that she regretted that decision.
In July 2003, nearly six years after entering into the settlement agreement, Julie Waterfield filed a complaint against her ex-husband and accused him of intentionally undervaluing or excluding assets in his list of the marital estate and committing fraud valued at $80 million. Richard Waterfield filed a counterclaim, citing abuse of process and requesting statutory attorney fees.

The trial court entered into partial summary judgment against Julie Waterfield’s claims of undervaluing in 2006 and full summary judgment against all of her claims in 2009.

Julie Waterfield then moved for summary judgment against both of her ex-husband’s claims in 2012, but that motion was denied in 2013.

The following year, she requested access to documents related to Richard Waterfield’s attorney fees claims, which prompted him to serve her with a discovery request to access her divorce attorney’s files. Richard Waterfield said those files contained information that could be used to refute her fraud allegation by showing how much knowledge she had of the marital estate and the process of discovery and settlement. Julie Waterfield fought her ex-husband’s discovery request, saying it violated attorney-client privileges.

Julie Waterfield failed to comply with the discovery request in 2014, saying in 2015 that her attorney had been too sick to gather the documents. As a result of her lack of cooperation, the trial court awarded default judgment as a discovery sanction to Richard Waterfield.

The Whitley Superior Court also awarded Richard Waterfield $842,021 in attorney fees in October 2015.

In its response to her appeal, the Indiana Court of Appeals wrote that although Julie Waterfield contended that she relied solely on Richard Waterfield’s representations when making the decision to enter into the settlement, and that she had no reason to ask for an independent evaluation of the value of the marital estate, she could not hide behind attorney-client privilege to keep her ex-husband from accessing documents that would contradict her testimony.

Further, when the communications between Julie Waterfield and her attorney were disclosed, they showed that she was advised at least three different times not to enter into the settlement without doing a detailed discovery. Julie Waterfield signed three different letters acknowledging her attorney’s advice, but still chose to enter the settlement.

By signing these documents, the appellate court wrote that Julie Waterfield surrendered her right to claim she relied on misinformation from her ex-husband when entering into the settlement to support her fraud allegation.

Julie Waterfield also appealed the court’s decision to deny her motion for summary judgment against her ex-husband’s claims of abuse of process. However, the Court of Appeals wrote that the timing of her decision to file suit against her ex-husband – in 2003, shortly after he remarried in 2002 – indicates that she entered into the legal process for a purpose other than what it is intended for.

Further, the appellate court wrote that Julie Waterfield’s new counsel failed to review the communications between his client and her previous counsel. Had he done so, he would have learned of her previous attorney’s advice not to enter into the settlement without a discovery, which could have prevented her lawsuit against her ex-husband.

“Accordingly, we cannot say that Julie used the legal process to accomplish an outcome which the process was designed to accomplish,” the Court of Appeals wrote in its Friday opinion.

Julie Waterfield also appealed the default judgment as a sanction against her. While the appellate court wrote that it sympathized her with attorney’s illness, it also wrote that the illness did not strike until more than a month after the discovery request.

Finally, Julie Waterfield appealed the decision to award her ex-husband attorney fees. But because her new attorney prolonged the litigation process by failing to research her communications with her previous attorney and ignoring the court’s discovery orders, the Court of Appeals said Richard Waterfield was entitled to an attorney fee award.
